HomeMy WebLinkAbout2019_04_24 Town Board Minutes April 24, 2019 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON APRIL 24, 2019, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION Additionally Present: Lindsay Luft Administrative Assistant On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00PM. Review – Firehouse Renovation Bids Additionally Present: Rob Wasp, Town Engineer, Tracy Yogman, Town Comptroller Joe Russo, Fire Chief, and Shawn Hughes, Deputy Fire Chief The Town Board reviewed Mr. Altieri’s memo dated April 18, 2019, and discussed the renovations to the lower level of the Firehouse, which was significantly affected by the replacement of the apparatus floor. The Board also reviewed a design development budget estimate prepared by the Town’s project manager dated February 13, 2019. The discussion surrounded the additional costs of the project based on the current bids received. The Fire Chief and the Town Engineer explained some of the aspects of the project effecting the cost. Tracy Yogman distributed a schedule of existing debt for the Fire District. The Town Board noted the significance that the lower level of the Fire House plays in recruitment and maintaining volunteers. The Town Board discussed possible June dates for a referendum, and in order to keep on schedule for a June referendum, the Board will need to approve a bond resolution and a call for election at their upcoming Special meeting with the Village of Larchmont. Comprehensive Plan Supervisor Seligson noted the improved RFP before the Town Board. Supervisor Seligson noted her additional discussions with Melissa Kaplan-Macey. The Town Board reviewed and commented on the document in detail. Supervisor Seligson read through the comments and changes per her discussion with Ms. Kaplan-Macey, and will distribute a red lined version to the Town Board to review for the next meeting. ADDED ITEM Supervisor Seligson stated that Norma Drummond, Commissioner of the Westchester County Department of Planning has been invited to speak with the Town Board regarding the Westchester County Housing Report, prior to the continued discussions regarding the BLD Diner. Councilwoman Elkind Eney noted the Public Service Commissions has issued their report regarding the March 2018 storm. 1 April 24, 2019 Proposed Development – BLD Diner Site The Town Board discussed a visit to the BLD Diner site, prior to any additional discussions with the developer. Discussion – Intersection Palmer Avenue and Weaver Street The Town Board reviewed the draft resolution being proposed to send to the Department of Transportation regarding a request to study the intersection. Approval of the resolution was added to the regular agenda for this evening. Update – Natural Gas Main Installation – Fenimore Road Mr. Altieri gave an update, adding that full closure of the street from 8:00 am to 5:00 pm may need to take place for two to three weeks. New Business Mr. Altieri advised that the IT Audit will begin in June and should take approximately four to eight weeks to complete. Mr. Altieri advised that Liz Paul has discussed with Ace Trapping what trapping methods they could enlist to trap coyote’s. Ms. Paul was advised that they would not utilize snare traps, but rather a baited snare trap that would not be strong enough to break a leg of a significant size. The cost would be between $500.00 and $700.00 a day. Mr. Altieri will put this information aside for future reference. Mr. Altieri stated that the local law drafted regarding no parking five feet from a driveway is still being reviewed by the Traffic Committee. Mr. Altieri informed the Town Board that the Town is fully eligible for Community Block Development th Grants (CBDG) based on eligible census tracks. There is a deadline of June 28 for infrastructure grants and Anna Danoy is working on projects the Town would apply for. There is a maximum of four grants, each totaling $250,000 which could be applied for. The Town Board will need to move quickly as these grants require a public hearing. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. PROCLAMATION BUILDING SAFETY MONTH On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby adopt the following Building Safety Proclamation: 2 April 24, 2019 PROCLAMATION ARBOR DAY thth Supervisor Seligson announced that this Arbor Day, April 26 , the Town will be celebrating its 27 th year with the honor of “Tree City U.S.A.” status. On Tuesday, April 30 the Town will be planting a tree in memory of “Our Departed Brothers from the PBA.” Supervisor Seligson read the Proclamation for Arbor Day. SUPERVISOR’S SUMMARY REPORT Spring is a busy time in the Town of Mamaroneck and for the entire community. I’ve attended and participated in many events over the past few weeks and would like to share some of them with you. Congresswoman Nita Lowey invited me to speak about funding needs for Long Island Sound at a press conference she held to highlight the president’s proposed budget. I again had the opportunity and fun to judge the Friends of the Larchmont Library Spelling Bee and I’m happy to report that Deputy Supervisor Jaine Elkind Eney and her team progressed way past the first th round. The Town Board held a public meeting on April 8 regarding commuter parking in 3 April 24, 2019 residential areas to discuss the draft report of the consultant. Many residents from the North Chatsworth Avenue area attended and gave input. The consultant plans to complete the report by the end of May and the Town Board will consider options at that time. th There was a TVS meeting, Town, Village School, on April 9 and a WMOA meeting in Mt. Vernon on that evening. The WMOA meeting was held in a most unusual setting. It