HomeMy WebLinkAbout1951_11_14 Town Board Special Minutes 635 i MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO- NECK, HELD NOVEMBER 14, 1951, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MA'IARONECK. Supervisor Mandeville called the meeting to order at 8: 15 P . M. PRESENT: Supervisor Mandeville Councilmen Embury, Watson, Waterman and McKeever ABSENT: None Presence was also noted of Town Clerk Gronberg and Town Accountant Finson. i Mr. Edward A. Pearson, 109 Griffen Avenue, appeared before the Board to request permission to erect a fence, approximately 6 feet in height, along the front boundary line of his property. This is desirable be- cause the front of the house is constructed almost entirely of 8ldss and in the winter, is open to the street. He said the fence would be a very attractive one of Frence rustic, and it is his intention to plant shrubbery in front of it. The Supervisor informed Mr. Pearson that the Town Clerk would be in- structed to write to his neighbors for their views on this matter, and the Town Board would then make its decision at the next meeting to be held December 5th. Mr . John B. Clifford, 14 Edgewood Avenue, wished to know whether or not the parking lot, located at the corner of Vine Street and Myrtle Boule- vard, concerning which Mr. Arthur Mancini had appeared before this Board at its last meeting, would be a permanent or temporary one and he also wished to know whether the Town Board had jurisdiction over the property in question. The Supervisor stated that the property is owned by the Westchester County Park Commission which will agree to lease it to an individual or group of individuals, only upon the recommendation by the Town Board. He went on to say that the Town Board, to date, has taken no action in the matter. Mr. Edward Roeder, Garden Road, said he wished to go on record that he finds it impossible to locate a parking space for his car at the station, and asked why parking is now prohibited on Myrtle Boulevard. He said he would like to know what the Town Board proposed to do in order to provide parking facilities for Town residents. The Supervisor said that 20% of the people who park at the Larchmont railroad Station do not reside in the Town of Mamaroneck. He also stated that the matter of parking and policing the streets throughout the Town is strictly a Police Commission matter. Mr. Roeder thought that, perhaps, the answer to the parking problem at the station might be parking meters. The :Supervisor agreed that it might be the answer but he said that, at present, the Board must keep in mind the building of the New England Thruway. He then explained that the New Haven Railroad Comapny owns most of the land presently being used for parking purposes and said that Mr. John Wang, Chairman of the Town Park Commission, together with Councilman Embury and himself, had had interviews with the New Haven Railroad officials with a view to obtaining more land from the Railroad Company to be used for parking purposes. 637 At these interviews the use of parking meters was suggested to the Railroad Company. Mr. Embury explained that the Park Department and Town Board are both keenly aware of the situation. He said there is a more or less permanent plan under consideration which will bring relief but it must wait until there is some idea of the route to be taken by the Thruway. It is expected that there will be a decision on this very soon. Mrs. Arthur Todhunter, 39 Myrtle Boulevard, asked, if any action is -- to be taken on the leasing of this property to Mr. Arthur Mancini, that the residents of the surrounding area be notified. The Supervisor said nothing would be done without notice to the tax- payers. Mr. William Weinberg, 77 Myrtle Boulevard, said he commended Mr. Man- cini, s enterprising spirit but he is afraid the parking lot might be an entering wedge for commercial ventures on Myrtle Boulevard at the Station. As there was no one else who wished to speak on the parking situation, the Supervisor asked those present who wished to register opposition to the parking lot, to do so by a show of hands. Twelve persons registered opposition. j Mr. Richard Paul, Mr. Fred Marleton and Mr. Peter Bordas of the Consolidated Edison Company appeared before the Board to request a contract with the Town which would mean an increase to the Town in the cost of the service of street lighting of approximately 95,000. Mr. Bordas submitted charts and explained the two types of contracts to the Board members. The Supervisor informed the Board that some time ago it was the idea of the Lighting Company to sell to the municipalities what they owned in the nature of equipment which meant that the municipality became the owner of the equipment and assumed the obligation of replacing and maintaining it. He further stated that many municipalities took advan- tage of the situation but the Town of Mamaroneck did not. Councilman Waterman asked Mr. Bordas if this were a matter which could be adjusted by the Public Service Commission. Mr. Bordas said that if the Lighting Company could not come to an agreement with the Town of Mamaroneck, this matter could be taken before the Public Service Com- mission. Mr. Bordas, in behalf of Consolidated Edison Company, thanked the Board members for granting him the time to appear and explain the situation. The Town Clerk was requested to read a letter received from the Larch- mont Gardens Civic Association, opposing any proposal which would in- volve rezoning to the category of "business property" the vacant corner at Vine Street and Myrtle Boulevard. Mr. Philip M. Dean, Secretary of the Association, was present at the meeting. Supervisor Mandeville brought up the matter of the request made by Fire Chief Thomsen to send a piece of fire equipment to New York City, to take part in the Civil Defense drill being held this evening. In con- nection with this, the Supervisor read an opinion by the Town Attorney, dated November 10, 1951, stating that if participation in this event in New York City is a result of an invitation from New York City or anything other than a formal directive or order from the Civil Defense Director, none of the insurance policies carried by the Town will cover the situation. The Supervisor said that he had requested Chief Thomsen not to send any of the apparatus until the Board could discuss the matter. When informed 09 that the apparatus had been sent to New York, the Supervisor requested that Chief Thomsen be asked to appear before the Board. The Chief appeared and informed the Board members that the Town Fire Department is a member of the Fire Chiefst Emergency Plan and at 7- 1/a this evening, an order had been received to send the apparatus to New York City. The Chief admitted that he had talked with Supervisor Mandeville re- garding the situation and that the Supervisor had told him he would take this matter up with the Town Board. The members of the Board agreed to investigate this matter further. Messrs Ricardi and NacCallum who were present to address the Board, decided to appear at a later date. The Clerk informed the Board that a tentative date for a meeting with the officials of the Village of Mamaroneck had been set for December 3rd. The Clerk presented a letter dated November 5th, received from Mrs. Mildred Leggette, 34 Rockland Avenue, Larchmont, asking that the Town Board assist the Chatsworth Garage in its generous offer to build additional parking space and to set aside sufficient area for residents and make certain that it is used by residents only. The letter was re- ceived and filed. The Clerk presented two letters from Mr. A. J. Foote, one addressed to the Supervisor and the other to the Town Board, stating that for reasons of health, he wished to retire from his Towns jobs at the end of the current year. On motion by Councilman McKeever, seconded by Councilman Watson, the following resolution was unanimously adopted- WHEREAS, A. J. Foote, who has been known to his numberless friends as 1tJim Foote" , has indicated his desire to retire as Super- intendent of Highways and Town Engineer, as of December 31st, 1951; and WHEREAS; ever since 1925, he has been called upon by the Town of Mamaroneck and its taxpayers for professional help in the capacity of Engineering Consultant to the former Sewer Commissioners, to the Park Board, and in many other instances where engineering services were re- quired in connection with municipal projects and improvements; and WHEREAS, from 1936 to date, Jim Foote has functioned as Town Superintendent of Highways, Town Engineer and at one time Building Inspector of the Town, applying his professional skill, his knowledge of 'Local conditions and his experience in municipal engineering to the job, far in excess of the monetary compensation which he has received; and WHEREAS, for his work and effort so greatly deserving, he has won the regard, friendship and gratitude of all those who, over this period of service, made contacts with him, and of his co-workers, NOW, THEREFORE, BE IT RESOLVED that this Board hereby expresses its heart- felt thanks and gratitude to Jim Foote for a job well done and, though regretting his retirement from municipal service, extends its best wishes for a successful future in his profession, and it is FURTHER RESOLVED that the Town Clerk be and he hereby is instructed to send a certified copy of this resolution to Jim Foote. It is an excellent plan, he said, will be a great asset to the community, and some money has been included in the budget for it. Councilman McKeever said he had nothing to report for his departments. Councilman Waterman submitted the Fire Department claims, approved by Chief Thomsen and audited by the Comptroller. The members of the Town Board, sitting as the Board of Fire Commissioners, considered the claims and on motion by Councilman Waterman, seconded by Councilman Embury, it was unanimously RESOLVED that the following described claims be and they hereby are approved and that the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the Budget for the Fire Department: A & A Automotive Co. $46. 