MAMARONECK, HELD AUGUST 5, 1953, IN THE COURT ROOM OF THE
MFMARONECK TOWN POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN.
PRESENT: Supervisor Mandeville
Councilmen Embury, Kane, Waterman, and McKeever
ABSENT: None
Presence was also noted of the Town Clerk, Mr. Gronberg.
The Supervisor called the meeting to order at 5: 15 P . M.
Mr. George R. Bishop appeared to regtiwst acceptance by the Town of
dedication by his company of 1,000 feet of street, extending from
Griffin Avenue through Murdock Road into Split Tree Road, complete
with sewer, water, gas, electricity, etc. and finished according
to specifications, and approved by Councilman McKeever.
Mr. Bishop said he is anxious to transfer one of his completed
houses on August 12th, and cannot obtain a Certificate of Occupancy
until the road has been accepted by the Town.
It was decided that Mr. Bishop could obtain a temporary C . 0 . sub-
ject to approval of the deed, title search, etc . by Mr. Delius
who is away on vacation.
Mr. Harry Alpiar appeared to request a decision on the matter of
the proposed swimming pool. He suggested that the Town Board
contact the Village Board and discuss having such a proposition
put on the ballot in the next election.
-- Mr. Mandeville suggested that Mr. Van Hook, who was present at the
meeting, might give his ideas about a swimming pool.
Mr. Van Hook believes the general sentiment is against a pool.
Mr. O'Donnell was then asked for his opinion and he said ( speaking
as an individual) it would seem to him that if enough money could be
found to have a survey made and brought before the Board, it might
solve the problem.
Mr. Topping (also representing only himself) feels if it is an
economically sound and self-sustaining thing, it should be under-
taken by private interests. He does not think such a thing should
be put on the tax rolls.
The Supervisor believes a swimming pool might be popular because of
the condition of Long Island Sound. He suggested that the Board
would consider the matter and inasmuch as the Town has a location for
a pool if the people want one, it was decided to put $2,000 in next
yearls budget to have a survey made of the situation, after which
consideration will be given to putting some sort of a proposition
on the ballot, if the results of the survey warrant this.
Mr. Steve Hartley reported that the local office of Civil Defense
had been host to the County and the meeting had been very successful.
The County Department feels the local office is in good shape.
The Supervisor complimented Mr. Hartley on his job.
Mr. George Hamilton appeared to ask that his father be reinstated
with the Town where he had been emoloyed for the past 15 years with
the Highway Department. He was discharged about 4 months ago and
his son asked the Board to "please reconsider this" .

Mr. Bernard Lancia a ,peared to inquire about refunds which he claims
are due him from the Water Company. The Clerk read a memorandum,
dated July 28, 1953, submitted by the Town Attorney. After dis
cussion, the Supervisor announced that the matter would be taken
up with Mr. Forbes, who was attorney for the Water Company at the
time this situation arose, and Mr. Delius.
The Supervisor stated that, although Judge Close had rendered an
opinion in the matter of the application to re-zone 65 Palmer
Avenue, he believed the Board should take no action until Mr.
Delius returns from his vacation. The matter was put over until
September 1.
Mrs. Winton L . Miller, Jr. , 125 Weaver Street, appeased to inquire
concerning property at the corner of Murray Avenue and Cleaver Street.
She had been under the impression that it might be used as a park.
The Supervisor stated that he did not so understand it and in any
event,he feels there are enough parks in the Town.
The Town Clerk submitted a request from Mr. Louis Zingesser, attorney
for Mrs . Hansen, that discussion of her application for a dance hall
license be adjourned because of illness of her son. The reauest was
granted.
The Clerk presented a letter, dated June 28, 1953, from Mr. Gil
Allen, Secretary and Treasurer of the Mamaroneck Independent Soft
Ball League, requesting financial assistance.
On motion by Councilman McKeever, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the Town purchase soft ball equipment
in an amount not to exceed $300 from the appropria-
tion in the 1953 Budget ^General Town, Miscellaneous
Recreation!', and
FURTHER RESOLVED that this equipment be placed at
the disposal of the Soft Ball Leagues of the Village
of Larchmont and Village of Mamaroneck.
The Clerk presented a Certificate of Appointment of Election In-
spectors for the election year beginning July 15, 1953, signed by
Supervisor Owen A. Mandeville on July 3, 1953, in accordance with
the recommendation of the Chairmen of the two major political
parties.
The Town Clerk presented a list of polling places for the purpose
of designating a place in each election district of the Town in
which a meeting for the registration of voters, election and pri-
maries, shall be held in the year following the ensuing lst day
of October.
On motion by Councilman McKeever, seconded by Councilman Embury,
it was unanimously
RESOLVED that, in accordance with the provisions of
Section 66 of the Election Law, being Chapter 17 of
the Consolidated Laws of the State of New York as
amended, the Town Board of the Town of Mamaroneck
hereby designates a place for each election district
in the Town at which a meeting for the registration
of voters, election and primaries, shall be held in
the year following the ensuing lst day of October,
as follows:

The Clerk submitted the Report of the State Commission of Correc-
tion, approving the Town Lockup, dated May 5, 1953.
For the record, the Clerk submitted affidavit of publication and
posting of notice of amendment to Area District Map which is part
of the Zoning Ordinance of the Town of Mamaroneck as amended, so as
to show the following described property in Use, Area, and Height
District AA (Residence) :
ALL that plot or area bounded on the North by the
Town of Scarsdale-Town of Mamaroneck boundary line;
on the East by Weaver Street; on the South by the
southerly boundary line of lands acouired by the
Westchester County Park Commission for the Cross
County Parkway; and on the West by the Town of
Mamaroreck-City of New Rochelle boundary line.
Councilman McKeever had nothing to report for his departments.
Councilman Embury reported that he had received a letter from Mr.
Rufus K. Allerton, Jr., g Leafy Lane, stating that the paving of
Leafy Lane is completed and is a very fine job.
Councilman McKeever said that Mr. L . J. Venerose, 10 Leafy Lane,
is also very much pleased with the paving.
The Supervisor stated that this road had been built by private
contract at a lower cost than would have been possible had the
Town done the job.
The Supervisor requested a resolution appointing Patrolman Mazza,
who has served this three-month probationary period, to permanent
status as a Patrolman in the Town of Mamaroneck Police Department.
Upon motion by Councilman Embury, seconded by Councilman Kane, it
was unanimously
RESOLVED that Vincent Mazza, Jr., whose period of
probationary service terminated on July 16, 1953,
be and he hereby is appointed as permanent Patrol-
man at an annual salary of $3,600 effective
July 16, 1953 .
The Supervisor requested a resolution authorizing an increase in
salary for Patrolmen Eugene Agnessanto and John Infelsh and Fire
Truck Driver Nicholas Soriano.
Upon motion by Councilman Embury, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the annual compensation of Eugene
Agnessanto, Police Patrolman, be and it hereby is
fixed at $$+,200, effective September 1, 1953, and
that of John Welsh, Police Patrolman, be and it
hereby is fixed at $4, 200, effective September 1,
1953, in accordance with the regular increment
schedule allowed.
FURTHER RESOLVED that the annual compenstion
of Nicholas Soriano, Fire Truck Driver, be and
it hereby is fixed at $3, 510, effective August
1, 1953, in accordance with the regular increment
schedule allowed.
A letter from Village Manager Johnson, dated July 15, 1953, was sub-
mitted, stating that Mrs. Winifred Taylor had returned to work at
the Health Center, after a leave of absence, and had been returned
to the payroll as of July 1st, with an annual salary (from the
Village$ of $1,930.
On motion by Councilman Waterman, seconded by Councilman McKeever,
it was unanimously
RESOLVED that Winifred 0 . Taylor be and she hereby
is re-appointed Public Health Nurse (P . T .) for the
Town of Mamaroneck at an annual salary of $1,930,
effective July 1, 1953, funds for which are provided
in the 1953 Budget.
The Supervisor requested a resolution authorizing the acceptance of
$294.24 from the Village of Mamaroneck as its share of the proceeds
of sale of Block 902 Parcel 487 and authorization to cancel 1952
and prior years? taxes in the amount of $387.06.
On motion by Councilman McKeever, seconded by Councilman Waterman,
the following resolution was, upon roll call, unanimously adopted:
WHEREAS, the Village of Mamaroneck heretofore has sold the
premises known as Block 902 Parcel 487 which were acquired by the
Village in its foreclosure proceeding in rem; and
WHEREAS, this Board heretofore approved the sale of said
premises by the Village for the sum of $575 by resolution adopted
November 5, 1952; and

WHEREAS, a computation has been made of the division of the
proceeds of said sale showing the Town to be entitled to $294.24
NOW, THEREFORE, BE IT
RESOLVED that the Supervisor is hereby authorized
to accept as the Town' s share of the proceeds of
sale of -remises mown as Block 902 Parcel 487

(Village No. - Section 9, Block 9, Lot 3) to
Bernard uericia the sum of $294.24
- FURTHER RESOLVED that the tax on above premises
for 1952 and prior years in the amount of $387.06
be and it hereby is cancelled and that the
Receiver of Taxes is hereby directed to mark
his records accordingly.

The Supervisor reauested a resolution transferring $106.02 from
Surplus of Sewer District to Capital Fund on account of the Feni-
more Road Pumping Plant.

