HELD APRIL 7, 1948
In the Council Room of the 74eaver Street Fire House , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. (Eastern Standard Time) .

The presence was also noted of Town Clerk Gronberg ,
Town Attorney Delius, Accountant Finson.
A letter dated April 5, 1948, was received from Police
Chief Paul A. Yerick advising the members of the Board that he had
appointed Mr. James Moloney of 706 Grove Street , Mamaroneck, N.Y. ,
as custodian of the Town of Mamaroneck Police Headquarters, to
replace John W. Potts.
On motion by Councilman Emburv, seconded by Councilman
I:IcKeever , it was , upon roll call , unanimously
RESOLVED, that I.?r. James Moloney be and he hereby
is appointed as custodian of the Police Department
effective April 1 , 1948, at an annual salary of
$1 ,500.00.
A letter dated April 1 , 1948 , was received from Police
Chief Paul A. Yerick advising that the Board of Police Commissioners ,
at a meeting held March 25, 19489 had appointed Patrolman Eugene De
Veau to the position of Sergeant, effective April 1 , 1948.
On motion by Councilman- Embury, seconded by Councilman
Watson, it bras , upon roll call , unanimously
RESOLVED, that this Board unanimously ratifies
the action of the Board of Police Commissioners
of the Town of Mamaroneck_, in the appointment of
Patrolman Eugene DeVeau as Sergeant of the Town
of Mamaroneck Police Department , effective April
1 , 1948 , at an annual salary of $3 ,840.00.
A letter dated March 25, 1948 , was received from Edward
Ely Hoxie , requesting that the dead end of Edgewood Avenue be closed
against children playing and a notice to that effect be posted. He
complained of the damage to his property by children playing ball
in front of his house.
The Clerk was instructed to send this communication to
Chief Yerick for report at the next meeting.
A letter dated April 7, 1948, was received from Edward
Ely Hoxie , offering to buy seven lots in the rear of his property
for the sum of $700.

The matter was referred to Councilman Mills to advise
Mr. Hoxie that the next property auction would be held on April
19, and to submit his bid to the Supervisor on or before that date ,
accompanied by a certified deposit check in the amount of ten (10;x)
per cent.
A letter dated April 6 , 1948 , was received from 1jr.
Robert Stadler. , 220 Palmer Avenue , in which he complained of the
unsightly condition of the property opposite his home.
This matter was referred to the Town Attorney.

Councilman Matson presented the following petitions
received from the Assessor for the correction of the assessment
roll so as to permit the apportionment of taxes.
On motion by Councilman Watson, seconded by Councilman
Embury, the following resolution was , upon roll call , unanimously
adopted :
WHERFAS , the Assessor has presented petitions for
the correction of the assessment roll for certain
- years pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 as amended, known
as the dlestchester County Tax Act ; and
WHEREAS , after due consideration this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll:

Councilman Embury reported that the work on the Memorial
would be definitely completed by Memorial Day. He also reported
that the committees for the Town, Village of Larchmont , and Larch-
mont Post , American Legion, are to arrange suitable dedication
ceremonies to tie in with the regular Memorial Day exercises.

The Supervisor presented sales which had been approved
by the Trustees of the Village of Larchmont , covering property
acquired by that Village in its foreclosure proceeding In Rem.
On motion by Councilman Watson, seconded by Councilman
Wills , the following resolution was , upon roll call, unanimously
adopted:
WHEREAS , the Village of Larchmont , through the
institution of an action begun on February 13,
1946 , in the County Court of Westchester County ,

BE IT RESOLVED , that the sales prices bid for the
parcels of real property listed above are hereby
approved, and that all consents and approval by
the Town Board of the Town of Mamaroneck for the
sale of the aforesaid parcels of real property
by the Village of Larchmont required under the
provisions of the aforesaid agreement between
the Village of Larchmont and Town of Mamaroneck
dated May 20 , 1946 , are hereby granted and allowed.
On motion by Councilman Watson, seconded by Councilman
Embury , the following resolution was presented:
WHEREAS , the Village of Larchmont , through the

WHEREAS , pursuant to Section 165-a of the Tax Law

WHEREAS , the Board of Trustees on April 5, 1948 has
accepted the following offer to purchase property;