53 Joe and Patsy' s Garage 19.00 G . RR Company 30.00 Total $274.73 647 The Board members discussed the request of the Lighting Company and it was decided that, inasmuch as the representative had stated that the Public Service Commission would have jurisdiction in this matter, the request should be directed to that Commission, The Supervisor presented a resolution received from the Village of Mamaroneck with a request for approval of their sale of property acquired by their foreclosure proceeding in rem. Upon motion by Councilman McKeever, seconded by Councilman Waterman, the following resolution was, upon roll call, unanimously adopted: WHEREAS, the Village of Mamaroneck, through the institution of an action in the County Court of Westchester County, entitled "In the Matter of the Foreclosure of Tax Liens pursuant to Article VII-A, Title 3 of the Tax Law by the Village of Mamaroneck, List of Delinquent Taxes for 1945" has become and now is the owner of a number of parcels of real estate situate in the Village of Mamaroneck and Town of Mamaroneck; and WHEREAS, both the Village of Mamaroneck and the Town of Mamaro- neck held tax liens on said parcels of real property; and WHEREAS, pursuant to Section 165H of the Tax Law, an agreement was entered into between the Village of Mamaroneck and the Town of Mamaroneck, which, among other things, set forth the interests of said municipalities in the properties being foreclosed, the manner of the sale of said properties, and the manner of the dis- tribution of the proceeds received from said sales; and WHEREAS, the Village of Mamaroneck has, pursuant to an agree- ment had with the Town of Mamaroneck, advertised for and has here- tofore received bids on certain properties owned by the Town of Mamaroneck as well as on certain properties owned by the Village of Mamaroneck in the Town of Mamaroneck; and WHEREAS, the Board of Trustees of the Village of Mamaroneck has given consideration thereto and after due deliberation, accepted the bids hereinafter listed as to price and terms therein set forth; and WHEREAS, since receipt of said bids, this Board has given consideration thereto, and after due deliberation, it is i RESOLVED that the bids hereinafter listed be accepted at the price and terms therein set forth: LIST OF BIDS ACCEPTED IN SECTION 8 Total Town Village Assessed Blkm Pare Sec. Smith) The Supervisor presented a letter dated October 19th, 1951, received from Mr® James C . Harding, Commissioner of Public Works of Westchester County, advising that the County has extended for another year, its con- tract with the State Department of Public Works for the removal of ice and snow from the State highways in Westchester County. Upon motion by Councilman McKeever, seconded by Councilman Embury, the following resolution was unanimously adopted: 649 WHEREAS, Section 12 of the Highway Law as amended by Chapter 305 of the Laws of 1946, provides that if the removal of snow and ice from the State highways is taken over by the County, the County can arrange with the Town Superintendents of the various towns in the County of Westchester and/or the villages therein for the removal of the snow from such State highways as are within their municipal boundaries, and the entire cost of such work will be reimbursed by the State; and WHEREAS, the Town of Mamaroneck under date of November 8, 1946, -- entered into a contract with the County of Westchester for the removal of snow and ice from the State Highways within this Town, including the Villages of Mamaroneck and Larchmont, in accordance with the provisions of Section 12 of the Highway Law as amended, and under date of November 15, 1950, extended this contract for the season 1950-1951, NOW, THEREFORE, BE IT RESOLVED that the Town of Mamaroneck extend the above mentioned contract with the County of Westchester for an additional year, and be it FURTHER RESOLVED that a certified copy of this resolution be forwarded to the Westchester County Commissioner of Public Works. The Supervisor presented an agreement with the County of Westchester for removal of snow on County roads for the winter season of 1951-1952 at a flat rate of $200. per mile. On motion by Councilman Watson, seconded by Councilman McKeever, it was unanimously RESOLVED that the Supervisor be and he hereby is authorized to sign the agreement with the County of Westchester for the removal of snow from County roads within the Unincor- porated Section of the Town of Mamaroneck at a flat rate of $200. per mile. Councilman Watson stated with regard to the Fire Department, that he feels the Westchester Fire Chiefs@ Emergency Plan is a good one and that the Town can mutually benefit from it. He also said he is in sympathy with the Civil Defense idea and feels the Town should go along with the West- chester Emergency Plan for Civil Defense but that the Town must also be sure that no insurance is invalidated. M. in the Council Room of the Weaver Street Fire House, Town of Mamaroneck. On motion duly made and seconded, it was unanimously RESOLVED that the Town Clerk give notice of said Public Hearing as required by Section 113 of the Town Law in "The Daily Times", the official newspaper published in the Town of Mamaroneck, in its issues of November 2L+th and December 1st, 1951.
