HomeMy WebLinkAbout1951_04_04 Town Board Regular Minutes 483 MINUTES OF A REGULAR MEETING OF THE TOWN' BOARD OF THE TOIn'N OF MAMARO- NECK, HELD APRIL 4th, 1951, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMARONECK. Supervisor Mandeville called the meeting to order at 8: 15 P . M. PRESENT: Supervisor Mandeville Councilmen Embury, Watson, Waterman and McKeever ABSENT: None Presence was also noted of Town Attorney Delius, Town Clerk Gronberg, and Town Accountant Finsor.. Supervisor Mandeville stated that the regular order of business would be dispensed with in order to give those present an opportunity to be heard. Mr. James P . Wall, 430 Weaver Street, submitted a petition signed by 48 residents of the Unincorporated Area of the Town, approximately 30 of whom were present. The petition asks that the Town Board take action to control the waters of the Sheldrake River to avoid damage to adjacent homes and property during flash floods. I Mr. Wall asked that the petition be made a part of the meeting and the Clerk was instructed to read it. Mrs . Leo Safran, 420 Weaver Street, said that the sewer pipe, con- nected with Murray Avenue homes and running through property at 282 Murray Avenue, has been responsible for the overflow in the basement of Mr. Harold H . Horton of 419 Weaver Street. Last week, during the, storm, she said, the water overflowed the Murray Avenue curb and carried sewage to her property creating a lake 2 feet deep in her garage, with a two foot deep pool in her basement causing ruin to the equipment stored there. Mrs . Safran went on to say that each time it rains, there are odors of sewage in her home and all the Murray Avenue homes are hooked up to dry wells and when the rain stops, the overflow seeps through her basement walls. Mr. Harold H . Horton of 419 Weaver Street, said there are two problems affecting these people, one is the overflowing of the Sheldrake Brook and the other is the sewage. Dr. George G. Rapp, 482 Weaver Street, described the Sheldrake River as an open sewer and a source of contamination. Supervisor Mandeville explained that to remedy this condition would involve the expenditure of at least $500,000, according to a survey made by the United States Army Engineers in 1938. He also said. that the Town has no right to enter private roperty to correct trouble- some sewers. When asked if this situation had been brought about by the opening of the Larchmont Reservoir, the Supervisor answered that he would investigate and rea_uest that those in charge of the reservoir be -- more watchful in the future. The Supervisor also said that he would have additional catch basins built in Weaver Street, and the Sheldrake River bed would be cleaned. The regular order of business was now resumed. The minutes of March 21st were approved as presented. i The Clerk read a. letter dated March 31st, received from Mrs. Dorothy Hill Shea, 207 Mulberry Lane, Larchmont, complaining that her garage and cellar were flooded as a result of the development of property across the street which completely altered the normal drainage functions of the immediate area. I I The letter was ordered received and filed. The Clerk presented and read a letter dated March 23rd, 1951, re- - ceived from Mr. George Polera, requesting the issuance of a duplicate tax lien for property known as Block 124, Parcel 445 . This letter was referred to the Town Attorney. The following reports were ordered received and filed: Town Clerk' s Report, March, 1951 Report of Receiver of Taxes and Assessments, March, 1951 Building Report, March, 1951 Attendance Report, March, 1951 Fire Report, March, 1951 Statement of Bank Balances as of April lst, 1951 List of Claims Audited and Paid by the Comptroller, March 7 to April 4, 1951 Councilman Watson presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes and on motion by Councilman Watson, seconded by Councilman Embury, the following resolution was unanimously adopted: WHEREAS, the Assessor has presented petitions for the correction of the assessment roll for certain years, pursuant to the provisions of Section 557, Article 16 of the Westchester County Administrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petitions for the correction of said assessment roll, NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1950, taxes of 1951, which shows property now appearing on the roll as follows: Block Parcel Name Land Imo. Stanton & W 400 Councilman Watson reported in connection with the recent storm, that on Saturday, about noon, calls were received at the Town Office from people in the Lafayette Road area saying that there was a large amount of sewage in their basement. He said Mr. O 'Brien checked and found the condition to be as reported. In the Supervisor' s absence, Mr. Watson requested the Fire Department to pump these cellars out, and he said he received immediate cooperation from Chief Thomsen. Councilman Embury submitted a letter dated April 3rd, 1951, received from Chief Yerick, stating that the annual inspection of the Police Department would be held