On motion by Councilman McKeever, seconded by Councilman Ernbury,
the following resolution was, upon roll call, unanimously adopted:
WHEREAS, the Town heretofore has appropriated, either from
budget or sale of certificate of indebtedness, the sma of $61,000
for construction of a sewer pumping plant and force main in Fenimore
Road, which funds are a charge against Sewer District No. 1 in the
Town of Mamaroneck: and
WHEREAS, it now appears that the total cost of completing such
project is $61,106.02
NOW, THEREFORE, BE IT
RESOLVED that there is hereby transferred $106.02 from
Surplus now in the Sewer District Budget, to the Capital
Fund for the purpose of paying for the construction of
the sewer pumping plant and force main.
The Supervisor requested a resolution authorizing the Receiver of
Taxes to accept payment of School taxes in two installments .
Upon motion made by Councilman Embury, seconded by Councilman
McKeever, it was unanimously
RESOLVED that, pursuant to Section 96A of Chapter
62 of the Laws of 1909 as amended, the Town Board
of the Town of Mamaroneck does hereby authorize
and empower the Receiver of Taxes of the Town of
Mamaroneck, to collect the 1953 School taxes for
Union Free School District No. 1 in the Town of
Mamaroneck and School District No. 2, Town of
Scarsdale, New York, which, under the provisions of
the Westchester County Tax Law, being Article 16
of the Westchester County Administrative Code, become
a lien and are payable on September lst, 1953, in two
partial payments, each amounting to fifty per cent
(50%) of any such school tax as levied.
FURTHER RESOLVED that the Receiver of Taxes of the
Town of Mamaroneck is authorized and empowered to
receive the payment of such partial payments or in-
stalments of the 1953 School taxes for Union Free
School District No. 1 in the Tom of Mamaroneck,
and School District No. 2, Town of Scarsdale, New
York, at any time, but subject to the same penalties
as are specified and provided in Section 5/+2 of the
Westchester County Administrative Code, for neglect
to pay the total amount of the School taxes after
the levy thereof.
FURTHER RESOLVED that the acceptance of any such
partial or instalment payment of the 1953 School taxes
for Union Free School District No. 1 in the Town of
Mamaroneck, and School District No. 2, Town of Scars-
dale, New York, shall not be deemed to affect, in any
manner, any right of the Town of Mamaroneck under any
general or special act, to enforce collection of the
unpaid balances of such taxes as may remain due and
owing to said Town, but such rights and powers shall
remain in full force and effect to enforce collection of
the unpaid balance of such school taxes, together with
interest, penalties and other lawful charges.

On motion made by Councilman Embury, seconded by Councilman
McKeever, it was unanimously
RESOLVED that this Board hereby designates "The Daily
Times" , a daily newspaper published in the Village
and Town of Mamaroneck, for the purpose of publish-
ing the notice of the collection of the 1953 School
taxes as required by law; and be it
FURTHER RESOLVED that,in accordance with the provisions
of Section 550 of the Westchester County Administrative
Code, the Town Board do and hereby does direct the Re-
ceiver of Taxes and Assessments, to mail to each taxpayer
of the Town of -Mamaroneck, whose address is known to said
Receiver of Taxes and Assessments, a, tax_ bill for 1953
School taxes, the expense thereof to be a Town charge.
The Supervisor requested a resolution setting a date for the next
public auction of the Town-o-vmmed property.
On motion by Councilman Kane, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the date for the next public auction
of Town-owned property be and it hereby is set for
September 1, 1953, at 8 P. M. , in the Court Room at
Police Headquarters, 11 Edgewood Avenue, Town of
Mamaroneck.
The Supervisor submitted a claim from Close, McCarthy & Gaynor for
services rendered in connection with 65 Palmer Avenue, involving
attendance at two meetings and a legal opinion by Judge Close.
On motion by Councilman Embury, seconded by Councilman Yaterr.-an,
it was, upon roll call, unanimously
RESOLVED that the Supervisor is authorized to retain
the Honorable Frederick P . Close as Special Counsel for
the Town of Mamaroneck in connection with the petition
of various property owners in Howell Park and other
portions of the Town for the re-zoning of premises on
Palmer Avenue known as 65 Palmer Avenue and also Down
as Block 401 Parcel 1, owned by Douglas Smith.
FURTHER RESOLVED that there is hereby appropriated the
sum of $500 for the purpose of paying the fee or com-
pensation of Close, McCarthy & Gaynor, Esgs. , in this
matter.
There being no further business to come before the meeting, it ad-
journed at 9: 55 P . M. and immediately reconvened as the Board of
Fire Commissioners .
Mr. Waterman submitted the Fire Inspectorts Report for June, 1953,
together with the Fire Report for July, 1953, and also the claims
of the Fire Department which had been approved by the Fire Chief
and audited by the Comptroller. On motion by Councilman Waterman,
seconded by Councilman Embury, it was unanimously
RESOLVED that the following described claims be and
they hereby are approved and that the Supervisor and
Comptroller be and they hereby are authorized to pay
the same out of the budget for the Fire Department:
