Mir . 3emadict Ginsberg, 11 Bishop Place , presented and read a,
letter, dated November 24, 1u?54, and addressed to the Board by
himself, which stated in effect that there is land close to the
Larchiront Railroad Station suitable for for severe..! hun-
dred cars , o,,T,,ned by the Westchester C'oumty Paxl�, Commission and
originally acquired for the proposed Pelham-Port Chester P2rk-way:

The Supervisor said he feels the parking meters will tape care of the
situation . The letter was received and filed .
Councilman Waterman said the Town had considered leasing or pur-
chasing additional property but there is substantial expense for
grading and paving any parking area. If the parking meters do not
solve the problem, the Board will get extra space, because the
problem is going to be solved .
Chief Yerich stated that the peak of the parking problem is from
October 1 until shortly after the New Year . In the summer there is
plenty of parking space .
The Supervisor said the Board is trying to solve the situation with-
out making it a burden to the taxpayers . Three years ago, the
present project was shelved because it was believed that the Thru-
way would go through and destroy the parking area. However, he said,
pressure has been such that something must be done at once .
Mr. A . G. Bogardus, 17 Overlook Terrace, asked if the Chief has any
information as to what percentage of the cars parked are out-of-Town
cars . The Chief said he would Bess about 50%.
The Supervisor said there is 28% from New Rochelle and 12% from
other adjacent communities . They come from as far away as Greenwich,
Mr . Bogardus asked if any thought had been given to an area for the
Town residents, and was told that this had been considered but it
is not a practical solution,
Mr . Budd Lynton also spoke about a special parking license for the
Unincorporated Town residents .
Mr. Albert Gould, 526 Cortlandt Avenue, Mamaroneck, said that he
understood the Town had received a letter, dated August 4, 1954,
from the Westchester Joint Water Works , relative to a water line in
his property. He said he is willing to put up the necessary amount,
$21812.60 .
The letter, dated August 4, 1954, from Mr . George H. Straub, addressed
to Supervisor Mandeville, was presented to the Board, together with
an estimate from the Water Company, and stated that Mr . Albert Gould
had reouested an estimate on the cost of installation of a new 61,
main and fire hydrant in the new street in his development south
of Wesleyan Avenue, along Old White Plains Road, and that such an
estimate was attached to the letter but did not include excavation,
backfill, or paving. The letter went on to request that a copy of
the resolution be sent to the Water Company, A the project were
approved .
On motion by Councilman Waterman, seconded by Councilman Brush, it
was, upon roll call, unanimously
RESOLVED that the Town Board hereby approves the usual
agreement between Testchester Joint Water Works , No . 1,
Albert Gould , 626 Cortlandt Avenue, Mamaroneck, N Y.
and the Town of Mamaroneck, for the installation of
500 feet of i inch cast iron pipe and a fire hydrant
in a new street in Yr . Gould 's development known as
Map of Winged Foot Knolls, Section 2, Hap Ko . S343
south of 7eslayan Avenue, along Old White Plains Road
at a total cost not to exceed $0, 312 . iO, provided that
applicant furnish an easement satisfactory to the
Town Attorney.

Councilmen Brush, Kane and Waterman had nothing to report.
Supervisor Mandeville commended and complimented Mr. Delius on the
memorandum submitted by him on the new State Equalization rate for
towns. Mr. Mandeville said he had used it at the meeting of the
Board of Supervisors and distributed copies to other interested
Supervisors. Mr. Delius and Mr. Mandeville will go to Albany to
attend a hearing on this on December 3rd.
Mr. Delius explained the new ratio of assessment to true value, and
asked the Board to authorize the Supervisor to sign the protest.
On motion by Councilman Kane, seconded by Councilman Waterman, the
following resolution was unanimously adopted:
e,'HEREAS , the Tax Commission of the State of New York has ten-
tatively fixed the equalization rates for towns in the State of New
York, pursuant to Article two-a of the Tax Law as added by Chapter 874
of the Laws of 1953, and given notice of a hearing before such Com-
mission in the City of Albany, New York, on December 3, 1954, for the
hearing of protests duly filed; and
?HETEIS , the tentative rate as fined for tie Town of Hamaronecl-,
is 501 and the Westchester County Tax Commission fixed the eoualiza-
tion rate at S2%; and
VHEREAS , such tentative rates are approximately one-third below
the rates fixed by the Testchester County Tax Commission and the
egualimation r_., es established by the State Tax Commission in ure-
vicus years ; and
WHEREAS , such reductions would result in a corresponding de-
crease in revenues from special franchises levied by the towns,

RESOLVED that the Supervisor be and he hereby is
authorized to make protest to the State Ecard of
Equalization and Lssessment and file objections to
the tentative ecualization rate for the Town of
Mamaroneck as fixed by the State Board of
Equalization and Assessment .
FURTHER RESOLVED that the Supervisor and Town Attorney
be and they hereby are authorimed and directed to
attend the public hearing before the State Board of
Equalization and Assessment to be held in the City of
Albany on December 3 , 125J, at 10 A . Y. , in connection
with such protest .
Er . Delius presented the new Parking Meter Ordinance to the Board
and said he wished to suggest some very minor changes . Er . Waterman
said that Er . Delius had done a very accurate and careful job on this
Ordinance and he would recommend its passage with these minor changes
or amendments . Therefore , an motion by Councilman "!a, erntan, seconded
by Councilman brush, it was, upon Poll call , unanimously
RESOLVED : that this board hereby adopts the
following Parking Meter Ordinance :
PARKING METER ORDINANCE
An ordinance relating to traffic and regulating the use
of public streets and highways in the Town of Mamaroneck;
prescribing regulations relative to the larking of motor
vehicles upon such public streets and highways ; and providing
for the establishment of parking meter zones in certain areas
L;'`, ned and/or !eased by the Town of Kamaroneck; providing for
the enforcement thereof; and providing penalties for the viola-
tion thereof, pursuant to the provisions of the Vehicle and
Traffic law of the State of New York.
Section 1 . DEFINITIONS FOR THE PURPOSE OF THIS ORDINANCE .
Q' The word "vehicle" shall mean any device by which any person or
property may be transported upon a highway, except that operated
upon rails or tracts .
(b) The words "metered municipal Parking field" shall mean any, land
=_ area heretofore or hereafter acquired by and/or leased by and
operated by the Town of Eamyroneck as a public parking field for the
parking of motor vehicles off the streets of the Town and heretofore
or hereafter designated by the Town Board as "metered municipal
parking fields'' .
(c) The word "Person" shall mean and include a natural person, firm,
association, co-partnership or corporation .

Section 7 . it stall be unla7ful to deposit or cause to be
deposited in any larking meter, any slug, device, or a metallic
substitute for a coin of the Unitaf States .
Section S . it shall be unlawful for any person to deface, injure,
tamper with, open, willfully break, or destroy any parking meter .
Section 3 . It shall be the duty of the patrolman or police
officer assigned thereto, to tate the number of any meter
in any "metered municipal Ca- inn field" or along any street
in which "Parting meter zones" have been established by this
Ordinance, at which any motor vehicle is overvarked as provided
in this Ordinance, and the tate Hot or Vehicle tag number of
such motor vehicle, and mate complaint therefor in tie police
Court having -Jurisdiction, together with the length of time
during which said motor vehicle is parkas in violation of any
provisions of this Ordinance, as well as any other facts a.
knowledge of which is necessary to a thorough understanding
of the circumstances attending such violation. Such police
Officers or patrolmen shall attach to every motor vehicle,
parking in violation of any of the provisions of this Ordinance,
a notice or tag that such motor vehicle has been so illegally
parted, and instruct the operator to appear in court and that
each such operator may, within 43 hours of the time when such
notice was attached to such vehicle, pay to the Town Clerk at
the Police Station, 11 Edgewood Avenue, Town of Mamaroneck, per-
sonally or by mailing same to "Town Clerk, 11 Edgewood Avenue,
Lanchmont, N. Y. " , as a penalty for and in full satisfaction
of such violation, the sum of "1 . 00 . The failure of such
operator to make such payment of SIM within said 48 hours ,
shall render such opera.for subw'ect to the penalties thereafter
provided in Section 11 of this Ordinance .
Section 10 . The parking meters herein provided for shall control
parting only between the hours of 7 A . N. to 7 P . E, daily except
Sundays and legal holidays . When said parking meters are not con-
trolling parking as in this section provided, motor vehicles may
be parted without inserting any coin in said meter, but the parking
lines adjacent to said meters shall doe adhered to in such parking in
the same manner as is required during other times .
Section !I . Any person violating any provision of this Ordinance
shall be guilty of a misdemeanor and may, upon conviction, be
punished for the first offense by a fine not exceeding $5.00, and
for the second offense, by a fine of not more than $10 .00, and for
any subsequent offenses, by a fine of not more than $25.00 .
Section 12 . This Ordinance is intended to and shall be in
addition to all other Ordinances , rules and regulations concerning
traffic7 larking, and the use of streets in the Town of Mamaroneck,
and shall not be taken to repeal any other Ordinance of part of any
Ordinance, unless in direct conflict therewith.
Section 13 . Each separate section and each separate provision of
each section of this Ordinance shall be deemed independent and
separate from every other section and provision, and the invalidity
of any section or part of a section of this Ordinance stall not
affect the validity of the remainder of said section or the remainder
of this Ordinance, it being the intention of the Town Board of the
Town of Mamaroneck to enact as a law, separate provision herein
regardless of its relationship to any or all of the other pro-
visions , and regardless of the invalidity of any other provision ,
FURTHER RESOLVED that the Town Clerk shall
post and publish notice of the adoption of
this resolution as required by Town Law.