at Police Headquarters on Saturday, April ' 4th, at 8: 30 A. M. An invitation has been extended by the Board of Police Commissioners to the Supervisor and members of the Town Board to attend this inspection. Councilman Embury submitted a letter received by the Police Department from Mr. J. D. Kelnberger, 129 Hickory Grove Drive, with reference to the parking situation on the Town, side of the Larchmont railroad station and also a copy of the reply sent to him by Chief Yerick. Councilman Embury submitted a letter dated April 2nd, 1951, received from Mr. Cecil W. Borton, Chairman of the Board of Police Commis- sioners, advising the Town Board that, at a meeting held March 29, 1951, the following appointments were made: Sergeant Francis J . Waterbury to the position of Lieutenant Patrolman William Cunningham to the position of Sergeant William Celestino to the position of patrolman On motion by Councilman Embury, seconded by Councilman Ldaterman, it was unanimously RESOLVED that Francis J . Waterbury be and he hereby is appointed to the position of Lieutenant in the Police Department at a salary of $4,780 per annum, effective April 15th, 1951, to fill the vacancy created by the retirement of Lieutenant Paul Euiler. FURTHER RESOLVED that William Cunningham be and he hereby is appointed to the position of Sergeant in the Police Department at a salary of .0. ,380 per annum, effective April 15th, 19512 to fill the vacancy created by the promotion of Sergeant Waterbury. FURTHER RESOLVED that William Celest ino, 72 Main Street, Tuckahoe, New York, be and he hereby is appointed pro- bationary Patrolman at a salary of $2,880 per annum, effective April 15, 1951, to fill the vacancy created by the promotion of Officer Cunningham. Councilman Embury reported that the following bids had been received by the Police Commission for the purchase of summer uniforms: D . & M. $1,038. 50 I . Goldberg & Son 12097.25 Smith Gray Corp. 11112.60 The Police Commission recommended acceptance of the bid of D . & M . , Pelham, New York. 9 I i On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously RESOLVED that the bid of D. & M ., Pelham, New York, in the amount of $1,038.50 for summer uniform requirements in the Police Department, be and it hereby is accepted. Councilman Embury said that the Commission recommended the purchase, from Margolius & Sons, of 3 suits at $55 . each, one for Chief Yerick - and one each for Detectives Smith and Paonessa. i On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously i RESOLVED that the Police Department be and it hereby is authorized to purchase from Margolius & Sons, Mamaroneck, New York, 3 suits at $55 . each, one for Chief Yerick and one each for Detectives Smith and Paonessa. Councilman Embury reported that the Commission had received bids from the following for the purchase of 6 dozen summer shirts: Charles Greenblatt $42.75 per dozen I . Goldberg & Son L+2.50 Der dozen Creighton Shirt Co. , Inc. 36.25 per dozen The Commission recommended acceptance of the bid submitted by Creighton Shirt Co. , Inc. On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously RESOLVED that the bid of Creighton Shirt Cc. , Inc. for the purchase by the Police Department of 6 dozen summer shirts at $36.25 per dozen, be and it hereby is accepted. Councilman Embury reported that the Police Commission had received bids for the purchase of 50 gallons of street paint as follows: C . F. McCulloch $ 2.95 per gallon Everseal 3.45. per gallon Socony Paint Products 2.85 per gallon j The Commission recommended the acceptance of the McCulloch bid be- cause of past satisfactory performance of tneir Hanlite White Zone Mark product. On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously RESOLVED that the bid of C . F. McCulloch, for the pur- chase of 50 gallons of street paint for the Police De- partment at 2.95 per gallon, be and it hereby is accepted. Councilman McKeever submitted a letter dated March 30th, addressed to A. J . Foote, received from the State Department of Health, re sewers in Lancia Lane and Colonial Lane. Mr. Delius was instructed to go into this matter with Mr. Foote, with reference to the storm drains of the Winged Foot Golf Club. 4911 1 The Board next discussed the parking situation at the Larchmont Railroad Station. The Supervisor said that he would arrange a con- ference between Councilman Embury, Mr. Bardo of the New Haven Rail- road Company, and himself, to try to arrange to reserve a portion of the parking area at the Station for residents of the Unincorporated Section of the Town. Mr. Delius reported that he had investigated the insurance coverage on Bus Companies having franchises within the Town of Mamaroneck, and in all cases the coverage was $50,000 - $1002000. Mr. Delius reported that he had collected some model ordinances and information relating to radio aerials and antennae and said he would submit it to Councilman Watson for comment or suggestion. There being no further business, the meeting adjourned at 11 P . M. to meet again on April 18th, 1951. Town C erk i
