MINUTES OF k SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF iMAMARO-
NECK, HELD DECEMBER 21 19525 IN THE COUNCIL ROOM OF THE WEAVER STREET
FIRE HOUSE, TOWN OF MAMARONECK.
Supervisor Mandeville called the meeting to order at 8: 15 P . M.

Presence was also noted of Mr. Delius, Town Attorney; Mr. Gronberg,
Town Clerk; and Mr. Finson, Town Accountant.
On motion duly made and seconded, the minutes of October ist, 15th,
November 5th3 12th, and 19th, were approved as presented.
The Clerk presented and read a letter dated December 1st, received
from Mr. Irwin Guttag, 4 Briar Close, requesting the installation of
a street light on that road. The letter was referred to the Superin-
tendent of Highways.
The Clerk presented a letter from Judge Brewer,e , forwarding to the
Adler 11 Althea III
Clerk a letter addressed to the Judge by Mr. Robert D s ,
Lane, complaining in general about the parking situation at the Larch-
mont Railroad Station and suggesting that parking passes be given (by
the ticket agent at the station) to purchasers of commuter tickets
on the New Haven Railroad.
The letter was received and filed.

The Clerk reported that he had, in accordance with instructions from

this Board, contacted the various members of the Board with reference
to the issuance of a permit to Mr. Vincent Marinello, Leafy Lane, to
erect a solid board fence to a height of 7 feet, and all had approved
of the issuance of this permit.
On motion by Councilman Embury, seconded by Councilman Kane, the
following resolution was unanimously adopted:
WHEREAS, Vincent Marinello heretofore requested a permit for the
erection of a solid board fence to be erected in the rear of his
property at No;.. 7 Leafy Lane, Town of Mamaroneck; and
- WHEREAS, the Building Inspector refu sed to g rant such permit on
the ground that the construction or erection of such fence violated
the provisions of Section 1123 Article 21 of the Building Code; and
WHEREAS, Mr. Marinello has appealed to this Board for a modifi-
cation of the ruling of the Building Inspector, pursuant to Section 23,
Article 1 of the Building Code so as to allow the erection of said
fence,

NOW, THEREFORE, BE IT
RESOLVED that permission is hereby granted to Vincent
Marinello to erect a solid board fence to a height not

The Supervisor announced that the regular order of business would be
dispensed with in order to hold the public hearing on the budget.
The Clerk presented the affidavit of publication and affidavit of post-
ing of the "Notice of Public Hearing on the Preliminary Budget of the
Town of Mamaroneck for the Year 1953" •
The Supervisor explained that the 1953 Budget is generally the same as
that of 1952, with the exception of salary increases and increments
which amount to approximately $19,.400. He feels that the personnel of
the Town is able and loyal and these salaries are far below what would

station in Fenimore Road had been made necessary by the demands of
both the County of Westchester and the Village of Mamaroneck because
of the alleged deposit of raw sewage in homes in the Village of
Mamaroneck at times of flood, and this, together with the purchase of
new equipment and the continuation of capital improvements and main-
tenance for the Park Department, accounts for more than the 56 cents
increase contemplated by the budget. In other words, because of the
reduction of debt and savings which have been effected over the past
years, this budget would have been reduced by about 15 cents but for
the inclusion of all expenditures in this budget and the continuance
of the pay-as-you-go plan.
With regard to the Police Department, he stated that there are 11 mem-
bers in the local Pension Fund and 1 are members of the State Retire-
em. Under the local system, pensions are being paid to 7 in-

dividuals totaling approximately X102500 a year. The Fund had secure i
valued at $59,500 and approximately $9,700 in cash at the beginning
of this year. The income from all sources, except budget appropria-
tion, is approximately %61500 and the deficiency is estimated to be
met in part by an appropriation in the Police Department budget, and
the balance from the liquidation of a portion of the securities owned
by the Pension Fund.

Mrs. Elizabeth Morrison, representing the League of Women Voters,
asked if there is any provision in the Budget for fluoridation. The
Supervisor explained that this item (if it appeared at all) would
appear in the budget of the Westchester Joint Water Works.
At the conclusion of the discussion of the Budget, the Supervisor
thanked those who were present for their interest in the public hearing.

the year 1953; and

WHEREAS, notice of the completion and filing of said tax budget
public hearing thereon, has been duly published on
and calling a
November 21st and 28th, 1952, in the Daily Tames, Mamaroneck, and
posted in the manner required by law; and
WHEREAS, a public hearing upon said tax budget was duly held
this day in accordance with the notice so published; and
WHEREAS, all persons present were afforded an opportunity to be
heard; and
WHEREAS, this Board has reviewed the items in said preliminary
tax budget as required by Section 113 of the Town Law,
NOW, THEREFORE, BE IT
RESOLVED that the final estimates, as completed by
the Town Board and filed in the office of the Town
Clerk, be and the same hereby are adopted as the budget
for the year 1953, pursuant to the provisions of the
Town Law, and that said estimates, as so adopted,
be entered in detail in the minutes of the Board
as follows:

RESOLVED that the annual budget estimates of the
expenditures of the Town of Mamaroneck for the fiscal
year 1953, be adopted and confirmed and that the Town

stated are hereby appropriated from the current revenues.,

After being seconded by Councilman Waterman, a vote was taken upon
the foregoing resolution and after roll call, the vote was recorded
as follows:

On motion by Councilman Embury, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the appropriation in the amount of $2,500.
(Shade Tree Fund) appropriated under "Miscellaneous Ex-
ends ,
--- tunes General Town" is subject to a permissive

referendum as provided in Section 64, Paragraph 17 (b)
of the Town Law.
FURTHER RESOLVED that the Town Clerk be and he hereby
is authorized and directed to publish a notice of the
adoption of this resolution subject to permissive
referendum as required by the Town Law.
Councilman Kane submitted a partial list of names of men and women
now serving in the Armed Services, containing about 400 names, and
stated that he would try to have a complete list for the next Board
meeting.
The Supervisor stated that he believes there should be an Honor Roll
erected in the Town containing the names of these men and women.
Councilman Embury had nothing to report for his departments.
Councilman McKeever, reporting on the Grand Street sewer project,
said some difficulty had been encountered with the water main and
they had finally b one under it, makin g it necessary

The Supervisor presented a lease received from the Westchester

Count Park Commission for vacant land located between Baldwin
Y P r
Avenue and Myrtle Boulevard to be used by the Park Department.
Upon motion by Councilman McKeever, seconded by Councilman Waterman)
it was unanimously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the lease with the Westchester
County Park Commission which provides for the further
extension of lease dated February 13, 1945, covering
the use of several parcels of vacant land situate on
Chester Parkway,Port Ches Y, for a period of
Sheet 9, Pelham P
1 year, ending December 31, 1953, at an annual rental
of $1.
The Supervisor presented a letter, dated November 14, 1952, from
Mr. James C . Harding, Commissioner of Public Works of the County
of Westchester, advising that the County has extended, for another
year, its contract with the State Department of Public Works for
the removal of ice and snow from State highways in Westchester
County, and inquiring if the Town is desirous of continuing its
contract, dated November 5, 1946, for the removal of snow and ice
on State highways within the Town by Totim forces.
On motion by Councilman Waterman, seconded by Councilman Kane, the
following resolution was unanimously adopted:
WHEREAS, Section 12 of the Highway Law, as amended by Chapter
305 0 the L aws of 19 4 ,
6 provides that if the removal of snow and ice

from the State Highways is taken over by the County, the County can
arrange with the Town Superintendents of the various towns in the
County of Westchester and/or the villages therein for the removal
of the snow from such State Highways as are within their municipal
boundaries, and the entire cost of such work will be reimbursed
by the States Pnr7.

LIHEREAS, the Town of Mamaroneck, under date of November 8,
1946, entered into a contract with the County of Westchester for
the removal of snow and ice from the State Highways within this
Town, including the Villages of Mamaroneck and Larchmont, in
accordance with the provisions of Section 12 of the Highway Law as
amended, and under date of November 14, 1951, extended this con-
tract for the season 1951-1952,
- NOW, THEREFORE, BE IT
RESOLVED that the Town of Mamaroneck extend
the above mentioned contract with the County
of Westchester for an additional year, and
be it further
RESOLVED that a certified copy of this resolu-
tion be forwarded to the Westchester County
Commission_ of Public Works .
Upon motion by Councilman McKeever, seconded by Councilman Kane, the
following resolution was, upon roll call (Supervisor Mandeville not
voting) unanimously adopted:
WHEREAS, the Assessor has presented to this Board, a petition
dated November 28, 1952, pursuant to Section 557 of the Westchester
Countv Administrative Code (Sub. °First") , requesting that the
1952 Tax Assessment Roll of the Town of Mamaroneck, be corrected
with respect to property known as Block 965 Parcel 1, so as to
reduce it from X105,600 to $76,700; and
WHEREAS, the owner of said property, Samuel Friedenberg, has,
by endorsement on said petition, waived notice of presentation
thereof; and
WHEREAS, the Chairman of the Board of Review has indicated
his approval and consent to such correction by endorsement of said
petition,
NOW, THEREFORL, BE IT
RESOLVED that the Assessment Roll of 1952 be and it
hereby is corrected with respect to the valuation of
property known thereon as Block 965 Parcel 11 to the
extent that the assessed valuation is reduced from L
$105,600 to 276,700 .
FURTHER RESOLVED that the Assessor and Receiver of Taxes
are hereby authorized to correct their records accordingly.
Mr. Delius discussed with the Board the details of the notice and
attached map which will be published in connection with a public
hearing to be held on December 17th2 in connection with re-zoning
application.
Mr. Delius stated he had received a letter from Mr. Moody (in reply
to a letter written him by Mr. Delius) saying he would be able to
close title to property known as Block 204 Parcel 247, which he
had bid on at a Town auction, right after the first of the year.
Mr. Delius was instructed to write and tell Mr. Moody that title
must close the first week in January.

The Supervisor stated that there are 3 pick-up trucks at the Town
garage and inasmuch as one of these trucks is no longer being used
and Mr . George Os-orne is leaving the employ of the Town after the
first of the year, he believes said truck should be advertised for
sale at public auction.

The Town Clerk was instructed to prepare an advertisement for bids

and notice of public sale
for the January meeting of this Board.
There being no further business, the meeting adjourned at 9-40 P . M .
to meet again on December 17th and immediately re-convened as the Board
of Fire Commissioners.
Councilman Waterman presented the Fire Department claims, which had
been approved by the Fire Chief and audited by the Comptroller, and
on motion by Councilman Waterman, seconded by Councilman Embury, it
was unanimously
RESOLVED that the following described claims be and
they hereby are approved and that the Supervisor and
Comptroller be and they hereby are authorized to pay
the same out of the budget for the Fire Department:
