REGULAR MEETING OF THE TOWN BOARDS TOWN OF MAMARONECK,
HELD MAY 5, 1948
In the Council. Room of the !`leaver Street Fire House, Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8 ;15 P.M. ( Daylight Saving Time) .
Present : Supervisor Mandeville
Councilmen McKeever, Mills , Watson, Embury
Absent : None
The presence was also noted of Town Clerk Gronberg , Town
Attorney Delius , Town Accountant Finson.

Councilman Watson reported that there was a noticeable improve-
ment in the operation of the Incinerator, but there were two or three
things he wished to discuss with Mr. Foote Just as soon as he returned
to the office, Since his last visit, the men were repainting the inside
of the Plant.
Councilman Embury reported that the work on the Memorial was
completed with the exception of the plaque and eagle . He said this would
be finished shortly and kept covered until Memorial Day. An appropriate
program has been arranged in cooperation with the Larchmont Post, American
Legion, for the Memorial- exercises .
Councilman McKeever stated that he had nothing to report for
his Departments.

Councilman Mills brought up the matter of the installation
of a hydrant on Cabot Road.
The Supervisor said that he would take the matter up with
Superintendent Thrasher of the Water Forks.
The Supervisor reported that he had at hand a resolution from
the Village of Mamaroneck approving the sale of property acquired by the
-- Village in its foreclosure proceeding In Rem. It was his recommendation
that the sale be approved.
On motion by Councilman Embury, seconded by Councilman Watson,
the following resolution was , upon roll call, unanimously adopted :
WLEREAS, the Village of LRa.maroneck through the institution
of an action in the County Court of Westchester County,
entitled " In the matter of the Foreclosure of Tax Liens
Pursuant to Article VII-A, Title ? of the Lax Law by the
Village of Mamaroneck, List of Delinquent Taxes for 1945'' ,
has become and now is the owner of a number of parcels
of Real Estate situate in the Village of Mamaroneck and
Town of Mamaroneck; and
"WHEREAS, both the Village of Mamaroneck and Town of
Mamaroneck hold tax liens on said parcels of real
property; and
THEREAS, pursuant to Section 165H of the Tax Law an agree-
ment was entered into between the Village of Mamaroneck
and the Town of Mamaroneck, which among other things set
forth the interests of said municipalities in the pro-
perties being foreclosed ; the manner of the sale of said
propgcr iv d and the manner of the distribution of the
- procee s/from said sale ; and

WHEREAS, the Village of I:?amaroneck, has pursuant to an
agreement had with the Town of I,Iamaroneck advertised for
and has heretofore received bids on certain properties
owned by the Town of I,4amaron.ec'k as well as on certain
properties owned by the Viilage of Mamaroneck in the
Town of Ilamaroneckg and
7,1HEREAS, the B oard of Trustees of the Village of
B:lamaroneck have given consideration thereto and after
due deliberation accepted the bids hereinafter listed
as to price and terms therein set forth; and
iVHEREAS, since receipt of said bids this Board has
given consideration thereto, and after due deliberation,
it is
RESOLVED, that the bids hereinafter listed be accepted
at the price and terms therein set forth:

The Supervisor stated that as a result of his negotiations
with the ' estchester County Park Commission, he had at hand a lease for
the rental of County property on Grand Street and Sheldrake River, to
be used for playground purposes by some of the high school children.
IIe asked that he be authorized to sign the lease.
On motion by Councilman ?Watson, seconded by Councilman Mills ,
it was , upon roll call, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the lease between the Town of
Mamaroneck and 17estchester County Park Commission
for land known and distinguished as a portion of
Parcels 1,2,- ; 5, 22-A, 23-A and 24, Sheet 10-A,
Pelham-Port Chester Parkway, for playground purposes ,
for the term of one year comencir_g on the ist day
of May, 1948 and terminating on the 30th day of April,
1949, at an annual rental of $5.00.
The Supervisor stated that he had at hand a letter of resignation,
effective May 15, 1948, from Irlr.C.D. DeVinne , Service Officer.
On motion by Councilman Hills, seconded by Councilman Embury,
the following resolution was unanimously adopted :
WHEREAS, Charles D. DeVinne, Public Welfare Officer
and Service Officer of the Town of Mamaroneck. has
tendered his resignation to tki;s Board, effective as
of IIay 15, 1948; and
INTIEREAS, the said Charles D. DeVinne has served the
Town of Mamaroneck in the capacity of Public Kelfare
Officer from March 15, 1933 , until December 31, 1946,
when he became Service Of�igEr under the provisions
of the Public ','welfare Lava asPamended, and
during all of such period has earned the respect
and admiration of the taxpayers and citizens of
the Town in the conduct of his office ; and

