MINUTES OF A REGULAR MEETING AND PUBLIC HEARING HELD BY AND BEFORE
THE TOWN BOARD OF THE TOWN OF MAMARONECK IN ACCORDANCE WITH THE
PROVISIONS. OF THE TOWN LAW, ON DECEMBER 7th, 19¢9, IN THE AUDITORIU11
OF THE WEAVER STREET FIRE HOUSE.
The meeting was called to order at 8:15 P.M. (Eastern Standard Time}
PRESENT : Supervisor Mandeville
Councilmen: Embury, Watson, Mills and McKeever
Presence was also noted of Town Clerr, Gronberg, Town Attorney Delius
and Town Accountant Finson.
The Supervisor stated that the regular order of business would be
dispensed with in order that the Budget might be reviewed.
The Town Clerk presented the affidavit of publication and the affi-
davit of posting of notice of public hearing on the preliminary
budget of the Town for the year 1950•
The Supervisor reviewed the Budget, page by page. He stated that
the propD�z dsalaries of the Chief of Police, two patrolmen and
several of the paid firemen would be slightly higher than the salary
scale in the Budget in order to correct inequities .
At the conclusion of the review, Mr. Herbert Baum moved the approval
complimented the com lim Supervisor. He went on to say

that for many years the Gardens Association has had occasion to
recommend some small changes in the Budgets, in order that they
might be made clearer but this is the first year that the Associa-
tion has been unable to recommend any improvement in the Budget .
The Supervisor expressed his gratitude.
Mr. Rex Riccardi seconded the motion and endorsed the sentiments
expressed.
The Supervisor called for a vote and those present answered in the
affirmative, there being no negative votes registered.
The Supervisor thanked those present for attending the hearing.
The following resolution was moved by Councilman Embury:
WHEREAS, this Board has heretofore made, compiled and
filed with the Town Clerk, a preliminary tax budget containing the
estimated probable revenues and estimated expenditures for the
several departments, offices and other town and special district
purposes for the year 1950; and
WHEREAS, notice of the completion and filing of said
tax budget and calling a public hearing thereon has been duly pub-
lished on November 26th and December 3rd, 1949, in the Daily Times® i
Mamaroneck, and posted in the manner required by law : and
WHEREAS, a public hearing upon said tax budget was duly
held this day in accordance with the notice so published, and
WHEREAS, all persons present were afforded an opportunity
to be hea# and
WHEREAS, this Board has reviewed the items in said pre-
liminary tax budget as required by Section 113 of the Town Law,
NOW, THEREFORE, BE IT
RESOLVED that the final estimates, as completed
by the Town Board and filed in the office of the
Town Clerk, be and the same hereby are adopted as

the budget for the year 1950, pursuant to the pro-
visions of the Town Law, and that said estimates, as
so adopted, be entered in detail in the minutes of
the Board as follows :

and it is further
RESOLVED that the annual budget estimates of the
expenditures of the Town of Mamaroneck for the fiscal
year 1950 be adopted and confirmed and that the Town
Clerk be and he hereby is directed to enter the same
upon the minutes, and that the sums of money hereinafter
stated are hereby appropriated from the current revenues ,
as provided by law, for the offices, departments, boards,
commissions and purposes hereinafter enumerated for
expenditure in the manner directed by law, to wit ;

RESOLVED that as the Estimated Revenues and Cash on
Hand equal the Estimated Expenditures for the General
Town purposes, there be no General Town Tax levied for
the year 1950; and it is
FURTHER RESOLVED that for the fiscal year 1950, the sum
hereinafter set forth and for the purposes listed below,
be levied, assessed and collected upon the taxable pro-
perties in the Town of Mamaroneck outside of the Villages
of Larchmont and Mamaroneck, the properties of the
several districts specified below and the several parcels
of taxable property, franchise assessments and persons
within the Town and within such special districts be
extended on the Tax Roll of the Town of Mamaroneck
against each of the several parcels affected by such
assessments or parts thereof, to ,wit®

After being seconded by Councilman Watson, a vote was taken upon
the foregoing resolution and after roll call, the vote was announced
as follows :

The minutes of September 14th, October 5th and 26th and November 12th
were approved as presented.
The Clerk read a letter received from Chief Yerick regarding the
installation of a new street light at the intersection of Richbell
Road and Palmer Avenue. This matter was referred to Town Engineer,
A.J. Foote.

