HomeMy WebLinkAbout1954_10_06 Town Board Minutes 761 MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARO- NECK, HELD OCTOBER 6, 1954, IN THE COURT ROOM OF MAMARONECK TOWN POLICE HEADQUARTERS AT 11 EDGEWOOD AVENUE, TOWN. Supervisor Mandeville called the meeting to order at 8: 15 P. M. PRESENT: Supervisor Mandeville Councilmen McKeever, Kane, Brush, and Waterman ABSENT: None Presence was also noted of Mr . Gronberg, Town Clerk, Mr. Delius, Town Attorney, and Mr. O'Brien, Superintendent of Highways . The Clerk presented and read a letter addressed to the Town Board, dated September 29, 1954, from Mr. Lloyd A. Maeder, Director of the State Traffic Commission, stating that Chief Yerick had recently re- quested the establishment of a bus stop on the south side of Route 1, immediately east of Dillon Road ; that the Traffic Commission has issued an order covering the requested bus stop (copy enclosed with letter) ; and that the Department of Public Works will erect a. sign posting the restrictions as soon as possible . This letter was received and filed. The Clerk submitted the following reports : Building Report for September, 1954 Report of Receiver of Taxes for September, 1954 Town Clerk's Report for September, 1954 Statement of Bank Balances as of October 1, 1954 Summary of Receipts and Disbursements, January 1 to August 31, 1954 Analysis of Budget Appropriations and Expenditures, January 1 to August 31, 1954 Analysis of Estimated Revenues, January 1 to August 31, 1954 List of Claims Audited and Paid by the Comptroller from September 1 to October 1, 1954 The Clerk presented affidavit of publication of notice that the Town Board would receive bids for parking meters, together with bids which had been submitted in accordance with said notice . M. for the Board to witness a demonstration of the meters . Mr. James Harding, Commissioner of Public works of the County of Westchester, presented Mr . Simon Carman, Engineer of the County Stater Agency and Mr . Alfred IV. Sawyer of the engineering firm of Hazen and Sawyer, 110 East 42nd Street, New York City. Supervisor Mandeville said that Mr. Sawyer would address the Board on the matter of the future development of the Westchester Joint Water Forks, No. 1, which services the Town and Village of Mamaro- neck and the Town of Harrison. Mr. Mandeville said the `dilater Com- pany's charter provides for agreement by the three municipalities on any major or capital expenditure . Inasmuch, therefore, as this Board has always been kept informed, the Supervisor said he had invited Mr. Sawyer and Mr. Harding to appear tonight . Mr. Sawyer then talked to the Board and gave a resume of his report to the water Company. Mr . Harding, as Chairman of the Westchester County dater Agency, gave some of the background of the water situation throughout the County, and particularly in Mamaroneck. Mr . strongly supported Mr . Sawyer 's report, which presents three solu- tions to the water problem and recommends the one which would take water from the Delaware water Gap . Mr. Walter E. Starner, Jr. , Chairman of the Swimming Pool Committee, submitted the Committee 's report. He said the Committee recommends the construction of a. Town-owned and operated swimming pool and reports that there is a definite need in the community for such a pool. The report was unanimous with one exception. There was, how- ever, no dissenting report. Mr. David Eggers , Architect, presented plans and sketches and ex- plained the proposal to the Board . It was decided that there would be another meeting in the near future for further consideration of this project. Councilman Brush said he had gone on a. tour of the 24 Town-owned parks with Mr . Julian Cargill, Chairman of the Park Commission, and Mr. Aitchison, Park Foreman, and he was happy to report these parks are in excellent condition and the Park Department is doing a fine job, especially in the Gardens Lake Park and the Station Park. Councilman Brush also suggested that on Weaver Street, between the Post Road and Palmer Avenue, that parking be prohibited on both sides of the street. This was referred to the Police Department for study. i Councilmen McKeever and Kane had nothing to report. The Supervisor submitted a. proposed compensation plan for the Town of Mamaroneck and recommended that it be adopted and put into opera- tion on January 1, 1955. He said this is the result of an analysis and study of all salary plans throughout the County, and a comparison of salaries and classifications of individuals . The Town Attorney presented a. letter from the Village of Mamaroneck asking that the Town give a quitclaim deed to Block 806 Parcel 1 on the Town Assessment Map, property in Mamaroneck Knolls, which had 765 been sold by the Village to Bernard Fraioli, the sale having been approved by the Town on February 10, 1954, but which since then was included in the foreclosure proceeding in rem commenced by the Town in April, 1954. On motion by Councilman McKeever, seconded by Councilman Kane, the following resolution was, upon roll call, unanimously adopted: WHEREAS, this Board, by resolution adopted February 10, 1954, approved the sale by the Village of Mamaroneck of a. portion of the property known as Block 806 Parcel 1 on the Assessment trap of the Town of Mamaroneck and as Section 8, Block 12, Parcel A on the Assessment Map of the Village of Mamaroneck, to Bernard Fraioli, for $4,440, which said property had been acquired by the Village in a foreclosure proceeding in rem, conducted