HomeMy WebLinkAbout1953_03_18 Town Board Minutes 07 MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO- NECK, HELD MARCH 18, 1953, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMAR0NECK. The Supervisor called the meeting to order at 8: 15 P . M. PRESENT: Supervisor Mandeville Councilmen Embury, Kane, Waterman, and McKeever ABSENT: None Presence was also noted of Mr. Gronberg, Town Clerk, Mr. Delius, Town Attorney, and Mr. ^?Brien, Superintendent of Highways. At the request of the Supervisor, the Clerk read an Order of the Town Board calling a public hearing in relation to the creation of the proposed extension to Sewer District No. 1 in the Town of Mamaro- neck, to be held March 18, 1953, at 8: 15 P . M. , in the Council Room of the Weaver Street Fire House, Weaver Street and Edgewood Avenue in the Town of Mamaroneck, and reported that a certified copy of said Order had been duly published and posted as required by law. The Supervisor thereupon declared the hearing open and asked if there were any persons present who desired to be heard in connection with the proposed extension of Sewer District No. 1 as requested in the Petition filed in the office of the Town Clerk on February 18, 1953 • There being no persons who desired to be heard, the Supervisor de- clared the hearing closed. Councilman McKeever intr2duced the following resolution: RESOLVED by the Town Board of the Town of Mamaroneck, County of Westchester, State of New York, as follows: Section 1. The following Order and Determination is hereby adopted and approved and when signed by members of this Board present at this meeting, constituting a majority of the entire Board, the same shall constitute a.n 05,der and Determination of this Board: STATE OF NEW YORK COUNTY OF WESTCHEST'ER TOWN OF M.LMTARONIECK IN THE MATTER of the proposed Extension of Sewer District No. 1 A ORDER AND of the Town of Mamaroneck, County X DETERMINATION of Westchester, State of New York Xri%Tn nY.-ri icXC TCXX v v ,r r n rt n XX ri'n n n n n ri iCX ri o,n L WHEREAS, on the 18th day of February, 1953, a petition, together with a map and plan, was filed in the office of the Town Clerk of the Town of Mamaroneck, purporting to be signed by the - requisite number of property owners as required by Article 12 of the Town Law, petitioning the Town Board of said Town to create an exten- sion designated as Section ??K?' to Sewer District No. 1 of the Town of Mamaroneck and the construction of a sewer system therein; and 209 WHEREAS, the said Town Board on the 18th day of February, 1953, adopted an Order and caused the same to be entered in the minutes of its proceedings, reciting in general terms the filing of said petition, the boundaries of the proposed extension, the improve- rents and services proposed a-nd the estimated expenses thereof, and specifying the 18th day of March, 1953, at 8: 15 P . M. , in the Council Room of the Weaver Street Fire House, Weaver Street and Edgewood Avenue in the Town of Mamaroneck, as the time when and the place where said Board would meet to consider said petition, and hear all persons interested in the subject matter thereof and concerning the same; and WHEREAS, said Town Board caused a copy of said Order, certified by the Town Clerk, to be published and posted according to laws and WHEREAS, said hearing was duly held at the time and place so fixed in said Order; and WHEREAS, the said Town Board has caused a copy of the aforesaid i Map and Plan to be submitted to the State Department of Health; and WHEREAS. said Map and Plan was approved by the State Department of Health and, as so approved, was duly filed in the office of the State Department of Health and in the office of the Town Clerk of the Town of Mamaroneck NOW, THEREFORE, IT IS HEREBY ORDERED A11D DETER14IKED as follows: ( 1) The petition referred to in the recitals hereof is signed and acknowledged or proved as required by law, and is otherwise sufficient. (2) All the property, property owners and interested persons *within said Sewer District Extension will be benefitted by the construction of the proposed extension and all the property and property owners who will be benefitted by said construction are included in said extension. (3) It is in the public interest to grant the relief --- sought by the petition referred to in the recitals hereof and the relief sought by said petition shall be granted. �z 4. An extension. to Sewer District No. 1, designated as Section "K" is hereby created and established in the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of Article 12 of the Town Law of the State of New York as amended, said Extension to include the lands and premises described in said petition and shown on a map entitled "General Plan of Sewers for Proposed Section 4K' in an Extension of Sewer District No . 