The meeting was called to order by Supervisor Mandeville at 8:15 P.M. (Eastern Standard Time) . Presents Supervisor Mandeville Councilmen McKeever , Mills , '°fatson, Embury Absent None !, The presence was also noted of Town Clerk Gronberg , Town Attorney Delius and Accountant Finson® 11,2essrs. John and 1117illiam G. Paonessa appeared in reference to their application for leasing Town property known ;as Block 411 , Parcels 1 and 76. After discussion by the members of the Board , Councilman McKeever presented the following resolution, seconded by Councilman Mills: WHEREAS , John Paonessa and William G. Paonessa have made an offer to this Board to lease from the Town of Mamaroneck, the property known and described on the assessment roll as Block 411, Parcels 1 and 76 , which the Town acquired in foreclosure proceedings , for a golf driving range; and WHEREAS , this property is zoned Residential "All except the first 100 feet thereof south of the Boston Post Road , which is zoned for business ; and WHEREAS , this Board is willing to lease the property for the purpose requested, for a term to expire not later than 'December 31 , 1949 , NO',',;, THEREFORE , BE IT RESOLVED, that this Board hereby accepts the offer of John Paonessa and William Paonessa to rent the property owned by the Town of Mamaroneck, known and described as Block 411 , Parcels 1 and 76 on the Town Assessment Roll, for a term to expire not later than Decdmber 31 , 1949 , at a rental of 8600. a year , payable at the rate of $50. per month , in advance; FURTHER RESOLVED , that acceptance of this offer is contingent upon John Paonessa and T7illiam Paonessa obtaining from the Zoning Board of Pppeals of the Town of I.lramaroneck, a variance from the Zoning Regulations , so as to permit a golf driving range to be operated on the property, and is further made contingent upon the approval by the Police Iluthor- ities of the Town, of the operation of a golf driving range at this location, so far as traffic , parking, etc. , is concerned; FURTHER RESOLVED , that if the Zoning Board of Appeals grants the variance and the Police De- partment approves the operation of the golf driving range as contemplated by the proposed lease , that the Town Attorney be instructed to prepare a lease in form satisfactory to this Board , providing for but not limited to pro- visions with regard to the proper operation of the golf driving range , regulations as to park- ing , maintenance of flood lights , maintenance of drainage and mosquito ditches and provisions that none of the property shall be filled or graded except with the approval and subject to the supervision of the Town Engineer. Summary of Receipts and Disbursements ) Analysis of Budget Appropriations and Expenditures) 1/1 to 1/31/48 Analysis of Estimated Revenues ) In reference to a request made for a street light on E1kan Road , Councilman Tiills offered the following resolution, se- conded by Councilman ^atson, and upon roll call , unanimously RESOLVED , that the Superintendent of Highways be and he hereby is authorized to have installed a new street light at the intersection of Elkan Road and Palmer Avenue , in accordance with the recommendation made by the Westchester Lighting Company. A letter dated February 9 , 1948 , was received from the County Transportation Co. Inc. , enclosing report in accordance with terms of consent and as prescribed in twenty-fifth paragraph, for the year ended December 31 , 1947. The report was ordered placed on file. A letter dated February 12, 1948, was received from County Transportation Co. , enclosing verified report relative to — operation of buses of this Company for the six month period ended December 31 , 1947. The report was ordered placed on file. . The Town Clerk informed the members of the Board that both the Village of Larchrnont and the Village of Mamaroneck have requested the use of election equipment , including voting machines , for their registration and election days , March 6 and 16 , respectively. The use of this equipment was granted to both Villages. The Town Clerk read the following letter: February 28 , 1948 The Honorable Town Board Mamaroneck, New York Gentlemen: i There is a record in the Commissioner of Finance ' s office , White Plains - sale March 30, 1874-Tax of 1873 - lots 167 and 170 , map of Grand Park, west of Railroad - for $2.70 each. This property is now known on the map of the Town of Mamaroneck a. s Block 823 , Parcel 229. The above mentioned taxes against this property do not appear in the records of this Tax Office. In order that we may appropriately issue a cancellation certificate , vie ask that you pass a resolution enabling my office to issue this certificate. This property was foreclosed In Rem by the Village of iiamaroneck and all other taxes have been cancelled. Yours very truly, Henry R. Dillon HRD:ws Receiver of Taxes On motion by Councilman Embury, seconded by Councilman McKeever , it was , upon roll call , unanimously RESOLVED , that the Receiver of Taxes be and hereby is authorized to issue such a cancellation certificate to cover Block 823 , Parcel 229, sale of March 30 , 18749 Tax of 1873 (lots 167 and 170 , Yap of Grand Park, west of Railroad) for $2.70 each. A letter dated March 1, 1948 , was received from Edward Ely Hoxie , requesting a print of the assessment map for a piece of property located on Myrtle Avenue. The Town Clerk was instructed to reply to Mr. Hoxie. Councilman Watson presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. Because of the many new homes that will have to be inspected between now and the First of June , Councilman Watson suggested that the Assessor carry some suitable identification to serve as a mark, of recognition, when making his inspection. The Supervisor said that this suggestion would be carried out. Councilman Embury reported that the Flag Pole at Station Park is in bad condition and should be replaced. He estimated that the total cost of a new steel pole would be somewhere between $1300. and $1400. He said there was sufficient surplus in the Park District budget and prior years ' operations to cover the cost of installing a new flag pole. Following discussion, it was suggested that at least three estimates be obtained by the Park Commission for this work. Councilman Embury reported there were more trees afflicted with Dutch Elm disease. He said that the trees in the Town had been taken care of by the Park Department , but there are many diseased trees on County Parkway property and the County has done absolutely nothing about them. He suggested that perhaps they could be persuaded to take care of them. 105 The Supervisor replied that the answer is that the County Commission seems to be lacking men and money . However , he added, he would try to use his best efforts to see if something can be done. Councilman McKeever reported that other areas will have to be found for future dumping of ashes and rubbish. Councilman Mills reported that at the annual meeting and election of officers of the Town of Iiamaroneck Fire Department on Monday, February 16 , 1948, the following members were elected to hold office for 1948: Chief: George W. Macri The Supervisor presented a sale which had been approved by the Trustees of the Village of Larchmont, covering property acquired by that Village in its foreclosure proceeding In Rem. On motion by Councilman `'latson, seconded by Councilman "mbury , the following resolution was unanimously adopted, WHEREAS , the Village of Larchmont , through the institution of an action begun on February 13 , 19469 in the County Court of 111estchester county , and en- titled "In the Matter of the Foreclosure of Tax Liens Pursuant to Article Seven-A , Title 3 of the Tax Law by the Village of Larchmont (List of Delin- quent Taxes for 1946) 11 , has become and now is the owner of a number of parcels of Real Estate situate in the Village of Larchmont and. Town of Mamaroneck by virtue of a judgment in said foreclosure action made and entered on June 19, 1946 and conveyances to the Village by the Village Treasurer made in pursuance of said judgment ; and WHEREAS, both the Village of Larchmont and Town of Mamaroneck held tax liens for unpaid taxes on said parcels of real property; and WHEREAS , pursuant to Section 165-a of the Tax Law an agreement dated May 20 , 1946 was entered into between the Village of Larchmont and the Town of Mamaroneck, which among other things set forth the interests of said municipalities in the properties being foreclosed, the disposition of said tax liens and unpaid taxes and the manner of the distribution of the proceeds received from said sales ; and WHEREAS , the highest bid received by the Village Treasurer pursuant to authorization of the Village Board of the Village of Larchmont on July 28, 1947 accepted the following offers of the upset prices - on said property; LIST OF BIDS ACCEPTED IN SECTION 6 Village Blocky Parcel Purchaser Price-Accepted Assessment 614 164 Mortimer Stein $1 ,800. 53 ,800. BE IT RESOLVED, that the sales prices bid for the parcels of real property listed above are hereby approved , and that all consents and approval by the Town Board of the Town of Mamaroneck for the sale of the aforesaid parcels of real property by the Village of Larchmont required under the provisions of the aforesaid agreement between the Village of Larchmont and Town of Mamaroneck dated May 20 , 1946 , are hereby granted and allowed. The Supervisor reported that the Receiver of Taxes had requested the usual resolution which must be adopted at this time of the year to provide for the method of collection of taxes. On motion by Councilman Embury , seconded by Councilman Watson, it was , upon roll call, unanimously RESOLVED , that pursuant to Section 96A of Chapter 60 of the Consolidated Laws as amended , known as the Tax Law, the Receiver of Taxes and Assessments of the Town of Mamaroneck is authorized to collect the 1948 State , County, Town and District taxes and water rents which become a lien April 