MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO-
NECK, HELD JULY 1, 1953, IN THE AUDITORIUM OF THE WEAVER STREET FIRE
HOUSE, TOWN OF MAMARONECK.
PRESENT: Supervisor Mandeville
Councilmen Waterman and McKeever
ABSENT: Councilmen Embury and Kane
Presence was also noted of Mr. Gronberg, Town Clerk, and Mr. Delius,
Town Attorney.

called the meeting The Supervisor c g to order at 8: 15 P . M.
Mr. Walter E. Warner, Jr. , 3 Briar Close, spoke on behalf of himself
and some 30 other homeowners in the so-called Bonnia Way, Briar
Close, Sackett Circle and Althea Lane area of the Town. He said
they are petitioning this Board to change and re-zone the area
from the "A" Residence which it now is, to "AA14 Residence. He
filed a petition containing 3 names to be added to those previously
submitted.
The Clerk submitted affidavit of publication of notice of the
hearing on this matter and an affidavit of mailing of notice of
the meeting to the Westchester County Park Commission.
There was no opposition to this change of zoning.
On motion made by Councilman Waterman, seconded by Councilman
McKeever, it was unanimously
RESOLVED that the amended Area District Map which
is a part of the Zoning Ordinance of the Town of
Mamaroneck as amended is hereby amended and cor-
rected so as to show the following described
property in Use, Area and Height District AA
(Residence) :
ALL that plot or area bounded on the north
by the Town of Scarsdale-Town of Mamaroneck
boundary line; on the east by Weaver Street;

the southerly boundary on the south by y line
of lands acquired by the Westchester County j
Park Commission for the Cross County Park-
way; and on the west by the Town of Mamaroneck-
City of New Rochelle boundary line.
A map showing the boundaries of the area re-
zoned and included in the Use, Area and Height
District AA (Residence) is hereto attached.

FURTHER RESOLVED that the Town Clerk is hereby
authorized and directed to post and publish a
notice of the adoption of this resolution as
required by Section 267 of the Town Law.
Mr. Charles G . Williams appeared and the Supervisor read a letter,
dated July 1, 1953, from Mr. Williams advising that he wishes to
dedicate to the Town of Mamaroneck, a new street known as South
Ridge Road, which he recently developed in Larchmont Ridge, Sec-
tion W. in the Town of Mamaroneck, in which he has installed all
facilities such as sewer, water and gas and which street he has
completed to the Town' s specifications with Bituminous Macadam
surface.
The Town Attorney presented a map and description of this street
and suggested that the Town accept the same, subject to a title
search showing the necessary parties to a deed or release.
Upon motion by Councilman McKeever, seconded by Councilman Waterman,
the following resolution was, upon roll call, unanimously adopted:
RESOLVED that the Town hereby accepts the street
known as South Ridge Road, which is bounded and
described as follows:
ALL that lot, plot or parcel of rand lying, being and situate
in the Town of Mamaroneck, Westchester County, New York, known by
and as South Ridge Road, as shown on a map entitled "Map of Larch-
mont Ridge, Section W'1, made by A. J . Foote, Civil Engineer, Juiy
23, 1952, and filed in the County Clerk' s Office, July 28, 1952,
as Map No. 7778, said lot, plot or parcel being more particularly
bounded and described as follows:
BEGINNING at a point in the southerly line of Mohegan Road as
shown on "Map of Larchmont Ridge, Portion of Section No. 5" as
made by H. G. Johnston, March 12, 1933, and filed in the County
Clerk' s Office, March 16, 1933, as Map No. 3942, which point is
S. 460 141 11" W. 144.25 feet as measured along the southerly line
of Mohegan Road from a point of curve with a radius of 25 .00 feet

