HomeMy WebLinkAbout1955_02_16 Town Board Minutes 5 i MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD FEBRUARY 16, 1955, IN THE COURT ROOM OF MAMARONECK TOWN POLICE HEADQUARTERS AT 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. PRESENT: Supervisor Mandeville Councilmen Waterman, Brush, Kane, and McKeever ABSENT: None Presence was also noted of Mr. Delius, Town Attorney, and Mr. Gronberg, Town Clerk. The Supervisor called the meeting to order at 8:15 P. M. , and the Clerk presented affidavit of publication of notice of public hear- ing to be held on the 16th day of February at 8:15 P. M. , for the purpose of considering a proposition to amend the Zoning Ordinance of the Town of Mamaroneck so as to add a new paragraph to Article III , Section 13 of the Zoning Ordinance, to be known as Subdi- vision 7, which will read as follows: 7. Notwithstanding anything to the contrary herein con- tained, a corner lot in a Class C District (Business) of fronts on a main thoroughfare where one side of the 1 street and another side of the lot fronts on a side s and which lot is adjacent to a residential Use District, the minimum side yard on the side street shall be not less than ten feet. Mr. Jerome Wanshel, 6 Beverly Place, Larchmont, appeared for the petitioners and stated that this is an application by 17 petitioners and property owners in the Town to change the Zoning Law pertain- ing to Town zoning, Article 31 Section 13, so as to provide, in effect, that on any main thoroughfare such as the Post Road, where there is a business district or zo ne which is immediately adjacent III _ to a residence district, and where that meets on a side street right at the corner, that there be a set-back insofar as the side street is concerned of 10 feet. He said this ordinance is not new; it exists in many communities; which provides for of Larchmont has a provision and the Village a 15 _f oot set-back in similar lar ins tances . He feels such an ordi nance makes sense an d would improve rove the Town and protect the III residential areas. He said he had submitted photographs for the record, showing the results of not having such an ordinance, and said that the people he premarily represents, i.e . those people living on Rockridge Road, are desirous of protecting the entrance to their homes . Mr. James Lowry, 8 Rockridge Road and Mr. A. W. Bogardus, 17 Overlook Terrace, were present and registered their approval of the proposed amendment. Mr. Anthony Sansone, representing Castro Convertible Corporation, owner of the property located at 1289 Boston Post Road, a piece which would be immediately affected, addressed the Board, citing Zoning Board applications and decisions as well as certain deci- sions of this Board, and said this was a most unusual application. He said these people seem to be looking for protection, but Castro is also looking for protection. As most of the other corners in the Town are built up, "we are practically talking which was assessed se d fo r corner" , a piece of property III about this c , $200 before Mr. Castro paid $3, 500 for it, after which (the next year) the assessment went up to $3,000. He said if 10 feet is taken from this property, there will be over 300 of the property made useless . I 7i II Mr. Sansone said the street, 50 feet in width, is wide enough and that to do what these people are asking, would be to have too much damage fall on one property owner. He also represented the "lot across the way" . I d. that the He respectfully requested application be dense P Mr. John M. Thompson, 1880 Palmer Avenue, objected to the applica- tion and said he had been authorized to enter a protest for Mary Mead and others . He presented a petition signed by 9 owners of property located on the Boston Post Road. Mr. Irving Keenan, 1320 Boston Post Road, registered objection. Mr. Edmund B. Van Hook, 198 Weaver Street, said that he is in favor of the proposed amendment. The Town Clerk presented a letter, dated February 14, 1955, from Mr . Rudy Novak, protesting the adoption of this amendment. Mr. Delius said that if the people,whom Mr. Thompson represents, constitute 20% of all property owners affected by this amendment, he would advise the Board that it requires an .affirmative vote of 4 members of the Board to make this change. Mr. Delius said it would be impossible for him to tell at this time, without making some research, whether the names on the petition constitute 20% of the persons affected in this instance, who are owners of corner property in a C business zone immediately adjacent to residential property, which means certainly all corners of the Boston Post Road, and possibly some others in the business zones along lower Myrtle Boulevard, etc . - The Supervisor suggested that the Town Attorney take it up with the Assessor and make a report. -- The Board now took up the regular order of business and Mr. Wanshel appeared for Mr. Frank Guadagnolo and withdrew a petition which he had submitted to this Board on January 19th, petitioning that the entire block bounded by Garfield Street, Madison Avenue, Chatsworth Avenue