BE IT RESOLVED, that the sales price bid for the parcel
_- of real property listed above is hereby approved, and
that all consents and approval by the Town Board of

parcel of real property by the Village of Larchmont
required under the provisions of the aforesaid agree-
ment between the Village of Larchmont and Town of
Mamaroneck dated May 20 , 1946 , are hereby granted and
allowed.
The vote on the foregoing resolution was as follows:

The Supervisor reported that it would be necessary to
transfer the sum of $4,000.85 to pay the cost of the installation
of a 6" main and fire hydrant on Barnum Road, and the cost of meters
installed during the year 1947.
On motion by Councilman Mills , seconded by Councilman
McKeever, it was , upon roll call, unanimously
RESOLVED, that the Supervisor is hereby authorized to
transfer the sum of $4,000. 85 from Water District
surplus to the Capital Fund to pay the following:
Installation of a 61' main and fire
hydrant - Barnum Road $2 ,861.88
Meters Installed during year, 1947 ls1a8.92

The Supervisor presented and read a resolution passed
by the Board of Trustees of the Village of P7amaroneck on Yarch 22 ,
1948, with respect to the Vocre Plan as it affects villages in
Westchester County.
The Town Clerk was instructed to acknowledge receipt of
this resolution, with thanks.
The Town Attorney reported that after conferences with
a group of 'residents representing the property owners in the Larch-
mont Ridge section, the Supervisor and himself, it was proposed by
this committee that the Town rezone a certain area in that district
to be known as Class AA. He enumerated the features pertaining
thereto.
Following discussion, the following resolution was on
motion by Councilman Embury, seconded by Councilman McKeever ,
unanimously adopted:
RESOLVED, that a public hearing be held upon the
question of amending the Zoning Ordinance and map
which accompanies the same , at a meeting of this
Board to be held April 28, 1948, at 8:15 o' clock
P.M. in the Council Room at the Weaver Street Fire
House ;
FURTHER RESOLVED, that notice be given of such
public hearing pursuant to provisions of the Town
Law and that the following notice be inserted in
the Daily Times, at least ten (10) days prior to
the hearing:

PUBLIC NOTICE
TAKE NOTICE that the Town Board of the Town of
Mamaroneck will hold a public hearing , pursuant to Section
264 of the Town Law, in the Council Room at the !'leaver
Street Fire House , Weaver Street and Edgewood Avenue , in
the Town of Mamaroneck, on April 28, 1948, at 8:15 P.M.
to consider amendments to the provisions of the Zoning
Ordinance of the Town of Mamaroneck, and to the map
accompanying and forming part of such Zoning Ordinance.
Said amendments to the Ordinance and changes in the Zoning
Map are substantially as follows:
(1) To create a new use area and height district
to be known as Residence District AA, in which no building
shall be erected which is arranged, intended or designed
to be used as a house or dwelling for more than one family
and in which Residence District AA no house or dwelling
shall be erected on a plot less than 15,000 square feet
in area or on any plot having a frontage of less than
100 feet on any street or avenue dedicated to public use ,
except that where such house or duelling fronts on a
street having a curve with a radius of 150 feet or less ,
such house or dwelling may be erected on a lot or plot
having a frontage of not less than 50 feet on any street
or avenue dedicated to public use , provided that the width
of such lot or plot , between side lines at the point where
such house or dwelling is set back from the street , be not
less than 100 feet.
(2) To provide that in such Residence District AA
(use , height and area) the following shall apply:
(a) No part of any building shall be built within 40 feet
of any street line;
(b) There shall be a rear yard having a depth of at least
25 feet ;
(c) Two side yards shall be provided , the least dimension
of which side yards to be not less than 15 feet;
(d) The height of building in said district shall be
limited to 40 feet ;
(e) No house or dwelling shall be erected or altered in
said district , to accommodate or make provision for more
than three families on any acre of land nor more than a
proportional number of families on a proportional acre
of land:
(3) To amend the map which accompanies the Zoning
Ordinance , so as to show the following described property
in use , area and height districts as Residence District AA:
BEGINNING at a point formed by the intersection
of the westerly side of Old White Plains Road and the
boundary line of the Town of Mamaroneck and the Town
and Village of Scarsdale; thence in a southwesterly
direction along the boundary line between the Town
of Mamaroneck and the Town and Village of Scarsdale
to the intersection of said boundary line with the
easterly side of Weaver Street ; thence in a generally
southerly direction, along the easterly side of ?'leaver
Street , to the northerly side of Rockland Avenue;
thence along the northerly side of Rockland Avenue ,
to a point where the said northerly side of Rockland
Avenue intersects the boundary line between the Town
of Mamaroneck and the Village of Mamaroneck; thEnzPax

