Councilmen Waterman, Kane, and Brush
ABSENT: None
Presence was also noted of Hr. Gronberg, Town Clark, Mr. Delius,
Town Attorney, Mr. Pinson, Town Accountant, and Mr. O'Brian,
3uperintendent of Highways .
The Supervisor called the meeting to order at 3: 15 P. M. , and
again brought up the matter of the cancellation of the sale of
Eloch 227 Paxcel 1, to Van Realty Corporation, held September 72
1955, and stated that the representative for Van Realty Corpora-
tion and a person who now desires to purchase this property, have
agreed that the property be offered at the next sale to be held
and that Van Realty Corporation, as bidder, will let its bid
remain with the understanding that it will be considered as the
first bid received, which bid is for the sum of $800 .
After some discussion, on motion by Councilman Brush, seconded by
Councilman Waterman, it was unanimously
RESOLVED that this property, Block 227 Parcel 1, will
be offered for re-sale at the sale to be held December
72 1955, at 7:45 P . K. , provided that Van Realty Corp.
be considered as the first bidder, with a bid of "3300,
for which a deposit of $100 has been made, and that
in all other respects, the sale heretofore made on
September 7, 1255, be cancelled.
The Supervisor requested that a date be set for an auction sale
of Town-owned properties .
On motion by Councilman Kane, seconded by Councilman Brush, it
was unanimously
RE50LVED that an auction for the sale of Town-owned
properties will be held on December 7, 1955, at
7:45 P. Y. , in the Court Room of the Town of
Eamaroneck Police Headquarters, 11 Edgewood
Avenue, Town of Mamaroneck.
Hr. Harry Alpiar appeared and read a prepared statement from
the citizens of the Laxchmont Postal area, requesting that the
Town Board of Mamaroneck make it possible for the people of
the Town to decide whether or not they want a swimming pool
by setting a date for a special election on the matter in the
very near future.
Mr . Thomas Abrahamsen and Mr . Sidney Anton also spoke in favor
of a special election to decide this issue.
Supervisor Mandeville and Councilman Kane expressed tlemselves in
favor of a special election, and Councilman Waterman and Brush were
opposed, saying they would prefer to await the construction of
the County Pool in Saxon Woods, as they do not wish, at this time,
to incur any further indebtedness for the Town of Mamaroneck,
because of the increase in the School taxes .
Supervisor Mandeville then suggested that a compromise measure be
Ti oted upon which would authorize the expenditure of '3150, 000 for
the construction of a beach in the Hommochs .
Mr. Delius said this would not be possible unless some definite
plan could be submitted, showing costs, etc .
Following some further discussion, on motion by Councilman Kane,
seconded by Supervisor Mandeville, the question was put to a vote
on the issuance of bonds in the amount of $4401000 for the con-
struction of a swimming pool .
The resulting vote was recorded as follows :

Mr. Morton Levin, Old White Plains :,load, then addressed the Board
regarding the installation of sewers in the Prince Nillows area.
He said that both plans , that is the pump station and the inverted
siphon had been approved by the authorities in Albany and he under-
stands that the sewer lines can be constructed at a price of
approximately $250,000 . It is the desire of the people in the
Prince Willows area to become a part of the present Sewer District .
Mr . Delius said the first step must necessarily be the preparation
of new petitions for presentation to the Town Board .
Mr . George R. Bishop who was present, submitted a bond for $3,000,
issued by the Indemnity Insurance Company of North America for
the completion of a portion of the street known as Split Tree
Road. This bond is given in accordance with resolution adopted
by the Planning Board at its meeting of November 7, 1955, and
was required by the Planning Board in order to insure the
completion of this street or road in accordance with their
specifications and requirements, as a prerequisite to the issuance
of a certificate of occupancy by the Building Inspector.
On motion by Councilman Kane, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the bond of GB and EL Realty Corporation
and Indemnity Insurance Company of North America, given
in pursuance of resolution of the Planning Board duly
adopted on November 7, 1955, is approved, and the Town
Clerk is directed to endorse upon the bond, the approval
of this Board.
Mr. Jerome Wanshal$ 132 Larchmont Avenue, addressed the Board with
reference to flood conditions in the Pinebrook area.
The supervisor advised Yr. Wanshel that Councilman Kane had been
appointed a committee of one to meet with Mayor Eadie for con-
sideration of this matter.
The Clerk presented and read a letter dated November 4, I055, from
the Title Guaranty and Trust Company of White Plains, requesting
cancellation of certain taxes which appear on the records of the
Commissioner of Finance in White Plains but do not appear on the
records of the Receiver of Taxes of the Town of Mamaronech.
On motion by Councilman Brush, seconded by Councilman Waterman,
it was, upon roll call, unanimously
RESOLVED that the following taxes, liens or leases,
appearing on the records in the County Finance Com-
missioner's Office, on premises known on the Tax
Assessment Lap of the Town of Mamaroneck as Kock
802 Parcel 119, and also further known and desig-
nated as Lots Nos . 209 and .211 on a certain map
entitled "Map of the Village of Washingtonville, being
the purchase of the New York and Mamaroneck Home-
stead Association7 made by C . W. Hopkins, Surveyor,
dated May 12, 1851 and filed in the office of the
County Clark, Division of Land Records, Westchester
County, N. Y. , February 13, 1377 as Map No. 230,
be cancelled, the same having apparently been paid
according to the records in the office of the
Receiver of Taxes of the Town of Mamaroneck:

The Clerk presented a letter dated November 1, 1955, from Mr. Luois
Zingesser, attorney for Mr . and Mrs . Herbert L. Johnson, 203 Pelham
Street, Mamaroneck, N. Y. , approved by Mr. Henry R. Dillon,
Receiver of Taxes of the Town of Mamaroneck, requesting issuance
by the Receiver of Taxes of certificate of cancellation in
order that certain taxes or liens may be cleared in the office
of the Commissioner of Finance of the County of Westchester,
and title closed on the property which is being taken by the
Thruway Authority.
On motion by Councilman Brush, seconded by Councilman Waterman,
it was, upon roll call, Unanimously

The Town Clerk presented a letter dated October 27, 1955, from
the Department of Public Works of the County of Westchester, stating
that the rules and regulations relative to reimbursement to
Towns for the control of snow and ice on State highways, have
been modified, namely, that such reimbursement shall include
payments or contributions made by the Town to the New York
State Employees ' Retirement System or the U. S . 3ureau of Old
Age and Survivors ' Insurance . This was received and filed .
The Clerk presented a letter dated November 2, 1955, from the
Department of Public Works of the County of Westchester, stating
that the County has extended for one year, its contract with
the State Departmant of Public Works for the control of snow and
ice on State highways and asking that the Town Board, if it
approves of the Town handling with Town forces, this snow and
ice control work on the State highways during the coming season,
adopt a resolution so stating.

On motion by Councilman Kane, seconded by Councilman Brush, the
. following resolution was , upon roll call, unanimously adopted :
WHEREAS , Section 12 of the Highway Lan, as amended by
Chapter 305 of the Laws of 1946, provides that if the removal
of snow and ice from the State Highways is taken over by the
County, the County can arrange with the Town Superintendents of
the various towns in the County of Westchester and/or the
villages therein for the removal of the snow from such State
Eighways as are within their municipal boundaries, and the
entire cost of such work will be reimbursed by the State; and
WHEREASY the Town of Mamaroneck under date of November 32
iT46, entered into a contract with the County of Westchester
for the removal of snow and ice from the State Highways within
this Town, including the Village of Mamaroneck and Larchmont,
in accordance with the provisions of Section 12 of the Highway
Law as amended, and under date of November 3, 1954, extended
this contract for the season 1954 - 19552
Nows THEREFOREP BE IT
RESOLVED that the Town of Mamaroneck 'extend the
above mentioned contract with the County of
Westchester for an additional year, and be it
FURTHER RESOLVED that a certified copy of this
resolution, be forwarded to the Westchester County
Commissioner of Public Works .
The Clerk presented a letter dated November 141 1955$ from Margaret
Barnes giving notice of her retirement from service with the
Town of Mamaroneck as of December 31, IS55 and advising that she
was so notifying the State Comptroller.
This was received and acknowledged with regret .

On motion by Councilman Erush, seconded by Councilman Kane,
the following resolution was unanimously adopted :
WHEREAS, this 2oardp by resolution adopted February IS, 1053,
approved the sale by the Village of Mamaroneck of a pa. cel of
property known on the Assessment Map of the Village of Mamaronecl:
as Section 9, Block SSE, Lot 2A and Section 9, Bloch 24, Lots
U, 3, and on the Assessment Map of the Town of Mamaroneck as
Block 949 Parcel 230, to William A. Glaser for 01, 970, which
said property had been acquired by the Village in a foreclosure
in rem, conducted by it ; and
WHEREAS, thereafter and prior to the consumation of said sale,
the Town of Mamaroneck acquired said property in a certain fore-
closure proceeding in rem, entitled "In the Hatter of the Fore-
closure of Tax Liens pursuant to Article VII-A, Title 3 of the
Tax Law, by the Town of Hamaron6ch, List of Delinquent Taxes
for 1954" by reason of the non-payment of taxes for a period
of 4 years prior to April 29 , 1954, the date when the list of
delinquent taxes in said proceeding was 'filed . in the County
Clerk's Office; and
WHEREASP said premises were included in the deed delivered by
the Supervisor acting as the Collecting Officer, to the Town of
Mamaronech, which deed was recorded on 3eptember 22, 1954, in
the County Clerk's Office of the County of Westchester; and
WHEREAS, the Village has now requested that the Town give a
quitclaim deed to the Village in order to clear the title and
enable the Village to consumate the sale to William A. Glaser,
provided that the proceeds of sale be divided between the Town and
Village in accordance with a certain agreement entered into
between the Town and Village pursuant to Section 165H of the
Tax Law,

RESOLVED that the Supervisor is authorized to
deliver to the Village of Mamaroneck a quitclaim
deed of the property known and described as Lots
2 and 3 on Amended Subdivision Map of Property
called Orienta Gardens made by Hollister & Young,
Civil Engineers and Surveyors , June 29, 1929,
filed in the County Clerk's Office, Division of Land
Records on July 12, 1929 as Map No. 3463 and also
known as Block S49 Parcel 230 on the Town Assessment
Map and as Section 9 Bloch S32, Lot 2A and Section 9,
Block 94, Lots 22, 3 on the Village Assessment Map.
The Town Attorney stated that tae action brought by the Town of
hamazoneck against Mortimer J. Solomon and wife to enjoin use of a
garage accessory to a residence building on Fenimore Road, on the
ground that it was occupied by tenants who were neither members
of the family nor employed by the owners of the residence building ,
which was alleged to be in Violation of the Ordinance, could be
settled and discontinued . He reported that the tenants have vacated
the premises and submitted a proposed stipulation signed by the
defendants and their attorney, in which they stipulated to use
the garage and apartment over it in conformance with the present
`:loaning Ordinance of the Town, which the Attorney stated had referenae
to amendments made on August 10th to the Zoning Ordinance, limiting
such use to members of the family or servants or employees of the
owner of the principal residence building.
Lr. Wansial who had originally brought this matter to the attention
of the Boardp approved the settlement.
On motion by Councilman Kane, seconded by Councilman Brush, it
was unanimously

RESOLVED that the Supervisor is authorized to sign
the stipulation submitted by the Town Attorney,
settling and discontinuing the action brought in
the Supreme Court, entitled "Town of Mamaroneck
against Mortimer. J. Soloman and Gladys W. Soloman''
to enjoin the use of the garage on premises
known as Block 301 Parcel 387 on the Tax Assess-
ment Map of the Town of Mamaroneck.
The Town Attorney stated that in the certiorari proceeding
pending on behalf of the Dayhar Realty Corporation, the attor-
ney for the petitioner had raised the issue of inequality which
made it necessary for both sides to submit a list of properties
to be used as a basis of comparison on this issue . He stated
further that Mr: Harry N. Keller, the expert retained by the
Town, had suggested 5 parcels of property to be used by the
Town, to wit :

Michael J. Cantor Sales and Garage
Sound View Sales and Service
and that he had requested to be paid $250 apiece for his wor:�
in appraising these parcels .
After some discussion, the Supervisor said he believed he would
be able to have Hr. Haller make these appraisals at a more
reasonable figure and would tame it up with him.
The Board now toot up the Proposed Tax Budget for 1956 and
suggested the following changes :
That all full time Town employees be given a raise of $240 each
with the exception of Fire Lieutenants Harrington and Testa,
Part Foreman Thomas Aitchison, and Town Attorney Delius, who
will be given raises of $420 each Arthur Johnson, Assistant
Pact Foreman, who will receive a raise of $270; the Justices
of the Peace, who will receive an increase of $180; and tie
engineer (vacant) salary for which office will be increased
from $7, 500 to $8, 500.
in the Fire Department budget, the item "Materials , Supp. tS
Misc ." was increased from $3,000 to $1, 200, and the item
"Repairs and Maintenance of Building" was increased from
11, 500 to 14, 000.
In the budget of the Department of Civil Defense, the salary of
the Deputy Civil Defense Director, $1, 500 was removed and the
item "Traveling expenses" was increased from $300 to
after some further discussion of the preliminary budget, the
Town Board prepared the following itemized statement of the
estimated revenues and expenditures of the Town for the fiscal
year commencing January 1, 056, which statement is known as
the Annual Estimate:
