MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE,
TOWN OF MAMARONECK, NEW YORK, ON MAY 17th, 1950.
Supervisor Mandeville called the meeting to order at 8:15 P.M.
PRESENT: Supervisor Mandeville
Councilmen Embury, Watson and McKeever
A BSENT: Councilman Waterman
Presence was - also noted of Town A ttorrey Delius, Town Accountant
Finson and Town Clerk Gronberg.
The minutes of April 5th and April 19th were approved as presented.
The members of the Board took exception to the proposed fare of 20¢
from any point in the Town of Mamaroneck to any point in the Village
of Mamaroneck, which fare was part of the schedule of rates submitted
by Fordham Transit Co.,Inc. and incorporated in a resolution of this
Board, adopted April 19th, 1950, amending the Consent granted to
the Company.
Mr. Delius was instructed to oppose this rate at the hearing before
the Public ServiceCommission.
A letter dated April 20th, 1950, was received from Mr. William Paonessa,
re- applying to lease Town-owned land on the Boston Post Road, south
of Hommocks Road, for use as a golf driving range.

RESOLVED that the request of William G. Paonessa be and it
hereby is referred to the Board of Appeals for Zoning.
The Town Clerk reported that he had a request from the Board of Educa-
tion for 3 voting machines to be used in student elections.
On motion by Councilman Watson, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the request of the Board of Education for
3 voting machines to be used in student elections, be and
it hereby is granted.
The Town Clerk presented a letter received from Mr. Fred Pittera,
req uesting that Lester Place be made a dead-end street at the New
Rochelle line. The letter was referred to the Police Department and
Superintendent of Highways for a report at the next meeting.
A_ letter dated . April 22nd, 1950, was received from Mr. Arthur M. Brown
Secretary of the Town of Mamaroneck Fire Department, stating that the
Department, after receiving a letter from Mrs. Louise Bissett, telling
of the dire circumstances of Mrs. Ireland, widow of Mathew Ireland,
had approved sending her a check for $150. The letter went on to say
that the members of the Department hoped that, if it were at all possi-
able, the Town Board might be able to help this poor widow in her time
of need, either by some light employment or other means.
The members of the Board discussed the letter and inasmuch as there is
no light employment available at the present time, and there is no
law which would permit them to offer any financial help, the Clerk was
instructed to acknowledge the letter and inform the Fire Department
of the Board' s position.

A letter dated May 15th, 1950, was received from Mr. Arthur M. Brown,
Secretary of the Town of Mamaroneck Fire Department, inviting the Town
Board to participate in the annual Memorial Day Services. The mem-
bers of the Board made note of this date, and the Clerk was instructed
to acknowledge the letter with thanks.
A letter dated May 2nd, 1950, was received from Mr. Loren R. Dodson,
Secretary of the Board of Police Commissioners, together with 3 bids
for the purchase of 3 dozen light blue summer uniform shirts. The
bids were as follows:

The letter recommended that the bid of the Creighton Shirt Co., Inc. ,
be accepted, that being the lowest bid.
The Commission also recommended the purchase of 3 uniforms, one for
Chief Yerick and one for each of two detectives, at a total cost of
$150.
On motion by Councilman Embury, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the Police Department be and it hereby is
authorized to purchase from Creighton Shirt Co®,Inc. ,
3 dozen light blue summer uniform shirts, made of Simpson
Soulette poplin, at a cost of $3. each.
FURTHER RESOLVED that the Police Department be and it
hereby is also authorized to purchase 3 uniforms, one
for the Chief and one for each of the two detectives,
at a total cost of $150.
The Clerk presented a letter dated May 9th, 1950, received from Mr.
Loren B. Dodson, Secretary of the Board of Police Commissioners,
submitting 3 bids for the proposed new traffic light at Forest and
Murray Avenues, 3 bids for the installation of the same, and 3 bids
for installing 2 bullst eyes in each of 3 traffic lights on Chatsworth
Avenue and Myrtle Boulevard.
It was the recommendation of the Police Commission that the bid of
Charles F. McCullough for the proposed new traffic light, and the bid
of Foley Hardware Company for the installation of the same, be accepted.
Following discussion, these bids were referred to Councilman Embury
to confer with the Police Commission and report at the next meeting.
The Commission also recommended the installation of 2 bullst eyes in
each of 3 traffic lights on Chatsworth Avenue and Myrtle Boulevard.
The bids for this are as follows:

On motion by Councilman Embury, seconded by Councilman McKeever, it

RESOLVED that the bid of Foley Hardware Co. in the amount

3 traffic lights on Chatsworth Avenue and Myrtle Boulevard
be and it hereby is accepted.