thence along the
boundary line between the Torah of Mamaroneck and
the Village of Mamaroneck, to a point where said
boundary line is intersected by the westerly side
of Old 77hite Plains Road; thence along the westerly
side of Old White Plains Road to the point where
the said westerly side of Old White Plains Road
intersects the boundary line between the Town of
Mamaroneck and the Town and Village of Scarsdale ,
the point or place of beginning.
The exterior boundaries of the proposed Residence District
AA are indicated on the appended map by crosshatching.
(4) To provide that in area district AA, no dwelling
or house shall be constructed with a total cubic content
of less than Twenty-five thousand (25,000) cubic feet ,
not including basements , enclosed porches , attics , garages
and breezways , which are not intended to be used for resi-
dence purposes; in area districts A and A-2 , no dwelling
or house shall be constructed with a. total cubic content
of less than Eleven thousand (11 ,000) cubic feet , not
including basements, enclosed porches , attics , garages
and breezways , which are not intended to be used for
residence purposes; and in area districts A-3 , no dwell-
ing or house shall be constructed with a total cubic
content of less than Nine thousand (9 ,000) cubic feet ,
not including basements , enclosed porches , attics , garages
and breezways , which are not intended to be used for
residence purposes.
- - (5) To add a new section to the Ordinance , providing
that the invalidity of any provision of the Ordinance shall
not invalidate any other provision thereof.

TAKE FURTHER NOTICE that all rersons interested will
have an opportunity to be heard at the above stated time
and place.

Councilman McKeever presented written permission given
to him by Tar, Sidney Doherty for the use of his property for dumping
incinei°ator residue , as reported by him at the last meeting.
Discussion was held as to what insurance would be necessary
to protect the Town in the event this property is to be used for
dumping purposes. The matter was referred to the Town A+torney.
Councilman Mills presented a list of claims from the
Fire Department , totaling $1 ,035.61. He stated that he had checked
the bills and recommended their approval.
The members of the Board sitting as the Board of Fire
Commissioners considered the claims and on motion by Councilman
Mills , seconded by Councilman Embury, it was , upon roll call ,
unanimously
RESOLVED, that the following described claims
be and they hereby are approved and the Supervisor
and Comptroller be and they hereby are authorized
to pay same out of the budget for the Fire Depart-

Montessori Play School #137 Palmer Ave. in session Sept. 15 - June 15
approximately 15 pupils conditions good installation of extinguisher
ordered.
Murray Ave. School - Conditions excellent. Ordered standpipes and
hose attached thereto flushed. out and tested.

Monroe Plat* School 4685 "leaver St . in session Sept. 15-June 15,
extensive alterations to building. Conditions good approval
granted pending completion of work and compliance with safety
devices ordered installed.
Smith Residence , x`65 Palmer Ave. Conditions not satisfactory,
corrections ordered within thirty days.
Mr. J. Kennedy, #39 Dillon Rd. sheet metal fabrication. No work
that would create fire hazard done on premises. Installation of
extinguisher ordered , conditions satisfactory.
Empire State Boats , T'39 Dillon Rd. Steward V% Campbell, Pres®
No paints or violatiles used on premises, concrete ceiling under
living quarters above , conditions satisfactory.

cleaning up of premises. Notified of re inspection. April 15.

Oak Haven Apt. Cellar inspected and found in good condition.
Tally Ho Riding Academy, dwelling house , barns , outbuildings in
good condition.
Myrtle Garage. Paint spraying done on premises , all precautions
observed conditions satisfactory.
Water supply on Hommocks area tested, very poor, recommendations
regard sea hydrant will be forthcoming.

The violation pert&ining to the Smith Residence , 1#65 Palmer
Avenue , was referred to the Town Attorney.
The members of the Board discussed at length the legal possi-
bility of the Town contributing to the Larchmont Soft Ball League.
After discussion , it seemed to be the unanimous opinion that this
payment could not be made.
There being no further business; the meeting adjourned at
9:15 P.M. to meet on April 28, 1948.