FURTHER RESOLVED that the Town Attorney is hereby
authorized to make the necessary searches and obtain
a deed or release from parties shown to have any
interest in the land lying in this street.
Mr. Bernard. Lancia, 829 Halstead Avenue, Mamaroneck, appeared in
connection with his request for the usual contract with the Town L
and the Water Company after installation of water main in Lancia
Lane.
This was referred to Mr. Delius for recommendation at the next
meeting.
Mr. Harold Hamilton appeared before the Board and the Clerk read
a letter dated June 19, 1953, from John M. Derwin, Commander of
Larchmont Post 347, American Legion, addressed to the Town Board,
advising that at a regular meeting of Larchmont Post 3475 Ameri-
can Legion, held on Tuesday evening, June 15, 1953, a motion was
regularly made, seconded, and carried, that a letter be sent to the
Town Board of the Town of Mamaroneck, asking for reconsideration
of the discharge of Robert Hamilton.
The Supervisor announced that the Board would not act on this
matter during the present meeting.
The Clerk submitted an affidavit of publication of a notice of
public hearing, pursuant to Section 130 of the Town Law, for the
purpose of considering certain amendments to the General Ordinances
of the Town of Mamaroneck, to be held at the Weaver Street Fire
House, corner of Weaver Street and Edgewood Avenue, in the Town of
Mamaroneck, on July 1, 1953, at 8: 15 P. M.

After recommendation by Mr. Delius, on motion by Councilman
McKeever, seconded by Councilman Waterman, it was, upon roll call,
unanimously
RESOLVED:
(1) That Chapter IV (PEACE AND GOOD ORDER) , Section 1,
be amended to read as follows:
Section 1 - Firearms, etc. . It shall be unlawful for any
person to, at any time, fire, discharge, or cause to be fired,
or discharged, any gun, cannon, rifle, air rifle, pistol,
or firearm of any kind, or sling-shot. This section shall
not apply to peace officers in the discharge of their offi-
cial duties nor to persons using fire-arms in necessary
self-defense and in a careful manner, nor to bona fide gun
clubs, shooting galleries and to persons using fire-arms
in a careful manner in said shooting galleries.
(2) That Chapter IV (PEACE hND GOOD ORDER) , Section S,
be amended to read as follows:
Section 8 - Radios, Amplifiers, Television Sets, etc. :
No person shall locate radios, television sets or similar
devices or amplifiers thereof so as to, or that may project
sound into highways or neighborhoods for advertising or
business purposes; and no person owning, occupying, or having
__- charge of any building or premises,or any pert thereof, in
the Town of Mamaroneck, shall cause, suffer, or allow any
loud, excessive or unusual noise in the operation or use of
any radio, phonograph, television set or other mechanical
or electrical or reproducing device, instrument, or machine,
which loud, excessive and unusual noise shall disturb the
comfort, peace, and quiet of persons in the vicinity.

(
(3) That Chapter ter OPENING OF STREETS OR HIGHWAYS,

ETC.) , S ection 1, be amended to read as follows:
Section 1 - No person or corporation shall have the right
to make any opening in any street or highway, including
any sidewalk or curb and all such openings in streets,
sidewalks, or curbs, must be made under the supervision
of the Superintendent of Highways and by employees working
under him, except as hereinafter provided.
(¢) That Chapter VI (OPEN IQG OF STREETS OR HIGHWAYS,
ETC.) , Section 9, be repealed and a new Section 9 be
adopted to read as follows:
Section 9. - No vehicle shall be driven across any side-
walk or curb except at graded crossings in existence and such
as may be hereafter constructed,without a temporary permit
from the Superintendent of Highways. The applicant for such
a permit shall deposit with the Superintendent of Highways,
such sum as is considered by the Superintendent of Highways
sufficient to indemnify the Town of Mamaroneck against any
damage to the sidewalk or curb but not less than $100.00.
(5) That Chapter VIII (PEDDLERS AND HAWKERS) , Section 1,
as last amended May 3, 1939: is hereby amended to read as
follows:
Section 1 - No person shall barter, sell, peddle, hawk, or
vend goods, wares, merchandise, or produce, or services of
an established business,upon the streets, roads, highways,
or .public places of the Town, or by going from house to house
soliciting purchases, unless a license so to do has pre-
viously been obtained by him from the Town Clerk. The
applicant for such license shall register his name and
address with the Chief of Police as a condition for obtain-
ing such license.
(6) That Chapter VIII (PEDDLERS AND HAWKERS) , Section 4.
as last amended May 3, 1939, is hereby amended to read as
follows:
Section 4 - Where a vehicle has been licensed as provided
in Section 2 of this Chapter, such license shall include
the right of a driver or operator of such vehicle to sell,
peddle, hawk, or vend the goods, wares and merchandise
carried in such vehicle, provided, however, that no person,
including the owner of such licensed vehicle, shall operate
the same without a personal permit to be issued by the Chief
of Police, upon the production of satisfactory proof of the
fitness of the applicant therefor,or a
and such permit shall ex-
pire on the 31st day of December after the issuance thereof,
unless sooner revoked. Nothing herein contained shall be
construed to permit any salesman or helper upon any vehicle
for which a peddlerts or hawker' s license has been obtained,
to peddle, hawk, or vend the goods, wares or merchandise,
carried in such vehicle, by means of any stand or box_, or
otherwise than from the vehicleitself, unless a peddler' s
or hawker' s license has been separately obtained for each
such salesman or helper, in accordance with the provisions
of Section 1 of this Chapter.