and Adams Street, in the Town of Mamaroneck, be rezoned from a residence to a business district. Mr. George R. Bishop, representing Split Tree Realty Corp*, appeared and referred to a letter from the Westchester Joint Water Works, No. 1, dated February 7, 1955, addressed to the Supervisor, and stating that Split Tree Realty Corporation has requested that a water main be laid in a new street to be known as Salem Drive, from Split Tree Road to a point approximately 500 feet south, at which point a fire hydrant will be required. An estimate of the cost of this is extension was attached to the letter. On motion by Supervisor Mandeville, seconded by Councilman McKeever, it was, upon roll call, unanimously RESOLVED that the Town Board hereby approves the usual agree- ment between Westchester Joint Water Works, No. 1, Split Tree Realty Corp. , and the Town of Mamaroneck, for the installation of a water main to be laid in a new street to be known as Salem Drive, from Split Tree Road to a point approximately 500 feet south, at which point a fire hydrant will be required, at a total cost not to exceed $1, 618.86, provided that applicant furnish an easement satisfactory to the Town Attorney. After some discussion, on motion by Supervisor Mandeville, seconded by Councilman McKeever, the following resolution was unanimously adopted: WHEREAS, a petition purporting to be signed by the requisite number of property owners as required by Section 191 of the Town Law, petitioning the Town Board of the Town si of Mamaroneck to create an extension designated as "Section neck" and to 1 of the Town of Mamaroneck"L to Sewer District No. describing the therein Sewer system , said petition construct a y boundaries of the proposed extension and stating the amount to be expended for the proposed sewer system to be constructed in said extension, together with a map and plan prepared by C . Cioffoletti 82 Weaver Street; ,appeared to ask about the installation of a sewer in Ferndale Place and the Supervisor suggested that he obtain an estimate on the cost of this project and then come back to the Board with a proposition. The Clerk presented a letter from Chief Yerick, dated February 16th, submitting bids for 35 Pea Coats for members of the Auxiliary Police Department as follows: Caleb V. The Clerk presented a letter dated February 16, 1955, from Mr. C . J. Quinn, Secretary of the Board of Police Commissioners, addressed to the Town Board, presenting copies of letters directed to Detective Sergeant Chauncey E. Smith and Detective Christopher W. Loveley, together with a report from Chief Yerick covering the work of the Police Department in the apprehension and arrest of three youths f charged with committing 17 burglaries in the Town and Village Mamaroneck during December, 1954, and January, 1955, and recommending well-deserved citations of commendable merit for these men. On motion by Supervisor Mandeville, seconded by Councilman Waterman, it was unanimously RESOLVED that this Board do and it hereby does commend Detective Sergeant Chauncey E. Smith and Detective Christopher W. Loveley, members of the Town of Mamaroneck Police Department, upon their skill and ability for their part in apprehending the youths who were causing fear and consternation among residents of the Town and Village of Mamaroneck in connection with a series of house burglaries in these areas. The Supervisor said he would like to take this opportunity to compli- ment and commend Chief Yerick after his 30 years of service. On motion by the Supervisor, seconded by Councilman Waterman, it was unanimously RESOLVED that this Board do and it hereby does commend Chief Yerick for his 30 years of out- standing service to the Town of Mamaroneck as a member and Chief of the Town of Mamaroneck Police Department . Chief Yerick was present and expressed his thanks to the Board for their expressions of appreciation and commendation. The Clerk presented a letter, dated February 3rd, 1955, from Mr. Anthony ansone, Corporation Counsel for the Village of Mamaroneck, Y II addressed to the Town Board, in connection with Block 920 Parcel 275 (Sec . 9, Block 58, Lots 21C, 22B on the Village Assessment Map. The letter stated that on August 23rd, 1954, a deed was given by the Village to Russell E. Maltz and Dorothy Maltz, his wife for the above described property for $30.00, and that attention has now been called to the fact that this parcel was included in the 1954 Town foreclosure in rem proceeding, and title to the same was deeded to the Town by the deed in rem, recorded in September 1954. Mr. Sansone asked that the Town give a quit-calim deed to Mr. and Mrs. Maltz . Upon recommendation by Mr . Delius, n motion b y Councilman Brrush, sec onded by C ouncilma n McKeever, t h e following w III ...:.. unanimously adopted: 7 , I WHEREAS, this Board, by resolution adopted November 4, 1953, approved the sale by the Village of Mamaroneck of a 10-foot strip of property known as Block 920 Parcel 275 on the Assessment Map of the Town of Mamaroneck, Section 9, Block 58, Lots 21C, 22B on the Village Assessment Roll (Serial #31, Town Foreclosure In Rem) to Russell E . Maltz and Dorothy Maltz, his wife, which said ro ert had been acquired by the Village in a foreclosure pro- ceeding y I ceeding in rem, conducted by it; and I _ WHEREAS , thereafter and prior to the consumation of said sale, the Town of Mamaroneck acquired said property in a certain foreclosure proceeding in rem, entitled "In the Matter of the Foreclosure of Tax Liens pursuant to Article VII-A, Title 3 of the Tax Law, by the Town of Mamaroneck, List of Delinquent Taxes for 1954" by reason of the non-payment of taxes for a period . of 4 years prior to April 29, 1954, the date when the List of Delinquent Taxes in said proceeding was filed in the County Clerk's Office; and WHEREAS, said premises were included in the deed delivered by the Supervisor acting as the Collecting Officer, to the Town of Mamaroneck and which was recorded on September 22, 1954, in the y h Count Clerk's Office of the County of Westchester; and WHEREAS, the Village has now requested that the Town give a quitclaim deed to Russell E. Maltz and Dorothy Maltz, his wife, provided that the proceeds of sale be divided between the Town and Village in accordance with a certain agreement entered Vi pursuant to Section Z65H p Village a into between the Town and of the Tax Law NOW, THEREFORE, BE IT RESOLVED that the Supervisor is authorized to deliver to Russell E. Maltz and Dorothy Maltz, his wife, a quitclaim deed of the property known and described as "the southeasterly 10 feet of part of Lots 26 and 28 on Map of Rushmore Subdivision, Town of Mamaroneck, Westchester County, New York, filed in the County Clerk's Office, Division of Land Records, Westchester County, March 6, 1895 as Map No. Vol. 11; Page 10" . The Clerk presented a letter, dated February 4, 1955, addressed to Mr. Charles J. Gronberg, from Holden A. Evans, Jr. , General Manager of New York State Thruway Authority, acknowledging receipt of a resolution adopted by the Mamaroneck Town Board on January 19, 1955, relative to the construction of the New England Section of the New York Thruway, and stating that this will be brought to the attention of the Thruway Authority Board at its next meeting. The Clerk presented a letter, dated February 14, 1955, from the Village Clerk of Larchmont, addressed to the Town Clerk, requesting use of the usual election equipment, including two voting machines for the Annual Village Election on March 15th and Registration on March 5th, 1955, and also asking permission to borrow the Town registration books of the last general election for the 6th, 7th, 8th, 9th, and 10th Districts. The Clerk also stated that he had a similar request from the Village of Mamaroneck. On motion by Councilman McKeever, seconded by Councilman Brush, it was unanimously RESOLVED that the requests of the Villages of Larchmont and Mamaroneck, for use of the usual equipment for regis- tration and election purposes, be and they hereby are granted. 9 For the record, the Clerk presented a letter, dated February 14, 1955 addressed to the Town Clerk from the Deputy Clerk of the Village of Mamaroneck, enclosing certified copy of resolution adopted by the Village Board approving the sale by the Town, of property designated as Section 8, Block 81, Lot 6. (Town Block 832, Parcel 359) The Clerk presented the following: Report of Westchester Shore Humane Society, Inc. for January, 1955 Letter from County Transportation Company, Inc . , dated February 3, 1955, addressed to the Supervisor, from Mr. J. T. Looby, General Tax Accountant for the County Transportation Company, Inc. , enclosing a verified report relative to operation of buses of that Company in the Town of Mamaroneck, for the six months ended December 31, 1954, and a check for $127.87 covering gross earnings tax for that period. Letter from Mr. J. T. Looby, General Tax Accountant for County Transportation Company, Inc. , dated February 3, 1955, addressed to the Supervisor, enclosing report for the year ended December 31, 1954, prepared in accordance with Paragraph 25 of Franchise granted by the Town of Mamaroneck, and requesting an acknowledgment. Town Clerk's Report for January, 1955 Attendance Report for January, 1955 The Supervisor presented a letter, addressed to himself, from the Secretary to the Mamaroneck Republican Town Committee, dated February 16, 1955, recommending the appointment of Morgan J. Burke, Jr. , as a member of the Board of Appeals for Zoning. On motion by Councilman Brush, seconded by Councilman Waterman, it was unanimously RESOLVED that Morgan J. Burke, Jr. , be and he hereby is reappointed a member of the Board of Appeals for -'--- Zoning in the Town of Mamaroneck, for a term to expire February 19, 1960. The Supervisor presented a letter, addressed to himself from Charles p of the City N. Comber, City Clerk y of New Rochelle, dated January 12, 1955, enclosing a copy of Resolution No. 2, adopted by the Council of the City of New Rochelle, reiterating its request urging Westchester County Board of Supervisors to adopt the system of permanent personal registration in Westchester County, in accordance with the Election Law and suggesting that the Town Board take similar action. On motion by Supervisor Mandeville, seconded by Councilman Brush, the following resolution was unanimously adopted: WHEREAS the State Legislature has enacted a measure providing I registration, for the establishment of a system of permanent personal which may by local law, be adopted and put into effect in any county of the State of New York; and WHEREAS, the present system of annual registration for voting at general elections is a cumbersome task demanding unnecessary effort on the part of the voters each year, which involves con- siderable expense; and WHEREAS, this system of permanent personal registration would enable the citizens of Westchester to vote at general elections annually, without the necessity of annual registration, and would permit the electorage to register once and remain registered while living at the same address, and would entitle all registered citizens who have enrolled in a political party to vote in the primaries of said party, I 61 �. NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Mamaroneck does hereby urge the County Board of Supervisors to adopt by local law, the system of permanent personal registration for the County of Westchester, as provided by the Election Law, as amended by the State Legislature, and be it FURTHER RESOLVED that a copy of this resolution be forwarded to the Westchester County Board of Supervisors, and be it FURTHER RESOLVED that this resolution shall take effect immediately. The Supervisor presented a letter addressed to himself from the office of James C. Harding, Commissioner of the Department of Public dated January 20 1955, r da III Works of the County of Westchester, y referring to his inquiry as to when the County will take over the Town pumping stations, and stating that the matter is pending the execution of a formal agreement upon which the County Attorney and the Town Attorney are now working. The Supervisor presented a letter addressed to himself from Mr. Rufus K. Allerton, dated January 20, 1955, thanking Mr. Mandeville and the people in the Town Office for support, cooperation and understanding during his time as Treasurer of the Police Pension Fund and stating that the final badge presentation on January 19th, was deeply appreciated. The Supervisor presented the Annual Report from the Police Depart- ment of the Town, for 1954. Councilman Brush reported that on February 7th, he attended a / - meeting of the Planning Board which will probably not be ready to operate until April, as they have adopted Rules and Regulations and Requirements for Approval, etc . on which a public hearing will be held on March 7th, after which they will be referred to this Board for approval. On Manuary 14th, Mr. Brush attended a meeting of the Recreation Com- mission which invited interested members from the Village of -Mamaro- neck who want to form a golf tournament, and plans are under way. The same thing is true of the Teenage group. Councilman Waterman had nothing to report. Councilman McKeever presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes, and on motion by Councilman McKeever, seconded by Councilman Brush, the following resolution was unanimously adopted : WHEREAS , the Assessor has presented petitions for the cor- rection of the assessment roll for certain years, pursuant to the provisions of Section 557, Article 16 of the Westchester County Administrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable --- to grant said petitions for the correction of said assessment roll, NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1954, taxes of 1955, which shows property now appearing on the roll as follows : I Block Parcel Name Land only 104 119 Town of Mamaroneck $ 4,600 be corrected as follows in accordance with the provisions of subdivision 5 of Section 557: Block Parcel Name Land only 104 119 Joseph Gulia 4, 500 100 104 135 Village of Larchmont ICI FURTHER RESOLVED that the assessment roll of 1954, taxes of 1955, which shows property now appearing on the roll as follows: Block Parcel Name Land Improvement Total 201 153 Walter H. Wood as Referee. He asked the Board for authorization to employ an expert to testify. On motion by Councilman McKeever, seconded by Councilman Kane, it was unanimously RESOLVED that Harry K. Keller be retained to act as expert for the Town of Mamaroneck in proceedings now pending in Supreme Court in behalf of Dayhar Realty P g Corporation, to review the assessment of 1954-1955, affecting premises known as Block 411 Parcel 242 on the Tax Assessment Map of the Town of Mamaroneck. Mr. Delius reported that sentiment through the State is divided on the question of the new town equalization rates. Some county boards have accepted the State rates ; in other counties, appeals are pending by the cities where county authority has not adopted the State rates; and in still other counties, the sentiment is that equalization for county taxes should be strictly a county matter and the provisions regarding appeal to the State Tax Commission should be repealed .