WHEREAS, he has earned the gratitude of all persons
in need and who required assistance during the period
of his tenure of office,
NOW, THEREFORE, BE IT
RESOLVED, that this Board hereby expresses its thanks
and appreciation for the public service so ably ren-
dered by Charles D. DeVinne, Public 'Nelfare Officer
and Service Officer of the Town of Mamaroneck, and
with deep and sincere regret, accepts the resignation
so tendered by him.
FURTHER RESOLVED, that a copy of this resolution be
sent to Charles D. DeVinne ®
The Supervisor reported that he had an estimate of the cost
of two new Brockways, which would be idential with the latest one pur-
chased by the Highway Department, in the amount of $5,490. each, complete .
He pointed out that the automotive equipment, especially in the line of
heavy trucks , was being restricted, and it might be advisable at this
time to place an order for two of these units , inasmuch as delivery
probably could not be made for a period of six months .
He said that he had given consideration to the purchase of
FVITD ' s , but the cost is exceptionally high. Also , that before purchasing
any of this equipment, it would be necessary to get the approval of the
Westchester County Department of Public Viorks .
The members of the Board were in agreement with the Supervisor
and it was their unanimous opinion that an order should be placed at this
time.
The Supervisor stated that he had at hand a check in the
amount of $3 , 882.45, representing the Town's share of the distribution
of the current year ' s rental on the Hommocks Country Club, as follows *

On motion by Councilman Embury, seconded by Councilman Matson,
it was, upon roll call, unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept the sum of $3 , 882.45 in full payment of the

The Supervisor brought to the attention of the Board an offer
which he tied received to purchase by assignment tax liens presently open
on Block 121 9 Parcel 16. He said in addition, the purchaser of these
liens would pay the 1947 and 1948 taxes on this property.
Following discussion, it was on motion by Councilman Embury,
seconded by Councilman Elills , upon roll call, unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to sell by assignment to I:4aple Hill Estates , Inc . , the
follor ng tax liens on Block 121, Parcel 16, at the face
amount of the tax liens plus interest at the rate of six
per cent from the date of sale :

The Supervisor recommended that the First National Bank of
Nev Rochelle , N.Y. be designated as a depository for Town of Mamaroneck

unds .
Following discussion, it was on motion by Councilman Hills ,
seconded by Councilman 77atson, upon roll call, unanimously
RESOLVED, that the First National Bank of New Rochelle ,
New York, be and it hereby is designated as depository
of the Town of Mamaroneck and/or the Supervisor of the
Town of Maraaronec'k, provided that the amount on deposit
in said First National Bank shall not at an-,r time, be
in excess of the amount insured by the Federal Deposit
Insurance Corporation;

FURTHER RESOLVED, that all checks for the withdraVVal
of such funds as ar§ on deposit in the First national
Bank, shall be signed by the Supervisor and counter-
signed by the Coraptroller of the Town of Mamaroneck,
The members of the Board discussed the request of the Larchmont
Softball League for financial assistance amounting to $200. All the mega_
bers agreed that this rotas a worthy cause, that a great number of the
p=avers in this League came from the Unincorporated section, but it is
a question of finding ways and means of providing the money.
Councilman McKeever pointed out that if assistance is given
to the Larchmont League , a similar request mould probably come from
the Mamaroneck Softball League .
The Supervisor stated that if residents of the unincorporated
section were members of the Mamaroneck Softball League , they would be en-
titled to a contribution.
The Toi>n Attorney explained that the money could be provided
for if a To*atn Recreation Commission was appointed which could authorize
the expenditures .
Upon the recommendation of the Supervisor, Mrs . Henry R. Dillon
and Mr , Edward F. 'i1atson were appointed, they to select four other members
to serve on this commission.
The Supervisor referred to the vacancy left by Mr. ward and
stated that he had talked to Mr. Foote regarding the employment of Mr.
Thomas McEvoy. IIe said this was agreeable to Mr. Foote and that Mr.
McEvoy was presently teaching a new man his position and hoped tbcstart
at the To�rvn Offices on Monday, May; 10, 1948. He further stated that the
point has been reached where a qualified man is needed for the position
of Building & Plumbing Inspector, and that he had talked to P . David
Eggers of Larchmont about accepting this position on a part time basis.
He said he was �,:?aiting to hear from Mr . Eggers®