Councilman Watson presented the following petitions received from
the Assessor for the correction of the assessment roll so as to per-
mit the apportionment of taxest
On motion made by Councilman Watsonv seconded by Councilman McKeever
the following resolution was, upon roll call, unanimously adopted:
WHEREAS the Assessor has presented petitions for the
correction of the assessment roll for certain years,
pursuant to the provisions of Section 557v Article 16,
of the Westchester County Tax Law; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said roll.

Councilman Embury reported that the Park Department is anxious
to get work started on the restoration of the island in Larchmont
Gardens Lake and they request that specifications be prepared for
this work.
Councilman Mills presented a list of claims for Fire Department
expenditures and stated that he had checked the bills and recom-
mended approval and payment.
The members of the Town Board, sitting as the Board of Fire Com-
missioners, considered the claims and on motion by Councilman
Mills, seconded by Councilman Embury, it was, upon roll call,
unanimously
RESOLVED that the following described claims be
and they hereby are approved and that the Super-

Councilman McKeever stated that he had nothing to report for his
departments.
Supervisor Mandeville requested a resolution authorizing the renewal
of the lease with the Westchester County Park Commission for property
used for Park purposes.
On motion by Councilman Embury, seconded by Councilman Watson, it
was unanimously
RESOLVED That the Supervisor be and he hereby is
authorized to sign the extension agreement which pro-
vides for the extension of a lease dated October 18,
1945 with the County of Westchester covering use of
vacant land known as Parcel 45 and a portion of par-
cel 1B, Sheet99 Pelham-Port Chester Parkway, until
the 31st of Octoher, 19509 at an annual rental of $1.

The Supervisor presented a letter dated November 49 1949, from Mr.
James C . Harding, Commissioner of Public Works, advising that the
County of Westchester has extended for another year, its contract
with the State Department of Public Works for the removal of ice and
snow from the State highways in Westchester County.
On motion made by Councilman McKeever, seconded by Councilman Embury,
the following resolution was unanimously adopted.
WHEREAS, Section 12 of the Highway Law, as amended by
Chapter 305 of the Laws of 1946, provides that if the removal
of snow and ice from the State Highways is taken over by the
County, the County can arrange with the Town Superintendents of
the various towns in the County of Westchester and/or the villages
therein for the removal of the snow from such State Highways as
are within their municipal boundaries, and the entire cost of
such work will be reimbursed by the State, and
WHEREAS, the Town of Mamaronec; qunder date of Novem-
ber 8, 1946, entered into contract with the County of West-
chester for the removal of snow and ice from the State High-
ways within the Town, including the Villages of Larchmont and
Mamaronecs:, in accordance with the provisions of Section 12
of the Highway Law as amended, and under date of November 15,
1948, extended this contract for the season 1948-1949,
NOW, THEREFORE, BE IT
RESOLVED that the Town of Mamaroneck extend the
above mentioned contract with the County of West-
chester for an additional year, and be it further
RESOLVED that a certified copy of this resolution
be forwarded to the Westchester County Commissioner

The Supervisor requested a resolution authorizing the approval of
the claim of Beatty and Keller for appraisal of Knotty Knolls for
assessment purposes, in the amount of $1,250. and also for the
transfer of funds to cover same.
Upon motion made by Councilman McKeever, seconded by Councilman
Mills, it was unanimously
RESOLVED that the claim of Beatty and Keller,
real estate appraisers, in the sum of $1,250.
for services rendered in connection with the
appraisal of the apartment house °devel6pmentr
owned by Larchmont Properties, Inc. and generally
known as Knotty Knolls on Richbell Road in the
Town of Mamaroneck, for the purpose of fixing the
original assessment thereon, be and hereby is
approved and allowed, and
FURTHER RESOLVED that the funds for the payment
of said claim be appropriated from surplus
General Torun Funds .

