MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO-
NECK, HELD JANUARY 7, 1953, IN THE COUNCIL ROOM OF THE WEAVER STREET
FIRE HOUSE, TOWN OF MAPIARO>_ECK.
Supervisor Mandeville called the meeting to order at 8: 15 P . M.

Town Clerk; Mr. Finson, Town Accountant; and Mr. O'Brien, Superintendent

Happy New Near to the Board _members and others present. He said. he is
very grateful for the cooperation he has received and looks forward
to a continuation of the same happy relationship . He then said the
Board would dispense with its regular order of business to hear those
present.
Mr. Joseph S . Johnston, an attorney, residing at 17 Bonnett Avenue,
Town, appeared and presented a petition on behalf of Henry J . Dietz
and his wife, Marie L . Dietz, owners of premises known on the Tax Map
as Block 410 Parcels 473 and 463, requesting that the Town Board ex-
tend the present Class "C" zoning which now applies to the first One
Hundred (100) feet fronting on the Boston Post Road of the above
premises, so that the entire parcel may be included in Class "C" Busi-
ness Gone of the Town of Mamaroneck, and to take such action as may be
necessary legally to so extend the said Class "C" Zone to all of
petitioners' said property. Mr. Johnston stated that Mr. and Mrs .
Dietz wish to sell the property to persons who contemplate erecting
stores for the First National Company. The stores will be built 150
feet back from the street line to allow for parking space. The build-
ing will be a one-story shopping center . Pictures of the proposed
buildin g were shown to the members of the Board.

RESOLVED that the Clerk be and he hereby is authorized
to publish a notice of public hearing, pursuant to

PLEASE TAKE NOTICE that a public hearing will be held by the Town
Board of the Town of Mamaroneck, pursuant to Section 264 of the Town
Law in the Council Room of the Weaver Street Fire House at the corner
of Weaver Street and Edgewood Avenue in the Town of MayQroneck, on
January 212 1953, at 8: 15 o' clock P . M. , to consider amendments to the
provisions of the zoning Ordinance of the Town of Mamaroneck by
changing the map accompanying and forming part of said Ordinance, which
amendments and change to the map are as follows:
To re-zone the shaded portion of the property shown on
the accompanying map or dia.graaj 100 feet north of the
Boston Post Road and which runs from the street called
Ferndale Street, as shown on a. certain map of the Herbert

Land Company, Subdivision A, filec. in the �Re g ister' s
Office (now County Clerk' s Office) on May 28, 1892 as
Map No. 821, to the property of the Veterans of Foreign
Wars and which is also known as parts of Parcels 463 and 473
and all of Parcel 556, Block 410 on the Tax Assessment Map
of the Town of Mamaroneck.