The Supervisor reported that he has had under consideration
for some time moving the Town Office from its present location to the
second floor of the ?;eaver Street Fire Mouse. He explained that it was
planned to fit into that space the Board Room and all offices to house
the Town departments:, with the exception of the Police Department. He
explained further the advantages , and that it has been his feeling for
a long time that the Tovan Offices should be located in the unincorporated
area .
The Supervisor further stated. that Ur. David Eggers had been
working on a proposed layout and just as soon as it is finished he lvould .
present it to the Toiran Board for approval.
Upon the recommendation of the Town Attorney, the Board
unanimously agreed to grant Mr. Maxwell Halpern an extension to May 15,
1948.
The :members of the Board discussed the public hearing held
at the last meeting .
Following discussion, and on motion duly made and seconded,
it was unanimously

Daily Times , pursuant to the provision of the Town

PUBLIC NOTICE
TAIZ NOTICE that the Town Board of the Town of IvIamaroneck
will hold a public hearing, pursuant to Section 264 of the Town
Law, in the Council Room at the `i' eaver Street Fire House, Weaver
Street and Edgewood Avenue , in the Town of D!amaroneck, on 11ay 19,
1948, at 8 :15 P .L,1. , to consider amendments to the provisions of
the Zoning Ordinance of the Town of Mamaroneck, and to the mab
accompanying and forming part of such Zoning Ordinance, Said
amendments to the Ordinnce and changes in. the Zoning Map are
- substantially as follows :
(1) To create a new use, . area and height district to be
known as Residence District AA, in which no building shall be
erected which is arranged, intanded or designed to be used as
a house or dwelling for more than one family and in which Residence
District AA no house or dwelling shall be erected on a plot less
than 15, 000 square feet in area or on any plot having a frontage
of less than 100 feet on any street or avenue dedicated to public
use , except ti'°_at , here such house or dwelling fronts on a street
heaving a. curve with a radius of 150 feet merry. or less , such_ house or
dwelling may be erected on a plot or lot having a frontage of
not less than 50 feet on any street or gvenue dedicated to public
use, provided tLa.t the ti-idth of such lot or plot , between side
lines at the point where such house or dwelling is set back from
the street, be not less than 100 feet.
(2) To provide that in such Residence District AA ( use,
height and area ) the following shall apply :
(a ) No part of any building shall be built within
40 feet of anv street line ;
(b) There shall be a rear yard having a depth of
at least 25 feet ;
(c ) Two side yards shall be provided, the least
dimension of which side yards to be not less
than 15 feet ;
(d) The height of building in said district shall
be limAdd,.;to 40 .foet;
(e ) No house or dwelling shall be erected or altered
in said district, toaccoamodate or make provision
for more than three families on any acre of land
nor more than a proportional number of families
on a proportional acre, of land.
(3 ) To amend the map which accompanies the Zoning Ordinance ,
so as to show the following described property in use , area and
height districts as Residence District A :
BEGINNING at a point in the easterly line of Vueaver
Street, where the same is intersected by the boundary line
between the Town of Mamaroneck and the Town of Scarsdale ;
thence northeasterly along said boundary line to the V~ est-
erly line of Old %1hite Plains Road; thence southerly along
said westerly line of Old White Plains Road to a point
where the same is intersected b-= the northerly line of
Parcel 11D" as shown on man entitled, "' Map of Property
belonging to T,Zamaroneck Heights Co . , Inc . in the Towreof
Mamaroneck and Harrison, T estchester Co . , N.Y. " ,

thence in a general southwesterly direction, along the
northerly line of said Parcel "D" on above mentioned map
to the easterly line of Parcel "X" on above mentioned map ;
thence southeasterly along the easterly line of said Parcel
"X" , 582 feet more or less to the southerly line of said
Parcel "X" ; thence southwesterly along the southerly line
_ of said Parcel "X" , 150 feet to the easterly line of Grand
Park Avenue, as shown on said map, ( now tailed Feni-
more Road) ; thence in a southwesterly direction at right
angles to the easterly ,and westerly lines of Fenimore Road,

A map showing the exterior boundaries of the. property to
be re-zoned as District AA, is on file in the office of
the Town Engineer and printed copies of the same are
available for distribution, upon application of the Town
Clerk.
(4) To amend the Zoning Ordinance so as to provide that in
area district AA, mo dwelling or house shall be constructed with
a total cubic content of less than Thirty-five thousand (35,000)
cubic feet ; in area districts A and A-2, no dwelling or house
Shall be constructed with a total cubic content of less than
Nineteen thousand ( 19,000) cubic feet ; and in area districts A-3 ,
no dwelling or house shall be constructed with a total cubic con-
tent of less than Fourteen thousand five hundred (14, 500) cubic
feet.
(5) To add a new section to the Ordinance, providing that
the invalidity of any provision of the Ordinance shall not in-
va;idate any other provision thereof.
TAKE FURTHER NOTICE that all persons interested will have
an opportunity to be heard at the above stated time and place.
