MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO-
NECK, HELD JANUARY 19, 1955, IN THE COURT ROOM OF MAMARONECK TOWN
POLICE HEADQUARTERS AT 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK.
PRESENT: Supervisor Mandeville
Councilmen Kane, Brush, and Waterman
ABSENT: Councilman McKeever
Presence was also noted of Mr. Gronberg, Town Clerk, Mr. Delius, Town
Attorney, Mr . Finson, Town Accountant, and Mr. O'Brien, Superinten-
dent of Highways .
The Supervisor called the meeting to order at 8: 15 P. M. and said
that he would dispense with the regular order of business to hear
the unfinished business from the last meeting, i.e . re-zoning
of property on the Boston Post Road at the entrance to Rock Ridge
Road .
Mr. Jerome Wanshel addressed the Board and submitted two propositions .
He said he had had a meeting with Mr . Delius and Mr . Sansone and
was here at this meeting to request a public hearing on one or the
other of these two propositions . He exhibited the new Larchmont
Zoning Law which he said contains a 15-foot set-back on side
streets in a business zone where it adjoins a residential zone .
Mr. Sansone said he has not changed his position on this matter.
The Supervisor said it is the custom of this Board to grant a .public
hearing when requested .
On motion by Councilman Waterman, seconded by Councilman Kane, it
was unanimously
RESOLVED that a. public hearing be held on Proposition
No. 1, and that the following notice be published:
PUBLIC NOTICE
PLEASE TAKE NOTICE that the Town Board of the Town of
Mamaroneck will hold a public hearing on the 16th day
of February, 1955, at 8: 15 P. M. , in the Court Room
of Mamaroneck Town Police Headquarters, 11 Edgewood
Avenue, Town of Mamaroneck, for the purpose of con-
sidering a proposition to amend the Zoning Ordinance
of the Town of Mamaroneck so as to add a new paragraph
to Article III , Section 13 of the Zoning Ordinance, to
be known as Subdivision 7, which will read as follows :
7. Notwithstanding anything to the contrary herein
contained, a corner lot in a Class C District
(Business) where one side of the lot fronts on
a main thoroughfare and another side of the lot
fronts on a side street, and which lot is adjacent
to a residential Use District, the minimum side
yard on the side street shall be not less than
ten feet.
PLEASE TAKE FURTHER NOTICE that all persons present will
have an opportunity to be heard.
Next, Mr. John J. Mann, 10 Wildwood Circle, representing a
group of residents from the Pryer Manor Bridge area who were
present, asked the Board what progress had been made on the
bridge project .
Mr. Delius explained the situation in general .

Dr. Herbert Conway, 1 Pryer Manor Road, and Mr. William Hickey,
15 Dogwood Lane, were concerned about how long it will take
to repair the bridge .
The Supervisor said everything possible will be done to speed
its completion.
Mr. Mann thanked the Board for its continued consideration and
cooperation.
Mr . Irwin Oster, representing the Split Tree Realty Corporation,
said his company has 300 additional feet of highway to be dedi-
cated to the Town, and asked its acceptance.
Mr. O'Brien, Superintendent of Highways, stated that the road
in question has been improved to his satisfaction.
On motion by Councilman Waterman, seconded by Councilman Brush,
it was , upon roll call, unanimously
RESOLVED that the Town of Mamaroneck hereby accepts
the following portion of Split Tree Road:
PART of a parcel of land lying in the Town of Mamaroneck and
designated as Split Tree Road on map entitled "Part of Section
Two, Subdivision Map of Murdock Woods in the Town of Mamaro-
neck, Westchester County, New York" and filed in the Westchester
County Clerk's Office in the Division of Land Records on
October 21, 1952, as Map No. 7830. Said parcel being more
particularly bounded and described as follows:
BEGINNING at a point on the northerly side of Split Tree
Road, said point being on the division line of Lots
44 and 45 as shown on the aforesaid filed map R. 0. No.
7830; thence running along the northerly side of Split
Tree Road, S. 690 50' 20" W. 180 feet to a point of curve;
thence running on a curve to the left in a westerly and
southerly direction having a radius of 150 feet for a. dis-
tance of 227.20 feet ; thence running across Split Tree
Road, N. 730 03 ' 29" E. 50 feet to the easterly side of
Split Tree Road; thence running on a curve to the right
in a northerly and easterly direction having a radius of
100 feet for a distance of 151 .47 feet to a point of
tangency; thence running along the southerly side of Split
Tree Road, N. 690 50' 20" E. 215.18 feet; thence running
across Split Tree Road, N. 200 09' 40" W. 50 feet to the
northerly side of Split Tree Road; thence running S . 69°
50' 20" W. 35.18 feet to the point or place of beginning.
provided that G.B. and E . M. Corp. , owner of the above
premises, furnish a proper easement for drainage pur-
poses through Lot 42 on said Map No. 7830, and pro-
vided further, that all releases and easement be sub-
ject to the approval of the Town ?attorney.
Mr. Wanshel appeared for Mr . Frank Guadagnola, 195 Myrtle Boulevard,
and submitted plans and an artist 's conception of a proposed shopping
center, together with a petition asking for a re-zoning from Resi-
dential A to Business C of the entire block bounded on the north by
North Chatsworth Avenue, on the south by Madison Avenue, on the
east by Garfield Street, and on the west by Adams Street, and
requested the Board to set a date for a public hearing on this
matter.
Mr . A. G. Bogardus, 17 Overlook Terrace, said this is such a drastic
change that he would like to propose that it be referred to the
Planning Board for study and recommendation, and that any public
hearing be put off until they have acted .
Mr. Wanshel said he has no objection to going before the Planning
Board. However, he said that, since the Planning Board's action
will be only advisory, he would think it better to have the public
hearing first.
Mr. Bogardus objected .
The Supervisor suggested that both meetings be held at the same time .
Mr . Bogardus asked if the Planning Board does not make a decision,
- will the meeting be postponed.
Councilman Waterman suggested that the Planning Board be present
and that no action be taken until they give their recommendation.
The Supervisor objected to this as he said there might never be a
recommendation.

After some further discussion, on motion by Councilman Kane, seconded
by Councilman Waterman, it was unanimously
RESOLVED that a, public hearing be called for the 23rd day
of February, 1955, at 5: 15 P. M. , to be held in the
Auditorium of the Weaver Street Fire House, corner of
Edgewood Avenue and Weaver Street in the Town of Mamaro-
neck, for the purpose of considering the re-zoning
asked for.
FURTHER RESOLVED that this matter be referred to the
Planning Board, pursuant to Section 274 of the Town
Law for its report which is to be submitted to the
Town Board on or before February 23, 1955.
FURTHER RESOLVED that the Town Clerk is instructed to
publish the following notice:
PUBLIC NOTICE
PLEASE TAKE NOTICE that a public hearing will be
held on Wednesday, February 23, 1955, at 5:15 P. M. ,
in the Auditorium of the Weaver Street Fire House,
Corner of Edgewood Avenue and Weaver Street in the
Town of Mamaroneck, to consider the re-zoning of
the block or parcel of property bounded on the
north by North Chatsworth Avenue, on the south by
Madison Avenue, on the east by Garfield Street as
shown on Map of La.rchmont Heights, Map No. 2070,
and on the west by Adams Street, as shown on said
Map No. 2070, from Residence District A-1 to Busi-
ness District C , which property is known on the
Tax Assessment Map of the Town of Mamaroneck, as
Block 133, Parcels 145, 161, 179, 156, and 274, and
more particularly shown on the map or plan hereto
attached .
-- PLEASE TAKE FURTHER NOTICE that this matter has been
referred to the Planning Board, pursuant to Section 274
of the Town Law, to make a report on or before the
23rd day of February, 1955.
PLEASE TAKE FURTHER NOTICE that all persons at said
meeting will be given an opportunity to be heard .

