Supervisor Mandeville called the meeting to order at 5: 15 P . M.
PRESENT: Supervisor Mandeville
_ Councilmen Embury, Vatson, Vaterma.n and McKeever
ABSENT: None
Presence was also noted of Town Clerk Gronberg and Town Attorney
Delius .
Mr. Morgan H . Seacord, an attorney, presented a petition of Miss
Joanna Conlon, 9 Edgewood Park, New Rochelle, N. Y. , requesting
a change of zoning of property known on the max Assessment Map as
Block 130, Parcel 511.
Following discussion, on motion by Councilman Embury seconded by
Councilman Tatson, it was unanimously
RESOLVED that the Town Attorney prepare the neces-
sary notice for a public hearing to be held on March
15th, 1950 in connection with the re-zoning of pro-
perty located on the west side of Fifth Avenue from
Williams Place to the New Rochelle City line to a
depth of 100 feet.
The Town Clerk presented an affidavit of publication of notice to
bidders for the construction of shore protection of the island in
Larchmont Gardens Lake. He reported that he had received one bid
which had been submitted by the Barber and Coccola Corporation in the
amount of 43,600.
Following discussion and on motion by Councilman McKeever, seconded
by Councilman Watson, it was unani.-,ously
RESOLVED that the bid of Barber & Coccola Corp.
for the construction of shore protection of the
island in Larchmont Gardens Lake in the amount of
43,600. be referred to Town Enbineer A. J . Foote,
for recommendation, and to the Park Department with
power to act.
Mr. Peter Pergola appeared before the Board and explained that he
had purchased Block 604, Parcel 361 at the Town auction, held
January 16th, 1950, under the impression that this lot or parcel
adjointed property presently o;-Ted by him. He, therefore, when he
learned that this was not the case, recuested that his deposit be
refunded.
Supervisor Mandeville recommended that Mr. Pergolaas check be
returned to him.
On ,notion by Councilman McKeever, seconded by Councilman TTatson,
it was unanimously
RESOLVED that a check in the amount of 467 . which
was his deposit on -,property purchased at the Town
auction sale held January 16th, 1950, known. as Elock
604, Parcel 361, be returned to Mr . Pergola.
The Supervisor suggested that they _-roceed with the _ratters of
organization.

Councilman Vatson moved the adoption of a resolution to approve the
salaries of all Towr_ officials and employees and to appoint officers
and employees for the year 1950.
This _notion, being seconded by Councilman Embury, was duly adopted
as follows:
RESOLVED:
Section 1 . That the salaries of ail elected officials
of the Town of Mamaroneck for the year 1950 are to be
the salaries stated and appropriated in the annual
Budget or Estimate for the year 1950.
Section. 2 . That the following cersons are hereby ap-
pointed as Town Officers as of January 1, 1950, in
accordance with the provisions of the Town Law, and
for the respective terms and at an _annual salary or
rate of conpensa.tion hereinafter stated, such annual
salary or compensation to be paid_ from the amounts
appropriated in the annual Estir:iate or Budget for the
year 3950 or so much thereof as shall be sufficient
to pay the salary or con°ensa.tion as hereby fixed:

Section 5 . That the employment of the last named
persons to the aforesaid 0ositions, is in accordance

of the State and any vacancies which now exist or which
may, from time to time, occur in said positions, are
to be filed at salaries set in accordance with the
provisions of the salary scale adopted by the Town

Section 6. That a bond be required for the faithful
performance of the duties of each of the following

Section 8. That a bond be required for the faithful

Section 9. That the salaries of all officers, elected
and appointed, and all employees, be paid semi-monthly
on the first and fifteenth days of each month.
Section 10. That there is hereby appropriated from
the item in the annual Estimate or Budget for the
Year 1950 for the Department of Highways, Item III,
the sum of $3, 000. and from the Sewer Department,
Maintenance Man, the sum of $600. as the annual salary
and compensation of Joseph Donohue, Automotive Mechanic,
for services in the Departments of Highway and Sewer.
FURTHER RESOLVED that this resolution becomes effect-
ive as of January 1, 1950 .
It was, on motion by Councilman Uatson, seconded by Council-
man Embury, unanimously
RESOLVED that the following bonds for elected officials
are hereby required pursuant to the Tovn Law and approved
as follows:
Bend, Owen A. Mandeville, as Supervisor of the Town of
Manaroneck, conditioned for the faithful performance
of his duties including the payment of all school moneys,
pursuant to Section 25 of the Town Law, upon which the
National Surety Corp. is surety in the penal sum of
$25,000, for a term of two years .
Bona, Charles J. Gronberg, as Clerk of the Town of
Mamaroneck, conditioned for the faithful performance
of his duties including the depositing of all funds
or moneys of the Town received by him, pursuant to
Section 25 of the Town Law, upon which the National
Surety Corp . is surety in the penal sum of $1,000 . for
a term of two .years .
Bond, Munn Brewer, Justice of the Peace of the Town
of Mamaroneck, conditioned for the faithful performance
of his duties, including the depositing of all funds
or moneys of the Town, received by him, pursuant to

it was unanimously
RESOLVED that in accordance with a request received.
from Henry R. Dillon, Receiver of Taxes, this Board
hereby approves of his appointment of Leo N. Orsino,
Senior Account Clerk, as Deputy Receiver of Taxes,
and his designation of Alexander Finson, Accountant,
as a person authorized to receive tax money, give pro-
per receipt therefor in his name, enter such payments
upon the records and deposit tax money in the bank.
On motion by Councilman Matson, seconded by Councilman Embury,

RESOLVED that the appointment by the Town Clerk of
Vilhelmina Schroeder and Margaret Barnes as Deputy
Town Clerks, in accordance with his certificate dated
December 31, 1949, and this day presented to the Board,
is hereby approved. ,
On motion by Councilman Watson, seconded by Councilman Embury,
it was unanimously
RESOLVED that Charles J. Gronberg be and he hereby
is appointed Registrar of Vital Statistics of the
Town of Mamaroneck for the term beginning January 1,
1950 and ending December 31, 1951
FURTHER RESOLVED that the Supervisor be and he hereby
is authorized to sign the Certificate of Appointment
of the Registrar of Vital Statistics to be filed with
the New York State Department of Health.
The Supervisor asked the members of the Board their wishes insofar
as the dates of the Town meeting are concerned.
On motion by Councilman Watson, seconded by Councilman Embury,
it was, u animously
RESOLVED that the regular meetings of this Board be
held on the first and third Wednesdays of each month
at 5:15 F. M. in the Council Room of the Weaver Street
Fire House.

The Supervisor recommended the appointment of the following
committees for the year 1950:

The Board unanimously approved the foregoing appointments.
On motion by Councilman Watson, seconded by Councilman Embury,
it was unanimously

RESOLVED that the "Daily Times" of Mamaroneck be
and it hereby is designated the official newspaper
of the Town of Mamaroneck for the ,purpose of pub-
lishing notices .
The Supervisor stated that it would be in order to appoint the
auditors to examine the Town' s records for the year 1950.
On motion by Councilman Watson, seconded by Councilman Embury, it
was unanimously
RESOLVED that the firm of Glick-Freedman, Certified
- - Public Accountants of New Rochelle, New York, be ap-
pointed to audit the records of the Town for the year
1950.
FURTHER RESOLVED that the compensation for this
service be in the amount of $1, 500. which is the
amount in the 1950 Budget.
On motion by Councilman Watson, seconded by Councilman Embury,
it was unanimously
RESOLVED that the following be and they hereby are
appointed constables to serve for "the term beginning
January 1, 1950 and ending December 31, 1950, without
salary:

FURTHER RESOLVED that the appointed Constables, Rocco

the sum of $ 2, 500. for the faithful performance of their
duties, said bond to be for one year and to be approved
by the Town. Attorney, and the premium for the same to be
paid out of Town funds.
On motion by Councilman Watson, seconded by Councilman Embury,
it was unanimously
RESOLVED that in accordance with the provisions of
Chapter 465 of the Laws of 1935 which amends subdivision

1 of Section 102 of the Town Law, the Town Board of
the Town of Mamaroneck hereby determir_es to allow and
pay the following Town Officer in an amount not to ex-
ceed six cents per mile for the use of his own auto-
mobile for each mile actually a_r_d necessarily traveled
by him in the performance of his duties as the Assessor
for the Town of Mamaroneck:

missioners of Park District No. 1 of the Town of

The Supervisor reported that he had at hand the renewal of the con-
tract between the Town of Mamaroneck and the Vestchester County Dog
Protective Association for the year 1950 in the sun of $1, 500.

