HomeMy WebLinkAbout1952_04_02 Town Board Minutes 77 MINUTES'ES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO- NECK, HELD IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMARONECK, NEW YORK, ON APRIL 2, 1952. Supervisor Mandeville called the meeting to order at 8: 15 P . M . PRESENT: Supervisor Mandeville Councilmen Embury, Kar_e, Waterman and McKeever ABSENT: None I Presence was also noted of the Town Clerk, Mr. Gronberg, the Town Attor- ney, Mr. Delius, the Town Accountant, Mr. Finson, and the Town Superin- tendent of Highways, Mr. O'Brien. The minutes of February 6th and 20th were approved as presented. The Clerk presented and read a , letter, dated March 19th, 1952, received from the League of Nomen Voters, Larchmont, requesting that tale Town make a study of the question of fluoridation of water, and if such a study has already been made, that a report be submitted to the residents. The letter was received and filed. The Clerk presented and read a letter, dated March 9th, received from Mrs . Clelland D . Curtis, stating that she had signed a petition asking that a study be made on the subject of fluoridation of water, but had since discussed the matter with her dentist and, as a result, she is not now in favor of it . The letter was received and filed. The Clerk presented and read a letter, dated March 9th, received from Mrs . Clelland D . Curtis, referring to the heavily traveled condition of Cooper Lane, into which two new outlets from the Church and School of Sts. John and Paul have recently been opened. Mr. O'Brien informed the Board that this matter had been investigated, and the letter Baas received and filed. The Clerk presented and read a letter, dated March 14th, received from Mr. Vito N . Barbieri, stating that he has abandoned the idea of erecting a fence in the rear of premises at )+4 Holly Place , The Clerk presented and read a letter, dated March lst, received from Fire Chief Leonard Ericson, extending thanks for himself and his fellow officers for the unanimous approval of their nominations by the Town Board. The letter was received and filed. The Clerk presented and read a letter, dated February 28th, received from the Board of Elections of Westchester County, with reference to certain districts, the registration of which are now in excess of the 950 registrants provided by §64 of the Election Law. The letter was referred to Councilman Waterman for study and report. The Clerk announced that he had received a request from the Villages of Larchmont and Mamaroneck for the use of voting equipment for both registration and election purposes, which request had been granted. The Clerk said he had also received a request from the Board of Educa- tion for the use of election equipment for the annual School Election. On motion by Councilman Embury, seconded by Councilman Waterman, it was unanimously RESOLVED that the request of the Board of Education for the use of election equipment for the Mamaroneck School Election, be and it hereby is granted. The Clerk presented a letter, dated February 14th, received from Mr. Charles H. Kitchell, in which he said he had no objection to the erec- tion of a fence by Mr. Vito N. Barbieri at 44 Holly Placee The letter was received and filed® The Clerk presented and read a letter, dated March 19th, received from Mr. Julian Cargill, in which it is stated that at a meeting of the Park_ Commission on March 19th, a contract for resurfacing asphalt walks at the Larchmont Railroad Station, was awarded to Daniel F. MacNamee & Co., Inc. for the sum of $"1,2510120 On motion by Councilman Embury, seconded by Councilman Waterman, it was unanimously RESOLVED that the Torn Board hereby approves the action of the Park Commission in awarding the contract for resurfacing asphalt walks at the Larchmont Railroad Station to Daniel F. MacNamee & Co. , Inc . for the sum of Pl,251.120 On motion by Councilman McKeever, seconded by Councilman :Kane, it was unanimously RESOLVED that the claim. of Thomas J. McEvoy in the amount of $24.76 for attendance at Eastern States Building Offi- cials' Federation School on February 21, 22, and 23, in New York City, be and it hereby is approved, such amount to be taken from the item in the budget appropriated for this purpose. On motion by Councilman Waterman, seconded by Councilman Embury, it was unanimously RESOLVED that Arthur E. Wullschleger be and he hereby is reappointed a member of the Board of Zoning Appeals of the Town of Mamaroneck for a five-year term, expiring February 19, 19570 FURTHER RESOLVED that Arthur E. Z^?ullsehleger be and he hereby is reappointed Chairman of said Board of Zoning Appeals . The Clerk requested permission to destroy the old election guard rails, which permission was granted. The Supervisor requested a resolution authorizing the borrowing from Surplus, of an amount, not e°ceeding ; 27,945.53, which represents the outstanding balance due School Districts 1 and 2 on 1951 School levies. Councilman McKeever introduced the following resolutions 1 779 RESOLUTION AUTHORZING THE ISSUANCE OF TAX. ANTICIPATION NOTE OF TI3E TOWN OF MAMARONECK IN AMOUNT NOT EXCEEDING $27,945 .53 IN ANTICIPATION OF THE COLLECTION OF UNPAID SCHOOL TAXES FOR THE FISCAL YEAR JULY 1, 1951 to JUNE 30, 1952 RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK IN THE COUNTY OF WESTCHESTER, STATE OF NEW YORK2 AS -- FOLLOWS: Section 1. In anticipation of the receipt of unpaid school taxes for the fiscal year beginning July 1, 1951 and ending June 30, 1952 and for the purpose of providing moneys to pay to the Treasurers of Union Free School District No. 1 and School District No. 2, the amount of unpaid school taxes, the Supervisor is hereby authorized and directed to issue a Tax Anticipation Note of the Town in a total principal amount not exceeding $27,945< 53 pursuant to Section 555 of Chapter 852 of the Laws of 1948 of the State of New York, and pursuant to Section 24000 of the Local Finance Law of the State of New York. Section 2. It is hereby determined and declared: (a) The total amount of school taxes levied in said Town for said fiscal year is School District No. 1 - $1,508,714®48 School District Nom 2 26,064®51 (b) The total amount of said taxes due and unpaid. is: School District No, 1 - $272676.07 School District No. 2 - 269.46 (c) The total amount heretofore borrowed and outstand- ing in anticipation of the collection of said taxes, is none. Section 3. The note issued under this resolution shall be dated April 1, 1952, and shall mature on September 1, 1952, and the date of maturity of such note, or any renewal thereof, shall not extend beyond the close of the appli- cable period provided in Section 24®00 of the Local Finance Law of the State of New York for the maturity of such notes. Section 4. The Supervisor is hereby authorized to deter- mine the interest rate and all other matters in conrec- tion herewith not determined by this or subsequent resolution and his signature upon said note shall be conclusive as to such determination. The note issued hereunder shall be substantially in the form of "Model Form of Note Payable to Borrower092 set forth in Schedule B of the Local Finance Law of the State of New York and shall be signed by the Supervisor and countersigned by the Town Clerk and shall have the seal of the Town affixed thereto. 781 Section 54 The Supervisor is hereby further authorized to issue said note and to borrow the principal amount thereof as hereby determined from the reserve fund resulting from moneys received from the redemption of transfers of tax liens as provided in Section 556 of Chapter 852 of the Laws of 1948 as amended® Section 6> The faith and credit of the Town of Mamaroneck are hereby pledged for the punctual pavement of the pripicipal of and interest on said note and unless otherwise paid or payment provided for, taxes shall be levied on all of the taxable property in said Town in an amount sus"ficiant to pay said principal and interest® The foregoing resolution was seconded by Councilman Embury and adopted by the Following vote AYES: Supervisor Mandeville Councilmen Embury, Kane, Waterman and McKeever ,NOES: None i On motion by Councilman Embury, seconded by Councilman Kane, it was, upon roll call, unanimously RESOLVED that, pursuant to Section 96A of Chapter 60 of the Consolidated Laws as amended, known as the Tax Law, the Receiver of Taxes and Assessments of the Town of Mamaroneck is authorized to collect the 1952 State, County, Town and District taxes and water rents which become a lien January 1, 1952, in two partial payments, each amounting to fifty per cent of the total of said taxes and water rents. FURTHER RESOLVED that the Receiver of