The Clerk was asked to note that the matter was referred to the Plan-
ning Board for study.
Mr. Morton S . Levin, Old White Plains Road, appeared to learn what,
if anything, had been done about the matter of installing sewers
in the Prince Willows area. He said they had delivered the neces-
sary petition to the Assessor for approval, and would now fake to
know the next step. He said they had encountered some difficulty
with Messrs. Cronquist and Gregory.
After discussion, it was agreed that Mr. Mabel would contact Mr.
Delius to learn what to do next and the Clerk was instructed to
invite Messrs . Cronquist and Gregory to the next meeting of this
Board .

The Clerk presented sealed bids received in accordance with notice
published January 13, 1955, asking for bids to furnish:

After consideration, on motion by Supervisor Mandeville, seconded
by Councilman Waterman, it was , upon roll call, unanimously
RESOLVED . that this Board, with the approval of the Town
and County Superintendents of Highways, hereby accepts
the low bid, to wit, the bid of Chulew Motor Sales,
for furnishing 1 - Chassis and Cab equipped and mounted
with Model LP216 16 cu. yd. Gar Wood Loa.dpacker body
as per specifications on file in the office of the
Town of Mamaroneck, including additional equipment
as stated in published notice, for a net price of
$8, 742.
FURTHER RESOLVED that the Town Superintendent of High-
ways is hereby authorized, subject to the approval of
the County Superintendent of Highways, to surrender to
the above named vendor, one 1950 Chevrolet Dump Truck
Engine No. HEA 268954, Serial No. 2TWB-2566 as part
payment.

After consideration, on motion by Councilman Waterman, seconded by
Councilman Brush, it was, upon roll call, unanimously
RESOLVED that this Board, with the approval of the Town
and County Superintendents of Highways, hereby accepts

the low bid, to wit, the bid of Hory Chevrolet Co. , to
furnish one 1955 Chevrolet two-door custom deluxe sedan
model 2102, 6 cylinder for a net price of $917.69 .
FURTHER RESOLVED that the Town Superintendent of
Highways is hereby authorized, subject to the approval
of the County Superintendent of Highways, to surrender
to the above named vendor, one 1951 Ford 2-door sedan
model LBA, Motor No. B1EG-107463 and one 1952 Ford
_ 2-door sedan, Model 70B, Motor No. B2EG105597 as part
payment.
The Clerk presented sealed bids received in accordance with notice

for the Police Department, three (3) new 1955

Chevrolet two-door sedans, model 2102 , eight cylinder
cars in accordance with specifications, less allow-
ance for one 1954 Chevrolet sedan serial No. B54TO70116
Engine No. 019569OT54ZC and one 1954 Chevrolet sedan
serial No. B54T070077, Engine No. 0195689T54ZC for
the net price of $3, 780 .26.
Mr. West Hooker, 1 Overlook Terrace, appeared to request the Town
Board to go on record as recommending to the Fire Council that the
auditorium in the Fire House should be available to anyone who has
occasion to use it.
Mr . Hooker gave a resume of his difficulties in trying to arrange
a meeting to be held in the auditorium by the organization he
represents which is the Nationalist Party of the United States .
He said he has been trying to get the hall for the past year,
his object being to obtain members for his party, and place it
on the ballot.
The Supervisor informed him that the fire Council is responsible
for the auditorium and any application for its use must be made
to the Fire Council .
Mr . Hooker again asked if the Town Board would pass a resolution
recommending that the hall be granted to him or any individual who
wanted to use it .
The Board declined to take any action.
Mr. Daniel Cioffoletti, 86 Weaver Street, appeared to ask about a
sewer for his property on Ferndale Road .
The matter was referred to the Superintendent of Highways and the
Town Counsel for recommendation at the next meeting.
The Town Clerk presented :
A letter dated January 14, 1955, from Mr . John Sharbough, thanking
the Board for his reappointment as a member of the Park Commission.

Councilman Brush reported that on January 10th, he had attended a
meeting of the Recreation Commission and they are now studying a
request from a group of teenagers for a. teenage center to be built
on Town property near Hommocks Road . They are again meeting tonight
on the same subject . The teenagers are represented by Mr. John
Forrest and Peter Turtellot.
Councilman Waterman had nothing to report.
Councilman Kane, in line with the Supervisor's suggestion at the
-- last Board meeting, concerning a. new Town Hall, submitted an
article and picture which appeared in today's New York Herald
Tribune. This will be forwarded to the Planning Board .
The Supervisor presented a list of properties which had been sold
at public auction earlier in the evening and requested approval
of the sale.

On motion by Councilman Waterman, seconded by Councilman Kane,
the following resolution was, , upon roll call, unanimously adopted.
WHEREAS , the Town of Mamaroneck, through the institution of
actions in the County Court of Westchester County, pursuant to
Article VII-A, Title 3 of the Tax Law, has become and now is the
owner of a number of parcels of real estate situate in the Unin-
corporated Section of the Town of Mamaroneck; and
-- WHEREAS, the Town of Mamaroneck advertised for bids and held
a public auction on January 19, 1955, and received bids on certain
of said parcels of real estate now owned by the Town of Mamaroneck;
and
WHEREAS , since the receipt of said bids, this Board has given
careful consideration thereto, and after due deliberation, it is
RESOLVED that the bids hereinafter listed be
accepted at the price and terms therein set forth:

FURTHER RESOLVED that the Supervisor is authorized
and directed to execute and deliver deeds to these
parcels in accordance with the terms and contracts
of sale and the Town Attorney is authorized to take
all steps necessary to complete the sale and transfer
these parcels .
On motion by Councilman Waterman, seconded by Councilman Kane, the
following resolution was, upon roll call, unanimously adopted:
WHEREAS, the Town of Mamaroneck, through the institution of
actions in the County Court of Westchester County, pursuant to
Article VII-A, Title 3 of the Tax Law, has become and now is the
owner of a number of parcels of real estate situate in the Village
of Larchmont and Town of Mamaroneck; and

WHEREAS , both the Village of Larchmont and Town of Mamaroneck
held tax liens on said parcels of real property; and
WHEREAS, pursuant to Section 165H of the Tax Law, an agree-
ment was entered into between the Village of Larchmont and the
Town of Mamaroneck which, among other things, set forth the
interests of said municipalities in the properties being fore-
closed, the manner of the sale of said properties, and the
manner of the distribution of the proceeds received from said
sales ; and
WHEREAS , the Town of Mamaroneck has, pursuant to an agree-
ment had with the Village of Larchmont, advertised for bids and
- held a public auction on January 19, 1955, and received bids on
certain of said parcels of real estate now owned by the Town
of Mamaroneck; and

FURTHER RESOLVED that upon approval of the bids
by the Village Board of the Village of Larchmont,
the Town Attorney is authorized to proceed with
the preparation of contracts, and such other docu-
ments as are necessary to pass title to said pro-
perty, and the Supervisor is hereby authorized to
sign such contracts and deeds as are necessary to
pass title to said property.

FURTHER RESOLVED that upon approval of the bid by
the Village Board of the Village of Mamaroneck, the

Supervisor Mandeville presented the following petitions received
from the Assessor for the correction of the assessment roll so as
to permit the apportionment of taxes , and on motion by Supervisor
Mandeville, seconded by Councilman Kane, the following resolution
was, upon roll call, unanimously adopted :
WHEREAS, the Assessor has presented petitions for the correc-
tion of the assessment roll for certain years, pursuant to the pro-
visions of Section 557, Article 16 of the Westchester County Admin-
istrative Code, known as the Westchester County Tax Law; and
WHEREAS, after due consideration, this Board finds it desirable
to grant said petitions for the correction of said assessment roll,

The Supervisor suggested that the Board adopt a. resolution urging
the Thruway Authority to instruct her. Briggs, with all due haste,
to use his best efforts to have the plans and specifications
completed as quickly as possible for the Thruway from the Chatsworth
Avenue Bridge to the Village of Mamaroneck line. He also suggested
that Mr. Delius do what he can in this connection, in the Associa-
tion of Towns .
On motion by Councilman Kane, seconded by Councilman Waterman, the
following resolution was, upon roll call, unanimously adopted :
WHEREAS , the New York State Thruway Authority has let contracts
in connection with the work of constructing the Thruway in Westches-
ter County to North Chatsworth Avenue in the Village of Larchmont;
and
WHEREAS, further construction plans have been held in abeyance,
which will seriously affect traffic conditions and depress real
estate values, both residential and business ,
NOW, THEREFORE, BE 1T
RESOLVED that this Board hereby requests the Thruway Authority
to proceed immediately with plans for the construction of
the New England Thruway from North Chatsworth Avenue in
the Village of La.rchmont, eastward through the Town and
Village of Mamaroneck, in accordance with the general
plan of the Authority.
FURTHER RESOLVED that this Board urges the Thruway
Authority to proceed with all convenient speed to prepare
specifications and let contracts for the construction of
the section of the New England Thruway east of Chatsworth
Avenue.
FURTHER RESOLVED that the Town Clerk be and he hereby
is "instructed to forward a copy of this resolution
to the Thruway Authority,
The Supervisor reported that it was essential that the Assessor be
provided with a car in order to properly perform his duties and he,
therefore, recommended that the 1953 Ford Sedan which the Police
Department plans to turn in for a new Police (Department car, be
purchased from that Department for use by the Assessor.
On motion by Councilman Brush, seconded by Councilman Waterman, it
was unanimously
RESOLVED that there is hereby appropriated the sum of
$500 to the 1955 budget of the Assessor from Beneral
Town Surplus.
- FURTHER RESOLVED that the Assessor is hereby authorized
to purchase a 1953 Ford Sedan from the Mamaroneck Town
Police Department for the sum of $500.
The Supervisor reported that the Highway Department has a truck which
it apparently does not need for highway purposes and it is his recom-

mendation that a much greater allowance can be obtained by using
this as a trade-in against the purchase of a new garbage truck
which was provided for in the budget, rather than by a sale, and
that he, therefore, recommended that the Garbage Department purchase
this truck from the Highway Department at a fair value and then in
turn, use it as part of the purchase price for the purchase of
their new truck.
On motion by Councilman Brush, seconded by Councilman. Waterman, it
was unanimously
RESOLVED that the Garbage Department be and it hereby
is authorized to purchase one used 1950 Chevrolet
Dump truck Engine No. HEA268954, Serial No. 2TWB-2566,
from the Mamaroneck Town Highway Department, for the
sum of $500, from funds provided within the 1955
Garbage District budget .
The Supervisor presented a letter dated January 17, 1955, from Mr .
C . J. Quinn, Secretary to Police Commission, saying that the Com-
mission recommends the purchase of one emergency oxygen inhalator
to be installed in a patrol car at a cost of approximately $110.
Oxygen refills will cost approximately $17 each. Two cars are
already equipped and a third is necessary to round out the
Department's active patrol equipment .
On motion by Councilman Brush, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the Police Department be and it hereby
is authorized to purchase one emergency oxygen inhala-
tor to be installed in a patrol car at a cost of
approximately $110.
The Supervisor presented a letter, dated January 18, 1955, from
Mr. Orsino, Comptroller, requesting authorization to transfer
$1, 180.29, the surplus remaining in the 1954 Lighting District
budget, to the 1955 Lighting District budget.
On motion by Councilman Kane, seconded by Councilman Waterman,
it was, upon roll call, unanimously
RESOLVED that the Comptroller be and he hereby is
authorized to transfer $1, 180.29, the surplus re-
maining in the 1954 Lighting District budget,
to the 1955 Lighting District budget .

The Town Attorney stated that the County of Westchester is willing
to accept the sewer pumping plant on Fenimore Road with the force
main and also the pumping plant on Colonial Avenue near Murray
Avenue, and to maintain these in the future as part of the
Mamaroneck Valley Sewer District .
The Supervisor added that the acceptance will depend on the expen-
diture of some money to put these plants in condition for accep-
tance by the County and the County would prefer to do the work
and be paid therefor by Sewer District No. 1 in the Town.
On motion by Councilman Waterman, seconded by Councilman Brush,
it was, upon roll call, unanimously
RESOLVED that the Town of Mamaroneck hereby
transfers to the Westchester County Sanitary
Sewer Commission, the pump station on Fenimore
Road and the land upon which it is built, which
is described as follows :

line between the Village of Mamaroneck and the Town of Mamaro-

chester County Trunk Sewer and also the pumping plant in the
bed of Colonial Avenue, approximately 10 feet from the
easterly side of Murray Avenue .
The Town Attorney explained to the Board that since the last meet-
ing, he had submitted a bill authorzing and permitting the Town of
Mamaroneck to pay to the City of New Rochelle, 50% of the cost of
construction and maintenance of the pryer Manor Bridge, provided
the City acquired the same as a public bridge in the City of New
Rochelle; that when he had submitted this bill to the legal staff
of the City, they had suggested a change and proposed that the
bill provide that the City of New Rochelle be authorized to accept
the bridge as a City bridge because apparently they now have some
doubts as to whether this can otherwise be done.
He said that the Corporation Counsel of the City of New Rochelle
had re-drawn the bill with some changes and a further provision
that the Town might enter into a contract for the future mainten-
ance of the bridge. Mr. Delius said that he would have preferred
to exclude this . The Supervisor, however, warned that if the City
of New Rochelle wants this, it had best be included as, otherwise,
the City may not go through with the proposition.

The Town Attorney then submitted the bill and on motion by Council-
man Kane, seconded by Councilman Waterman, it was unanimously
RESOLVED that this Board hereby approves the bill
prepared by the Town Attorney entitled "AN ACT
AUTHORIZING THE CITY OF NEW ROCHELLE, WESTCHESTER
COUNTY, TO ACQUIRE PRYER MANOR BRIDGE WHICH SPANS
THE PREMIUM RIVER, THE CENTER LINE OF WHICH IS
THE BOUNDARY LINE BETWEEN THE CITY OF NEW ROCHELLE,
WESTCHESTER COUNTY, AND THE TOWN OF MAMARONECK,
WESTCHESTER COUNTY, AS A PUBLIC BRIDGE, AND AUTHORIZING
THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, TO PAY
50% OF THE COST OF THE MAINTENANCE OF SAID BRIDGE, "
which reads as follows :
The People of the State of New York represented in
Senate and Assembly, do enact as follows:
Section 1. The City of New Rochelle, Westchester County,
is authorized to acquire as a public bridge, the Pryer
Manor Bridge, a bridge in the City of New Rochelle and
Town of Mamaroneck which spans the Premium River, the
center line of which is the boundary between the City of New
Rochelle and the Town of Mamaroneck.
§ 2. Notwithstanding the provisions of the Highway Law,
the Town of Mamaroneck, Westchester County, is authorized
to pay to the City of New Rochelle, if it acquires the
Pryer Manor Bridge under Section 1 of this act, fifty per
cent of the cost of maintenance including repair and
reconstruction when necessary of the said bridge which
spans the Premium River, the center line of which river
is the boundary line between the Town of Mamaroneck and
the City of New Rochelle or to enter into a contract
with the City of New Rochelle therefor .

§3 . A request for payment may be submitted annually
by the chief fiscal officer of the City of New Rochelle to
the supervisor of the Town of Mamaroneck on or before November
1st in any year except that in the year 1955, when such
request may be submitted on or before July 1, 1955. Such
request, when submitted, shall be accompanied by a verified
statement of the actual cost of such maintenance, repair or
reconstruction incurred for a period of twelve months
preceding such request.
§4. This act shall take effect immediately.
FURTHER RESOLVED that the Town Attorney be
and he hereby is instructed to use all
honorable means to secure the passage of
this bill and, if necessary, to consent
to amendments not substantially altering
the purposes and objects to be attained .
FURTHER RESOLVED that copies of this
resolution be furnished to Assemblyman
Venter Meighan and Senator Frank S .
McCullough, who are hereby urged to
secure passage of this bill by the
Legislature .
