HomeMy WebLinkAbout1955_02_02 Town Board Minutes �3 MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, FIELD FEBRUARY 2, 1955, IN THE COURT ROOM OF MAMARONECK TOWN POLICE HEADQUARTERS AT 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. The meeting was called to order at 8:15 P. M. PRESENT: Supervisor Mandeville Councilmen McKeever, Kane, Brush, and Waterman ABSENT: None Presence was also noted of Mr. Gronberg, Town Clerk. The minutes of December 22, 1954, and January 5, 1955, were approved as presented . The Clerk presented a letter from the Westchester Tax Bureau, dated February 1, 1955, asking that the Receiver of Taxes be authorized to issue Cancellation Certificate to be filed with the County Commissioner of Finance (formerly the County Treasurer on certain tax leases sold to the Town prior to 1916 and which taxes do not appear on the record of the Receiver of Taxes . Gironda, concerning the rezoning of land adjacent to the New haven Railroad, the extension of Fifth Avenue, and the widening and rezoning of Myrtle Boulevard. On motion by Supervisor Mandeville, seconded by Councilman Brush, it was unanimously - RESOLVED that the letter dated January 29, 1955 from Mr. Frank D. Gironda, addressed to this Board, concerning rezoning of certain land, be and it hereby is referred to the Planning Board . 3? i The Clerk presented a memorandum from the Justice's Court of the Town of Clarkson, addressed to Town Boards in the State of New York, regarding "Judge Morrison's new Town Manual, 'Guide for Constables "' No action was taken. The Clerk presented a letter, dated January 19, 1955, from Walter W. westall and William F. Luddy, Commissioners of the Board of Elections, addressed to the Town Board and stating, "there is no doubt that the provisions of Section 64 of the Election Law, requiring the creation, division or other altera- tion of election districts that have exceeded nine hundred fifty (950) registered voters, is mandatory." , and that "such creation, division or other alteration must be done pursuant to the statute on or before July 1 (effeve October 1) , but because Central Registration (for the November 8, 1955 Election) will probably begin on May 2, we request that the certified resolutions, descriptions and maps be filed with us not later than April 30th. The letter went on to give certain data regarding the districts in the Town which must be divided or otherwise altered, and then further stated "in view of the natural increase in registration expected for 1956, a presidential year, the creation of new districts this year must not be relegated to the future, we insist that for the protection of the electorate and continued excellence in administration, necessary action be instituted at once, and that this Board be notified as to your intentions not later than April 1st, 1955." No action was taken. The Supervisor reported that he had met with the planning Board who had requested that Mrs . Margaret Barnes act as Secretary to that Board. The Supervisor said he had agreed to this and went on to say that a Sound Scriber would be tried out here. After discussion, during which the Town Clerk announced that he did not believe a Sound Scriber would be practical, but that he would agree to try it at one meeting, it was agreed that if the Sound Scriber would not do the required job, Miss Jean Corbia would take the Town Board minutes . The Clerk presented the following: Letter from Mr. G. Crawford Eadie, dated February 1, 1955, acknowledging the congratulations of the Supervisor and Council- men, to Mr. Eadie upon his appointment as Mayor of the 'Village of Larchmont. Town Clerk's Report, for the year 1954 Building Inspector's Report for January, 1955 Report of Receiver of Taxes for January, 1955 Statement of Bank Balances as of February 1, 1955 List of Claims Audited and paid by the Comptroller from January 1, 1955 to February 1, 1955 Annual Report of the Fire District Treasurer for the Town of Mamaroneck, Fire District No. 1 for the fiscal year ending December 31, 1954 Annual Report of the Supervisor for the fiscal year ended December 31, 1954 The Supervisor reported that the resolution passed by this Board on January 19th, requesting the New York State Thruway Authority to proceed 'immediately with plans for Thruway con- struction from North Chatsworth Avenue eastward through the Town and 'Village of Mamaroneck, had been sent to the Thruway Authority. i 39 He said that plans for both a temporary roadway over the Chats- worth Avenue Bridge and the Mamaroneck Cloverleaf in the Village of Mamaroneck, have been completed . Councilman Kane reported with regard to the need for temporary parking during the period of the 'thruway construction, that he understands one or two lots on the north side of Myrtle Boule- vard, across from the Railroad Station are to be used for parking during the construction period. i The Supervisor stated that he had, on January 31, 1955, re- ceived a petition from Albert Construction Co. , owners of approximately 8 acres of property on the westerly side of Mamaro- neck Avenue between the northerly boundary of the Village and the westerly reservoir of the Water works, asking that this land be annexed to the Village of Mamaroneck on the ground, apparently, that the Village of Mamaroneck is better equipped to furnish the ordinary municipal services as the owner intends to build houses on this property which is now vacant and unim- proved. He stated that he had submitted this to the Town Attorney but since he was unable to be present, he had put his comments and suggestions in writing. I These are to the effect that under Section 348 of the Village Law, the Supervisor, within 10 days after the receipt of such petition, must post notices in 5 public places within the territory to be annexed, calling a public hearing not less than 10 nor more than 20 days thereafter, at which the Town Board must pass upon the questions of whether or not the petition is properly signed, con- tains the necessary facts, etc . He also comments on the fact that the Village thereafter may take action to accept this property and in connection therewith, should assume the proportionate share of the bonded indebtedness against this property created prior to the annexation. With the application, there was a check for $100 payable to the Town of Mamaroneck, which is a deposit to cover expenses of the Town Clerk and members of the Town Board, at the rate of $5. a day for time spent in processing this petition. On motion by Councilman Waterman, seconded by Councilman Brush, it was, upon roll call, (Councilman McKeever not voting) unanimously RESOLVED 'that the Supervisor is authorized, pursuant to Section 348 of the Village Law, to have prepared a. notice to be posted in 5 public places within the territory to be annexed and which is described in the notice, which notice is to be as follows: PUBLIC NOTICE PLEASE TAKE NOTICE that I have, on January 31, 1955, received a petition verified by Albert Construction Co. , stating that it is the owner of certain premises des- cribed in the petition as follows : ALL that lot or parcel of land in the Town of Mamaroneck, County of Westchester and State of New York, on the west of Lot 1 on a certain map "Subdivision Map of Section 1, Moor- land Estates, Village of Mamaroneck, Town of Mamaroneck, Westchester County, N. Y." made by Ralph Cronquist, dated April 18, 1951, and filed May 31, 1951, in the County Clerk's Office, Division of Land Records, as Map No. 7395, more particularly bounded and described as follows : I 41 ' BEGINNING at a point on the southerly side of Mamaroneck Avenue, which point is the westerly side of loot 1 as shown on the aforesaid map; running thence along the westerly boundary of the incorporated village of Mamaroneck and said lot and along the westerly line of land as shown on Bap of Section 2 of Moorland Estates filed in the County Clerk's Office as Map No . 7330 and along the westerly line of land now or formerly of Cabalon Holding Co. , Inc . , the following courses and distances : South 170 51' 20" East 1130 .25 feet and South 210 44' 40" West 309.31 feet to a point on the northerly line of land of the County of Westchester (Saxon Woods Park) ; running thence along said land and along a stone wall, the following courses and dis- tances: North 390 39' 40" West 310.64 feet, North 39® 34' 30" `Nest 339.03 feet and North 41° 24' 30" Hest 94.52 feet to a point of curve; thence continuing along the easterly line of land of the County of Westchester in a northeasterly direction on a curve to the right having a radius of 412.54 feet, a distance of 665.95 feet to a point of tangency; thence continuing along the said lands of the County of Westchester running along the easterly line of land of the Westchester Joint Water Works, No. 1, North 51® 04' 55" East 106.14 feet to a point on the southerly side of Mamaroneck Avenue; running thence along said side of Mamaroneck .Avenue in an easterly* direction on a curve to the left having a radius of 409 feet, a distance of 116.74 feet to the point or place of beginning. in which petition the petitioner prays that the Village of Mamaroneck shall annex the property above described, pursuant to the provisions of Section 343 of the village Law. TAKE FURTHER NOTICE that a public hearing will be held pursuant to said Section 343 of the Village Law, at the builder 's shack or office erected on the premises, which is a place within such territory, on the 19th day of - February, 1955, at 11 A. M. , which public hearing is upon the application of Albert Construction Co. for consent by the members of the Town Board to the petition for annexation. I TAKE FURTHER NOTICE that at the time and place stated in this notice, the Town Board will hear any objections which may be presented against such proposition for annexation as provided in Section 343 of the Village 'Law. FURTHER RESOLVES that the Town Board meet as stated in said notice on the 19th day of February at 11 A. M. , at the builder 's shack on the premises owned by Albert Construction Co. and situated on the westerly side of Mamaroneck Avenue between the northerly boundary of the Village and the westerly reservoir of the hater Works, for the purpose of holding a meeting upon the application for annexation as stated in the notice and to hear any objections which may be presented . The Supervisor read Mr. Delius ' report on the matter of the extension of Sewer District No. 1 in the prince Willows area. This report stated that there were some minor changes necessary in the petition and went on to state that the next step is to obtain a permit from the New York State Department of Health Water Pollution Control Board under the pro- visions of the Public Health Law. Plans and specifications will be necessary for this and a report of the designing engineer. The appli- cation must be signed either by the officials of the municipality or commission having charge of the work or the designing engineer, if accompanied by a letter of authorisation. The Board should probably, therefore, designate an engineer to make this application and prepare the necessary plans and specifications . 43 Mr . T. Stanley Gregory who had been requested to be present at this meeting, announced that the preliminary plans are not sufficient to permit taking bids . After discussion, the Board recommended that the firm of Cronquist and Gregory, comsulting engineers, consult with the New 'York State Health Department to ascertain gust what will be necessary in the way of plans and specifications for a. permit to begin construction. ?fir. Gregory stated that final plans completed, by his firm would. cost $S,00t'J. The Supervisor instructed the engineers to go. a.head but added that he would only pay $400 or $500 at this time . "If the plans are approved and if we gain approval at the public hearing on the proposal , we 'll go on with it .P4 Yr. Delius ' report had stated that after a permit is obtained, the Town Board can order a public hearing but the final resolution approving and establishing the extension to the district, cannot be made until the approval of the State Comptroller is received . Mr. Daniel Cio€foletti, 82 Weaver Street, appeared to again ask the Board about the matter of a sewer to serve his property on Ferndale Road . Councilman McKeever presented a blueprint and estimate in the amount of approximately $1, 500, prepared by A. J. Foote . The Board discussed this and agreed that it would not be wise to establish a precedent . It was suggested that Mr. Ciofffoletti contact the other people on the street in an attempt to have them help in installing this sewer line . Mr . Cioffffoletti did not think this would be practical . The Board did not take any action. There being no further business to come before the meeting, it - adjourned at 5:30 P. PAP. , and immediately reconvened as the Board of Fire Commissioners . Councilman Waterman presented the Fire Inspector's Report for November and December, 1954.