1 , 1948, in two partial payments each amounting to fifty per cent of the total of said taxes and water rents; i FURTHER RESOLVED, that the Receiver of Taxes and Assessments is authorized and empowered to receive such partial payments or instalments of taxes and water rents at any time prior to the sale of tax liens but subject to the same penalties as are speci- fied and provided in Section 18 of Chapter 105 of the Laws of 1916 as amended, for the neglect to pay -- the total amount of said taxes , and water rents; FURTHER RESOLVED, that the acceptance of any such partial payment or instalments of the 1948 taxes and water rents , shall not be deemed to affect in any manner any right of the Town of 1amaroneck under any General or Special Law to enforce collection of any unpaid balance of such taxes and water rents as may remain due and owing to the Town of Mamaroneck but such rights and powers shall remain in full force and effect to enforce the collection of the unpaid balances of such taxes and water rents together with interest penalties and other lawful charges. On motion by Councilman Embury, seconded by Councilman Watson, it was , upon roll call, unanimously RESOLVED, that in accordance with the provisions of Section 26 of the Westchester County Tax Act , "The Daily Times" , the official newspaper published in the Village and Town of Mamaroneck, be and it hereby is designated as the newspaper in which the Receiver of Taxes and Assessments shall publish the notice of the collection of State , County, Town and District taxes , and Water Rents; and be it FURTHER RESOLVED that said ,publication be made on March 100 1948 , in the Daily Times; and be it FURTHER RESOLVED, that in accordance with the pro- visions of Section 26 of the Westchester County Tax Act , the Town Board do and it hereby does direct the Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose ad- dress is known to said Receiver of Taxes and Assess- ments, a tax bill for all taxes and water rents , the expense thereof to be a town charge. FURTHER RESOLVED , that pursuant to Chapter 82 of the Laws of 1944, the Town Board hereby approved the of- ficial form of tax receipt used by the Receiver of Taxes in the year 1948 for taxes for the year 1948. Hughes President The County Trust Company The Supervisor read the following letter received from the Larchmont Post #347, American Legions February 6 , 1948 Office of the Supervisor Town of Mamaroneck Mamaroneck, N.Y. Dear Mr. Supervisors It is indeed a pleasure to write this letter since it, serves to confirm the telephone conversation I had with you concerning the desire on the part of this Legion Post to secure and donate an ambulance for the use of the Larchmont Postal Area. We are now considering plans to achieve this purpose , but , before we can actually start , the membership has requested that written confirmation be secured from i i your government of the Town' s willingness to accept and maintain the ambulance jointly with the Village of Larchmont. t°de are indeed gratefil of the opportunity of being of service to our community , and await your reply with keen. anticipation. On motion by Councilman Embu.rv , seconded by Councilman Mills , it was unanimously RESOLVED, that this Board expresses its willingness to accept and maintain the ambulance jointly with the Village of Larchmont , which Larchmont Post , ¢x347, American Legion rlans to donate. The Supervisor reported that the Committee on Legislation met with the Testchester Count , Village Officials Association to see what possible solution could be decided upon to satisfy the Villages as to a larger percentage of state aid. He said there were several formulas presented for con- sideration but that finally the one known as Formula Pao. 3 was considered as being most likely to meet the approval of the Board of Supervisors and the Villages. Linder this Formula , the Town' s share would drop about 824,000. which would be distributed to the Village of Larchmont and Village of Mamaroneck. -- He added that there is no definite assurance this would be acceptable to the Wlestchester County Village Officials Association and Board of Supervisors , but it is about the only encouraging formula that can be considered. It is his feeling that something should be done for both Villages in an effort to satisfy them in this respect. Wks) .82i 1.00 The Town Attorney reported that Mr. Joseph Grassi , the purcha.serof three parcels of In Rem property, known as Block 608, Parcel l ; Block 608 , Parcel 114; and Block 612, Parcel 430 , owes a balance of 813,610. He said that Mr. Grassi *wishes to pay an additional deposit of $5,00C. and postpone the closing until April 1, 1948. He also advised that Yr. Robert Johnson, purchaser of two parcels known as Block 818, Parcels 78 and 85, owes a balance of $386.10. He has paid $197.50 and wishes to postpone closing until April 1 , 1948. Upon the Town Attorney ' s recommendation , the members of the Board authorized this extension of time.