Taxes and Assess- ments is authorized and empowered to receive such partial payments or installments of taxes and water rents at any time prior to the sale of tax_ liens but subject to the same penalties as are specified and provided in Section 542 of the Westchester County Administrative Code for the neglect to pay the total amount of said taxes and water rents. FURTHER RESOLVED that the acceptance of any such partial payments or installments of the 1952 taxes and water rents, shall not be deemed to affect in any manner, any right of the Town of Mamaroneck, under any general or special law, to enforce collection of any unpaid balance of such taxes and water rents as may remain due and owing to the Town of Mamaroneck but such rights and powers shall remain in full force and effect to enforce the collection of the unpaid balances of such taxes and water rents together with interest, penalties and other lawful charges. On motion by Councilman Embury, seconded by Councilman Kane, it was unanimously RESOLVED that, in accordance with the provisions of Section 550 of the Westchester County Administrative Code, 'The Daily Times" , the official newspaper published in the Village and Town of Mamaroneck, be and it hereby is designated as the newspaper in which the Receiver of Taxes and Assessments shall publish the notice of the collection of State, County, Town and District taxes and water rents; and be it 783 FURTHER RESOLVED that said publication be made on March 19, 1952, in the Daily Times; and be it FURTHER RESOLVED that in accordance with the provisions of Section 550 of the Iestchester County Administrative Codes the Town Board do and it hereby does direct the Receiver of Taxes and "assessments to mail to each tax- payer of the Town of Mamaroneck whose address is knovn to said Receiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. FURTHER RESOL-VED that, pursuant to Section 551 of the Westchester County Administrative Code, the Town Board hereby approves the official form of tai; receipt used by the Receiver of Taxes in the year 1952 for taxes for the year 1952. The Supervisor requested a resolution approving the purchase of a type -vrater for the Department of the Receiver of Taxes and Assessments; and submitted two bids as follows: Remington Rand, Inc. 4155 . (Royal) 155. i 78 on motion by Councilman McKeever, seconded by Councilman Kane, it was, upon roll call, unanimously RESOLVED that the Receiver of 'faxes be and he hereby is authorized to purchase from Remington Rand, lnco, one new standard Super Riter model typewriter equipped with a 15" carriage, for the sum of $155 ® The Supervisor requested a resolution renewing the lease with the West- chester County Park Commission for property used for recreational pur- poses, at an annual rental of $5® On motion by Councilman McKeever, seconded by Councilman Kane, it was, upon roll call, unanimously RESOLVED that the Supervisor be and he hereby as authorized to sign an agreement with the Westchester County Park Corr- mission which provides for the further extension of lease dated May 72 1948, covering the use of several parcels of vacant land situated on ,Sheet 10, Pelham-Port Chester mark- way, for a further period of one year, ending April 30, 1953 at the same rental of $5 . The Supervisor presented bills for taxes on property, title to which was obtained by the Torn in the 1947 Foreclosure in rem. These taxes cover the period from 1947 to date, and have accrued since the property was acquired by the Town. The Supervisor stated that he desired a resolution cancelling these taxes as the properties are to be retained by the Town for municipal purposes. Upon motion by Councilman Kane, seconded by Councilman Embury, it was, - upon roll call, unanimously RESOLVED that all taxes accrued upon the following parcels of property from 1947 to date, be cancelled and that the records of the Receiver of Taxes be marked accordingly: Block Parcel Block Parcel 125 372 413 1 125 384 413 25 125 426 413 39 227 1 415 1 411 1 923 29 411 76 935 240 107 48 The Supervisor requested a resolution rescinding a former resolution authorizing the purchase of a Chevrolet truck for the Highway Department, and authorizing its purchase for the Garbage Departments Upon motion by Councilman Waterman, seconded by Councilman Embury, it was, upon roll call., unanimously