TAKE FURTHER TJOTICE that all persons interested will be given
an opportunity to be heard at the above stated time and place .
The Town Clerk submitted affidavit of publication of notice of pub-
lic hearing to be held at this meeting, for the purpose of consider-
ing amendments to the General Ordinances of the Town of Mamaroneck,
as follows:
(a) Amending Chapter III, LICENSES; FEES, REGULATIONS (taxicabs)
(b) Amending Chapter Imo`:, DANCE HALLS AND DANCES (Permits)
(c) Amending Chapter V, ANIMALS (licenses)
Mr. Edward Leon, of Leon' s Taxi Service, 181 Myrtle Boulevard, appeared
to vigorously protest an amendment making it mandatory to post his
taxicab driver' s license in such a place as to be in full view of all
passengers while such driver is operating a taxicab.
The Clerk stated there are 16 licensed cabs in the Totem, 3 of which
are operated by Mr. Leon.
Chief Yerick appeared and, after stating that this amendment is merely
. a precautionary measure for the safety and protection of the tax-
payers, went on record as recommending the adoption of this amendment
to the General Ordinances.
Mr. Embury asked about taxicab rates, as he said he has many times
been asked if there is any control or set rule for taxicab charges .
It seems this is a matter which is .controlled and settled by the taxi-
cab operators among themselves.
Mr. Waterman asked about the investigation made of the men who apply
for licenses and was assured that the Police Department conducts such
an investigation.
The amendment to the provisions of Chapter Ix, DANCE HALLS AND DANCES,
was taken up next, and Mr. Delius said he would recommend this as
being a necessary amendment.
No one appeared in connection with this.
Mr. Delius explained the amendment to Chapter V , ANI�rALS, and no one
appeared.
The Clerk presented and read a letter, dated December 20, 1952, from
Mr. Julian Bers, thanking the Board for its action in connection with
denial of the application for permission to erect garden type apart-
ments on premises knoti+n as Block 133, Parcels 242, 229, 214, 256, 209,
204, 264, 267, 199, 269, 186, 274, and 179 •
The Clerk was instructed to acknowledge this with thanks.
The Clerk presented and read a letter dated January 5, 1953, from Mr .
William J . Vey, thanking the Board for having a street light installed
on Murray Avenue.
The Clerk was instructed to acknowledge this with thanks.
The Clerk presented and read a letter, dated December 15, 1952, from
Mr . Sam Paonessa, thanking the Board for having a street light in-
stalled in front of his home on Old White Plains Road, opposite the
Winged Foot Golf Club.
The Clerk was instructed to acknowledge this with thanks .

The Clerk presented and read a letter, dated December 31, 19522
from Mr. Carl J . Noe, Deputy Commissioner of the Board of Elections
of Westchester County, stating that certain districts in the Town as
indicated, exceed 950 registrants permitted by Section 64 of the
Election Law, and requiring, pursuant to the provisions of Section 64
of the Election Law,, that these be altered, consolidated, divided,
or new districts created, so that none of the election_ districts in
the Town will exceed 950 registered voters.
The Supervisor said he had considered this matter, which has been
before the Board before, and he would like to defer this action for
at least another year. There was no particular crowding at the recent
Presidential election.
The letter was received and filed.
- The Town Clerk presented a letter, dated December 31, 1952, from the
Association of Towns of the State of New York, giving notice that the
Annual Meeting of the Association of Towns will be held at the Hotel
Statler, New York City, beginning at 9:45 A. M. Wednesday, February
4th, and ending at noon on Friday, February 6th, 1953.
The letter also requested designation of delegates and alternates.
On motion by Councilman Kane, seconded by Councilman Waterman, it
was unanimously
RESOLVED that John L. Delius, Thomas J. McKeever,
Alexander F inson and Francis J . OTBrien be and they
hereby are authorized to attend the Annual Meeting
of the Association of Towns of the State of New York,
to be held at the Hotel Statler, New York City, be-
ginning at 9:45 A. M. Wednesday, February 4th2 and
ending at noon on Friday, February 6th, 1953.
FURTHER RESOLVED that John L. Delius is designated
representative of the Town of Mamaroneck for the
purpose of voting and Alexander Finson is desig-
nated as alternate.
FURTHER RESOLVED that the Comptroller be and he hereby
is authorized to audit their claims for expenses of the
trip, said expenses to be paid out of the item in the
budget for traveling expenses.

For the record, the Clerk presented the application of David Potts, Jr.
Post 1156, V. F. W. for a dance hall license.

On motion by Councilman McKeever, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the application of David Potts Jr. Post
1156, V. F. W. for a dance hall license for the year
1953, be and it hereby is approved and the Town Clerk
- is hereby directed to issue the same.
The Clerk presented affidavit of publication of Notice of Request
for Bids for 1 - 1947 Ford Pick Up Truck, Engine No. 1765047,
together with the following bids for the truck:

Chatsworth Furniture Studio 205.00
Chulew Motor Sales 235.00
The Supervisor said, in view of the fact that the bids received for
the truck were so low, he would recommend that it be retained by
the Town, and with this Mr. O'Brien agreed, as he said he would be
able to find occasional use for the truck.
On motion by Councilman Kane, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the bids received for 1 - 1947
Ford Pick Up Truck, Engine No. 1765047, be
and they hereby are rejected.
For the record, the Town Clerk submitted affidavit of publication of
Notice of Examination for master plumbers held on December 20, 1952.
The Clerk submitted proof of publication and posting of the resolution
adopting the Budget so far as it concerns the appropriation for
$2, 500 for the Shade Tree Fund which was adopted subject to permis-
sive referendum.
Councilman Embury reported that, after the last meeting of the Board,
he had again reviewed, with Chief Yerick and Mr. C . J. Quinn, the
bids submitted at that meeting and on motion by Councilman Embury,
seconded by Councilman Kane, it was unanimously
RESOLVED that the bid of Brooks Uniform
Company, in the amount of $463.50 for
the following:

1 Motorcycle overcoat
1 pair Lieutenantts trousers
2 It Sergeantrs trousers

1 " Motorcycle breeches
be and it hereby is accepted, provided that
the material used be in accordance with
understanding with Mr. Budd Lytton.
FURTHER RESOLVED that the Police Department
be and it hereby is authorized to purchase
— from Margoluis Sons, Inc. , Mamaroneck, 3 suits
at $55 each, one for Chief Yerick, one for
Detective-Sergeant Smith and one for
Detective Paonessa.
Mr. Embury next presented a letter, dated January 2, 1953, from Chief
Yerick, giving the names of the 4 patrolmen who handled the incident
of the Hutchings hold-up at Larchmont Gables on December 25th.

On motion by Councilman Embury, seconded by Councilman Waterman,
it was unanimously
RESOLVED that Patrolmen James J . O'Brien, John Rowan,
James Knox and George Mulcahy be and they hereby are
commended for promptness and efficiency in the
handling of a dangerous situation, i.e. a hold-up
which occurred at Larchmont Gables Apartments on
December 28, 1952, and the Clerk is hereby
authorized to write to each of these men and
so inform them.
The Highway Agreement for the year 1953 was presented and, on motion
by Councilman McKeever, seconded by Councilman Embury, it was, upon
roll call, unanimously
RESOLVED that the Highway Agreement as presented
by the Superintendent of Highways for the year
1953, be and it hereby is approved.
Councilman Embury presented a letter received from Mr. C . deWitt
Rogers, Chatsworth Gardens Apartments, requesting that some action
be taken to prevent noise caused by the slapping of a rope against
the flagpole located in the Station Park. Mr. Embury said he would
take this matter up with the Park Commission.
Councilman' Kane had nothing to report.
Councilman McKeever had nothing to report.
__- The Supervisor submitted an offer to purchase in connection with
Town-owned property and on motion by Councilman McKeever, seconded
by Councilman Kane, it was unanimously
RESOLVED that the date for the next public auction
of Town-owned property be and it hereby is set for
January 21, 1953, at 8 P. P¢. , in the Council Room
of the Weaver Street Fire House.
The Supervisor presented his Annual Report of Highway moneys for
the year 1952. On motion by Councilman McKeever, seconded by Council-
man Embury, it was, upon roll call, unanimously
RESOLVED that the Supervisor' s Annual Report of
Highway moneys for the year 1952, be and it hereby
is approved.
Supervisor Mandeville suggested that the Board proceed with the mat-
ters of organization.
On motion by Councilman Embury, seconded by Councilman McKeever,
it was unanimously
RESOLVED that the salaries of all elected officials
and appointed Town officers of the Town of Mamaro-
neck for the year 1953 are to be the salaries stated
and appropriated in the annual Budget or Estimate
for the year 1953 as follows:

it was unanimously
RESOLVED that the following positions shown in the
Budget or Estimate, are hereby continued and the annual
compensation for the same in the year 1953 is hereby fixed
and shall be paid from the amounts appropriated in the
annual Estimate or Budget for the year 1953, or so much
thereof as shall be sufficient to pay such annual com-

