MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD SEPTEMBER 4th, 1951, IN THE COUNCIL ROOM OF THE {
WEAVER STREET FIRE HOUSE, TOWN OF MArARONECK.
PRESENT: Supervisor Mandeville
Councilmen Watson and McKeever
ABSENT: Councilmen Embury and Waterman
Presence was also noted of Mr. Delius, Town Attorney, Town Clerk
Gronberg, and the Assessor, Mr. McEvoy.
The Town Clerk stated that he had received from the Assessor, the
tentative Trial and Grand Jury lists and presented the same to the
members of the Board for consideration. After examination and veri-
fication of said lists by the Town Board, it was, on motion by Council-
man Watson, seconded by Councilman McKeever, unanimously
RESOLVED that the completed lists of Grand and Trial
Jurors be and they hereby are approved and certified
by the members of the Town Board and Assessor, and
be it
FURTHER RESOLVED that the Town Clerk be and he here-
by is authorized, empowered and directed to forward
certified lists of the Trial and Grand Jurors to the
Commissioner of Jurors in the form required by law.
_ The Town Clerk requested authorization to publish the usual regis-
tration notice in the Daily Times. On motion by Councilman Watson,
seconded by Councilman McKeever, it was unanimously
RESOLVED that in accordance with the provisions of Section
76 of the Election Law, a notice be published in the
Daily Times on September 15th and 22nd, 1951, giving a list
of the places of registration within the Town of Mamaroneck,
a statement of the days and hours of registration and a
brief description of the boundaries of each registration
district in the Town.
On motion by Councilman McKeever, seconded by Councilman Watson,
it was unanimously
RESOLVED that Arthur J. Foote and Francis O'Brien be and
they hereby are authorized to attend the annual meeting
of the New York State Association of Town Superintendents
of Highways to be held September 12th, 13th and i4th, in
Buffalo, New York.
FURTHER RESOLVED that the expenses for this trip be paid
out of the item in the budget appropriated for such pur-
pose.

The Town Attorney informed the Board that Mr. Benny Orsino had
brought a Mandamus proceeding against Mr. Thomas J . McEvoy as
Building Inspector, to compel him to issue a permit for a house
— at the top of Bonnie Way, known as Block 105, Parcel 444 on the
Assessment Map. Mr. Delius explained that the Building Inspector
had refused this permit on the ground that the street at that point
is not sufficiently improved to allow reasonable access, particu-
larly because of a shelf of rock which is located in the center
of the street, about opposite the property and that the contro-

versy is centered about the fact of whether or not there is
access since it is actually possibie to pass to one side of the
snelf of rock and enter the property. He exhibited to the Board,
photographs and a map which are part of the Answer and Return which
was served upon the petitioner, Mr. Orsin.c.
Mr. Delius said the matter would come before Judge Bailey in Supreme
Court on the following day, September 5th.
Discussion followed between members of the Board and the Attorney
and the Building Inspector.
The Town Attorney said that no Board action would be necessary
since the proceedings have been directed against only the Building
Inspector.
There being no further business to come before the meeting, it
adjourned at 9:30 to meet again on September 12th, 1951.