RESOLVED that this Board hereby authorizes the purchase, from Luby Chevrolet Co. , !no. , for the Garbage Department, _- of one 1952 Chevrolet Dump Truck, Engine Fo> KEM36140, for a total price of $3,469.71; and FURTHER RESOLVED that the resolution adopted by this Board on February 20, 1952, authorizing the purchase of the above truck for the Highway Department, be and it hereby is rescinded. The Supervisor presented an agreement between the Village of Larch- mont and the Town of Mamaroneck, which had been signed by the Mayor of the Village of Larchmont on march 17, 19520 The agreement is made pursuant to the provisions of §162 of the Tax Law and it provides that in the Tax Foreclosure In Rem, now pending and brought by the ;Tillage of Larchmont, certain parcels of property, against which there are unpaid Town taxes, may be sold by the Village !, of Larchmont free and clear of all taxes and then further provides for a division of the proceeds of any resale by the Village, in the same manner and subject to the same provisions as are now in force with re- gard to properties foreclosed by the Village. On motion by Councilman Embury, seconded by Councilman Kane, it was, upon roll call, unanimously _._ RESOLVED that the annual compensation of James O'Brien, Police Patrolman, be fixed at $3,920, effective April 1, 1952, in accordance with the regular increment schedule allowed. The Supervisor requested a resolution opening a Payroll Account in the County Trust Company in accordance with suggestion of the State Examiners. On motion by Councilman McKeever, seconded by Councilman Embury, it was unanimously RESOLVED that the Supervisor be and he hereby is authorized and empowered to open a new bank account in the County Trust Company, Mamaroneck, N. Vm , to be known as ''Town of Mamaro- neck Payroll Account47 FURTHER RESOLVED that disbursements from this account shell be made only upon the signature of the Supervisor together with the countersignature of the Comptroller of the Tov)M of Mamaroneck. The Supervisor requested a resolution closing the Town Office at noon on Good Friday, On motion by Councilman Embury, seconded by Councilman Naterman, it was unanimously- RESOLVED that the Town Office be closed as of 12 oWclock noon, on Good Friday. The Board next discussed a petition presented by Mrs. Paul Gerhold, 24 Crescent Road, Larchmont, which petition requested an appointment of a committee to investigate and study the use of fluorine in the drinking water of the Town, 1 FURTHER RESOLVED that the Police Department be and it hereby is authorized to purchase from H. V. The Board members were also unanimous in their opinion that nothing could be accomplished by further study of this matter at present, and agreed with the Supervisor that an expression of opinion from the con- sumers as to whether or not they would be in favor of fluoridation, would be desirable. The Supervisor requested a resolution authorizing the attendance of Thomas J . ?McEvoy, Assessor, at a School of Appraising to be held by the American Institute of Real Estate appraisers in Chicago on May 1, 2, and 3, expenses for the trip not to exceed $135 . On motion by Councilman McKeever, seconded by Councilman Embury, it was unanimously RESOLVED that Thomas J . McEvoy, Assessor, be and he hereby is authorized to attend the School for Appraising at the American Institute of Real Estate Appraisers in Chicago on May 1, 2, and 3, expenses not to exceed $135 . to be paid out of the item in the Budget appropriated for such purpose. Councilman Embury presented a letter, dated April 1, 1952, received from Chief Paul A. Yerick, together with bids for uniforms, equipment and building maintenance of the Department, which bids had been examined by the Board of Police Commissioners. Councilman Embury suggested that the Board approve the recommendation of t Police Commission which, in each instance, is the low bid. On motion by Councilman McKeever, seconded by Councilman Waterman, the following resolution was, upon roll call, unanimously adopted: WHEREAS, Kadel-Fisher Co., Inc. heretofore and on May 19th, 19523 submitted to this Board a proposal for the construction of a minimum of seven houses upon plots or lots shown on a certain map entitled, "Subdivision Map of Section Two, Prince Willows, Town of Mamaroneck, Westchester Co. , N.