by it; and WHEREAS, in connection with such approval, this Board further approved the retention by the Village of Mamaroneck, for municipal purposes , of a portion of the property which lies in the bed of the street known as Drury Drive as shown on Amended Subdivision Map of Mamaroneck Knolls, R. 0. Igo. 3152 and also the retention of a. 30-foot easement at the westerly or southerly boundary of said property, for drainage purposes ; and WHEREAS, thereafter and prior to the consumation of said sale, the Town of Mamaroneck acquired said property in a certain foreclosure proceeding in rem, entitled "In the Nia.tter of the Fore- closure of Tax Liens pursuant to Article VIZ-A, Title 3 of the Tax Law, by the Town of Mamaroneck, List of Delinquent Taxes for 1954" by reason of the non-payment of taxes for a. period of 4 years prior to April 29, 1954, the date when the list of delinquent taxes in said proceeding was filed in the County Clerk 's Office; and WHEREAS, said premises were included in the deed delivered by the Supervisor acting as the Collecting Officer, to the Town of Mamaroneck and which was recorded on September 22, 1954, in the County Clerk's Office of the County of Westchester; and TTHEREAS , the Village has now requested that the Town give a. quitclaim deed to the :tillage in order to clear the title and enable the Village to consumate the sale to Bernard Fraioli, provided that the proceeds of sale be divided between the Town and Village in accordance with a certain agreement entered into between the Town and Village pursuant to Section 165H of the Tax Law, NOW, THEREFORE, BE IT RESOLVed that the Supervisor is authorized to deliver to the Village of Mamaroneck, a quit- claim deed of the property known and described as Parcel A on Amended Subdivision Ma.p of Mamaro- neck Knolls, made by A. J. Foote, Civil Engineer, June 3, 1927, filed in the County Clerk's Office, Westchester County, on Jame 3, 1927, as Map No. 3152, and also known as Block 806 Marcel 1 on the Town Assessment Map, and Section 8, Block 12, Parcel A, on the Village Assessment Map. The Town attorney stated that in connection with the sale of Block 104, Parcel 111, property on Weaver Street adjoining the La.rchmont water Company property, the Village of La.rchmont had requested that the Town reserve out of the sale, the 50 foot strip along the northerly side of this property which is shown as Sheldrake Avenue upon the Assessment Map of the Town of Mamaroneck. P76 Ise stated that the property had been purchased by Joseph Gulia. for $1, 675 on April 7, 1954, but that since that time, the purchaser had expressed his willingness to accept a. deed to the property, exclusive of the 50-foot strip known as Sheldrake Avenue, inasmuch as the Title Company would not insure the same because of possible easements over it . Fe also presented a. letter from George P. Forbes , the Village Attorney, stating that the Village would pay IS100 for the 50-foot strip. __- Upon motion by Councilman hlcYeever, seconded by Councilman Kane, it was, upon roll call, unanimously RESOLVED that the resolution heretofore adopted by the Town, approving the sale of premises known as Block 104 parcel 111 to Joseph Gulia, be amended so as to provide for the sale of the same, exclusive of the 50-foot strip or street known as Sheldrake Avenue along the northerly boundary. FURTHER RESOLVED that this Board hereby authorizes the sale to the Village of Larchmont of the following strip of property which constitutes a street which is 50 feet wide and which is known as Sheldrake Avenue on the Tax Assessment Map of the Town of Mamaroneck, for $100, and which is bounded and described as follows : i ALL that certain lot, piece or parcel of land situate, lying and being in the Town of -Hama.roneck, Westchester County, State of New York, known and designated as Block 104, part of parcel 111 on the Tax Assessment Map of the Town of Mamaroneck, being more particularly bounded and described as follows : BEGINNING at a point of intersection of the westerly side of Weaver Street and the northerly line of Sheldrake Avenue; thence running along the northerly side of Shel- drake Avenue which is also the southerly boundary line of lands now of the Village of Larchmont, S . 800 53 ' 5011 77. 395. 70 feet to lands of the Village of Larchmont ; thence along the boundary line of lands of the Town of P;Iama.roneck and Village of Larchmont, the following courses and dis- tances : S . 5° 31 ' 101' F . 27.0-0 feet and S . 80 20 ' 50" W. 23 .24 feet ; thence .running through lands of the Town of Mamaro- neck and along the southerly line of Sheldrake Avenue, N. 800 531 50" E . 402 .76 feet to a point on the westerly side of Weaver Street ; thence northwesterly along the westerly side of Weaver Street, K. 70 13 ' 10" W. 50.03 feet to the point or place of beginning; said parcel being shown as Sheldrake avenue on the Assessment Map of the Town of Mamaroneck. The Town Attorney stated that the State Auditors had suggested that dumping permits should hereafter be issued by the Town Clerk, but after discussion, the Board preferred to have these permits issued by the Superintendent of Highways . There being no further business to come before the meeting, it adjourned at 10: 50 P. PCs . , and immediately re-convened as the Board of Fire Commissioners . Councilman Waterman submitted the Fire Report for September, 1954. There being no further business , the meeting adjourned at 11 D. M. , to meet again on October 20, 1954 TJ Clerk
