MI11UTES OF A REGULAR i,IEETING OF THE T'OW2� BOARD OF THE TOWN OF
MAMARO_�ECK, HELD IN THE COUNCIL ROOM OF THE IVEAVER STREET FIRE
HOUSE, TO1d1N OF M6:MAROAECK, INE-W YORK, ON OCTOBER IBth, 1950.
Supervisor Mandeville called the meeting to order at 8: i5 P . M.
PRESENT: Supervisor Mandeville
--- Councilmen riatson, Waterman and McKeever
ABSENT: Councilman Embury
Presence was also noted of Town Attorney Delius, Town Clerk Gronberg
and Town Accountant Finson.
Mr. Rudy Novak again appeared before the Board with reference to the
culvert which abuts his property. He was advised that Mr. Foote was
on vacation and that the matter would be discussed with him upon his
return.
The Clerk presented and read a letter, dated October 11, 1950, received
from Mr. L. R. Dodson, Secretary of the Board of Police Commissioners,
submitting 3 bids for the purchase of 13 winter overcoats. Although
slightly higher in price, the Commission recommended acceptance of the
bid of Smith Gray Corporation for model P96 overcoat, made of 19-oz.
whipcord, with special lining, because the coats are 7 pounds lighter
and are more flexible in use. The Commission also recuested approval
for the purchase of 3 additional overcoats from Margolius Sons, Inc.
at $50. each, one for the Chief and the other 2 for the detectives.
Following discussion and upon motion by Councilman Watson, seconded by
Councilman McKeever, it was unanimously
RESOLVED that the Police Department be and it hereby is
authorized to purchase from Smith Gray Corporation, 13
model P96 overcoats, made of 19-oz. whipcord, with special
— lining, at a price of $80.25 each, or a total of $1,043 .25 .
FURTHER RESOLVED that the Police Department be and it
hereby is authorized to purchase from M argolius Sons,
Inc. , 3 overcoats at $50. each, or a total price of $150.
The Supervisor stated that Chief Yerick wishes to turn in a 194$
Chevrolet which has been driven 60,000 miles, and is in need of repairs.
in connection with this, he had received 3 bids from dealers as follows:
Cook, New Rochelle $700.
Rice, New Rochelle 750.
Flinn, Larchmont 750.
The Supervisor further stated that the money received from the sale of
this automobile will be treated as a refund toward the purchase of the
police automobiles, previously authorized by the Board, and which the
dealer now has in storage.
On motion by Councilman Watson, seconded by Councilman Waterman, it
was, upon roll call, unanimously

RESOLVED that the Supervisor be and he hereby is
authorized on behalf of the Police Department, to
sell to Flinn Motor Corporation, Larchmont, N . Y. ,
one 1948 Chevrolet for the sum of $750.

The Town Clerk presented the Fire Report for the month of September,
1950.
Mr. Murray L . Banning, 9 nest Brookside Drive, appeared before the
Board and requested that a sign prohibiting dumping in the Sheldrake
River and one prohibiting littering the Lake and the surrounding
area with bread and other debris, be put up in those locations.
The Supervisor assured Mr. Banning that the Police Department would
take care of the matter.
Councilman Watson said he had nothing to report for his departments.
The Supervisor presented 2 resolutions received from the Village of
Mamaroneck for the sale of properties acquired in their foreclosure
in rem and recomrended approval of the sales.
On motion made by Councilman McKeever, seconded by Councilman Watson,
the following resolution was, upon roll call, unanimously adopted:
WnEREAS, the Village of Mamaroneck, through the institution
of an action in the County Court of Westchester County, entitled
T1 In the Platter of the foreclosure of Tax Liens pursuant to Article
VII-A, Title 3 of the Tax Law by the Village of Mamaroneck, List of
Delinquent Taxes for 195" has become and now is the owner of a
number of parcels of real estate situate in the Village of Mamaroneck
and 'Town of Mamaroneck, and
UHEREAS, both the Village of M araaroneck and the Town of
Mamaroneck held tax liens on said parcels of real property; and
WHEREAS, pursuant to Section 165H of the Tax Law, an agree-
ment was entered into between the Village of Mamaroneck and the
Town of Mamaroneck, which, among other things, set forth the interests
of said municipalities in the properties being foreclosed, the manner
of the sale of said properties, and the manner of the distribution
of the proceeds received from said sales; and
WHEREAS, the Village of Mamaroneck has, ;ursuant to an
agreement had with the Town of Mamaroneck, advertised for and has
heretofore received bids on certain properties owned by the Town
of Mamaroneck as well as on certain pro,�,erties owned by the Village
of Mamaroneck, in the Town of Mamaroneck; and
WHEREAS, the Board of Trustees of the Village of Mamaroneck
has given consideration thereto and after due deliberation accepted
the bids hereinafter listed as to price and terms therein set forth;
and
WHEREAS, since receipt of said bids, this Board has given con-
sideration thereto, and after due deliberation, it is
RESOLVED t'nat the bids hereinafter listed, be accepted
at t1e price and terms therein set forth:

The Supervisor submitted for approval, the lease received from West-
chester County Park Commission, covering Parcel 45 and a portion of
Parcel 1B, Sheet 9, Pelham Port Chester Parkway, which parcels of
property are used by the Town of Mamaroneck as a nursery.
On motion by Councilman Watson, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the Supervisor be and he hereby is authorized
to sign a lease with the Westchester County Park Commission,
covering Parcel 45 and a portion of Parcel 1B, Sheet 9, Pelham
Port Chester Parkway, for a period of 1 year, commencing
November 1st, 1950, at an annual rental of $1.
The Supervisor submitted and read a telegram received from the Honorable
Stanley W. Church, Mayor of the City of New Rochelle, requesting a
strong united- front by Westchester communities, to combat New Haven j
commutation increases arbitrarily ordered by the Interstate Commerce
Commission. in connection with this, Town Attorney Delius submitted
a report on the hearings before the Interstate Commerce Commission.
Following discussion, on motion by Supervisor Mandeville, seconded by
Councilman Watson, the following resolution was unanimously adopted:
WHEREAS, the Interstate Commerce Commission, on October 9th,
1950, made a Report and Findings in the New haven Railroad commu-
ters' fare case, requiring the Public Service Commission of the State
of ilew York to increase its commutation fares an additional 9% for
sixty trip books and 7% for forty-six_ trip books, on the ground that
the interim fares fixed by the Public Service Commission were discrimina-
tory with respect to interstate commutation fares on the New Haven
Railroad; and
WHEREAS, the Public Service Commission and several Westchester
communities, including the Town of Mamaroneck, opposed the further
increase of commutation fares by the Interstate Commerce Commission
on the ground (among others) that the action by the Interstate
Cormmerce Commission interfered with the power of the Public Service
Commission to fix New York State commutation rates,
NOW, THEREFORE, BE IT
RESOLVED that this Board hereby requests the Public
Service Commission of the State of New York, zo appeal
to the courts having jurisdiction, so as to maintain its
power and authority over intra-state commutation fares, and

BE IT FURTHER RESOLVED that the Town Attorney is hereby
authorized and instructed to cooperate with other muni-
cipalities and the Public Service Commission in connec-
tion with continuing the fight against increased commu-
tation fares.
Councilmen McKeever and Waterman stated they had nothing to report

or their departments.
Town Attorney Delius reported that he had received certiorari notices
from 4 apartments in the Town, among them being one from David Hummel,
owner of the Colony apartment, which certiorari had previously been
tried and a decision handed down, granting a reduction of '152000.
Mr. Delius was asked to have a full report, with figures, on this
matter, ready for the next meeting.
There being no further business to come before the meeting, it adjourned
at 9, 05 P . M. to meet again on November 15th.