On motion by Councilman VJatson, seconded by Councilman Embury,
it was unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the contract between the Town of
Mamaroneck and the Westchester County Dog Protective
Association, Inc . , for the ear 1950, in the amount
of p1, 500. as provided in the 1950 Budget.
The Supervisor reported that he had at hand the renewal of the con-
tract between the Town of Mamaroneck, the Village of Larchmont, and
the Larchmont Public Library in the sum of $10,907.60, as provided
in the 1950 Budget.
On motion by Councilman Watson, seconded by Councilman Embury,
it was unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the contract between the Town
of Mamaroneck, the Village age of LardMont, and the
Larchmont Public Library, in the sum of $10,907 .60
for the year 1950. Which amount is provided in the
1950 Budget.
The '.own Clerk presented a lease for two years, covering the
rental of the premises at 158 West Boston Post Road, used for the �
Town Offices .
It was, on motion by Councilman ?latson, seconded by Councilman
Embury, unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the lease for the rental of the
-- premises used as the To:m Offices at 158 West Boston
Post Road, Village of Mamaroneck, the lease being for
the sum of $5, 280. for the years 1950 and 1951.
On -motion by Councilman 'Jatson, seconded by Councilman Embury,
the following was unanimously adopted:
RESOLVED that the salary scale of Civil Service
employees of the Town of Mamaroneck, adopted
December 29, 1948, is hereby amended as follows,

FURTHER RESOLVED that this resolution shall take

On motion by Councilman idatson, seconded by Councilman Embury,
it was unanimously

RESOLVED that Keeler Associates be and they hereby
are appointed to act as Insurance Agent for the Town
of Mamaroneck for the year commencing January 1, 1950 .

FURTHER RESOLVED that the compensation insurance
policy be placed with the State Insurance Fund.
The Supervisor suggested that the regular order of business be
continued.
The Clerk read a letter dated January 17th, 1950, received from
Mr . Darold 0 . Thompsen, Secretary to the Fire Council, recommending
the appointment of Fireman Louis J. Testa to the rare of Fire
Lieutenant at the prevailing salary of Lieutenant.
- -- Supervisor Mandeville informed the members of the Board that at the
recent examination for the position of Fire Lieutenant, two persons
had passed and Fireman Testa was "high man" .
Following discussion, on _motion. by Councilman Matson, seconded by
Councilman McKeever, it was unanimously
RESOLVED that Louis J . Testa be and he hereby is
appointed Lieutenant in the Town of Mamaroneck Fire
Department, effective February 1st, 1950, at an annual
salary of 03,400.®
The Clerk read a letter dated January 17th, 1950, received from
Chief Paul A. Yerick advising. the .Board that Patrolman Raymond
Borho had resigned from the Police Department, which resignation
was effective as of January 15th, 1950.
After discussion, on motion by Councilman Embury, seconded. by
Councilman TrTatson, it was unanimously

RESOLVED that the resignation of Patrolmen Raymond
Borho be and it hereby is accepted with regret.
The Clerk read a letter dated December 27th, 1949, addressed to
Supervisor Owen A. Mandeville from the County Trust Company, ad-
vising that Moody @s Investment Service of December 24th, shows
that the rating of the Town of Mamaroneck has been raised. from
BAA to A.

The Clerk read a 'letter dated December 23rd, 1949, received from
Larry Santora, requesting a three-months' leave of absence, to
commence December 23rd, 1949 .
On motion by Supervisor Mandeville, seconded by Councilman
McKeever, it was unanimously
RESOLVED that Larry Santora be and he hereby is
granted a, three-months' leave of absence, effective
as of December 23rd, 1949, without pay.
The Clerk read a letter from the Association of Towns of the State
of New York, concerning the 1950 _membership of the Town of Mamaro-
neck in the Association.
Supervisor ?Mandeville recommended approval of the Town' s con-
tinued membership in the Association of Towns .
On motion by Supervisor Mandeville, seconded by Councilman Embury,
it was unanimously
RESOLVED that the Tote of Mamaroneck continue its member-
ship in the Association of Towns of the State of New York,
for the year 1950, and that the annual dues of $107. be
paid out of the item set aside for this purpose in the
1950 Budget.
The Clerk read a letter dated December 31st, 1949, received from

Meeting sill be held in New Yore. on February 6th, 7th and 8th,

On motion by Supervisor Mandeville, seconded by Councilman Embury,
it was unanimously
RESOLVED that Town Attorney Delius and Town Accountant
Finson be and they hereby are designated and authorized
to represent the Town of Mamaroneck at the Annual Meet-
ing of the Association of Towns of the State of New York,
to be held in New York City on February 6th, 7th and
8th, 1950.

FURTHER RESOLVED that the Comptroller is hereby
authorized to audit their claims for the expenses of
the trip, said amounts to be paid out of the items in
the Budget for travelling expenses respectively.
The Clerk_ reported that a request for the installation of a light
or lights on Byron Lane, previously referred to Town Engineer
A. J. Foote, had been surveyed by the Westchester Lighting Company.
He further stated that Mr. Foote recommended the installation of
3 lights on Byron Lane as outlined by the Westchester Lighting
Company engineers.
On motion made by Supervisor Mandeville, seconded by Councilman
Embury, it was unanimously
RESOLVED that A. J. Foote, Toirn Engineer, be and he
hereby is authorized to have installed. on Byron Lane,

The Su.'Nervisor stated. that Benny Orsino was esirous of purchas-
ing a piece of property known on the Tax Assessment Map of the
Totan as a portion of Parcel 1, Block 105 and a portion of Parcel
1, dock 1-04, which property is owned by the Town of Mamaroneck
as a result of foreclosure proceedings . Mr. Orsino wished to add-
this p1ropertyto premises which he owns and upon which he is con-
structing a house. Following is a description of the strip of

The Supervisor stated that, in accordance with the wishes of the
members of the Fire Department, it had been decided that a member
of the Town Board would no longer represent the Fire Department.
It is their wish that a .member of their Council or their Chief
shall represent them.

The Supervisor recuested a resolution authorizing an advertisement
for bids for the purchase of a 2 1/2 ton truck. He went on to state
that it is planned to turn in one of the old Brockway trucks and
the small pickup on this purchase . He further stated that it
was also desired to receive bids for the purchase of a new Incinera-
tor truck at the same time .
On motion by Councilman McKeever, seconded by Councilman Watson, it

NOTICE is hereby given in compliance with
Section 142 of the Highway Law that A. J. Foote,
Superintendent of Highways of the Town of

recommended the purchase of a 2 1/2 ton damp
truck, at a cost to exceed Five Hundred
Dollars .
The Town Board of the Town of Mamaroneck will
meet at the Council noon, of the Weaver Street

The Supervisor announced that for the past several years the Townes
Accountants, Glick-Freedman, have recommended the purchase of a tax
receipting machine for the Tar Office. The Supervisor read a letter
received from Glick-Freedman with respect to such a tax receipting
machine . He also presented a letter of recommendation received
from Mr. Henry R. Dillon, Receiver of Taxes and Assessments .
The Supervisor presented a bid received from the National Cash
Register Company for a national tax receipting machine in the amount
of $3, 195 .
Following discussion and on motion by Councilman Embury, seconded
by Councilman Watson, it was, upon roll call, unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to purchase from the National Cash Register
Company, one Model A. 2207 (6) AD Tax Receipting
Machine, for the sum of $31195 .
Supervisor Mandeville reported that, in order to make up a deficit
incurred by the purchase of water from New York City, it would be
necessary to revise the schedule of water rates .
Following discussion, on motion made by Councilman Embury, seconded
by Councilman Waterman, it was unanimously
RESOLVED that the following rate schedule for metered
service to the consumers in the water district served
by Westchester joint Water ?orks, No. 1, be and hereby
is adopted, effective as of March 1, 1950, or as soon
__. thereafter as it is possible to read the individual con-
sumer' s meters, and that all water consumed after the
said meter reading be charged at the following rates:
5/8 in. meters 4p4.03 per quarters, for which 12000
cubic feet of water will be furnished.
For meters larger than 5/8 in. fixed service charges
