HomeMy WebLinkAbout1951_10_31 Town Board Special Minutes 625 MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO- NECK, HELD OCTOBER 31st, 1951, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMARONECK. Supervisor Mandeville called the meeting to. order at 8: 15 P. M. PRESENT: Supervisor Mandeville Councilmen Embury, Watson and McKeever ABSENT: Councilman Waterman Presence was also noted of Town Clerk Gronberg, Town Attorney Delius, and Town Accountant Finson. The minutes of June 27th, August lst, September Lath and September. 12th were approved as presented and the minutes of October 3rd were approved as corrected. The Clerk presented a letter dated October 12th, received from the Building Trades Employers' Association of Westchester County, New York, Inc. , together with a resolution adopted by that Association on Octo- ber 11th, 1951, urging that municipalities of Westchester County adopt a resolution accepting the applicability of the State Building Con- struction Code in their respective municipalities in conformance with Section 374-a of Article 18 of the Executive Law of the State of New York. Mr. Delius reported on the Code and the members of the Board discussed it and decided to lay it over for the present, for further study. The following reports were received and filed: Report of Westchester Shore Humane Society, Inc. , September, 1951 Report of Receiver of Taxes and Assessments, October, 1951 Fire Inspector' s Report for August and September List of Claims Audited and Paid by the Comptroller, October l to November 1, 1951 Summary of Receipts and Disbursements, January 1 to September 30, 1951 Analysis of Budget Appropriations and Expenditures, January 1 to Sep- tember 30, 1951 Analysis of Estimated Revenues, January 1 to September 30, 1951 For the record, the Town Clerk presented the affidavit of publication of the Registration Notice. The Town Clerk requested a resolution approving rates of pay for Election Inspectors and Poll Clerks. On motion by Councilman Watson, seconded by Councilman McKeever, it was unanimously RESOLVED that the rates of pay for Election Inspectors and Poll Clerks shall be as follows: Election Inspectors Compensation per day Primary day, August 21 $10.00 Registration, Personal, September 24,25, October 3,4, 5 7.00 Registration, Personal, October 6 15 .00 Registration, Non-personal, October 6 15.00 Registration, Non-personal, October 13 11.00 Election Day, November 6 15 .00 Two instruction meetings at $1.50 each Election Day, November 6, Chairman $2. extra Poll Clerks Election Day, November 6 15.00 627 The Town Clerk presented a letter from the University of the State of New York, dated October 25th, 1951, together with a Local Records Disposition Request, which, when properly made out and signed by the Commissioner of Education, would authorize the destruction of cer- tain valueless dog records such as dog applications, Enumeratorfs lists and dog license books . The Clerk stated that it would be necessary for the Town Board to pass a resolution authorizing the forwarding of this Request to the - State Department of Education. On motion by Councilman Embury, seconded by Councilman Watson, it was unanimously RESOLVED by the Town Board of the Town of Mamaroneck, that Charles J. Gronberg, Town Clerk, be and he hereby is autho- rized to dispose of Record Items Nos. 1 to 8 on Records Dis- position Request, List No. 1, dated October 31, 1951, issued pursuant to Section 1.14 of the Regulations of the Commis- sioner of Education, and be it FURTHER RESOLVED that the Clerk of this Board be and hereby is directed to furnish a certified copy of this resolution to Charles J. Gronberg, Town Clerk, to be forwarded to the Com- missioner of Education. The Fire Department claims approved by Chief Thomsen and audited by the Comptroller, were submitted by the Town Clerk in the absence of Councilman Waterman. The members of the Town Board, sitting as the Board of Fire Commis- - sioners, considered the claims and on motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously RESOLVED that the following described claims be and they hereby are approved and that the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the budget for the Fire Departments Bonnie Briar Country Club, Inc. $641.50 Leonard W. Thum & Johnson 16.00 Ramon Martinez 35 .00 Mitchell 011 Corp. 44.70 State Insurance Fund 111.40 Westchester Joint Water Works No. 1 6.97 New York Telephone Company 32.00 Consolidated Edison Co. of New York, Inc. 37.75 $1,272.44 Hydrant Rental: Westchester Joint Water Works No. 1 23280.00 The New Rochelle Water Company 56.25 Village of Larchmont-Water Department 80.00 $3,688.69 Councilman Watson had nothing to report for his Departments. 6429 Councilman Embury presented and read a letter dated October 9th, 19512 from the Board of Police Commissioners, recommending acceptance of the low bid submitted by Merson Uniform Co. , New York City, for winter uniform requirements of the Police Department, and also recommending the purchase, from Margolius and Sons, Mamaroneck, New York, of 3 suits at $55 . each, one for Chief Yerick, another for Detective Sergeant Smith and the third for Detective Paonessa. On motion by Councilman Embury, seconded by Councilman Watson, it was unanimously RESOLVED that the bid of Merson Uniform Co. , New York City, in the amount of $419.50, for the purchase of the following: 1 pair lieutenant' s trousers 3 pairs sergeant' s trousers 12 pairs patrolmen' s trousers 4 pairs motorcycle breeches be and it hereby is accepted, and it is FURTHER RESOLVED that the bid of Margolius and Sons, Mamaroneck, New York, for 3 suits at $55 . each, be and it hereby is accepted. The Supervisor submitted a number of "thank you" notes sent to him by various persons upon receipt by them of the booklet "A Report to the Residents of the Town of Mamaroneck" recently distributed in the Town outside of Villages. On motion by Councilman Embury, seconded by Councilman Watson, it was, upon roll call, unanimously -- RESOLVED that the annual compensation of Edward Bakker and Louis Turco, Patrolmen, be fixed at $3,980. each, effective November 15, 1951, in accordance with the regular increment schedule allowed. Councilman McKeever moved and Councilman Watson seconded the follow- ing resolution which was, upon roil call, unanimously adopted: WHEREAS, the Town of Mamaroneck, through the institution of an action in the County Court of Westchester County, entitled "In the Matter of the Foreclosure of Tax Liens pursuant to Article VII-P , Title 3 of the Tax Law, by the Town of Mamaroneck, List of Delinquent Taxes for 1947" has become and now is the owner of a number of parcels of real estate situate in the Unincorporated Section of the Town of Mamaroneck; and WHEREAS, the Town of Mamaroneck advertised for bids and held a public auction on October 22nd, 1951, and received bids on certain of said parcels of real estate now owned by the Town of Mamaroneck; and WHEREAS, since the receipt of said bids, this Board has given careful consideration thereto, and after due deliberation, it is RESOLVED that the bids hereinafter listed be accepted at the price and terms therein set forth: LIST OF BIDS ACCEPTED IN SECTIONS 1 to 5 INCLUSIVE Assessed Sales Block Parcel Purchaser Value Price Terms 222 235 A. Gotti 1,700 567 Cash I FURTHER RESOLVED that the Supervisor is authorized and directed to execute and deliver deeds to these parcels in accordance with the terms and contracts of sale and the Town Attorney is authorized to take all steps neces- sary to complete the sale and transfer these parcels. Supervisor Mandeville requested a resolution appointing Mr. John C . Forrar as Dog Enumerator. On motion by Councilman Embury, seconded by Councilman Watson, it was unanimously RESOLVED that, pursuant to Section 108 of the Agriculture and Markets Law, John C . Forrar be and he hereby is appointed Dog Enumerator for the Unincorporated Area of the Town of Mamaroneck for the year 1952. Supervisor Mandeville presented a lease covering the use of vacant land known as Parcel 45 and a portion of Parcel 1B, owned by the Westchester County Park Commission, at an annual rental of $1. On motion by Councilman Embury, seconded by Councilman Watson, it was unanimously RESOLVED that the Supervisor be and he hereby is authorized to sign a lease with the Westchester County Park Commission covering the use of vacant land known as Parcel 45 and a portion of Parcel 1B, Sheet 9, Pelham Port Chester Parkway, for a period of one year ending October 31st, 1952, at an annual rental of $1. The Supervisor presented an estimate for the installation of a 6" spur to Heather Lane from Weaver Street including a fire hydrant, received from the Westchester Joint Water Works, in the amount of $1,751.05 • On motion by Councilman McKeever, seconded by Councilman Watson, it was, upon roll call, unanimously RESOLVED that the Westchester Joint Water Works, No. 1, be and it hereby is authorized to install a 6" spur to Heather Lane from Weaver Street, to include a fire hydrant, in tree amount of $1,751.05 . Councilman McKeever requested, inasmuch as Mr. Foote has been ill, that his report on the Fenimore Road sewer situation be postponed until the next meeting . Town Attorney Delius reported that he had received from various com- munities, their requirements and specifications for the acceptance of streets. It is Mr. Delius' recommendation that a set of such specifi- cations be made for use in the Town of Mamaroneck. He said Mr. Foote, whose recommendations are in tentative form at present, has also been working on this matter. The Town Board set November 20th as the date for a joint meeting with the Village Board of the Village of Mamaroneck to discuss drainage. The Town Clerk was instructed to contact Village Manager Johnson to learn whether this date will be suitable. Mr. Arthur Mancini, Jr. appeared before the Board to request that the Town Board recommend to the Westchester County Park Commission, its leasing to him of a piece of property on the east side of Myrtle Boule- vard, corner ' of Vine Street, for a parking space. He said that cars are 633 parked on Myrtle Boulevard as far as Preston Street, on Cabot Road and elsewhere, wherever space is available - even over embankments . The property he has in mind is about 200 feet by L+00 feet. He further said that he is willing to pay the expense of preparing the lot for park- ing and there would be no charge. The members of the Board discussed this matter and it was decided that Councilman Embury will discuss it with Mr. Wang, Chairman of the Park Commission, and Supervisor Mandeville will discuss it with Mr. George Haight of the Westchester County Park Commission.