The Supervisor requested a resolution setting January 16th, 1950,
as the date for the next auction for the sale of Town owned pro-
perty.
On motion made by Councilman Watson, seconded by Councilman Embury,
it was unanimously
RESOLVED that the next auction for the sale of
Town owned property, be held on January 16th,
1950, at the Weaver Street Fire House.
The Supervisor requested a resolution appointing John Seufert as
Custodian of the Police Department and Town Offices on a provisional
basis , effective December lst, 1949.
On motion made by Councilman Embury, seconded by Councilman Watson,
it was unanimously
RESOLVED that John Seufert be and he hereby is
appointed custodian of the Police Department
and Town Offices on a provisional basis, effective
December lst, 1949, at an annual salary of $2,440.
The Supervisor brought up the matter of closing of Lafayette Road
and Madison Avenue which had been laid over from a previous meeting.
He submitted sketches and a letter received from Mr. Hugh R. Pomeroy,
Director of the Westchester County Planning Commission.
Councilman Embury stated that he was concerned about two aspects
of this situation, the first being the fact that if the road were
closed it would mean additional traffic in the Station Plaza which
is already over-crowded. He said he was also concerned about the
matter of establishing a__grecedent. If Fifth Avenue were cut
through to North Chatsworth Avenue, as outlined on the sketch of
the Westchester County Planning Commission, his objections would
be eliminated.
The Supervisor stated that he believed it would be cheaper to put
through the new street than to repair Madison Avenue.
Councilman. McKeever suggested getting prices on both projects .
Councilman Watson said that he had checked on the traffic situation
on Lafayette Road and found it to be considerable. He further
stated that he would be reluctant to close Madison Avenue unless
the other street were cut through. Councilman Watson also would
like to have prices on these projects.
P-Jr. Rex Riccardi was present at this meeting, representing the resi-
dents on Lafayette Road. He spoke in behalf of the closing of Madison
Avenue .
This matter was tabled until the costs for the extension of Fifth
Avenue could be obtained by the Town Engineer.
Mr. Delius brought up the matter of the claim of Ida H. Wood as
Assignee of Rockcliffe Estates, Inc . for refund of 90% of revenues `
obtained by reason of advancement of moneys for the- iftstallation
of water mains in Bonnie Way and Briar Close in Rockcliffe Estates,
representing revenues collected by the Westchester Joint Water Works
No . l from 1943 to 1949 inclusive, amounting to $1,106,93: 909 of
which is $996®25•
After discussion the Board instructed Mr. Delius to attempt to
compromise the matter for less than the amount of the claim.

Upon recommendation of the Town Attorney and the Assessor, the fol-
lowing resolution was, on motion by Supervisor Mandeville, seconded
by Councilman Embury, unanimously adopted:
WHEREAS, heretofore writs of certiorari were obtained by
ABE ADLER and ROCHELLE TRUCK TART, INC. , owners of property des-
cribed on the assessment map and assessment roll of the Town of
Mamaroneck as Block 926, Pa reel 43, to review the Assessments
- for the y ears 1947, 1948 and 1949, (taxes of 19489 1949 and 1950) ;
and
`- WHEREAS, the Assessor and Board of Review of the Town
of Mamaroneck duly filed returns to said writs and no further
proceedings have been had; and
WHEREAS, the Town Attorney and Assessor recommended to
this Board that the proceedings be settled and discontinued
upon the reduction of the assessments,
NOW, THEREFORE, BE IT
RESOLVED that the assessments for the years
19479 1948 and 1949 (taxes of 1948, 1949 and
140) upon property owned by Abe Adler and
Rochelle Truck Mart, Inc . and described upon
the assessment map and assessment roll of the
Town of Mamaroneck as Block 926.9: Parcel 43, be
reduced as follows :

The above are being sold on as "as is" basis and can be inspected
at the Town Yard, Palmer Avenue, Larchmont, New York.
Bids should be addressed to the Town Clerk, 158 Test Boston Post
Road, Mamaroneck, N.Y. , and should be accompained by a check for
ten (10°x) per cent of the amount of bid. The envelope should be
marked on the outside, "Bid for Trucks" .
Bids will be received until 5:00 P.M. on December 28, 1949.
The Town Board reserves the right to reject any or all bids .

NOTICE is hereby given in compliance with Section 142 of the
Highway Law that A.J. Foote, Superintendent of Highways of
The Town of Mamaroneck, Westchester County, New York, has re-
commended the purchase of a Dump Truck and a Sedan, at a cost
to exceed Five Hundred Dollars .
The Town Board of the Town of Mamaroneck will meet at the Council
Room of the Weaver Street Fire House, Weaver Street, Larchmont,
New York, on the 28th day of December, 1949, to consider such a
purchase.