was in the warehouse of American Christmas, a store that supplies Christmas decorations to Rockefeller Center and Cartier stores worldwide among others. It was like eating backstage at the Nutcracker. Highway Forman, Alan Casterella’ s son, Danny is the CEO of the company. Sue Odierna and I went on a tour of the Mamaroneck sewage treatment plant with teacher Sophia Andrews’ AP environmental students from MHS. Keith May, supervisor of operations, gave us the tour. The plant is built to handle 28 MGD of water. Keith said that up to a 100 MGD can flow through the plant on a rainy day. I happily spoke about the Town of Mamaroneck at the Women’s Club with the mayors from the th two Villages on April 12. It is always a pleasure to update that group on issues in the Town. I also participated in the annual LWV “Running and Winning” program that brings together exceptional female high school students from around the County with female elected officials to encourage the students to consider running for office. I attended County Executive George th Latimer’s State of the County Address on April 11. George talked about the programs of the County and the benefits of working together as an inclusive diverse community. Here is an update on the construction on Fenimore Road: Fenimore Road will be closed in the southbound direction between Cornell and Winding Brook Road for the next week to 10 days due to the extensive construction needed to build the new gas distribution main. Motorists are asked to use alternate routes. th Four upcoming Town events: The Town’s spring coastal cleanup is this Saturday, April 27 from 10 to noon at Hommocks Conservation Area. The famous spring 5K Run and Lil Bunny Hop races th are on for this Sunday morning, April 28 starting at Memorial Park. Arbor Day is this Friday, thth April 26 and this is the 27 year that the Town of Mamaroneck has been recognized with “Tree th City U.S.A.” status. In honor of Arbor Day, we will plant a tree next Tuesday, April 30 at approximately 10am in the Town Center parking lot, outside of the police department entrance. This tree will be a rededication in memory of “Our Departed Brothers from the PBA.” th There will be a compost give back day at Maxwell Avenue on Saturday, May 4 from 8:00 am to 1:00 pm. Please go to the Town’s website for details about these events. Finally, please remember - don’t litter. We’ve had several complaints about litter on the Post Road. Its spring and we all want to enjoy the community outdoors. Supervisor Seligson asked if anyone in the audience would like to address the Board. CITIZEN’S COMMENTS Cathy Sears, representing the Larchmont Gardens’ Civic Association, addressed the Town Board. Ms. Sears thanked the Town for all the work done around the Duck Pond, and then asked if aerators were put back in place. Mr. Altieri responded not as yet. Ms. Sears noted the upcoming coffee hour this Saturday, and the Kenducky Derby on May 5. A fundraiser is taking place to add dog waste receptacles around the Pond. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Public Hearing (s) were unanimously closed. On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the following Local law was approved: Local Law No. 3 - 2019 This local law shall be known as the “Payment of the fees for experts needed by the Town in connection with reviewing applications for Subdivision Plat approval” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The Town’s site plans laws, both commercial and residential, contain a provision that requires an applicant to reimburse the Town for the costs of the experts that the Town needs in order to review an application. The chapter of the Town Code regulating subdivision approval does not. This law adds that requirement to that chapter. Section 2 – Amendment of a current section of the Mamaroneck Code: Section 190-22 of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: §190-22 Fees. Every application for subdivision plat approval shall be accompanied by the fee set forth in §A- 250-1. Should an agency of the Town having jurisdiction over that application deem it necessary to hire consultants for technical review and/or on-site inspection, the applicant shall be required to pay the actual cost to the Town for such services. Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. BE IT ENACTED by the Town Board of the Town of Mamaroneck 7 April 24, 2019 Section 1 – Purpose: The Town’s site plans laws, both commercial and residential, contain a provision that requires an applicant to reimburse the Town for the costs of the experts that the Town needs in order to review an application. The chapter of the Town Code regulating wetlands permits does not. This law adds that requirement to that chapter. Section 2 – Amendment of a current section of the Mamaroneck Code: Section 114-7 (B) of the Code of the Town of Mamaroneck hereby is amended to add the following paragraph (5) to that section: §114-7 (B) Procedure for permits. . . . (5) Should an agency of the Town having jurisdiction over that application deem it necessary to hire consultants for technical review and/or on-site inspection, the applicant shall be required to pay the actual cost to the Town for such services. Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The Town’s site plans laws, both commercial and residential, contain a provision that requires an applicant to reimburse the Town for the costs of the experts that the Town needs in order to review an application. The chapter of the Town Code regarding applications to the Board of Appeals does not. This law adds that requirement to that chapter. Section 2 – Amendment of a current section of the Mamaroneck Code: Section 240-91 of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: §240-91. Fees. Any person or corporation, other than the Town of Mamaroneck, making any application to the Board of Appeals under the provisions of this chapter shall pay to the Building Inspector or the Director of Building Code Enforcement and Land Use Administration the fees, set forth in §A250-1 for both processing the applications and advertising the notice of hearing for each application filed. Should an agency of the Town having jurisdiction over that application deem it necessary to hire consultants for technical review and/or on-site inspection, the applicant shall be required to pay the actual cost to the Town for such services. Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. AFFAIRS OF THE TOWN 1. Authorization – License Agreement – National Water Main Company On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was RESOLVED, that the Mamaroneck Town Board does hereby approve the license agreement with National Water Main Cleaning Co. to utilize the Town owned site, located at the corner of Madison Avenue and Fifth Avenue, as a staging area for construction materials in conjunction with the process of completing repairs and improvements to sanitary sewer infrastructure in what is termed the “Trenchless Lining and Manhole Repairs” Construction Project, and BE IT, FURTHER RESOLVED, that the License is for six months with the Licensee paying a total license fee of $6,000, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – Amendment to Easement – 11 Marbourne Drive On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved, WHEREAS, a plat entitled “Subdivision Map of Marbourne Meadows Section 2 in the Town of Mamaroneck, Westchester County, New York” made by Arthur J. VanSuetendael, III, P.A. and L.S. dated October 27, 1978 and filed in the Office of the Clerk of the County of Westchester (Division of Land Records) as Map No. 20060 on October 11, 1979 (the “Plat”) depicted a drainage and retention easement area across Lots 47, 48, and 49 as shown on the Plat; WHEREAS, the Town of Mamaroneck Town Board agreed to reduce the size of the drainage and retention easement insofar as it impacted Lot 47 (also known as 11 Marbourne Drive (SBL: 3-34- 47)) (“11 Marbourne Drive”) and accepted the indenture dated March 8, 1990 which memorialized the Town’s acceptance of the revised easement; WHEREAS, the aforementioned indenture which identified the easement area by a metes and bounds description of the revised easement area and a map showing the easement area known as 11 April 24, 2019 “Map of Drain and Retention Easement to be Abandoned prepared for Enclave Associates in the Town of Mamaroneck, Westchester County, N.Y.” made by Ward Carpenter Engineers, Inc. dated October 3, 1988 was recorded in Liber 9854, Page 18 in the Office of the County Clerk of Westchester, Land Records Division on July 20, 1990; WHEREAS, the Town of Mamaroneck no longer needs additional easement area encumbering 11 Marbourne Drive and wishes to abandon and release the Town’s rights to such easement area but only in the areas indicated by the attached survey known as “Survey of Lot No. 47 as shown on a certain map entitled subdivision map of Marbourne Meadows Section Two Located in the Town of Mamaroneck, Westchester County, New York” made by Gabriel E. Senor, P.C. last updated March 25, 2019; NOW, THEREFORE, BE IT RESOLVED: The Town of Mamaroneck Town Board hereby releases and abandons any and all easement, right, title and interest, if any, in that portion of the 11 Marbourne Drive described in the Partial Termination of Declaration of Drainage and Retention Easement presented to the Town Board on the date that this resolution was passed; and BE IT FURTHER RESOLVED THAT: The Town of Mamaroneck Town Board hereby authorizes and directs the Town Administrator to sign the Partial Termination of Declaration of Drainage and Retention Easement in the form that accompanies this resolution and to deliver it, a certified copy of this resolution and the updated survey referred to above dated March 25, 2019, and the other documents that are required for recording these documents in the Office of the County Clerk of Westchester, Land Records Division to the owner of 11 Marbourne Drive. Report of Bids – TA-19-02 Landscape Maintenance On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved, WHEREAS, on April 1, 2019, the Town publically opened and read three (3) bids for Contract TA-19-02 Landscaping Maintenance. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-19-02 Landscaping Maintenance, to the lowest responsible bidder meeting all of the Town’s requirements, Acocella Contracting, to provide landscaping maintenance services at a total cost of $25,450 for the year 2019, and $25,950 for the year 2020, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. Report of Bids – TA-19-04 Grass Maintenance – Hommocks Field On motion of Councilwoman Fiddelman, seconded by Councilman King, the following was approved, WHEREAS, on April 1, 2019, the Town publically opened and read two (2) bids for Contract TA-19-04 Grass Maintenance – Hommocks Field and Hommocks Pool. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-19-04 Grass Maintenance – Hommocks Field and Hommocks Pool, to the lowest responsible bidder meeting all of the Town’s requirements, Pasquale Ferraro Landscaping, Inc., to provide grass maintenance services at a total cost of $8,850 for the year 2019, and $8,975 for the year 2020, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-19-06 Service Body – Central Garage to, the lowest responsible bidder meeting all of the Town’s requirements, Truis, Inc., to furnish and install a service body at a total cost of $24,691, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. Authorization – Capital Project 2019-06 Purchase of Highway Vehicle On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following was approved, WHEREAS, the 2019 Capital Project Schedule approved by the Town Board included the replacement of a dump truck for the Highway Department. 13 April 24, 2019 NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the purchase of one 2020 freight liner 6-wheel dump truck, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – Information Technology Audit On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby accept the proposal from PKF O’Connor Davies to conduct an information technology audit for a fee of $18,550 for the audit, plus out of pocket expenses not to exceed $500, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – New York State Snow and Ice Agreement – Supplement Payment On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the following was approved; WHEREAS, the Town of Mamaroneck conducts snow and ice control on both the Boston Post Road and Weaver Street which are roadways owned by the State of New York, and WHEREAS, in consideration of the Town’s snow and ice control activity, the State reimburses the Town. Set Public Hearing – Water District Bonding On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the following was approved, In the Matter ORDER of CALLING The Increase and Improvement of Facilities of PUBLIC the Consolidated Water District in the Town of HEARING Mamaroneck, Westchester County, New York WHEREAS, pursuant to proceedings heretofore had and taken by the Town Board of the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of Section 202-b of the Town Law, it has been determined to be in the public interest to provide for a certain increase and improvement of the facilities of the Consolidated Water District in the Town of Mamaroneck, Westchester County, New York, at a maximum estimated cost of $2,513,500, consisting of the construction of a new Kenilworth Water Storage Tank, reconstruction of the Rye Lake Ultra Violet facility and water infrastructure improvements related to the planned paving projects of the Town of Mamaroneck, including incidental improvements and expenses in connection therewith; and WHEREAS, a map, plan and report including an estimate of cost has heretofore been prepared in connection therewith and is on file in the office of the Town Clerk of such Town; and WHEREAS, said capital projects, as proposed, have been determined to be Type II Actions pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, as such, will not have any significant adverse impact on the environment; and WHEREAS, in order to undertake the improvements to the aforesaid facilities as described therein, it will be necessary to expend the sum of $2,863,500, an increase of $350,000 over that previously authorized and an addendum to said map, plan and report has been prepared in connection therewith; and WHEREAS, it is now desired to call a public hearing on the question of authorizing such increase and improvement of facilities of said Consolidated Water District at the revised maximum estimated cost; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. A public hearing will be held at the Town Hall, 740 West Boston Post Road, in st Mamaroneck, New York, in said Town, on the 21 day of May, 2019, at 8:00 o’clock P.M., Prevailing Time, on the question of increasing and improving the facilities of the Consolidated Water District in the manner described in the preambles hereof, and to hear all persons interested in the subject thereof, concerning the same, and to take such action thereon as is required or authorized by law. Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of Public Hearing hereinafter provided to be published once in the official newspaper designated for this purpose, and also to cause a copy thereof to be posted on the sign board of the Town, such publication and posting to be made not less than ten, nor more than twenty, days before the date designated for the hearing. Section 3. The notice of public hearing shall be in substantially the form attached hereto as Exhibit A and hereby made a part hereof. Section 4. Authorization – New York State Resolution – Intersection of Palmer Avenue and Weaver Street On motion of Councilwoman Fiddelman, seconded by Councilman King, the following was unanimously approved Whereas, the intersection of Palmer Avenue and Weaver Street (Route 125) is located in the unincorporated Town of Mamaroneck, and, Whereas, Weaver Street (Route 125) is a New York State owned road, and, Palmer Avenue a Westchester County owned road, Whereas, the traffic signal at the intersection is controlled by the New York State Department of Transportation, and, Whereas, the intersection has been the site of a frequent number of car accidents, the most recent occurring on March 29 and April 4, and, Whereas, the Town believes that based upon the accident history, it is time to evaluate the intersection to improve traffic flow and vehicular safety, now be it RESOLVED, that the Town Board of the Town of Mamaroneck unanimously requests that the New York State Department of Transportation initiate straightaway an evaluation of this intersection to investigate traffic flow and to consider safety improvements including the installation of left turn arrows on the traffic signal for traffic traveling in all directions on Palmer Avenue and Weaver Street (Route 125). And be it, FURTHER RESOLVED, that the Town of Mamaroneck is prepared to provide whatever assistance is necessary to assist with the review of the intersection by the New York State Department of Transportation.