The Board discussed the continued absence of Miss Wilhelmina Schroeder
and on motion by Councilmar_ McKeever, seconded by Councilman Watson, it
was unanimously

RESOLVED that Wilhelmina Schroeder be and she hereby is
granted a leave of absence with pay, from March 28 to June
7, and that the Clerk be and he hereby is instructed to ob-
tain a doctor' s report regarding her condition and present
it to the Board at its next meeting.
The Clerk presented a description of the boundaries of New District 17
which had resulted from the division of District 4. He stated that
this had the approval of Town Engineer Foote as well as that of the
Chairmen of the 2 major political parties. On motion by Councilman
McKeever, seconded by Councilman Embury, it was unanimously
RESOLVED that the map submitted, creating seventeen
election districts in the Town of Mamaroneck, be and
it hereby is approved, and be it
FURTHER RESOLVED that the boundaries of said seven-
teen election districts as shown on said map be and
they hereby are described as follows:
DISTRICT NO. 1
Bounded on the south by the New York, New Haven and Hartford Railroad
tracks; on the east by the center line of Mamaroneck River; on the
north by the center line of Barry Avenue and Winfield Avenue; and on the
west by the center line of Old White Plains Road, and Mamaroneck Avenue.
DISTRICT NO. 2
Bounded on the south by-the New York, New Haven and Hartford Railroad
tracks; on the east by the center line of Mamaroneck Avenue and Old
White Plains Road; on the north by the Town of Mamaroneck-Village of
Mamaroneck boundary line; and on the west by the Town of Mamaroneck-
Village of Mamaroneck boundary line.

the northerly line of the Boston Post Road; thence northwesterly along

and Hartford Railroad; thence northeasterly along said right-of-way
to Fenimore Road; thence southeasterly along Fenimore Road to the
northerly line of the Boston Post Road; and thence southwesterly along

from the center line of Fenimore Road; on the east by a line 1,300

Bounded on the south by a line drawn parallel with and 100 feet north-

to the northerly line of Pelham-Port Chester Parkway; thence north-

DISTRICT NO . 16
Bounded on the east by the Town of Mamaroneck-Village of Mamaroneck
boundary line from the center line of the New York, New Raven
and Hartford Railroad to the waters of Long Island Sound; on the
west by the waters of Long Island Sound, and the Village of Larch
mont line to the center line of the Boston Post Road; thence east-
erly-along the center line of Boston Post Road to Weaver Street;
thence continuing bounded on the west by the center line of Weaver
Street to the center line of the New York, New Haven and Hartford
Railroad.
DISTRICT N0. 17
BEGINNING at a point in the boundary line between the Town of
Mamaroneck and the Village of Mamaroneck and at the southerly
end of same on the stone boat landing pier on the westerly shore
of Edgewater Point, (said point of beginning being also the
southwesterly corner of existing Election District No. 4) ; thence
northwesterly along said boundary line to the Boston Post Road;
thence northeasterly along the Boston Post Road to Fenimore Road;
thence southerly to a point in the West Basin of Mamaroneck Harbor
and continuing southwesterly through the. West Basin of Mamaroneck
Harbor to the shore line of Ori6nta Point near Bleeker Avenue;
thence following the shore lines of Orients. Point and Edgewater
Point, southeasterly and southwesterly to the point or place of
beginning. Said Election District No. 17 being bounded on the
southwest by Election District No. 16, on the northwest by Election
District No. 4, on the northeast by Election District No. 3, and
on the southeast by Long Island Sound.
The Clerk presented the lease for the Court Room used by Judge
Baxter at 100 Mamaroneck Avenue. On motion by Councilman Watson,
seconded by Councilman Embury, it was unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the lease for the Court Room
used by Judge Charles M. Baxter, known as Room 15
at 100 Mamaroneck Avenue, Mamaroneck, New York,at
an annual rental of $480. for one year commencing
May lst, 1950.
Mr. Robert MacCallum and Mr. Rex Ricardi appeared before the Board
regarding a shack which has been constructed on Garfield Street.
Town Attorney Delius informed the Board that the building permit
for the building in question had been revoked and the owner subpoenaed
to appear before Judge Brewer on the 18th of May.
Mr. MacCallum and Mr. Ricardi again brought to the attention of the
Board, the matter of closing Lafayette Road.
The Supervisor thanked these gentlemen for appearing and assured
them that the Board would consider this matter®
Mr. Peyton Hughes, 39 Briarcliff Road, appeared and submitted a sub-
division map of Colonial Gardens made by A.J. Foote and filed in the
office of the County Clerk, Division of Land Records, as Map No. 7011.
He asked the Board to approve the subdivision plan, in view of the fact
that there are shown upon said map, 6 building plots, only 2 of which
have a frontage upon a proposed street known as Colonial Lane which runs
from the southerly side of Colonial Avenue, a distance of som76 feet
and then in a turning circle® The other 2 lots shown on the plan have
access to this circle or street, by means of a 25 foot right-of-way
which right-of-way is not suitable for acceptance by the Town as a pub-
lic street or highway. Mr. Hughes offered to give a deed of dedica-

ion to the Town for the so-called "Colonial Lanett including the
urning circle, and upon motion made by Councilman McKeever, seconded
by Councilman Embury, it was unanimously
RESOLVED that the subdivision map of Colonial Gardens
made by A.J. Foote and filed as Map No. 7011, is
hereby approved on condition that the owner of the
property give to the Town, a deed of dedication for
the street or highway shown upon said subdivision,
known as Colonial Lane.
The Supervisor requested approval of the installation of 500 feet
of water main in Colonial Lane at no cost to the Town.
On motion by Councilman Embury, seconded by Councilman McKeever,
it was, upon roll call, unanimously
RESOLVED that the Westchester Joint Water Works, No. 1
be and it hereby is authorized to install 500 feet of
water main in Colonial Lane, at no cost to the Town of
Mamaroneck.
Mr. Irving Roosin, Brooklyn, N.Y. , appeared before the Board in
connection with the installation and rehabilitation of water mains
to supply property of the Post Road Building Corp. at the inter-
section of Hommocks Road and Eagles Knolls Road in the Town and
Village of Mamaroneck. He said that there is at the present time,
a main in Hommocks Road which has never been connected at the Bos-
ton Post Road and he requested the Town Board to make this con-
nection which he referred to as the " missing link" .
Supervisor Mandeville informed Mr. Roosin that the Board would
give thisLmtter its consideration.
- -- Mr. Rudy Novak appeared before the Board regarding a storm drain.
Councilman McKeever reported that he had discussed this matter with
Mr. Foote and that the cost of installing 25 feet of 54" pipe,
would be $375. and if 2 lines were installed, the cost of the pipe
would be $750. plus labor costs of between $ 750. and $800.
The Supervisor asked Mr. Novak to leave this matter with the Board
for consideration.
Chief Burton presented a list of claims for Fire Department expen-
ditures and stated that they had been audited by the Comptroller
and that he had checked the bills and recommended their approval
and payment.
The members of the Town Board, sitting as the Board of Fire.Commis-
sioners, considered the claims and on motion by Councilman Watson,
seconded by Councilman Embury, it was unanimously
RESOLVED that the following described claims be
and they hereby are approved and that the Super-
visor and Comptroller be and they hereby are
authorized to pay the same out of the budget for
the Fire Department:

Chief Burton reported that the new, fire truck would arrive on May
26th or 27th.
He also reported that Mr. Anthony Gagliardi had submitted a group
insurance policy by which each volunteer could be insured for $1,000. ,
at the time of his death. To be eligible for this benefit, how-
ever, the man must be actively connected with the Department at the
time of his death.
Supervisor Mandeville suggested that the Chief leave this matter
with the Board for consideration.
Councilman Watson presented the following petition received from
the Assessor for the correction of the assessment roll so as to
` permit the apportionment of taxes.
On motion by Councilman Watson, seconded by Councilman Embury, the .
following resolution was unanimously adopted:
WHEREAS, the Assessor had presented petitions for the correc-
tion of the assessment roll for certain years, pursuant to the provi-
sions of Section 557, Article 16 of the Westchester County Adminis-
trative Code, known as the Westchester County Tax Law; and
WHEREAS, after due consideration, this Board finds it
desirable to grant said petitions for the correction of said
assessment roll,

Councilman Watson presented each member of the Board with a memoran-
dim relative to his study of the sample annual report which had been
prepared by Kennedy Associates for the Village of Rockville Center.
The Board discussed the memorandum and agreed that it would be neces-
sary to obtain an expert to prepare the material for such a report
covering the Town of Mamaroneck.
Councilman Embury said he wished to compliment the Garden Clubs of
Larchmont and Iviamaroneck, and also the Daily Times for their very
excellent cooperation with the Park Department in its efforts to
protect the shrubs and trees around the Larchmont Gardens Lake and the
wild life in the Lake.
Councilman Embury also reported that Mr. John A. Wang, Chairman of
the Park Board, had written to the New Haven Railroad Company con-
cerning an extension of the parking area. The answer was a definite
"riot' apparently because of a wish on the part of the Company, to
liquidate their real estate holdings. However, just recently, Mr.
Wang had received another letter from the Company, saying that they
might consider such a proposition next year and they had in mind
a considerable larger area than that submitted to them by the Park
Department.
At the request of Mayor B.C . Washburn of the Village of Larchmont,
the Supervisor appointed a committee to consist of Councilman
Watson, Chief Yerick and himself to study the traffic situation and
parking problem at the Railroad Station.
The Clerk was instructed to notify Mayor Mashburn of the appointment
of this Committee.
At the request of the Supervisor, the following resolution was moved
by Councilman Embury, seconded by Councilman McKeever, and upon roll
call, unanimously adopted:
WHEREAS, this Board, upon request of the Village of Mamaroneck,
heretofore and on the 30th day of April, 1949, adopted a resolution
cancelling certain taxes against premises known as Block 820, Parcel
85 on the Tax Assessment Map, which premises were foreclosed by the
Village of Mamaroneck in foreclosure proceedings in rem, upon the
ground that these premises are used for municipalpurposes by the
Village of Mamaroneck; and
WHEREAS, through inadvertence, these taxes were not cancelled
of record and the lien for same was sold at the 1949 sale to Bonded
Municipal Corporation who paid therefor the sum of $72.93: and
WHEREAS, Bonded Municipal Corporation is willing to return
and surrender said lien upon being paid the amount of its purchase
price, to wit, $72.93.
NOW, THEREFORE, BE IT
RESOLVED that the Receiver of Taxes be and he hereby is
authorized to refund to Bonded Municipal Corp. for the
re-purchase of the 1949 lien on premises known as Block
820, Parcel 85, the sum of $72.93.
FURTHER RESOLVED that upon the return of said lien, the
lien and the taxes which it represents, be cancelled of
record.
The Supervisor presented to the Board, a traffic count taken on
the Boston Post Road by the State of New York on August 20th,
1949 and one taken by the County of Westchester on April 27th,
1950.

On motion by Councilman Embury, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the Town Offices be closed on Saturdays,
May 27th to September 2nd, 1950, both inclusive.
Supervisor Mandeville requested a resolution appointing the following
to the Board of Review; Mr. Percy M. Biba.s, Mr. S . Mills Harris, and
Mr. Silvio Rairaldi.
On motion by Councilman Watson, seconded by Councilman Embury, it
was unanimously
RESOLVED that in pursuance of Section 529 of Chapter
852 of the Laws of 1948 (Westchester County Adminis-
trative Code) a Board of Review is hereby appointed
to consist of Percy M. Bibas, S. Mills Harris, and
Silvio Rainaldi, all being resident tax payers of the
Town, and shall serve at the pleasure of the Town
Board.
FURTHER RESOLVED that the compensation of the fore-
mentioned members is hereby fixed at the sum of $25.
a day but not to exceed $250. each.
Councilman McKeever reported that the sewer in Althea Lane is now
under construction and also a drain at the end of Bonnie Way. He
also reported that there had been a number of calls received, re-
questing rubbish removed, all of which had been taken care of.
With regard to a letter, dated April 13th, 1950, received from the
Department of Health of the County of Westchester and referred
to him, Councilman McKeever reported that where septic tanks are
used, no occupancy permit is given until a certificate from the
Health Department is presented.
The Town Attorney submitted a list of tax arrears against certain
blocks and parcels of property formerly owned by Larchmont Fenimore
Corp. and which were foreclosed by the Town of Mamaroneck in a Pur-
chase Money Mortgage foreclosure, the property having been previously
sold to Larchmont Fenimore Corp. by the Town.
Upon motion made by Councilman Embury, seconded by Councilman
McKeever, it was, upon roll call, unanimously
RESOLVED that the following arrears of taxes,

The Town Attorney presented a letter received from Seacord, Ritchie
and Young, Esqs., attorneys in New Rochelle, requesting that the
Town Board cancel a tax lien sold to the Town on March 18, 1872,
in the amount of $2.58 on property known as Block 823, Lot 619, and
still on file in the office of the County Commissioner of Finance.
On motion by Councilman McKeever, seconded by Councilman Embury, the
following resolution was upon roll call unanimously adopted:
WHEREAS, it appears that the records of the Commissioner of
Finance of the County of Westchester indicate a tax lien or lease
owned by the Town of Mamaroneck, dated March 18th, 1872, which
affects property known as No. 156 Center Street, Mamaroneck, Block
823, Parcel 619 on the Tax Assessment Map of the Town of Mamaroneck;
and
WHEREAS, no record of such tax lease or lien appears in the
tax or tax arrears records of the Town of Mamaroneck; and
WHEREAS, the owners of the said property have requested
this Board to indicate its approval of the correction of the
records in the office of the County Commissioner of Finance and/or
the cancellation of the said tax lien or lease which appears to be
owned by the Town of Mamaroneck,
NOW, THEREFORE, BE IT
RESOLVED that this Board authorizes and approves the
cancellation of the tax lien or lease now appearing on
the records of the County Commissioner of Finance as follows:

The following resolution moved by Councilman McKeever and seconded
by Councilman Watson, was unanimously adopted:
WHEREAS, the Westchester Lighting Company has instituted a
proceeding to increase its rates for gas; and
WHEREAS, the Public Service Commission has granted and
fixed interim rates which materially increase the rates pre-
viously charged for gas, which interim rates expire on June
30th, 1950; and
WHEREAS, the proceeding is still pending before the
Public Service.Commission; and

WHEREAS, the payment for gas on the basis of the interim
rates is burdensome to the consumers,
NOW THEREFORE, BE IT
- RESOLVED that the Town Board of the Town of Mamaroneck
hereby records itself an opposition to the extension
of the interim rates and urges the Public Service Com-
mission not to extend the same after June 30th, 1950
and not to fix any interim or other rates until a
final determination by the Commission, and be it
FURTHER RESOLVED that a copy of this resolution be
transmitted to the Public Service Commission, and
be it
FURTHER RESOLVED that this resolution shall take
effect immediately.
The Town Attorney reported, with reference to the New Haven rate
-- case, that an examiner from the I .C .C . recommended a further in-
crease and that exceptions must be filed by May 25th. Mr. Delius
said he would prepare such exceptions. He also reported that there
would be a hearing in Washington on this matter and on motion by
Councilman McKeever, seconded by Councilman Watson, it was unani-
mously
RESOLVED that Town Attorney Delius be and he hereby
is authorized to attend the hearing in Washington
on the New Haven rate case.
FURTHER RESOLVED that the expenses for such trip be
paid out of the item in the budget for same.
Mr. Delius requested a resolution confirming revocation of a building per
mit and on motion made by Councilman McKeever, seconded by Councilman
Embury, the following resolution was unanimously adopted:
WHEREAS, heretofore and on November 10th, 1949, a permit
was issued to Angelo Malagiero by the Building Inspector (Permit
No. 2682) for the construction of a garage on certain premises
owned by him on the northwest corner of Madison and Garfield
- Streets in the Town of Mamaroneck; and
WHEREAS, the construction of said garage is in violation
of the Building Code and Zoning Ordinance of the Town of Mamaro-
neck and the permit was, for such reason, revoked by the Build-
ing Inspector on April 28th, 1950, of which revocation the said
Angelo Malagiero had due notice,
NOW, THEREFORE, BE IT
RESOLVED that the revocation of the said Permit
No. 2682 is hereby ratified, affirmed and approved
by this Board and the permit thus granted by the
said Building Inspector is hereby revoked pursuant
to power given this Board by the Building Code,
for the reason that the same is in violation of the
Building Code and Zoning Ordinance of the Town of
Mamaroneck.
Mr. Delius reported that Mr. Henry R. Dillon, Receiver of Taxes,
had questioned a resolution passed at a Town Board meeting held
April 20th, 1949, whereby certain taxes were cancelled upon condi-
tion that the property be devoted to public purposes by the
Village of Mamaroneck, thereby making the Tax Office responsible
for checking to see whether or not these properties were devoted
to public use.

After discussion the Town Attorney was instructed to ask 'the--Vil-
lage for a certification of properties being used for public pur-
poses.
The Town Attorney reported that the Building Code amendments would
be ready for presentation at the next meeting.
A copy of the annual Town audit, prepared by Glick-Freedman, was
presented to each member of the Board®
