HomeMy WebLinkAbout1947_09_24 Town Board Minutes ..... . ... . _.. 801 SPECIAL MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK HELD SEPTEMBER 24, 1947 in the Council Room of the weaver Street Fire House, Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8:11� P.M. ( Eastern Standard Time) . Present : Supervisor Ylandeville Councilman Stiner, Mills, Watson, Embury The presence was also noted of Town Clerk Gronberg, Town Attorney Delius and Accountant Pinson. The Town Clerk presented and read the affidavit of publication calling for a public hearing upon a proposed amendment to the General Ordinances . The Supervisor asked if there was any one present who wished to speak in opposition to this proposed amendment. There being no one who desired to speak, he declared the hearing closed. On motion by Councilman Embury, seconded by Councilman 'Watson, it was, upon roll call, unanimously RESOLVED, that the Town Board of the Town of Mamaroneck, hereby enacts the following amendment to the General Ordinances adopted February 17, 1937: Chapter 1V, Section 3, is hereby amended to read as follows : Section 3 . REMOVAL OF RUBBISH, NEEDS, ETC . Every owner, tenant or occupant of land shall cut, trim or remove all brush, grass, rubbish, noxius weeds, litter or other similar unsightly or objectional material there- from at his own expense . In addition to the enforcement of the fines and penalties provided in Chapter X1 of these Ordinances, the Town Clerk may serve written notice upon owners, tenants and/or oc- cupants of any such premises, to trim, prune and, if ne- cessary, remove noxius weeds, rubbish, litter or other similar unsightly or objectionable material from the premises within 20 days, and in default thereof, the Town may carry out the provisions of this section and collect the expense thereof from the owner, or assess the expense thereof upe;n,the land, where the owner refuses or neglects to comply w: th the notice so served. Such notice may be served either personally or by mail, addressed to any owner, tenant or occupant at the address or place of business designated in any deed, conveyance or other instrument filed or recorded in any public office or in any letter or writing addressed to the Assessor or Receiver of Taxes of the Town of Mamaroneck. 803 The Town Clerk was instructed to write to the Police and Fire Departments calling attention to the new amendment that was adopted, and if there are any properties that come under the heading of the new amend- ment, to notify the Town Clerk who in turn would notify the Town Attorney of the ones that are not Town-owned. The minutes of September 10, 1947, were approved as corrected. A letter dated September 16, 1947, was received from the Village of Mamaroneck enclosing a resolution passed at their meeting of September 89 1947, requesting the Town to take ir,mediate steps to correct that portion of the Town sewer line which connects with the Village line . The Supervisor informed the members of the Board that Mr. Foote is presently working on the plans and specifications for correcting this condition. The Town Clerk brought up the mat er of the rate of pay for the election inspectors, and on motion by Councilman IT.atson, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that the rate of pay for the Election Inspectors shall be as follows : Primary DE Z__= JR 29 1 47_ 12:00 noon to 9:00 P.M. $8.00 Per day aegistration_- Personal Oct . 6, 79 8, 9, 10 - 5:00 to 10:30 P.M. - $4.50 per day Oct . 11 - 7.00 A.M. to 10:30 P.M. - $10.00 per day ReLsstration - Non-Personal Oct. 4 - 7;00 A.M. to 10:00 P.M.) - $10.00 for Oct . 11 - 1:00 P.M. to 10:00 P.M.) each day Election - November 4th 6:00 A a% to 7:00 P.M. - $10.00 for day 2.00 extra for chairman 10.00 Poll Clerks The Town Clerk stated that he had received from Assessor the tentative trial and grand jury lists and presented the same to the members of the Board for consideration. After examination and verification of said lists by both the Assessor and the Town Board, it was on motion by Councilman Stiner, se- conded by Councilman 1,ills, upon roll call, unanimously RESOLVED, that the completed lists of the grand and trial jurors be and they hereby are approved and certified by the members of the Town Board and Assessor; and be it FURTHER RESOLVED, that the Town Clerk be and he hereby is authorized, empowered and directed to forward certified lists of the grand and trial jurors to the Commissioner of Jurors in the form required by law. 805 Councilman Watson presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes . Palmer 625. Councilman Embury reported that he had nothing to report for - his Departments . Councilman Stiner reported that he and Mr. Foote, accompanied by the County Engineer made an inspection of Dillon Road where some four or five years ago, he explained, the County Sewer Department had relaid a sewer force main. It was discovered that there was quite a sinkage due to the fact that the trench and the pavement is settled. He said that Yr . Foote has asked the County Sewer Department to resurface over the trench, for which the estimated cost of materials is $500. , allowing them the use of the Town's roller. The County Engineer is to let Mr. Foote know in a day or two I if there is sufficient funds in the Sewer Department budget to do the work this year® I Councilman Mills presented a list of claims for Fire Department expenditures and stated that he had checked the bills and recommended approval and payment. The members of the. Town Board sitting as the Board of Fire Commissioners considered the claims, and on motion by Councilman Mills, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that the following described claims be and they hereby are approved and that the Supervisor and Comptroller be and they hereby are authorized to pay same out of the budget for the Fire Department : Westchester Lighting Company $ 25.98 New York Telephone Company 14.25 The C .G. The Supervisor suggested that the Town Attorney contact Lir . Samuel Robinowitz for immediate action concerning this violation. The Supervisor asked if there was any one in the room who wished to be heard . Mr . W.T . Keon of 30 Lester Place appeared to ask if the Town Board has come to any conclusion regarding the Lester Place road im- provements . The Supervisor informed Tyr. Keon that this matter has not gotten by the thinking stage and that estimates are being prepared for consideration as to whether this project will be included in next year ' s budget. He pointed out that although the deed to this street is in the Town Attorney' s hands, it has not been accepted by the Town. The Supervisor further explained that when this job is under- taken it will have to be properly drained before the paving work is done which will be costly. Mr . Keon asked for temporary help, such as snow removal during the coming winter. The Supervisor assured 11r. Keon that the Town will be glad to send the snow: plow providing that it can get through the street . Councilman Watson brought up the matter of the utilities re- quested by Mr. Carnoy at the last meeting. After reviewing Yr . Carnoy' s request, Councilman 171atson stated that he had discussed the matter with Lr. Foote .. He informed the members of the Board that he had gone over the estimates which the Town Engineer had prepared for these improvements. He explained that the improvements requested, fall in different .catagories and that :; r. Foote @s estimates are as follows: Sanitary Sewer - $ 5, 711. Water Main - 29004. Gas Yain - 2,672. Street Improvements - _L2C7. _ Estimated Total Cost $16, 674. The matter was discussed by the members of the Board, but no definite action was taken at this time. The Supervisor stated that he had at hand a resolution from the Village of Mamaroneck approving the sales of property in their In Rein action. It was his recomrendation that these sales be approved. On motion by Councilman Stiner, seconded by Councilman 7Watson, it was, upon roll call, unanimously resolved WH3EREAS9 the Village of Mamaroneck, through the institution of an action in the County Court of Westchester County, entitled IP In the Matter of the Foreclosure of Tax Liens Pursuant to Article Vll-A, Title 3 of the Tax Law by the Village of Mamaroneck, List of Delinquent Taxes for 194150 1 , has become and now is the owner of a number of parcels of Real Estate situate in the Village of Mamaroneck and Town of Mamaroneck; and I 13 7THEREAS, both the Village of 1aamaroneck and Town of Mamaroneck hold tax liens on said parcels of real pro- perty; and MIEREAS, pursuant .to Section 165H of the Tax Law and agreement was entered into between the Village of Mamaroneck and the Town of Mamaroneck, which among other things set forth the interests of said municipalities in the properties being foreclosed, the manner of the dale of said properties ; _ and the manner of the distribution of the proceeds re- ceived from said sales ; and 'WHEREAS, the Village of PTamaroneck has, pursuant to an agreement had with the Town of Mamaroneck advertised for and has heretofore received bids on certain properties owned by the Town. of Mamaroneck, as well as on certain properties owned by the Village of P,Tamaroneck in the Town of Mamaroneck; and WHEREAS, since receipt of said bids this Board has given careful consideration thereto, and after due deliberation, it is RESOLVED, that the bads hereinafter listed be accepted at the price and terms therein set forth: LIST OF BIDS ACCEPTED IN SECTION 8 Block Lot Bidder Amount Total Asslt . Cash The Supervisor presented a statement regarding the distribution of funds on Block 913, ' Parcel 227, together with a check of $872.78 from the `village of Mamaroneck. He recommended that the Board approve this distribution. The Supervisor presented water distribution system claims by the plestchester Joint IATater Works No. 1, covering various charges for broken pipe and meter installations . He recommended that these claims be paid and stated that surplus funds for -water purposes were available and these claims could be paid from these funds . On motion by Councilman Embury, seconded by Councilman 71atson, it was, upon roll call, unanimously RESOL`vED, that the Comptroller be and he hereby is authorized to audit and approve the following claims of the aestchester Joint -+later glorks No. 1, which claims are to be charges against the cost of the local water distribution system and payment of same to be made from surplus water funds available in the Capital Fund: 1944 June 9 Repairs - 61, LJain - Cooper Lane broken by Town Employees while blasting 80201.97 Dec . 31 Ileters Installed Year 1944 179.99 19945 Dec . 31 T:ieters Installed Year 1945 16.32 i 1246 _ Keters Installed - Year 1940 274409 $ 672.37 817 The Supervisor stated that the time has arrived when the Town must pay the County of 'Westchester the balance of its 1947 tax levy which amounts to $177,347.78 . He said that inasmuch as there were sufficient funds available in the 1947 General Fund, he be authorized to make the payment out of these funds instead of borrowing as has been the custom in the past . On motion by Councilman Stiner, seconded by Councilman Watson, it was, upon roll call; unanimously RESOLVED, that the Supervisor be and he hereby is authorized to pay the balance of the 1947 State and County Tax levy from available General Funds . The Supervisor informed the members of the Board that there were surplus funds in the Capital Fund which funds were really surplus of the mater and Sewer districts, and it would be his recoiraendation that these funds be transferred to the respective surplus accounts of these two Districts. To Water Surplus : Refund Water Company on deter Installations 1, 074.60 Balance .costs of water distri- bution system paid from surplus 4.0� loi Less : Construction costs paid from surplus 672.x7 43732 On motion by Councilman nfatson, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to transfer the sum of $1, 277.67 from the Capital Fund to Sewer District No . 