HomeMy WebLinkAbout1955_02_19 Town Board Minutes 7 MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD FEBRUARY 19, 1955. PRESENT: Supervisor Mandeville Councilmen McKeever, Kane, Brush, and Waterman ABSENT: None The Town Board met at 11 A. M. at the Builders' shack erected in territory in the Town of Mamaroneck on the westerly side of Mamaroneck of the Village g Avenue between the northerly boundary of Mamaroneck and the West Reservoir of the Westchester Joint Water Works, No. 1, owned by Albert Construction Co. , pursuant to notice posted in 5 public places in said territory and which property is more particularly described in a petition for annexa- tion of this territory by the Village of Mamaroneck, verified by Albert Construction Co. on December 22, 1954. Upon motion made by Supervisor Mandeville, seconded by Councilman Waterman, the Town Board thereupon adopted the following resolu- tion and decision: IN THE MATTER OF THE ANNEXATION BY THE VILLAGE OF MAMARONECK OF CERTAIN TERRITORY IN THE TOWN OF MAMARONECK ON THE WESTERLY SIDE OF MAMARONECK AVENUE BETWEEN THE NORTHERLY BOUNDARY OF THE VILLAGE OF MAMARONECK AND THE WEST RESERVOIR OF THE WESTCHESTER JOINT WATER WORKS, NO. 1 n the 31st day of January, 1955, WHEREAS, heretofore and o y a P etition duly verified by Albert Construction Co. was sub- mitted to the Supervisor of the Town of Mamaroneck pursuant to the provisions of Section 348 of the Village Law in which the petitioner alleges that he is the owner of certain unoccupied -- territory in the Town of Mamaroneck, more particularly described in the petition, to which petition there is a map attached show- ing the property consisting of approximately 8.047 acres, in h annexation of said petitioner prays e which petition p p Y s for t property by the Village of Mamaroneck and for the consent of P y the Town Board of the Town of Mamaroneck to such annexation; and WHEREAS, the Supervisor of the Town of Mamaroneck, pur- suant to the provisions of Section 348 of the Village Law, caused to be posted upon the premises to be annexed, a Public Notice that he had received the said petition for annexation as afore- said, and that a public hearing would be held on the 19th day of February, 1955, at 11:00 A. M. at a place in such territory, rs shack or office of the Albert Construc- tion wit, the builds III Co. , erected on the premises; and WHEREAS, pursuant to such notice, a public hearing was held, at which the Supervisor and all members of the Town Board were present, NOW' THEREFORE, the Town Board of the Town of Mamaroneck I, hereby determines and decides: (1) That the petition of Albert Construction Co. for the annexation of said property in the Town of Mamaroneck, by the Village of Mamaroneck, complies in all respects with the pro- visions of Section 34$ g of the Village Law. ' (2) That a description of the property sought to be annexed is as follows: ALL that lot or parcel of land in the Town of Mamaroneck, County of Westchester and State of New York on the avert of Lot 1 on a certain map "Subdivision Map of Section 1, Moorland Estates, village of Mamaroneck, Town of Mamaroneck, Westchester County, N. Y." , made by Ralph Cronquist, dated April 18, 1951, and filed May 31, 1951, in the County Clerk's office, Division of Land Records, as Map No. 7395, more particularly bounded and described as follows : BEGINNING at a point on the southerly side of Mamaroneck Avenue which point is the westerly side of Lot 1, 9 running thence along the aforesaid ma as shown on the P westerly boundary of the incorporated village of Mamaro- neck and said lot and along the westerly line of land as shown on Map of Section 2 of Moorland Estates filed in the County Clerk's office as Map No. 7880 and along the westerly line of land now or formerly of Cabalon bolding Co. Inc. , the following courses and distances: South 170 51' 20" East 1,130.25 feet and South 21° 44' 40" West 109.31 feet to a point on the northerly line of land of the County of Westchester (Saxon Woods Park) , running thence along said land and along a stone wall, the following courses and distances: North 390 39' 40" West 310.64 feet, North 390 34' 30" West 389 .08 feet, and North 410 24' 30" West 94.52 feet to a point of curve; thence continuing along the easterly line of land of the County of Westchester in a northeasterly direction on a curve to the right having a radius of 412 .54 feet, a distance of 665.95 feet to a point of tangency; thence continuing along the said lands of the County of Westcheste r running I along the easterly line of land of the Westchester joint East 106.14 feet to Water Works, No. 1, North 51 04 e 55„ Ea a point on the southerly side of Mamaroneck Avenue; run- ning thence along said side of Mamaroneck Avenue, in an easterly direction on a curve to the left having a radius of 409 . feet, a distance of 116.74 feet to the point or place of beginning. (3) That in accordance with the provisions of Section 348 of the Village Law, the Town Board of the Town of Mamaroneck harsh consents to such annexation, provided that the premises to y for remain subject to assessment and taxation be annexed shall J II Town District taxes, as provided by law. (4) This decision, together with a copy of the petition and the notice with an affidavit of posting thereof when executed by the Supervisor and the Town Board, shall be delivered to the Village of Mamaroneck and shall also be filed with the Town Clerk of the Town of Mamaroneck.