(7) That Chapter II (USE OF STREETS, HIGHWAYS, ETC.) as
amended, is hereby repealed and a new Chapter II adopted
which will read as follows:
CHAPTER II
Use of Streets, Highways, Etc.
Section 1 - The Police Commission of the Town of Mamaroneck
is hereby designated, pursuant to Section 86 of the Vehicle
- - and Traffic Law of the State of New York, to adopt regula-
tions establishing safety zones, parking spaces and bus,
cab, and taxi stands on public streets or highways of the Town
of Mamaroneck outside the Villages of Larchmont and Mamaro-
neck and not including State highways maintained by the
State of New York in the Town of Mamaroneck. The Police
Commission of the Town of Mamaroneck is authorized to limit
or prohibit parking in spaces and zones in such public
streets or highways provided such zones, spaces and stands,
except spaces in front of private driveways, shall be
marked and indicated by suitable signs to be erected and

shall be construed as superseding or conflicting with
Section J+40 of the Penal Law of the State of New York.
Section 2 - The Police Commission of the Town of Mamaroneck
is hereby authorized, pursuant to Section 90 of the Vehicle
and Traffic Law, to designate highways in the Town of Mamaro-
neck, outside the Villages of Larchmont and Mamaroneck, on
*which vehicles shall proceed in one direction only, or from
which heavy trucks shall be excluded, provided that highways, so
designated, shall be so marked at all intersections by con-
spicuous signs which shall be visible during the hours in
which such designation is to be observed. No State Highway
shall be thus designated without the approval of the State
Traffic Commission. Such designation shall not be construed
to prevent deliveries of merchandise or other property
along such highways.
Section 3 - The Police Commission of the Town of Mamaroneck
is authorized, pursuant to Section 90 of the Vehicle and
Traffic Law, to adopt regulations establishing a system of
truck routes and providing that all trucks having a total
combined gross weight of vehicle plus load in excess of five
tons, shall be excluded from all streets of the Town outside
he Villages of Larchmont and Mamaroneck except from

those streets which form a part of the system of truck routes
and upon which, trucks are permitted to travel and operate.
Such exclusions shall not be construed to prevent delivery
of merchandise or other property along the streets from

which such trucks maintained
are excluded. No State Highway
by the State shall be designated as part of such system of
truck routes nor shall any such trucks be excluded from
any such highway maintained by the State, without the
approval of the State Traffic Commission. All
streets form-
ing a part of such truck route system shall be marked by
signs which shall comply with the provisions of Section 90,
subdivision 1-A of the Vehicle and Traffic Law of the State
of New York and which sign shall be erected and maintained
by the Police Department. Any system of truck routes shall
provide suitable connection with all State routes entering
and leaving the Town.

Section 4 - The Police Commission of the Town of Mamaro-
neck is authorized, pursuant to Section 90 of the Vehicle
and Traffic Law,to adopt regulations for the crossing by
pedestrians of public highways in the Town of Mamaroneck
outside of the Villages of Larchmont and Mamaroneck but
with respect to State Highways maintained by the State of
New York, such regulations shall be subject to the control
- of the State Traffic Commission.
Section 5 - The Police Commission of the Town of Mamaroneck
is authorized, pursuant to Section 90 of the Vehicle and
Traffic Law, to adopt regulations providing for the removal
and storage of vehicles parked or abandoned on public
highways of the Town of Mamaroneck, outside of the Villages
of Larchmont and Mamaroneck a during snow storms, floods,
fires or other public emergencies, and for the payment of
reasonable charges for such removal or storage, by the
owner or operator of any such vehicle, but with respect to
State Highways, maintained by the State of New York, such
regulations shall be subject to the control of the State
Traffic Commission.
Section 6, - The following public highways in the Town of
outside of the Villages of Larchmont nt and Mamaro-
neck are hereby designated as main arteries of travel pur-
suant to Section 90 of the Vehicle and Traffic Law, and all
vehicles approaching said highways shall, before entering
same, come to a full stop unless otherwise directed by a
peace officer or signal. Signs shall be erected and main-
tained by the Police Department as required by Section 90
of the Vehicle and Traffic Law.

Section 7 - The following regulations regarding limitation
of parking in congested areas in the Town of Mamaroneck out-
side of the Villages of Larchmont and Mamaroneck, are hereby
established:
AREA SURROUNDING THE NEW HAVEN RAILROAD STATION
AT LARCHMONT
1 - Myrtle Boulevard
(a) On the South side - 156 feet West of North Chats-
worth Avenue, parking must be with front wheels to curb
and limited to one hour from g A. M. to 6 P . M. , ex-
cept Sundays and holidays.
(b) Between Murray Avenue and Vine Street - No park-
ing on either side.

(c) No parking on the North side from Vine Street
to Taylor Place.
(d) On the South side between Baldwin Avenue and
Preston Street, parking limited to 1 hour between
8 A. M. and 1 P . M. , except Saturdays, Sundays, and
holidays.
(e) No parking between Vine Street and Madison
— Avenue between 2 A . M. and 6 A. M.
2 - Baldwin Street
(a) No parking on either side
3 - North Chatsworth Avenue
(a) on West side, between Myrtle Boulevard and New
Haven Railroad Bridge, all parking with rear wheels
to curb and limited to 30 minutes from 6 A. M. to
S P . M. , except Sundays and holidays.
(b) On East side from Myrtle Avenue to Jefferson
Street, parking limited to 1 hour from 8 A. M. to
11 A. M. , except Saturdays, Sundays, and holidays.
(c) On West side, no parking within 50 feet of
Garfield Street in either northerly or southerly
direction.
(d) No parking between the Railroad Bridge and
Garfield Street between 2 A. M. and 6 A. M.
Murray Avenue
(a) No parking from Myrtle Boulevard to County
Parkway Bridge on East side.
(b) On West side, from Edgewood Avenue to Myrtle
Avenue parking is limited to 1 hour from 8 A. M.
to 11 A. M. , except Saturdays, Sundays, and
holidays.
(c) No parking between Myrtle Boulevard and

(a) On Cabot Road, parking is limited to 1 hour
from 8 A. M. to 1 P . M., except Saturdays,

Section 8 - Bicycles: No person over 10 years of
age shall ride a bicycle on the sidewalks of any street
and no person shall operate a bicycle on the public
streets of the Town of Mamaroneck outside of the Villages
of Larchmont and Mamaroneck, except in compliance with
the General Municipal Law and the Vehicle and Traffic
Law of the State of New York.
Section 9 - Trucks: Every vehicle used to trans-
port dirt, manure, sand, gravel, ashes, mud, garbage,
swill, offal, etc. in the public streets of the Town
of Mamaroneck outside of the Villages of Larchmont
and Mamaroneck, shall be so constructed or loaded as
to prevent any portion of the contents from escaping
therefrom. No vehicle used to transport dirt or soil
shall be operated or driven so as to permit dirt or
mud to adhere to the wheels and be deposited in the
public streets of the Town of Mamaroneck outside of
the Villages of Larchmont and Mamaroneck.
Section 10 - Coasting: No person shall coast with
hand sleds, bob sleds, carts or other vehicles on
wheels or runners upon any sidewalk.
Section 11 - Crosswalk: No vehicles or animal or
pushcart, baby carriage or other device moved by
human power shall stop or stay on any crosswalk or
driveway.
Section 12 - Parades: All parades in the streets of the
Town of Mamaroneck outside of the Villages of Larchmont
and Mamaroneck, and the playing of bands of music and ex-
hibitions of any kind in said streets are prohibited, with-
out a written permit from the Town Board.
(8) That Chapter XI (FINES AND PENALTIES) ,
as last amended November 5, 19411 is hereby
amended to read as follows:
Section 1 - Violation of any of the foregoing
ordinances shall be a misdemeanor and punishable by
imprisonment for not more than one year or by a fine
of not more than $500. for each offense, or both.
Section 2 - Violation of these Ordinances shall sub-
ject the offender, for each offense, to a civil penalty
not to exceed the following amounts respectively:

The penalties for violations as above provided shall
be in addition to any fine provided for in the pre-
ceding section.
Every day or part thereof that such violation shall
continue shall be deemed to be a separate and dis-
tinct violation of the said several provisions of
these Ordinances and shall render every person liable
for a separate penalty for each such violation.
The Clerk submitted a letter from Mr. Louis Zingesser, 434 Mamaro-
neck Avenue, relating to the application of Elin LocXwood Hansen
for a dance hall license (Terrace Lounge) , which letter requested
adjournment of consideration of this matter until the next meet-
ing of the Board, in August.
The letter was received and filed, and the adjournment granted.
The Clerk submitted a letter dated June 29, 1953, addressed to the
Town Board, from Mr. F . D. Gironda, 11 Cabot Road, Larchmont, sug-
gesting that a public beach be constructed in the Hommocks area.
The Clerk was instructed to acknowledge this letter with thanks.

of Chief Yerick for attendance at the New York State Association of
Police Chiefs' Convention in Syracuse, N. Y., on July 20, 21, 22

Yerick for attendance at the International Police Chiefs' Confer-
ence to be held at Detroit, Michigan, September 13, 141 15, 16, and
17.

exceeding $75 be paid out of the item in the Budget
appropriated for the same.
FURTHER RESOLVED that Chief Paul A. Yerick be and he
hereby is authorized to attend the International
Police Chiefs? Conference to be held at Detroit,
Michigan on September 13, 14, 15, 16, and 17, and
that expenses not exceeding $175 be paid out of the
item in the Budget appropriated for the same.
The Clerk read a letter, dated June 4, 1953, addressed to the
Town Council by the Republican Club of Mamaroneck and Larchmont,
Inc . , containing certain recommendations relating to recreation,
parking, and signs.
The letter was received with thanks and filed.

- At this point the Supervisor introduced Judge Frederick P . Close
who submitted and read his opinion in the Matter of the Applica-
tion for the Re-zoning of 65 Palmer Avenue in the Town of Mamaro-
neck and at the same time, the Supervisor announced there would be
no decision made by the Board at this meeting.
At the conclusion of the reading, Judge Close answered questions
put to him by various attorneys who were present.
Mr. Frank O?Donnell submitted certain recommendations made by the
Larcbmont Civic Association. These were received and filed.
Mr. Harold Hamilton was told to appear at the next meeting at
which it was expected there would be a full Board present.

The Supervisor explained that the Town Board has no jurisdiction
This is entirely over the Police Department. T �s Y a matter for the
Police Commission. The Clerk was instructed to notify Mr. Leon
of the date of the next meeting of the Board of Police Commis-
sioners.
The minutes of June 3rd were approved as presented.
Councilman McKeever submitted the name of Mr. Frank F . Herz, 1308
Crown Court, Mamaroneck, to be appointed as Constable for the
Town of Mamaroneck.

On motion by Councilman McKeever, seconded by Councilman Waterman,
it was, upon roll call, unanimously
RESOLVED that Frank F. Herz be and he hereby is
appointed constable, to serve for the term be-
ginning July 1, 1953 and ending December 31,
1953, without salary.
FURTHER RESOLVED that the appointed constable,
Frank F. Herz, file a bond in the sum of
-- $2,500 for the faithful performance of his
duties, said bond to be for six months and
approved by the Town Attorney, and the pre-
mium for the same to be paid out of Town funds.
Councilman McKeever presented the following petitions received
from the Assessor for the correction of the assessment roll so as
to permit the apportionment of taxes, and on motion by Councilman
McKeever, seconded by Councilman Waterman, the following resolution
was unanimously adopted:
WHEREAS, the Assessor has presented petitions for the cor-
rection of the Assessment Roll for certain years, pursuant to the
provisions of Section 557, Article 16 of the Westchester County
Administrative Code, known as the Westchester County Tax Law; and
WHEREAS, after due consideration, this Board finds it desira-
ble to grant said petitions for the correction of said assessment
roll,

