M. PRESENT2 Supervisor Mandeville Councilmen Embury, Matson and Waterman ABSENT: Councilman McKeever Presence was also noted. of Town Clerk Gronoerg, Town Attorney Delius and Town Accountant Finson. The minutes of December 7th, 1949 were approved as corrected. The Clerk presented a petition received from Mr. Frank Turco, re- cuesting that property known as Block 126, Parcel 442 on the Tax Assessment Map of the Town of Mamaroneck, be re-zoned for dsi- ness use. Following discussion, on :notion by Councilman Embury, seconded by Councilman Watson, it was unanimously RESOLVED that the Town Attorney is hereby authorized to prepare the necessary notice, calling a public hearing on March 15th, 1950, to consider a. change in zoning in connection with property known as Block 126, Parcel 442 on the Tax Assessment Map of the Town of Mamaroneck, for business use. The Clerk presented a letter From Mr. A. J. Foote, Building In- spector, requesting permission to attend the first annual School of the Eastern States Building Officials, to be held in the Hotel Statleer, New York City, on February 10th and 11th, 1950 . On motion by Councilman Embury, seconded by Councilman Taterman, it was unanimously RESOLVED that Arthur JP Foote, Building inspector, be and he hereby is authorized to attend the first annual School of the Eastern States Building Officials, to be held at the Hotel Statler, New York City, on February 13th and 11th. FURTHER RESOLVED that the expense shall be paid by the Town. The Town Clerk presented letters of resignation as members of the Zonfng Board of Appeals, from Messrs . J . C. Waterman and George D. Lurchell. On motion by Supervisor Mandeville, seconded. by Councilman hatson, it was unanimous, RESOLVED that the resignation of J. C . Waterman and that of George D. E;;_rchell be and they hereby are accepted_ with regret. The Town Clerk was instructed to express the thanks of the Town � Board to Messrs . Vaterman and Burchell . Butterfield be and he hereby is appointed a member of the Board of Appeals for Zoning to serve the unexpired term of George D. Burchell, which term expires February 15th, 1951. The following bids were received: Allowance for 1940 Brockway & 1945 Price Ford Net Bid Luby Chevrolet Co . , Inc, X3, 500.00 8 900. 12,600.00 Flinn Motor Co . 3,376.83 730. 2, 676.83 Bose & Parker Motor Corp . 3, 692095 700. 2,992 .95 Brockway Motor Co . , Inc . 3, 297.00 5250 2,772.00 Following discussion and on motion by Councilman Watson, seconded by Councilman Embury, the following resolution was unanimously adopted: WHEREAS, the Torn Superintendent of Highways did, on the 18th of January, 1950, duly recommend the purchase of certain equipment pursuant to the provisions of Section 142 of the Highway Law, notice of such recommendation having been duly published as provided in such section, NOW, THEREFORE, B E IT RESOLVED that pursuant to Section 142 of the Highway Law, the Tower Superintendent of Highways is hereby authorized to purchase from Luby Chevrolet Co. , Inc . , with the approval of the County Superintendent of Highways, one 1950 Chevrolet, 2 1/2 tan dump truck, for a total price of ~3, 500. FURTHER RESOLVED that the Toun Superintendent of Highways is hereby authorized, subject to the approval of the County Superintendent of Highways, to surrender to the above named vendor-, one 1940 Brockway truck for the, sum of $400. as part pay- ment for the above. FURTHER RESOLVED that this Board authorizes the Town Superintendent of Highways to surrender to the above named vendor, one 1945 Ford pick-up truck for the sum of $500. as part payment for the above. Councilman Natson reported that he had a fey apportionments which he would prefer to hold over until the next meeting in order that he might study them further. Councilman Embury reported that he had discussed the bid received in connection with work to be done on the island in Larc mont Gardens Lake, with the Park Department and Mr. Foote, and it was agreed that the bid received from Barber and Coccola was acceptable. Supervisor Mandeville presented a resolution received from the Village of Mamaroneck for the sale of property accuired by the Village of Mamaroneck through its foreclosure proceeding in rem, and recommended its approval. On motion by Councilman Watson, seconded by Councilman Waterman, the following resolution was unanimously adopted. ?WHEREAS, the Village of Mamaroneck, through- the institution of an action in the County Court of Idestchester County, entitled "In the Matter of the Foreclosure of Tax Liens pursuant to Article VII-A, Title 3 of the Tax Law by the Village of Mamaroneck, List of as Delinquent Taxes for 19 5" h `e q µ, come and now is the owner of a number of parcels of real estate situate in the Village of Mamaroneck and Toren of Mamaroneck; and WHEREAS;r1EREAti, 'ISO tri_ the Village of '"'?a.':1arOneck and the Town Of Mamaroneck hold tax liens on said parcels of real property; and VHEREAS, pursuant to Section 165H of the Tax Law, an. agree- ment was entered into between the Village of Mamaroneck and the - Town of Mamaroneck which, among other things, set forth the :.rater- I ests of said municipalities in the properties being foreclosed, the manner of the sale of said properties, and the manner of the distribution of the proceeds received from said sales; and WHEREAS, the Village of Mamaroneck has, pursuant to an agreement had with the Town of Mamaroneck, advertised for and has heretofore received bids on certain properties owned by the Town of Mamaroneck as well as on certain properties owned by the Village of Mamaroneck in the Town of Mamaroneck; and WHEREAS, the Board. of Trustees of the Village of Mamaroneck has given consideration thereto and after due deliberation, accepted the 'aids hereinafter listed as to price and terms therein set forth; and NHEREAS, since