MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO-
NECK, HELD JULY 21 1952, IN THE COUNCIL ROOM. OF THE WEAVER STREET
FIRE HOUSE.. TOWN OF MAMARONECK.
Supervisor Mandeville called the meeting to order at 8: 15 P. M.
PRESENT: Supervisor Mandeville
Councilmen Kane and Waterman
ABSENT: Councilmen Embury and McKeever
Presence was also noted of Mr. Delius, Town Attorney; Mr. Gronberg,
Town Clerk; Mr. Finson, Town Accountant; and Mr. O'Brien, Superin-
tendent of Highways.
Upon motion duly made and seconded, the minutes of May 6th, 21st,'
June 4th and 11th were approved as presented.
The Clerk presented and read a letter, dated June 30, 1952, received
from Mr. Charles G. Williams, petitioning the Town Board to enter
into an agreement with the Westchester Joint Water Works for the
installation of a water main in a new street called South Ridge
Road, which connects houses he proposes to build in the Town, with
Mohegan Road as shown on a map entitled, "Tentative Subdivision
South Ridge Road, Belonging to Charles G. Williams, Town of Mamaro-
neck", made by A. J. Foote, Civil Entneer, and a water main which
is now laid in that street.
The Supervisor stated that the Water Company had estimated that the
project would require a 6" pipe from Mohegan Road to a hydrant on
the proposed South Ridge Road, a distance of about 225 feet. If
installed, this line would serve 8 lots or houses to be built on
South Ridge Road. Since no further fire hydrants will be 'required.,
the remainder of the water main would be reduced to &'-.4" pipe. The
total cost of the installation; as estimated by the Superintendent
of the Westchester Joint Water Works, is $1;458.18, which is without
the labor to dig a trench, which the applicant will, himself, provide.
Mr. Williams' letter states that he will deposit $1,458:18 the cost
of the installation, to cover the estimated cost and in return, desires
the Westchester Joint Water Works and the Town to enter into the usual
agreement for 90°di refund of water revenues derived from the sale of water
to customers of this extension line, for period not to exceed 10 years.
On motion by Councilman Waterman, seconded by Councilman Kane, it was,
upon roll call, unanimously
RESOLVED that the Town Board approves the usual
agreement between the Westchester Joint Water Works
and Charles G. Williams and the Town of Mamaroneck
for installation of a water line as above described
in a private Istreet -to be known as South Ridge Road, `
provided that Charles G. Williams furnish the trench
and deposit $1,458.18 with the Westchester Joint
Water Works to cover cost of pipe and installation.
FURTHER RESOLVED that the agreement provide that
refund up to 90% of revenues derived from the sale
of water to customers along this line or extension,
be made for a period of 10 years or until the total
amount of the deposit is refunded, whichever event
shall first occur.
FURTHER RESOLVED that this agreement and the installa-
tion of the water line are conditioned upon the con-
veyance to the Town of a proper pipe easement.

The Clerk presented and read a letter dated June 30, 1952, from Mr.
Charles G . Williams, requesting approval of a tentative subdivision of
Block 206, part of Parcel 97 and Section 2, Block 206, Lot 208. Mr.
Williams was present and stated that he is now awaiting the approval
of the New York State Department of Health.
After discussion, the members of the Board decided to put this matter
over until the next meeting.
The Clerk presented and read a letter dated July 1, 1952, from Chief
Paul A. Yerick, saying that at a meeting of the Police Commission,
held June 30, he had been granted permission to attend a conference
of the New York State Association of Chiefs of Police, to be held at
the Hotel Utica, Utica, N. Y. , on July 22, 23, and 24, expenses not
to exceed $85 .
On motion by Councilman Waterman, seconded by Councilman Kane, it was
unanimously
RESOLVED that Chief Paul A. Yerick be and he hereby is
authorized to attend the Conference of the New York
State Association of Chiefs of Police, to be held at
the Hotel Utica, Utica, N. Y., on July 22, 23, and 24.
FURTHER RESOLVED that expenses, not exceeding $85 . be
paid out of the item in the Budget appropriated for
the same.
The Clerk presented a petition, dated July 2, 1952, received from the
Assessor, Thomas J. McEvoy, requesting approval of the Town Board
of certain corrections made on the Assessment Roll Maps as of June 1,
1952, such corrections being due to the sale or transfer of lots and/or
plots and the filing of maps in the Department of Land Records in
White Plains.
On motion by Councilman Kane, seconded by Councilman Waterman, it was
unanimously
RESOLVED that the Town Board hereby approves the
changes made in the Assessment Maps of the Town
of Mamaroneck as of June 1, 1952, and said maps
are hereby corrected and rectified as of June 1,
1952, in the following places:

The Town Clerk read a letter from Mr. Anthony DeC1eco, signed also by
Mr. George W. Lacks and Jeanette Lacks, his wife, dated June 21, 19523,
and to which is attached a revised map entitled "Revised Map of Part
of Block 1, High View Ridge, Town of Mamaroneck" .
This map was prepared by A. J. Foote, Civil Engineer and is ready for
filing in the County C1erkBs Office, Division of Land Records, but
this has not been done because the street or road known as Hickorty
Grove Drive, shown on that map, is partly in the Village of Mamaroneck
and requires the map to be approved by the Planning Board of the Village
of Mamaroneck which has not, as yet, been done.
The letter, hcwaever, states that it is signed by George W. Lacks in
order to induce Mr. DeCicco to grade the street shown on the map and
known as Hickorty Grove Drive, a 50 foot street upon which fron a
number of lots and which will give access to these lots from Rockland
Avenue.

In view of the request made by the signers of this letter for a state-
ment of the requirements of Village and Town for the acceptance of
the street, it was, on motion by Councilman Waterman, seconded by
Councilman Kane, upon roll call, unanimously
RESOLVED that the Town will accept a certain street or high-
way known as Hickory Grove Drive, from a point running gen-
erally west from the boundary of the Town and Village as
shown on "Revised Map of Part of Block I, Hignview Ridge,
situated in the Town and Village of Mamaroneck, Westchester
County, N. Y., County Sheet 27, Block 3189", made by A. J.
Foote, Civil Engineer and Surveyor, 75 Palmer Avenue, Larch-
mont, N. Y., and dated December 18, 1951, provided that the i
owners of land lying in such street or road, give to the Town
of Mamaroneck, a deed to be approved by the Town Attorney,
and provided further, that Anthony DeCicco will properly
grade and pave the street or highway and furnish storm drain-
age, such grades, pavement and drainage to be made to the
complete satisfaction of the Town Superintendent of Highways
who shall certify to this Board his approval of this installa-
tion prior to its acceptance.

The Town Clerk presented for the record, an affidavit of publica-
tion of Notice of Meeting of the Board of Plumbing Examiners, to be
held June 14, 1952• He also presented a report of the meeting held
- that day, at which there were no applicants.
The Town Clerk reported that he had received from the State Depart-
ment of Audit and Control, a Report of the Examination of the
Accounts and Fiscal Affairs of the Town of Mamaroneck and Fire Dis-
trict No. 1, for the years 1950 and 1951, and for the record, pre-
sented an affidavit of publication of Notice that the report had
been received and was available for inspection by all interested
persons.
The Clerk presented a Certificate of Appointment of Election In-
spectors for the election year beginning July 153 1952, signed by
Supervisor Owen A. Mandeville on. July 2, 1952, in accordance with
the recommendation of the Chairmen of the 2 major political parties.
Mr. George R. Bishop, 514 Pelham Manor Road, Pelham, N. Y., appeared
and exhibited to the Board, a map entitled "Amended Map of Part of
Section I. Subdivision Map of Murdock Woods, Property of George R.
Bishop, Town of Mamaroneck, Westchester County, New York", made by
Sal Spinelli and dated June 21, 1952. This map shows a street called
Murdock Road running generally south groin Griffen Avenue, 70 feet in
width, to a point approximately 212 feet south of Griffen Avenue and
then 50 feet in width. The map also shows 4 lots or building plots
fronting on this road.
Mr. Bishop stated that he is willing to improve this road, including
grading, paving and surfac, drainage and also storm water mains, all
at his own cost. He said he would not require sanitary sewers as he
expects to obtain approval for septic tanks from the County Health
Department.

However, he asked that building permits now be issued to him for 3
houses so that the work can be started, although the street is, per-
haps, not in such condition as would ordinarily warrant the issuance
of a building permit.
In this connection, Mr. Delius suggested that if Mr. Bishop be given
building permits, no occupancy permit shall be issued until the road
be graded, paved and drained to the satisfaction of the Town Super-
intendent of Highways so that it would give access to the houses to be
built.
Mr. Bishop agreed to this proposition and also agreed to file the
above map not later than July 8th, 1952, in the County Clerk' s Office,
Division of Land Records.
Mr. Bishop also requested approval of the usual agreement with the West-
chester Joint Water Works for the installation of an 8" water main
in Murdock Road at a cost of $$4,809.27.
Upon motion by Councilman Kane, seconded by Councilman Waterman, it was,
upon roll call, unanimously
RESOLVED that the Town Board hereby approves the issuance
of building permits for 3 houses along the street to be
known as Murdock Road, running generally south to Griffen Avenue,
provided that no Certificate of Occupancy for such houses
be issued unless or until the street known as Murdock Road
is graded, paved and drained to the satisfaction of the
Town Superintendent of Highways and a deed, in proper form
and approved by the Town Attorney, be furnished, deeding the
land lying within the bed of the said street, to the Town
of Mamaroneck, and upon the further condition that each
house for which a Certificate of Occupancy is issued,
be provided with water, gas and/or electricity and septic
tanks approved by the County Department of Health.
FURTHER RESOLVED that the Town Board approves the usual
agreement between the Westchester Joint Water Works,
George R. Bishop and the Town of Mamaroneck, for installa-
tion of a water line in a private street to be known as
Murdock Road, for a distance of 400 feet from its present
terminus, provided that George R. Bishop furnish the
trench and deposit $4,809.27 with the Westchester Joint
Water Works to cover cost of pipe and installation.
FURTHER RESOLVED that the agreement provide that refund
up to 90% of revenues derived from the sale of water to
customers along this line or extension, be made for a
period of 10 years or until the total amount of the
deposit is refunded, whichever event shall first occur.
FURTHER RESOLVED that this agreement and the installation
of the water line are conditioned upon the conveyance to
the Town of a proper pipe easement, including an easement
for such pipe as was previously laid in any part of Murdock
- Road.
Mr. Albert Poccia, 987 Winfield Avenue, Mamaroneck, appeared before
- - the Board requesting the installation of 400 feet of Ste pipe in front
of property owned by him on Fenimore Road, to serve as a drain. He
said that at the present time there is a 12 foot gulley which serves
as a natural drain for the surrounding area. He went on to say that
if the Town would install this pipe, he would do the filling.
Supervisor Mandeville suggested that the Town might be willing to
supply the pipe if Mr. Poccia would install it.

It was decided that Councilmen Waterman and Kane would inspect the
situation and Mr. 09Brien would obtain a price on the cost of pipe
and the installation of the same.
The Supervisor requested a resolution increasing the salary of Nicholas
Soriano, Fire Truck Driver, to $3,110. effective August 1, 1952.
On motion by Councilman Waterman, seconded by Councilman Kane, it was
unanimously
RESOLVED that the annual compensation of Nicholas Soriano,
Fire Truck Drive, be fixed at $3,110. effective August 1,
1952, in accordance with the increment schedule allowed.
Supervisor Mandeville requested the members of the Board to review the
State Auditorst Report for the Town of Mamaroneck for the period
January 1, 1950 to December 31, 1951.
Mr. Delius reported that Mr. A. J. Foote has secured approval of the
Sewer Pumping Plant and Force Main on Fenimore Road, by the State
Department of Health.
Also that the proposed Contract and Specifications as well as Instruc-
tions to Bidders are now ready, and the Notice to Bidders which will
be published in the newspaper.
Supervisor Mandeville suggested that this matter be laid over until
Councilman McKeever is present.
The Town Attorney brought up the matter of the extension of Sewer Dis-
trict No. 1 and presented a petition with a map showing an area in the
vicinity of Old Wilson Lane, also a plan or map showing the grades and
connections in this area with the trunk line sewer in Fenimore Road
which is part of the Mamaroneck Valley Sewer System and a permit from
the New York State Department of Health which has been recorded in
the County Clerkas Office as provided by law, all of which have been
filed in the office of the Town Clerk
Mr. Waterman introduced the following preamble and resolution-
WHEREAS, a petition purporting to be signed by the requisite number
of property owners as required by Section 191 of the Town Law, peti-
tioning the Town Board of the Town of Mamaroneck to create an exten-
sion designated as "Section J" to Sewer District No. 1 of the Town of
Mamaroneck, and to construct a sewer system therein, said petition
describing the boundaries of the proposed extension and stating the
amount to be expended for the proposed sewer system to be constructed
in said extension, together with a map and plan prepared by A. J. Foote,
Civil Engineer, Larchmont, N. Y . , entitled "Proposed Extension of
Sewer District No. 1, to be designated as Section J", showing the
boundaries of the proposed extension, a general plan of the proposed
sewers to be constructed therein including all outlets and the terminus,
course and the profiles of each proposed sewer or drain and a schedule
showing the manner in which said sewer system will connect with and
drain into trunk sewers of the Westchester County Sanitary Sewer Com-
mission (Mamaroneck Valley Sewer District) has been filed in the office
of the Town Clerk of the Town of Mamaroneck on July 2, 1952, and has
been duly presented to this Board, now, therefore,
THE TOWB BOARD OF THE TOWN OF MAMARONECK, IN THE
COUNTY OF WESTCHESTER, HEREBY RESOLVES AS FOLLOWS:
Section 1. The following order is hereby adopted and
approved and when signed by the members of this Board
present at this meeting, the same shall constitute an
order by this Board-

ORDER CALLING A HEARING ON AUGUST 6. 1952
IN THE MATTER of the extension of #
Sewer District No. 1 of the Town
of Mamaroneck, County of Westchester,*
State of New York #
WHEREAS, a petition purporting to be signed by the requisite
number of property owners as required by Section 191 of the Town
Law, petitioning the Town Board of the Town of Mamaroneck to create
an extension designated as Section J. to Sewer District No. 1 of the
Town of Mamaroneck, and to construct a sewer system therein, said
petition describing the boundaries of the proposed extension and sta-
ting the maximum amount to be expended for proposed sewer system to be
constructed in said extension, together with a map and plan prepared
by A. J. Foote, Civil Engineer, Larchmont, New York, entitled "Proposed
Extension of Sewer District No. 1, to be designated as Section J" ,
showing the boundaries of the proposed extension, a general plan
of the proposed sewers to be constructed therein, including all out-
lets and the terminus, course, and the profiles of each proposed
sewer or drain and a schedule showing the manner in which said sewer
system will connect with and drain into the trunk sewers of the
Westchester County Sanitary Sewer Commission (Mamaroneck Valley Sewer
District) has been filed in the Office of the Town Clerk of the Town
of Mamaroneck on July 2, 1952; and
WHEREAS, the boundaries of said proposed extension of Sewer
District No. 1 of the Town of Mamaroneck are as follows-
BEGINNING at a point in the Easterly line of Fenimore
Road, where the same is intersected by the existing
Northerly boundary line of Section "I" of the Town of
Mamaroneck Sewer District No. 1, and thence running
Northwesterly along the Easterly line of Fenimore Road
to a point where the Easterly line of Fenimore Road is
intersected by the dividing line between Lots 42 and
30 on map entitled "Map of Property belonging to
Fenimore Cooper Park, Inc., Section IDa in the Town
of Mamaroneck, Westchester County, New York", as made
by John M. Farley, Civil Engineer, July 9, 1923, and filed
in the Westchester County Clerk® s Office, July 13, 1923s
as Map Number Volume 55, page 79; thence Northeasterly
through Lot 30 on above mentioned Map along the
boundary lire between lands belonging to Rockledge
Holding Corp. on the South and lands belonging
to A. F. Beringer on the North, to a point in the
Westerly boundary line of lands belonging to the
Winged Foot Holding Corporation; thence South-
