659 i MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO- NECK, HELD DECEMBER 5th, 19512 IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMARONECK. Supervisor Mandeville called the meeting to order at 8115 P . M. PRESENT: Supervisor Mandeville Councilmen Embury, Watson, Waterman and McKeever ABSENT: None Presence was also noted of Town Clerk Gronberg, the Attorney, Mr. Delius, and the Accountant, Mr. Finson. Mr. Viggo Borgen, 159 Larchmont Avenue, Larchmont, appeared together with several builders for whom he acted as spokesman, and said that they were present to learn what happened with regard to the sewer problem in Fenimore Road. Plans for houses on Mohegan Road had been submitted to the Building Inspector, he said, but permits for said houses had been denied. Mr. Delius stated that he had talked to Mr. Anthony Sansone, Corpora- tion Counsel for the Village of Mamaroneck, on December 4th, the mor- ning following the joint meeting between the Town and 'village Boards. He said he had notified Mr. Sansone that a public hearing would be necessary to spend the sum of $40,000. Mr. Delius said he had then been informed that Village Manager Johnson would, if this step is taken, consent to the connection of these new houses to the present sewer. The Supervisor said that this is a matter between the Village of Mamaroneck and the Building Inspector. The minutes of October 31st were approved as presented. The Clerk presented a letter from the Board of Police Commissioners recommending approval of the purchase of 4 sheep-lined coats and 4 caps for the motorcycle policemen, from Merson Uniform Company in New York City, at a total cost of $282. On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously j RESOLVED that the Police Department be and it hereby is authorized to purchase from Merson Uniform Company, New York City, 4 sheep-lined overcoats and 4 caps, at a total cost of $282. For the record, the Clerk read the decision of the County Board of Canvassers of the County of Westchester regarding the persons elected at the General Election held November 6th, 1951, as follows; Owen A. Pearson, 109 Griffen Avenue, Town of Mamaroneck, at the last meeting of this Board, the Clerk stated that he had written letters to Mr. Pearsones immediate neighbors, two on either side of his house, and had received only one reply, from Mr. Gordon M. Kehler, which he read to the Board. Receiving no word from the others, he finally phoned them, and two had no objection while the third had "no commentB4 Following discussion, on motion by Councilman McKeever, seconded by Councilman Embury, the following resolution was unanimously adopted: WHEREAS, Edward A. Pearson heretofore requested a permit for the erection of a french rustic fence to be erected in front of his property at 109 Griffen Avenue, Town of Mamaroneck; and i WHEREAS, the Building Inspector refused to grant such permit on the ground that the construction or erection of such fence violated the provisions of Section 112, Article 21, of the Building Code; and WHEREAS, Mr. Pearson has appealed to this Board for a modifica- tion of the ruling of the Building Inspector, pursuant to Section 23, Article 1 of the Building Code, so as to allow the erection.of said fence, NOW, THEREFORE, BE IT RESOLVED that permission is hereby granted to Edward A. Pearson to erect a french rustic fence which is more than 1/4 solid, to a height not exceeding S feet 5 inches. Councilmen Watson, Embury, McKeever and Waterman stated that they had nothing to report® The Board next took up the budget for 1952. The Clerk presented the affidavit of publication and affidavit of post- ing of the public hearing on the preliminary budget of the Town of Mamaroneck for the year 1952. The Supervisor stated that he would answer any questions pertaining to the budget, but if agreeable to those present, he would pursue the old custom of going through it page by page. The Board then proceeded to so review the budget, the Supervisor answering several questions re- garding minor details. At the completion of the discussion of the budget, the Supervisor thanked those present for appearing at this hearing. The following resolution was moved by Councilman Embury: WHEREAS, this Board has heretofore made, compiled and filed with the Town Clerk, a preliminary tax budget containing the estimated probable revenues and estimated expenditures for the several depart- ments, offices and other town and special district purposes for the year 1952; and WHEREAS, a notice of the completion and filing of said tax budget and calling a public hearing thereon has been duly published on November 24th and December 1st, 1951, in the Daily Times, Mamaroneck, and posted in the manner requred by law; and ...._.__.......- .. .. . . . The Highway Department contemplates the continuance of the sealAcoating program which is so essential to the 4 afeguarding of our investment in our highways, replacement and repair of sidewalks, and the necessary maintenance and replacement -of our highways . In addition, a new road roller,_ truak and --- --- spreaders are included in this budget„ A:embers . of the Town Board -2- November 3, 1951 The Police Department budget provides for the payment of the cost of the three patrol cars purchased during 1951 and, in addition, anticipates the replacement of two cars and two motorcycles during 1952. The appropriation for the Police Pension Fund is decreased for the coming year because the cash position of the Fund was better than had been anticipated. The cost of the "Report to the Residents of the Town of Mamaroneck" which cost was advanced by the General Fund, is included in the Outside Villages budget for miscellaneous ex- penditures. A new item to cover the costs of water distribution system extensions is included in the amount of ?5,000. These costs In the past were met by either bonding or, more recently, . from Ifater District Surplus. However, the surplus has been reduced to a point where it can no longer be used for such a purpose and this item becomes necessary. Conferences have been held in regards to our street lighting costs, and it is our understanding that similar negotiations are progressing with all the municipalities in 17estchester County. There has been submitted a proposal which would in- crease our costs by approxima tehy `"x5,000. per year. No pro- vision is made for such an increase as it is hoped that we can continue under the present cost formula for 1952. There are two other general classifications of expenditures which have increased rather sharply. our insurance costs are estimated at ':19,500. for the year, - an increase of '6, 500. This increase is cause d by two factors ; the new comprehensive policy which the Board authorized; and increased rates for almost all types of insurance. , In addition, the To=om must pro- vide for an increase of about r 4,000. in our payment to the New York State Employees ' Retirement Sys tem, primarily the result of the change in law which allows retirement at age 55, if contributions of the employee and the Municipality are increased. There is also attached hereto, "Schedules of Comparative Salaries, Bonded Indebtedness, Assessments, and Tax Rates ." You will note that our assessment has increased by x;2,312,000. our bonded indebtedness outstanding on January 1, 1952, will amount to 129790000. As has been our policy, no bonds have been issued since 1943, and none are contemplated. Respectfully submitted, Owen A. I i 669 After being seconded by Councilman McKeever, a vote was taken upon the foregoing resolution and after roll call, the vote was recorded as follows: AYES: Supervisor Mandeville Councilmen Embury, Watson, Waterman and McKeever NOES: None The Supervisor said this will be the last budget hearing attended by Mr. Watson in the capacity of Councilman. He went on to say that he doesn' t know of anyone who has ever given better public service. With all respect to Peter Kane who will be Mr. Watson' s successor, he said, he doesn' t know anyone who can take Mr. Watson' s place on the Board. He has saved the taxpayers thousands of dollars. His first act on the Board was to cause a great saving at the Incinerator which is a matter of record. He has been a pillar of strength not only with advice but in giving approval of items which might be de- batable. He said he wanted Mr. Watson to know how he feels and is sure the other members of the Board share his feelings. He said, "We will miss you Ed and may God bless you and may you return again one of these days when you get some of your Company' s problems straightened out, and take your place at this table." Mr. Watson thanked the Supervisor and members of the Board for their kind remarks. Upon motion by Councilman Waterman, seconded by Councilman McKeever, the following resolution was unanimously adopted: WHEREAS, on December 31, 1951, the Honorable Edward F. Watson will retire from office as Councilman of the Town of Mamaroneck be- cause of the demands of his personal business which requires all of his time; and WHEREAS, during his term of office he has been an outstanding public servant, faithful at all times and thoughtful of the welfare of .the citizens of the Town of Mamaroneck; and WHEREAS, he has been untiring in his efforts on behalf of the Town of Mamaroneck, more particularly in his capacity as an engineer with reference to the operation of the incinerator Jointly operated j by the Town of Mamaroneck and Village of Larchmont, NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Mamaroneck hereby expresses its regret at the termination of the public service of EDWARD F. WATSON, a man widely known and respected for his untiring work on behalf of the people he served. FURTHER RESOLVED that the Town Clerk be and he hereby is instructed to send a copy of this resolution to the Honorable Edward F. Watson. The Torn Attorney reported that Mr. Dillon had been unable to collect the balance due upon the sale of one lien sold at the last tax lien sale to Robert A. Maheu, covering Block 504 Parcel 25 in the amount of $729.90. Mr. Maheu had made the 25% down payment but, in spite of all efforts on the part of the Receiver of Taxes, had made no further payment. Therefore, he recommended that the lien be re'-sold. The Attorney further stated that a resolution of the Town Board was necessary providing for this sale under the provisions of Section 560 of the Westchester County Administrative Code. 671 i Upon motion by Councilman McKeever, seconded by Councilman Waterman, it was unanimously RESOLVED that re-sale of property known as Block 504 Parcel 25, reputed owner, Robert A. Maheu, for $727. 1 with expenses of sale and advertising $28.71, be held on the 16th day of January, 1952 at 10 A. M., in the office of the Town Clerk of the Town of Mamaroneck and that pursuant to provisions of Section 560 of the Westchester County Administrative Code, notice of such re-sale be published once in each of 3 calendar weeks consecutively next preceding the calendar week in which the date of sale is fixed, in the Mamaroneck Daily Times and Copies of the notice posted in 5 public places in the Town at least 3 weeks before the date fixed for such sale, all as provided in the Westchester County Administrative Code. The Town Attorney reported that the appeal by the Public Service Com- mission to the United States Supreme Court, from the decision of the Statutory Federal Court upholding the action of the Interstate Com- merce Commission increasing the commutation fares in New York State on the New Haven Railroad, over the amount fixed by the Public Service Commission, had been dismissed, and that Mr. Herbert Askwith asked that the Town Board pass a resolution and send it to the Chairman of the Public Service Commission, urging the Public Service Commission to immediately move for a re-hearing of this case because of its impor- tance and because of the dissent of two Justices of the Supreme Court who stated that the case should have been heard, rather than submitted. Upon motion made by Councilman Waterman, seconded by Councilman McKeever, it was unanimously RESOLVED that this Board urge the Public Service Commis- sion to immediately apply to the United States Supreme Court for a re-hearing of the New Haven Railroad com- muters' rate case, in view of strong dissenting opinion of two Justices and because so important a case should not be disposed of without hearing. FURTHER RESOLVED that the Town Clerk send a telegram to the Honorable Benjamin F. Feinberg, Chairman of the Public Service Commission of the State of New York, containing the substance of this resolution. Mr. Delius reported that a Mr. Charles Everett Moore had requested the issuance of a duplicate lien with regard to the Schism property on Cooper Lane. After discussion, the Board decided to ask for a bond in connection with this and Mr. Delius was requested to report further on this matter at the next meeting . The Town Attorney reported on the project to build a pumping plant and force main in Fenimore Road to connect the Town trunk sewer in Sewer District No. 1 with the County' s Mamaroneck Valley Sewer. He said he had checked the statute and the money can be obtained upon - sale of capital notes payable not later than the last day of the fiscal year following the year in which the notes were issued and that it would be advisable to wait until after January 1, to adopt ` a resolution for this borrowing so that 1/2 could be inserted in the budget for 1953 and the other 1/2 in the budget for 1954. He recom- mended that, in view of the provisions of Section 202-b of the Town Law, a public hearing be called and notice published and posted as provided in that section. 7 i i i i Upon motion made by Councilman McKeever, seconded by Councilman Watson, it was unanimously RESOLVED that the Clerk be and he hereby is directed to publish and post the following notice in accordance with the provisions of Section 202-b of the Town Laws PUBLIC NOTICE PLEASE TAKE NOTICE that the Town Board of the Town of Mamaroneck will hold a Public Hearing pursuant to Section 202-b of the Town Law, on the 19th day of December; 1951 at the Council Room of the Weaver Street Firehouse in the Town of Mamaroneck, to consider the Map Plan and Estimates submitted by A. J . Foote, Town Engineer and a Civil Engineer duly licensed by the State of New York, for the con- struction of a Pumping Plant and Force Main on Fenimore Road in the Town of Mamaroneck near the boundary line between the Town of Mamaroneck and the Village of Mamaroneck, and ten (10) inch pipe connection with the line of Mamaroneck Valley Sewer maintained by the County of Westchester, which plan is intended to relieve the sewers in the Village of Mamaroneck into which a portion of Sewer District No. 1 of the Town of Mamaroneck now discharges its sewage. The estimated expense of constructing the pumping plant, force main, etc. is $/0,000.00 PLEASE TAKE FURTHER NOTICE that a'_1 persons present at said Public Hearing will have an opportunity to be heard. _ The Town Attorney stated that he had examined the agreement between Winged Foot Holding Corporation and the Board of Sewer Commissioners of Sewer District No. 1, dated and signed on March 11, 1929, which provided for the connection of the sanitary sewer from the Winged Foot Club with the trunk sewer line in Fenimore Road and it was his opinion, upon reading this agreement, that it was the obligation of the Club to connect the sewer directly with the trunk sewer in the street. The agreement provides that there shall be no cost or expense charged at any time against the Town by reason of this sewer connec- tion and particularly because the Winged Foot Club is not in Sewer District No. 1. Mr. Delius was instructed to write a letter to the Club requesting that they repair the last 70 feet of this line. The Town Attorney submitted a memorandum on fines which was referred to Councilmen Embury and Waterman for study. The Town Attorney filed his written report in connection with the Pryer Manor Bridge over the Premium River and its contemplated repair. There being no further business to come before the meeting, it adjourned at 10:15 P . M. to meet again on December 19th.