FURTHER RESOLVED that the employment of the last named
persons in the aforesaid positions, is in accordance
with the classifications made by the County Personnel
Officer, under the provisions of the Civil Service Law
of the State and any vacancies which now exist or which
may, from time to time, occur in said positions, are to
be filled at salaries set in accordance with the pro-
visions of the salary scale adopted by the Town Board
and in conformity with the Civil Service Rules and
amendments thereto, for towns, villages and special

RESOLVED that the following persons are hereby appointed
to positions classified as exempt under the Civil Ser-
vice Law, such appointments to be made as of January 1,
1953 and to continue at the pleasure of the Town Board,
at the annual salary or rate of compensation hereinafter
stated, which is to be paid from amounts appropriated
in the annual Budget or Estimate for the year 1953, or
so much thereof as shall be sufficient to pay the salary
or compensation as hereby fixed:

On motion by Councilman Kane, seconded by Councilman Embury, it was
unanimously
RESOLVED that the salaries of all officers, elected and
appointed, and all employees, be paid semi-monthly on
the first and fifteenth days of each month.
On motion by Councilman Embury, seconded by Councilman Waterman, it
was unanimously
RESOLVED that the compensation for part time employees
is as follows:

On motion by Councilman Embury, seconded by Councilman McKeever,
it was unanimously
RESOLVED that, in accordance with a rer,uest received from
Henry R. Dillon, Receiver of Taxes, this Board hereby
approves of his appointment of Leo N. Orsino, Senior
Accounty Clerk, as Deputy Receiver of Taxes, and his
designation of Alexander Finson, Accountant, as a person
authorized to receive tax money, give proper receipt
therefor in his name, enter such payments upon the records
and deposit tax money in the bank for the year ending
December 31, 1953•

Town Clerks, in accordance with his certificate, dated
December 30th, 1952, and this day presented to the Board,
is hereby approved.
On motion by Councilman McKeever, seconded by Councilman Kane, it
was unanimously
RESOLVED that the regular meetings of this Board be held
on the first and third Wednesdays of each month at 8:15 P . M. ,
in the Council Room of the Weaver Street Fire House.

The Board unanimously approved the foregoing appointments.
On motion by Councilman Kane, seconded by Councilman Embury, it
was unanimously
RESOLVED that the "Daily Times" of Mamaroneck, be and
- it hereby is designated as the official newspaper of
the Town of Mamaroneck for the purpose of publishing
notices.
On motion by Councilman Embury, seconded by Councilman Waterman, it
was unanimously
RESOLVED that the firm of Glick-Freedman, Certified
Public Accountants of New Rochelle, New York, be and
it hereby is appointed to audit the records of the
Town for the year 1952.
FURTHER RESOLVED that the compensation for this
service be in the amount of $2,000.
On motion by Councilman Embury, seconded by Councilman McKeever, it
was unanimously
RESOLVED that the following be and they hereby
are appointed constables to serve for the term
beginning January 1, 1953 and ending December
31, 1953, without salary:
Rocco V. Migliaccio, 243 Knollwood Avenue, Mamaroneck, N. Y.
Thomas Faillace, 601 Mamaroneck Avenue, Mamaroneck, N. Y.
FURTHER RESOLVED that the appointed constables,
Rocco V. Migliaccio and Thomas Faillace, each
file a bond in the sum of $2,500 for the faith-
ful performance of their duties, said bond to be
for one year and approved by the Town Attorney;
and the premium for same to be paid out of
Town funds.
On motion by Councilman Kane, seconded by Councilman Embury, it was
unanimously
RESOLVED that the following be and they hereby are
re-appointed as members of the Board of Police
Commissioners of the Town of Mamaroneck, New York,
to serve at the pleasure of the Town Board

On motion by Councilman Kane, seconded by Councilman McKeever, it
was, (Councilman Embury not voting) unanimously
RESOLVED that Town Councilman, David A. Embury,
be and he hereby is appointed as a member of the
Board of Trustees of the Police Pension Fund for
the term beginning January 1, 1953 and ending
December 31, 1953
On motion by Councilman Embury, seconded by Councilman McKeever, it
was unanimously
RESOLVED that Julian Cargill be and he hereby is
re-appointed a member of the Board of Park Com-
missioners of Park District No. 1 of the Town of
Mamaroneck, New York, to serve for the term be-
ginning January 1, 1953 and expiring December

FURTHER RESOLVED that all withdrawals from the

The Supervisor submitted the renewal of the contract between the
Town of Mamaroneck and the Westchester County Dog Protective
Association, Inc., for the year 1953.
-- On motion by Councilman McKeever, seconded by Councilman Embury, it
was unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the contract between the Town
of Mamaroneck and the Westchester County Dog Pro-
tective Association, Inc ., for the year 1953, for
the sum of $ 1,500 as provided for in the 1953 Budget.

The Supervisor presented the renewal of contract between the Town
of Mamaroneck, the Village of Larchmont, and the Larchmont Public
Library.
On motion by Councilman Kane, seconded by Councilman Embury, it

RESOLVED that the Supervisor be and he hereby is
authorized to sign the contract between the Town
of Mamaroneck, the Village of Larchmont, and the
Larchmont Public Library, in the sum of $15,050
for the year 1953, which amount is provided for
in the 1953 Budget.

FURTHER RESOLVED that this resolution shall
take effect as of January 1, 1953 .
A claim in the amount of $119, representing the annual membership
dues of the Town for the year 1953, in the Association of Towns of
the State of New York, was submitted for approval.
On motion by Councilman Embury, seconded by Councilman McKeever, it
was, upon roll call, unanimously
RESOLVED that the Town of Mamaroneck continue its
membership in the Association of Towns of the State
of New York for the year 1953, and that the annual
dues in the amount of $119 be paid out of the item
set aside for this purpose in the 1953 Budget.

After discussion, and upon recommendation by Mr. Delius, upon
motion by Councilman Embury, seconded by Councilman Waterman, the
following resolution was, upon roll call, unanimously adopted:
WHEREAS, Frank De Luca, the owner of premises known as Block
609 Parcel 39, has submitted proof by affidavit that a certain
tax lien, purchased by Bonded Municipal Corporation, covering said
Block 609 Parcel 39, has been lost and cannot, with due diligence
be found, together with a satisfaction of said lien, signed and
executed by Bonded Municipal Corporation, and an indeminty agree-
ment pursuant to provisions of the Westchester County Administra-
tive Code, Chapter 852 of the Laws of 1948, Section 582,
NOW, THEREFORE, BE IT
RESOLVED that duplicate lien covering premises
known as Block 609 Parcel 39 -on the Tax Assess-
ment Map of the Town of Mamaroneck, sold to Bonded
Municipal Corporation on June 19, 1935, in the
amount of $83.24, for State, County, Town and
School taxes for the year 1934, may be issued to
Bonded Municipal Corporation, pursuant to pro-
visions of the Westchester County Administrative
Code, Chapter 852 of the Laws of 1948, Section
582, in order that this duplicate lien. may be
surrendered to the Receiver of Taxes, together
with a satisfaction, so that the same may be
cancelled of record.