receipt of said bids, this Board has given consideration thereto, and after due deliberation, it is RESOLVED that the bids hereinafter listed, be accepted at the price and terms therein set forth: LIST OF BIDS ACCEPTED IN SECTION 8 Total Assessed -- Block Parcel Block Lot Bidder Amount Valuation Terms Part of 817 683 511 55 Sarah and 0,90000 $300.00 cash Joseph Jackson 4 I Supervisor Mandeville read a letter received from the Department of Udater Supply of the City of New York, which contained restric- tions to be applicable when buying water from the City of New York. Following discussion and on motion by Councilman Watson, seconded by Counncilman Embury, it was unanimously RESOLVED that this Hoard approves the regulations and restrictions contained in letter- from the Department of -- Water Supply of the City of New York to County Executive Gerlach, referring to orders issued December Sth, 22nd, and January 5th, which apply when water is being pur- chased by the 17estchester Joint 4later ITorks No. 1, from the City of Ner York. The members of the Board discussed the possible adoption of an ordin- ance which would restrict the use of water under certain conditions . The Town Attorney was instructed to -erepare such an ordinance for study by the Town. Board, making the Na.ter Board. or Chairman of the same, the a.uthoritjr for enforcing this ordinance. The Supervisor recuested a resolution authorizing the issuance of a budget note on behalf of Sewer District No. 1 in an amount not e:,ceeding µr4,000 . for the repair and reconstruction Of a. sewer pumping station at the corner of Murray and Colonial Avenues, the eXpenditure for which no provision is made in the annual estimate for Sewer District No. 1. II i 0n motion by Councilman Vatson, seconded by Councilman Vaterman, it was unanimously RESOLVED that the annual Re_,,ort of the Slapervi sor for the year 1949 be published in the Daily Times , The Supervisoi reported that the To;.n, of Ma_r aroneck has a rating of 95% in the Vestchester County Ecu_alization Table for 1949 . However, the two Villages will gain because their present allocation is -- $19, 632. and under the new proposal they will receive $4.5, 510. Supervisor Mandeville distributed to the members of the Board, a booklet iorea_ ared by Kenned5T Associates which is the Fourths Annual Report of the Village of Rockville Center. I After discussion and upon motion by Councilman Uaterman, seconded. by Councilman Watson, it was unanimously RESOLVED that, subject to approval by the Fire Council, this Board, acting as Fire Commissioners of Fire Dis- trict No. 1, hereby authorizes the sale of Engine No. 1, 500 gallon pumper, #10E3453, 1911 an,-,. Truck No. 2, City Service Ladder Truck, 2E34'OO, 1924, to the Stoney Hill Volunteer Fire Ccm^any; Inc . for yn;l, 330. said. Trice being a lump sum for both pieces of eTuipment, said sale, however, to be on the following conditions, {1) That the purchaser take delivery of both pieces i of eeuipment at the Weaver Street Fire House and pay the full consideration at the t17e of delivery; X2) That the purchaser obtain such insurance and I sign such other and further documents as the Town Attorney may consider necessary for the protection of the Town and its Fire Department. Town Attorney Delius reported that Mr. A. J. Foote had suggested an amendment to the Fire Prevention Ordinance which would make it mandatory for contractors to obtain a permit for each :,lasting Job, thus e_rabling the Building Department to maintain a closer and more complete check on each blasting operation within the Town. Under the present crovisions a contractor need obtain only one permit during the year. Following discussion and on motion by Councilman Embur-y, seconded by Councilman Watson, it was unanimously RESOLVED that the following notice of public hearing with relation to an amendment to the Fire Prevention Ordinance be published in the Daily Tunes: I I PLEASE TAKE .NOTICE that a Pudic Hearing will be held by the Town Board of the Town of Mamaroneck at a regular meeting to be held on the 15th day of February, 1950, in the Council Room of the Veaver Street Fire House at 5: 15 P . M. , to consider an amendment to Article II, of the Fire Prevention Code with regard to permits for blasting in. the Town of I11arna'roneck which will provide in substance as follows: (1) That no =,-erson or corporation shall blast or carry on any blasting operation in the Town of Mamaroneck outside of the incorporated villages without first having obtained a permit from the Building Inspector, which permit shall not be granted by him unless such person or corporation has qualified as a licensed blaster and is the holder of a certi- ficate from the State of New York for the handlinE and transportation of dyramite and detonators . (2) That all -persons and all corporations be required, � be'f'ore obtaining a -:Permit to blast, to file with the Build- ing Inspector a bond executed by a surety company authorized to do business in the State of New York, to be approved by the Town Attorney in such amount as shall be deemed adequate by the Building Inspector, but in no event to be less than 610,000.00, such bonds to be for a period of one year from the date they are issued and filed. The Town Attorney reported that there had been much opposition to the Turco application when it came before the Zoning Board of ''appeals and he felt that the Town. Clerk should notify all those people who opposed the application, whose names are known. The Tel-m Attorney read a letter from ire Edward J. Eagan, re- cuestion the Town Board to take some action in connection with taxes which become due in April for State, Cownty and Town pur- poses and in September for School purposes against property on Weaver Street, recently purchased by the Parish of St. John I I 57 and St . Paul.