1 surplus ; FURTHER RESOLVED, that the Supervisor be and he hereby is a uthorized to transfer the sum of $436.32 from the Capital .Fund to the 'Water surplus . The Supervisor stated that the 1948 Budget requests had been sent out to the various Departments . He said in going over the general financial picture of the Town he thought the Board might presently give thought to the possibility of using some of the cash surplus which had been 'built up to offset completely the General Toviin tax. He further stated that it was estimated that between Ninety and One Hundred Thousand Dollars will be necessary to put this into effect and there still would be a working reserve fund of at least $250®000. He said if this met with the approval of the Board it would be the first time this has been done in the Town of hfamaroneck and that he would proceed with the pre- - partition of the Preliminary Budget on that basis . Following discussion, the members of the Board unanimously agreed and authorized the Supervisor to proceed to prepare the 1948 Budget on this basis . 19 I II The Supervisor reported that Kr. Blaise Fat-one had asked that the amount which he paid at the auction sale, held September 2, 1947 of Town owned property, to purchase property known as Block 124, Parcel 373, be refunded to him on the ground that he had inadvertently made this bid for a parcel of property which he did not want, he having in- tended to purchase another parcel which, however, had been otherwise disposed of and was not now available . _ The Supervisor recommended that the amount of I:'_r. Fatonels deposit, being the sum of $20. , be refunded to him, and upon motion made by Councilman Watson, seconded by Councilman Embury, it was, unanimously RESOLVED, that the Supervisor be authorized to cancel the bid made by Blaise Fantone on September 2, 1947, for property known as Block 124, Parcel 373, upon receiving from him a release of the bid which he made at that time ; and FURTTMR RESOLVED, that the Supervisor is hereby author- ized to return to the said Blaise Fatone, the sum of $20. being the amount of his deposit made at the time of the bid. I The Supervisor stated that he had at hand an estimate from the Westchester Joint Water Works No. 1 of the cost of installing a 111 water main and fire hydrant in Cabot Road, amounting to $4,133 .89. He recalled that this matter had come up at the previous meeting upon the recommendation of the Fire Department . Councilman Mills said he understood, although he was not sure, that the present water main in Cabot ° Road was not of sufficient capacity to properly supply the houses which are to be connected to this main, The Supervisor replied if that were so, it would be one thing , whereas spending $4,133 .89 just for a hydrant would be entirely another matter. He added that perhaps for the present if the water supply was inadequate for the needs of the people living on Cabot Road that a larger water main might be installed. the Supervisor also pointed out that in the event a fire it would only require the laying of approximately 5001 of hose to any house on Cabot Road, and if a fire should occur in the Park area, which could only be a car fire, the Fire Department would probably use either their auxiliary wrier tank or fog to extinguish it . Following discussion, it was decided to have Pr?r. Foote check the water supply to the new and old houses in that area with a view to discover whether or not the present water main is of sufficient capacity to properly supply the houses on Cabot Road, and if not, to obtain an estimate of installing a larger brass or copper main. The Supervisor stated that he had at hand an estimate from the Westchester Joint Water Works in the amount of $425.70 of the cost of extension of a 611 water main in Stratford Road to Highland Road. He said he thought it might be advisable to have this refigured on the basis of using a 211 or 481 supply line, and with the permission of the Board he would recommend that this matter be referred to Mr. Foote . He suggested that this estimate be returned to the dater Company for revision under the above conditions. The Town Attorney presented a proposed lease covering rental I 21 II of the office at 100 Mamaroneck Avenue, which for a number of yearn has been used by the Justice of the Peace as a Court Room. The Town Attorney explained that in the past the Town has been a month®tomonth tenant at the rate of $25.00 per month, but that the new owners insist upon a one year' s lease commencing October 1, 1947, at an annual rental of $480. per year . Following discussion, it was on motion by Councilman Embur,y, seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute a leaee between W.K. Cooley and the Town of Mamaroneck for the period October 1, 1947, to ,September 30, 1948, at an annual rental of $480. for the office used as a Justice ' s Court Room at 100 Mamaroneck Avenue, Mamaroneck, New York The following statements were ordered placed on file : Claims Audited and Paid by the Comptroller from September 10 to September 24,1947, Summary of Receipts and Disbursements from January 1 to August 31, 1947; Analysis of Estimated Revenu .u ; Analysis of Budget Appropriations and Eitpenditures from January I to August 31, 1947® There berg no further business, the meeting adjourned at 9:40 P.M. to meet on October 15, 1947.