The Town Attorney stated that a letter had been received from Mr.
Andrew Wilson, Jr., requesting the Town Board to accept a deed to
premises known as Block 407 Parcel 82, which is a piece of property
originally purchased from the Town by Mr. Wilson for the Elkan
Park Association. Since the purchase of this property from the
Town, portions of it have been sold to various owners but the re-
maining portion is no longer usable for the purposes of the Associa-
tion_ As it adjoins the Town Yard, Mr. Wilson desires to re-convey
it to the Town in lieu of payment of taxes .
Upon motion by Councilman Embury, seconded by Councilman McKeever,
it was, upon roll call, unanimously
RESOLVED that the Town accept a deed from Andrew
Wilson, Jr. , for property known as Block 407 Par-
cel 82 on the Tax Assessment Map of the Town, and
the Town Attorney is hereby instructed to prepare
the necessary papers and record the deed.
The Town Attorney reported on the matter of the Weaver Street side-
walk and stated that it had been impossible to reach any agreement
with Bernard Miller who is not willing to transfer to the Town,
the portion of his property necessary to construct a sidewalk at
the intersection of Weaver Street and Heather Lane, as shown on
the map which had been furnished to Mr. Miller with an offer.
The Town Attorney was instructed to write to Mr. Miller, stating
that the Town Board will not consider the matter further but in-
sists that this property, as shown on the map, be acquired for
sidewalk purposes.
After some discussion, upon motion by Mr. Embury, seconded by Mr.
McKeever, it was unanimously

RESOLVED that the Town Board of the Town of Mamaro-
neck hereby adopts the following amendments to the
General Ordinance of the Town of Mamaroneck, ori-
ginally adopted February 17,1937:
(A) Chapter III - LICENSES, FEES, REGULATIONS, Section 6,
as last amended May 3, 1939, is hereby amended to read as
follows:
-- Section 6. Operator' s Permit.
(1) No person shall operate a taxicab for hire upon the
streets of the Town of Mamaroneck, outside of incorporated
villages unless the driver has first obtained a taxicab driver' s
license.
(2) Applications for such taxicab driver' s license shall
be filed with the Town Clerk on forms provided by him and such
application shall be verified under oath and contain the follow-
ing information:
(a) The names and addresses of four (4) residents
of the Town of Mamaroneck who have known the appli-
cant for a period of five (5) years and who will
vouch for the sobriety, honesty and general good
character of the applicant;
(b) The experience of the applicant in the transpor-
tation of passengers;
( c) A history of his employment;
(d) A statement as to whether or not applicant
has ever been convicted of any felony or mis-
demeanor.
(3) The Police Department shall conduct an investigation
of each applicant for a taxicab driver' s license and a report
of such investigation and a - copy of the traffic and police record
of the applicant, if any, shall be attached to the application for
the consideration of the Town Clerk.
(4) Upon approval of the application for a taxicab driver' s
license, the Town Clerk shall issue a license to the applicant
which shall bear the name, address, color, age, signature, and
photograph of the applicant. Such license shall be in effect for
the remainder of the calendar year and a license for every calendar
year thereafter shall issue to the applicant unless the license for
the preceding year has been revoked.
(5) Every driver licensed, shall post his taxicab driver' s
license in such a place as to be in full view of all passengers
while such driver is operating a taxicab.
(B) Chapter IX - DANCE HALLS AND DANCES, Sections 1, 2, L+,
5, and 11 are hereby amended to read as follows:
Section 1 of said Chapter is hereby amended to
read as follows:
Section 1. The term "public dance" or"public ball",
as used in this Ordinance, shall be taken to mean any
dance or ball to which admission can be had by payment
of a fee, or by the purchase, possession or presenta-
tion of a ticket or token, or in which a charge is
made for caring for clothing or other property;
Or any other puce where dancing is permitted to
which the public generally may gain admission with
or without the payment of a fee, including dancing
in hotels, restaurants and/or places licensed to
sell alcoholic beverages under the provisions of
the Alcoholic Beverage Control Law of the State of

New York. The term "public dance hall" as used in
this Ordinance, shall be taken to mean any room, place or
space in which a public dance or public ball may be
held, and any hall or academy in which classes in dancing
are held or instruction in dancing is given for compen-
sation or hire, including any premises where space for
dancing is provided in connection with the sale of food
and/or drink. The term "private homes" as used in this
Ordinance, shall be taken to mean only such buildings
- as are used exclusively for private dwelling purposes.