1 in the Town of Mamaroneck, Westchester County, New York, made by Sal Spinelli, Licensed Surveyor, Mamaroneck, N. Y ." , which map is attached to the petition and filed in the office of the Town Clerk of the Town of Mamaroneck. The lands and premises included in said Extension hereby granted and established are more particularly bounded and described as follows: BEGINNING at a point, being the northeast corner of lands now or formerly of H . Kennedy, 610 feet to the point or place of beginning . 5 A sewer system shall be constructed in said exten- sion substantially in accordance with the map and Plan prepared by Sal Spinelli, Civil Engineer, and approved by the State Department of Health of the State of New York on November 7, 1952, and filed in the office of the State Department of Health and thereafter filed in the Office of the Town Clerk of the Town of Mamaroneck on December 26, 1952, but all such construction shall be without cost or expense to the Town of Marra roneck and shall be paid by the owners and/or developers of the property to be added to the Sewer District. Section 2. A signed or certified copy of said Order and. Determination shall be duly recorded in the Office of the Clerk of the County of Westchester as provided by Section 195 of the Town Law. Section 3. This resolution shall take effect immediately. The Town Clerk presented affidavit of publication in the Daily Times on March 5, 1953, of the following notice: PUBLIC NOTICE PLEASE TAKE NOTICE that the Town Board of the Town of Mamaroneck will hold a public hearing at 8: 15 P . M. , on-March 18, 1953 in the Council Room of the Weaver Street Fire House on Weaver Street in the Town_ of Mamaroneck, for the purpose of considering an amendment to Article II, Section 7 of the Zoning Ordinance of the Town of Mamaro- neck, correcting a typographical error appearing in the amendments to this section made by resolutions adopted July 22, 1946 and June 4, 1947 with respect to the provision for garages in Class B and B-2 Residential Districts so that this -.rovision shall read as follows: A garage for more than three motor vehicles may be permitted in a Class B and B-2 Residential District for the exclusive use of the occupants of an apartment house if erected on the same lot or plot of land with such apartment house building, upon the consent of the Board of Appeals. TAKE FURTriER NOTICE that all persons interested will have an opportunity to be heard at the above stated time and place. 15 On motion by Councilman McKeever, seconded by Councilman Embur-y, it was, upon roll call, unanimously RESOLVED that the third unnumbered paragraph of Sec- tion 7 of Article II of the Zoning Ordinance of the Town of Mamaroneck as amended by resolution adopted June 4, 19475 is hereby amended so as to read as f ollo-YTS I - A garage for more than three motor vehicles may be permitted in a Class B and B-2 residential district for the exclusive use of the occupants of an apartment house if erected on the same lot or plot of land with such apartment house building, upon the consent of the Board of Appeals. The minutes of February 4th and February 18th were approved as submitted. The Clerk submitted and read a letter, dated March 6, 1953, from Mrs. James M. Ryan, 11 Overlook Terrace, requesting that a. light be located on a oole near her home . She said there is some distance between lights and as the dark stretch is on a turn, she believes it is very dangerous. She went on to say that she understands from neighbors that one of the lights nearest her home was recently removed as the pole interferred with neighbors getting in and out of their car. This was referred to the Superintendent of Highways for report at the next meeting. The Clerk submitted and read a letter, dated March 11, 1953, from Charles F . Kane. The Supervisor moved that the letter be acknowledged with thanks and made part of the minutes of this meeting as follows: 21 Oak Avenue Larchmont, ?,S. Y. March 11, 1953 Honorable Members of the Town Board Gentlemen: My sister and brothers join me in expressing to you our heartfelt appreciation for your beautiful tribute to our mother. We were deeply moved by your public act of respect to her. The resolution that you adopted was a fitting and beautiful eulogy, and we shall treasure it. Mom would have been very embarrassed if she ever received such acclaim in life, as would any other mother, as she led a very simple life and lived for her family. She was jus- tifiably proud of her family whose upbringing reflected her loving care and affection. She had a full life with its haTpiness and heartaches, and we thank God that He spared her suffering and permitted her to raise her family. We know that she was ready to meet her Maker at her ordained --- time and, though we will miss her terribly, we are resigned to Gods s Will. It is appalling, though heartwarming, to realize how wonderful our friends and neighbors were in our hour of sorrow. I 17 it In paying such a beautiful tribute to our mother, we feel that you were also praising all other women in our commu- nity who are also mothers in the true sense of the word. Again may I convey to you our prayerful thanks for your humble and sincere expression of admiration that she so -- truly deserved. Respectfully, Charles F. Kane /s The Clerk submitted a letter, dated March 16, 1953, from Mrs. John P . Gilgut, 51-01 39th Avenue, Long Island City, New York; another. , dated March 16, 1953, from Mrs. George A. Greenberg, Rock Ridge, Mamaroneck, N. Y. ; and a third, dated March 16, 1953, from Tishman Realty & Con- struction Co. , Inc. , 445 Park Avenue, New York 22, N. Y., all reques- ting extension of the water line along Old White Plains Road. These letters were turned over to the Superintendent of Highways with a request that he bring in a recommendation and cost prices at the next meeting. The Clerk submitted and read a letter, dated March 13, 1953, from Walter L. Roe, 584 Weaver 'Street, complaining about property damage caused by the overflow of the Sheldrake River. The letter was re- ceived and filed. For the Record, the Clerk submitted an affidavit of publication of the Supervisor' s report. On motion by Councilman McKeever, seconded by Councilman Kane, ''it was, upon roll call, unanimously RESOLVED that Bond No. 5341733A, in the amount of $12050 of the National Surety Corporation, is approved as to form and the Supervisor is hereby authorized to execute the same and file it pursuant to law. Councilman Kane stated that, as a resident of this community for many years and as a taxpayer as well as a Councilman, he believes public tribute should be paid to the Chamber of Commerce of Mamaroneck and the Mamaroneck Ministers? Association for the suggestion of prayer cards in the restaurants in this community. He also suggested that the School Board should give further thought to the introduction of prayer in the public schools. The Supervisor announced that he thinks these gentlemen have brought great dignity to our Village and Town by the introduction of prayer cards in the restaurants. 219 On motion by Councilman Kane, seconded by Councilman Embury, it was unanimously RESOLVED that this Board do and hereby does pay public tribute to the Chamber of Commerce of Mamaro- neck and the Mamaroneck Ministers' Association for the suggestion of prayer cards in the restaurants of this community. -- Councilman Embury submitted a letter from Mr. C . J. Quinn, Secretary of the Board of Police Commissioners, enclosing bids on motor cycles for the Police Department as follows: John H. Tracey Sales Co. , Inc. , Yonkers $2,996.70 Reggie Pink, Inc ., White Plains 2,885 .60 The Police Commission recommends acceptance of the low bid. Also enclosed were bids for 2 items of stationery as follows: The Star Press, Mamaroneck $ 124.50 The Larchmont Print, Larchmont 130.00 Printcraft, Mamaroneck 111.00 The Police Commission recommends acceptance of the low bid. On motion by Councilman Embury, seconded by Councilman Waterman, it was unanimously RESOLVED that the Police Department is hereby authorized to purchase 2 Harley-Davidson motor cycles from Reggie Pink, Inc. , White Plains, N. Y. , in an amount not to exceed $2,885 .60, and 10,000 Daily Report Sheets and 500 Motor Vehicle Accident Report Sheets from Printcraft, Mamaroneck, in an amount not to exceed $111. , from the sum provided for these items in the 1953 budget of the Police Department. The Supervisor submitted a recommendation from Chief Yerick in connection with bids for 3 new cars for the Police Department (less the turn-in value allowed for 3 Ford cars) as follows: Flinn Motor Corp. Fords $3,068.44 Luby Chevrolet Company, Inc. Chevrolets 2,023.10 Bose & Parker Motors Corp. Dodges 31301.55 Bose & Parker Motors Corp. Dodges 3, 595.55 Chulew Motor Sales Pontiacs 41213 .47 The Supervisor said that Chief Yerick recommends the purchase of 2 Fords and 1 Chevrolet in order that a comparison may be made of the efficiency, durability and cost of maintenance of these two cars. On motion by Councilman Embury, seconded by Councilman Waterman, it was unanimously RESOLVED that the Police Department be and it hereby is authorized to purchase from Flinn Motor Corp. , 2 1953 Ford Customline Tudors, for a total price not to exceed $4,023.96. FURTHER RESOLVED that the Police Department be and it hereby is authorized to surrender to the above named vendor,l - 1952 Ford, Engine No. B2EG105593 and 1 - 1951 Ford, Engine No. BIEG107462 for $2,350 as part payment for the above. 221 FURTHER RESOLVED that the Police Department be and it hereby is authorized to purchase from Luby Chevrolet Company, Inc. , 1 - 1953 Chevrolet 2-door Sedan, for a total price not to exceed $2,078.60. FURTHER RESOLVED that the Police Department be and it hereby is authorized to surrender to the above named vendor, 1 - 1950 Ford, Engine No. BOEG154878 for $600 as part payment for the above. The Supervisor requested a resolution authorizing an increase in salary for Patrolman James O 'Brien. On motion by Councilman Embury, seconded by Councilman Kane, it was unanimously RESOLVED that the annual compensation of James OPBrien, Patrolman, be and it hereby is fixed at $4,500, effective as of April 1, 1953, in accordance with the regular in- crement schedule allowed. Supervisor Mandeville requested a resolution approving collection of taxes by the Receiver of Taxes of the 1953 State, County, and Town taxes in 2 instalments. On motion by Councilman McKeever, seconded by Councilman Waterman, it was unanimously RESOLVED that, pursuant to Section 96A of Chapter 60 of the Consolidated Laws as amended, known as the Tax Law, the Receiver of Taxes and Assessments of the Town of Mamaroneck is authorized to collect the 1953 State, County, Town and District taxes and water rents which become a lien January 1, 1953, in two partial payments, each amounting to fifty per cent of the total of said taxes and water rents. FURTHER RESOLVED that the Receiver of Taxes and Assess- ments is authorized and empowered to receive such partial payments or instalments of taxes and water rents at any time prior to the sale of tax liens but subject to the same penalties as are specified and provided in Section 542 of the Westchester County Administrative Code for the neglect to pay the total amount of said taxes and water rents . FURTHER RESOLVED that the acceptance of any such partial payments or instalments of the 1953 taxes and water rents, shall not be deemed to affect in any manner, any right of the Town of Mamaroneck, under any general or special law, to enforce collection of any unpaid balance of such taxes and water rents as may remain due and owing to the Town of Mamaroneck, but such rights and powers shall remain in full force and effect to enforce the collection of the unpaid balances of such taxes and water rents together with interest, penalties and other lawful charges. On motion by Councilman McKeever, seconded by Councilman Waterman, --- it was unanimously RESOLVED that, in accordance with the provisions of Section 0 of the Westchester Count Administrative 55 Y Code, "The Daily Times", the official newspaper pub- lished in the Village and Town of Mamaroneck, be and it hereby is designated as the newspaper in which the Receiver of Taxes and Assessments shall publish the notice of the collection of State, County, Town and District taxes and water rents; and be it 223 FURTHER RESOLVED that said publication be made on March 19, 1953, in the Daily Times; and be it FURTHER RESOLVED that in accordance with the provi- sions of Section 550 of the Westchester County Admin- istrative Code, the Town Board do and it hereby does direct the Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is known to said Receiver of Taxes and Assess- ments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. FURTHER RESOLVED that, pursuant to Section 551 of the Westchester County Administrative Code, the Town Board hereby approves the official form of tax receipt used by the Receiver of Taxes in the year 1953 for taxes for the year 1953. The Supervisor went on to talk about the members of the School Board who have given their time willingly and unselfishly in studying the matter of the centralization of schools. He said, however, that, since this Board is charged with the duty of collect- ing these taxes and they must be paid_ to the School Board whether they are collected or not, he would recommend to the Board that some thought be given to this, so that a resolution may be adopted at the next meeting with a thought or view to employing some engin- eering firm or actuarial firm to make a survey of this matter. This survey should be made and widely publicized before any petition is circularized. This will be considered at the next meeting . Councilman McKeever said he had followed this matter of consolida- tion and is somewhat disturbed about it as he has not been able to learn anything about it. He would go along whole-heartedly -- with the idea of a survey. At the next meeting the Supervisor will submit the names of firms qualified to make this survey. Councilman McKeever presented the following petitions received from the Assessor for the correction of the Assessment roll so as to permit the apportionment of taxes, and on motion by Councilman McKeever, seconded by Councilman Embury, the following resolution was, upon roll call, unanimously adopted: WHEREAS, the Assessor has presented petitions for the cor- rection of the Assessment Roll for certain years, pursuant to the provisions of Section 557, Article 16 of the Westchester County Administrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desira- ble to grant said petitions for the correction of said assessment roll, NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1952, taxes of 1953, which shows property now appearing on the roll as follows: Block Parcel Name Land only 30L 1 George R. W. Cook, Jr. 6,300 Councilman McKeever said the pump station on Fenimore Road is close to completion. Mr. Delius stated that Mr. J. K. Priestly, President of Hubbell Con- struction Corporation, requests the issuance of a new deed for property which he purchased from the Town 'known as Block 107, Par- cel. 602. He states that the name, as given to the Town Attorney at the time of the issuance of the original deed, is incorrect insofar as it was given as t'Hubbell Construction Company, Inc." , instead of "Hubbell Construction Corporation", which is the correct name. Mr. Delius recommended the approval of the issuance of a new deed, provided Mr. Priestly pays the cost of recording, etc. The Town Board gave approval to this procedure. Mr. Erwin Oster, representing Split Tree Realty Co., appeared and displayed a sketch of their development. He requested that the Town top-grade Murdock Road and Split Tree Road, after suitable preparation of the roads by his Company, to meet the approval of the Superintendent of Highways. This was referred to Councilman McKeever and the Superintendent of Highways for report at the next meeting. On motion by Councilman Kane, seconded by Councilman Waterman, it was unanimously RESOLVED that C. Benjamin Brush, Jr. be and he hereby is reappointed a member of the Board of Zoning Appeals of the Town of Mamaroneck for a five-year term, expiring February 19, 1958. The Supervisor called on Mr. Joseph Johnston to introduce Mr. Justine Glickson who stated that he is General Counsel and Vice President of Shapiro Construction Company which is proposing to build 105 garden type apartments at 65 Palmer Avenue. Mr. Glickson gave a brief his- tory of the Company and then introduced Mr. Milton Kleban who, he said, had designed the building and layout in all its physical as- pects and was present and ready to answer any questions . Mr. Kleban exhibited a drawing of the proposed building. The Supervisor announced that this was not a public hearing . The members of the Board, he said, are merely trying to learn the inten- tions of the contractor who plans to purchase the property in question. T'No action will be taken tonight", he said. J 233 Mr. Kleban also showed plans for the basement garage, which garage will be entered from Woodland Avenue. Mr. Kleban said the building will be set back 15 feet from the front property line, 25 feet from each side line and approximately 40 feet from the side (west) property line which abuts the Colony Apartment, at the rear. Mr. David F. Hummel, part owner of the Colony suggested: Pitched roof Set-back in line with the Colony Off-street parking Mr. Kleban said the rentals will be $40 to $45 per room per month. There will be a master television system. Mr. William G. Ball, Jr., 19 Concord Avenue, asked about the sewer. Councilman McKeever does not believe this apartment will necessitate a new sewer. Mr. Ball asked concerning the assessed value of the property. The Supervisor said this might mean the employment of an expert to work with the Assessor as was done in the case of Knotty Knolls. The Supervisor stated that the proposed new building code in Larch- wont seems to be for multiple buildings and in the Town there are only 2 plots where that type of building can be erected. Councilman Waterman presented the fire report for February and the Fire Inspectoras report for February.