The Supervisor submitted two letters dated June 2nd and June 26th,
1953, respectively, from Mr. George H. Straub, Superintendent of the
Water Company, estimating the cost of the extension of a water main
in Blossom Terrace for houses now on that street and additional
houses which are planned for construction. The estimates call for
125 feet of transite pipe and 288 feet of cast iron pipe respectively
at a cost of $648.19.
On motion by Councilman McKeever, seconded by Councilman Waterman,
it was, upon roll call, unanimously
RESOLVED that the Westchester Joint Water Works,
No. 1 be and it hereby is authorized to extend the
main in the street known as Blossom Terrace, for
a distance of 413 lineal feet east from Merritt
Street, at a cost of $648.19 which sum is hereby
appropriated from Surplus and is to be included in
the 1954 budget.
The Supervisor requested a resolution authorizing increases in
salary for Patrolmen Winkler and McClintock.
On motion by Councilman McKeever, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the annual compensation of Richard
Winckler be and it hereby is fixed at $4,500,
effective as of June 15, 1953, and that the
annual compensation of David McClintock be and it
hereby is fixed at $4,500, effective as of July 11,
1953, in accordance with the regular increment
schedule allowed.

The Supervisor requested a resolution authorizing the transfer of
$5,477.85 from Surplus to be carried in next yearts Budget for con-
struction of sidewalk on Weaver Street, and on motion by Councilman
McKeever, seconded by Councilman Waterman, the following resolution
was, upon roll call, unanimously adopted:
WHEREAS, heretofore, in connection with the Weaver Street
Sidewalk Improvement in the Weaver Street Sidewalk District, estab-
lished by the Town Board of the Town of Mamaroneck in accordance with
-- the provisions of §250 et seq of Chapter 63 of the Laws of 1909 as
amended, proceedings were taken by the Town Board to acquire property
and construct sidewalks along Weaver Street from Palmer Avenue to
Forest Avenue; and
WHEREAS, the Weaver Street Sidewalk District, as established
by §250 et seq of the old Town Law, was dissolved by Chapter 804
of the Laws of 1945, which Chapter, nevertheless, provided that
all sidewalks and sidewalk property become the property of the Town
by reason of which the Town became liable for the care and main-
tenance of such sidewalks; and
WHEREAS, this Board, heretofore and on November 19, 1952, by
resolution then adopted, authorized the acquisition of certain pro-
perty on the east side of Weaver Street between Garden Road and
Heather Lane, consisting of two portions or strips, one being part
of Block 217 Parcel 117 on the Assessment Map of the Town of
Mamaroneck, owned by Jean R. Higgins for $1,250, and the other, part
of Block 217 Parcel 134 on the Assessment Map, owned by Bernard L.
Miller and Hilda Miller (formerly Samuel L. Mass) for $1,650; and
WHEREAS, this Board heretofore and on April 15, 1953, confirmed
the acquisition of the property required for the construction and
maintenance of sidewalk,and appropriated the sum of $35000 which
was the estimate, including incidental expenses for title search,
release of mortgage, etc. ; and
WHEREAS, it now appears that the total cost of acquisition of
the property is $2,978.30 and the cost of labor and materials for
constructing the sidewalk, removing trees, erecting fence and re-
taining wall, etc. is $2,499 .55, or a total of $5,477.85,
NOW, THEREFORE, BE IT
RESOLVED that there is hereby appropriated from Sur-
plus the sum of $5,477.85 for the acquisition of
property and the construction of a sidewalk on the
easterly side of Weaver Street between Heather
Lane and Garden Road.
FURTHER RESOLVED that this resolution supersedes
the resolution adopted April 15, 1953, insofar as
the amount appropriated for this purpose is con-
,
cerned.
Mr. Delius presented a memorandum which he had prepared re 1953
legislation and suggested that copies be sent to the various
interested Department Heads.
There being no further business to come before the meeting, it
adjourned at 10: 05 P . M. to meet again on August 5th, and imme-
diately reconvened as the Board of Fire Commissioners.

Councilman Waterman presented the Fire Department claims which
had been audited by the Comptroller and approved by the Fire
Chief and on motion by Councilman Waterman, seconded by Council-
man McKeever, it was unanimously