Section 2 of said Chapter is hereby amended to
read as follows:
Section 2. No public dance, public ball or classes
in dancing for compensation or hire shall be held
or conducted in any hall or academy within the Town
of Mamaroneck until the hall or room in which the
same is to be held shall first have been duly
licensed for such purpose, pursuant to the provi-
sions of this Ordinance. Such licenses shall be
issued by the Town Clerk as provided in Section 137 of
the Town Law, and posted in a conspicuous place near
the main entrance of the licensed premises and such
license shall expire on the 31st day of December
next following its issuance.
Section 4 of said Chapter is hereby amended to
read as follows:
Section 4. No dance hall or dance license shall be
- issued until it shall be found that the premises
comply with and conform to all regulations for the
protection of public health and safety of buildings
- and for the protection of the public from fire;
that they are properly ventilated and supplied with
sufficient toilet conveniences and that they are a
safe and proper place for the purpose for which
they are used. The Police Department, the Fire
Department, and the Building Inspector shall conduct
an investigation of any application filed with the
Town Clerk and report of such investigation shall
be attached to the application for the consideration
of the Town Clerk.
Section 5 of said Chapter is hereby amended to read
as follows:
Section 5 . The Town Clerk may refuse to issue any
dance or dance hall license for the reasons stated in
Section 137 of the Town Law, and the applicant may
apply to the Town Board of the Town of Mamaroneck
after such refusal, all as provided in Section 137 of the
Town Law, and any license issued pursuant to this Ordinance
may be revoked after a hearing as provided in Section 137
of the Town Law.
Section 11 of said Chapter is hereby amended to
read as follows:
Section 11. No building shall be constructed, re-
modled or altered for dance hall purposes except with
the approval of the Building Inspector and upon proof
that there has been compliance with all laws and regu-
lations of the State of New York, County of Westchester
and the Building Ordinance of the Town of Mamaroneck
applicable to the premises.

(C) Chapter V - ANIMALS, Sections 4 and 5 as last
amended June 6, 1951, are hereby amended to read as follows:
Section 4 of said. Chapter is hereby amended to read
as follows:
Section 4. No unmuzzled dogs shall be allowed upon
the streets, highways and public places in the Town of
Mamaroneck, unless held on a. leash. This section shall
not apply to places, parks, parkways, squares, circles
or concourses set apart and accepted as such and under
the jurisdiction of the Board of Park Commissioners
of Park District No. 1.
Section 5 o said Chapter is hereby amended to read
as follows:
Section 5. Except as provided in Section 4, no
animal except cats or muzzled dogs, and no fowl, shall
be allowed to run at large in the Town of Mamaroneck
except upon the premises of the person who owns, keeps,
harbors, or otherwise has the care or custody of such
animal or fowl, or except upon the premises of another
person with the knowledge and consent of such other person.
There being no further business to come before the meeting, it ad-
journed at 9:45 P. M., to meet again on January 21st, and immediately
re-convened as the Board of Fire Commissioners.
Councilman Waterman submitted a letter from the Chief of the Fire
Department relative to the fire siren at Madison Avenue which has
become corroded and useless. As the Chief considers this an emer-
gency, he would like to purchase a new siren and dispense with the
custom of obtaining informal bids from 3 suppliers.
On motion by Councilman Waterman, seconded by Councilman Kane, it
was unanimously
RESOLVED that the Fire Chief be and he hereby is
authorized to purchase a new siren at a price not
exceeding $235.
Councilman Waterman presented the Fire Department claims which had
been approved by the Fire Chief and audited by the Comptroller,
and on motion by Councilman Waterman, seconded by Councilman
Embury, it was unanimously
RESOLVED that the following described claims be and
they hereby are approved and that the Supervisor and
Comptroller be and they hereby are authorized to pay
the same out of the budget for the Fire Department:
