The Supervisor then announced that he wished, on behalf of Councilman
Kane, to recommend that a resolution be adopted, commanding the pilot
who recently crashed in Long island Sound, after beCOMing aW2re
[while over 7onkers) that his plans was in serious trouble . He said
this pilot deserved great praise for his bravery and presence of
mind, and suggested that a copy of the resolution be sent to his
Commanding Officer
On motion by Supervisor Mandeville, on behalf of Councilman Nana,

expenses of Chief Yerich for attendance at the 19-14' Conference of

$300 . to cover expenses of Chief Yericz for attendance at the
International 'Issociation of Chiefs of Police to be held at Nel,,,r

was, upon roll call, unanimously
.ESOLVED that Chief Paul Yerick be and he hereby
is authorized to attend the New York State Associa-
tion of Police Chiefs ' Convention in New Yorh City
on July 26, 27, 28, and 2C, and that expenses not
exceeding $'30 , be paid out of the item in the
Budget appropriated for the same .

Norman Tishman, 445 Park Avenue, New York 22, N , Y. , stating that
a.t the time of the construction of his home at 1000 Old Mamaroneck

that, since there 5.vas only one other house to the east oLf the entrance
to the Golf Club, the Town could not extend the water supply. He
went on to say that he has had to call out the Fire Department on
different occasions -for brush fires and, as there have been approxi-
mately 10 or 12 houses built in the vicinity during the past year,
he thinks the lack of water supply, particularly for fire protection,
is now a public ha-zard, lie respectfully requests and urges the Town
to extend the present water supply to the east on Old Mamaroneck
Road, from where it now ends at the Ivinged Foot Golf Club entrance,
to a point that will include all of the new houses built or nosy
being built on this road , Be has his own water supply from a well
and, therefore, is not making this appeal in order to get normal
water supply.
This matter was referred to the Superintendent of the ' a.ter Com-
pany nor study and recommendation.

Councilman Brush reported that the .recreation Commission had held its
first meeting, elected =dr . Talter Z. Warner, Chairman, and will meet
again on July 12th. Mr . Brush said the Commission cannot function
successfully until there is a. full Board, and he requested that the
Board make the necessary appointment .
Upon motion by Supervisor Mandeville, seconded by Councilman Waterman,
it was , Capon roll call, unanimously

member of the Recreation Commission established by
this Board at a. meeting held May 19, 1954, for a tern

Councilman Waterman reported that at an earlier meeting he had
brought up the matter of parking at the La.rchmon t Railroad Station
and it had been decided at that time that the Board would resume
negotiations with the New Haven Railroad Company for the purpose
of leasing parking facilities on the north side of the station plat-
form and installing parking meters . He said Par . Delius had fur-
nished him with a draft copy of the lease which hali`' been under con-
sideration in 052, and he "proceeded to give the 3oard a general
outline of the lease .
''fter some discussion, the Town Attorney was instructed to advise
the New Haven Railroad Company that the Town. Board is willing to
negotiate on the basis of the former lease for the space at the
Railroad :Station for the _nst_a
lla.tion of parking meters and to
obtain from the Railroad Company a. definite cohilmittment to ;made
such a. lease .
'Yr . Waterman also reporter on another matter brought up at all
earlier meeting, i .e . the appointment of 'a. Planning Commission. He
said the Supervisor had suggested that he contact the members of
the present Zoning Board to learn whether they would be wiling to
tale on the additional work if they were appointed as the Planning
Commission,

'r . Waterman said that, while he would prefer to have a. separate
Commission which h would devote all its time to planning and not
be concerned with other matters , still these men, Arthur ','ulischleger,
Joseph P.iga:no, '`'rein L Ma.ggini, George Schuler, and Morgan J.
Burke, Jr . , are now serving and doing an outstanding job, as
everyone will agree, as members of the Zoning Board of Appeals .
He said a Recreation Commission has recently been appointed and,
perhaps, the point has been reached where there might be too many
commissions to _function adequately. He would be Frilling to go
along with the appointment of these gentlemen if they are agree-
able . He feels they might have to hire some technical assistance .
Er . Brush, feels there should be a. separate B=oard, composed of
architects and engineers and people who are more familiar with Town
planning.
The Supervisor suggested that the present '_toning S'oa,rd be appointed
with the understanding that an architect and an engineer he
appointed, making the Board a. 7-man one .
Mr . Brush suggested that this be put over until the :suit meeting.

The Supervisor presented a letter dated .June 11, 1954, from Mr. Straub,
Superintendent of the Water Works, stating , that they had received an
application from Fetner Realty & Construction Co. , Inc . , for the in-
stallation of a. 6" main and fire hydrant on Washington Square to supply
two new apartment houses, together with an estimate of the cost, and
requested a resolution authorizing this installation.
On motion by Councilman McKeever, seconded by Councilman Brush, it
was , upon roll call, unanimously
RESOLVED that this Board hereby authorizes the
installation of a 6" main and fire hydrant on Wash-
ington Square, to supply two new apartment houses,
at an estimated cost of $997.68, provided the
owners, Fetner Realty & Construction Co. , Inc . ,
deposit with the Westchester Joint Water Works,
No. 1, the necessary funds to cover the cost.
The Supervisor presented a letter dated June 11, 1954, from Mr. Straub,
Superintendent of the Water Company, stating that they had received an
application from Marbourne Westchester for the installation of a 6"
main and two fire hydrants on Stonewall Lane from Fairway Drive to the
proposed dead end, together with an estimate of the cost, and requested
a resolution authorizing this installation.
On motion by Councilman McKeever, seconded by Councilman Brush, it
was, upon roll call, unanimously
- RESOLVED that this Board hereby authorizes the
installation of a 6" main and two fire hydrants on
Stonewall Lane from Fairway Drive to the proposed
dead end at an estimated cost of $4,099.36, pro-
vided Marbourne Westchester deposit with the

The Superintendent of Highways reported on the bids for various road

After these bids were publicly opened by the Town Board, the Superin-
tendent of Highways recommended that the bid be awarded to the lowest
bidder, Mamaroneck Stone Corp.
On motion by Supervisor Mandeville, seconded by Councilman Waterman,
it was unanimously
RESOLVED that the bid for crushed trap rock be and
it hereby is awarded to the lowest bidder, Mamaro-
neck Stone Corp.
Mr. Delius brought up the matter of installation of sewer in the prince
Willows development and stated that if work is to be started and the
sewer completed promptly as requested by Mr. Goodman, this Board must
first have a. petition signed by persons representing 50% of the
assessed value in the area which is to be added to the present sewer
district or is to constitute a. new sewer district.
The Supervisor stated that the Board will hold another meeting on July
28th, to try to expedite this matter.

Mr. Delius reported that Councilman Waterman had called him with regard
to a complaint from a. tenant of the Stonecrest Apartments concerning
noise at the new apartment building now under construction, and which
continues until 8 and 9 o'clock in the evening. Mr. Delius stated
that he had asked the Building Inspector to investigate this and he
had reported that nothing much could be done about this as the noise
is due to running water used in curing the concrete at night.
The Supervisor said this condition will be remedied in two weeks.
Mr. Waterman suggested that the Town Attorney ask the owners to conduct
the work in as quiet a way as possible.
The Town Attorney stated that complaint had been received from Mr. A .
M. Morris who resides at 50 Orsini Drive, concerning dogs running at
large in the neighborhood, which continues in spite of complaints to
the Police, and also complaining about the fact that a resident
in the vicinity is the owner of 6 licensed dogs .
The Supervisor thinkgs this Board will have to go on record and in-
struct the Police Department to have all unmuzzled and un-leashed dogs
taken into custody. He suggested that the Town Clerk write to Chief
Yerick that it is the desire of this Board that the law be strictly
enforced with regard to dogs .
The Town Attorney submitted the claim of Joan Schonberg for $36.
which states that on the 27th of May she left a wicker basket con-
taining miscellaneouls toys and other articles which are listed in the
claim, outside the rear door of premises near the garbage container,
and that the employees of the Town removed this container, destroyed
the contents and later returned the empty basket .
After discussing the matter and examining the claim, the Board re-
jected the claim and on motion by Councilman McKeever, seconded by
Councilman Waterman, it was unanimously
RESOLVED that the claim of Joan Schonberg, for loss
of personal property alleged to have been removed
by the Garbage Department, be and it hereby is
rejected.
The Town Attorney presented a. letter from the Deputy Receiver of
Taxes stating that a. search of their records disclosed that Block 909
Parcel 297 (old Map of Grand Park, Lot 24) showed no arrears , whereas
in the County Finance Commissioner's Office, there appeared to be two
old leases sold to the Town of Mamaroneck as follows :

The Town Attorney presented a. petition of Milton Krieger, requesting
issuance of duplicate liens in place of those lost, covering premises
known as Lots No. 14, 15, 16, and 17, Block 28, Section I (now
known as Lots Nos . 546, 548, 551, and 553, Block 112, Section 1) .
This states that the liens sold on June 19, 1935, being Tax Liens 534,
535, 536, and 537, of that year, purchased by the Town and thereafter
assigned to Hillandale Investors Corporation by assignment dated
Larch 1, 1938, were foreclosed in an action brought by Hillandale
Investors Corporation against Brondoli, et a.1 (County Clerk's Index
No. 7388 - 1938) but the original liens were not attached to the
Referee's Report in that foreclosure proceeding through an apparent
oversight on the part of the attorney for the plaintiff, Hillandale
Investors Corporation; that the petitioner, Milton Krieger, an attorney
in White Plains who is now the attorney for Jennie Pascale, present
owner of these premises which are situated on Senate Place in the Town
of Mamaroneck, has made every effort to locate an officer of Hillandale
Investors Corporation or the attorney, Morris Goldstein, who is
apparently now dead, and that, although he has made every effort to
locate these missing tax liens , he has been unable to do so.
The petition asks that duplicate liens be issued because a Title Com-
pany in White Plains has refused to insure this title unless dupli-
cates are produced and filed in the County Clerk's Office .
The Town Attorney suggested that the Town might obtain from Mr.
Krieger, an indemnity agreement.
On motion by Councilman Waterman, seconded by Councilman Brush, it
was, upon roll call, unanimously
RESOLVED, it appearing that tax liens Nos . 534,
535, 536, and 537, Sale of June 19, 1935, and
covering premises known as Lots ,dos . 14, 15,
16, and 17, Block 28, Section I (now known as Lots
Nos . 546, 5488 551, and 553, Block 112, Section 1)
have been lost and cannot with due diligence be
found, that duplicates of such liens be issued
and delivered to Milton Krieger, attorney for
Jennie Pascale, present owner of the premises,
upon his furnishing to the Town of Mamaroneck
an indemnity agreement satisfactory to the
Town Attorney.
Mr. Delius presented a letter dated June 17, 1954, addressed to Coun-
cilman Kane, from Mrs . J. A. Petterson, 1806 Palmer Avenue, Larchmont,
complaining that her number (1806 in the Village of Larchmont) is
next to No. 56 in the Town of Mamaroneck, and asking that something
be done to correct this situation as she is constantly being
bothered by people looking for Nos . 106, or 98, etc.
This was referred to the Tax Assessor .
Mr. Delius reported on the Multiple Residence Law and after discus-
sion, on motion by Councilman Brush, seconded by Councilman Waterman,
the following resolution was, upon roll call, unanimously adopted:
WHEREAS, the Multiple Residence Law (Chapter 580 of the Laws of
1951 as amended) became effective July 1, 1954 with respect to old
multiple dwellings in the Town of Mamaroneck; and
WHEREAS, the amendment to the Multiple Residence Law, made by
Chapter 637 of the Laws of 1954, provides that a. municipality may
continue an existing local Board of Review in existance at the effec-
tive date of said Chapter, which shall have jurisdiction solely within
the territorial limits of the municipality; and

WHEREAS, the Building Code of the Town of Mamaroneck heretofore
adopted on April 27, 1937, provided in Article 1, Section 2, Paragraph
23 , that any property owner or applicant shall have the right to
appeal from any decision of the Building Inspector to the Town Board
which was given power to affirm, reverse or modify such ruling, all
as provided in said Building Code,
NOW, THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Mamaroneck
is hereby continued as the Board of Review under the
provisions of the Multiple Residence Law of the State
of New York as amended by Chapter 637 of the Laws of 1954.
Mr. Delius reported that the action brought in the Supreme Court by
Joseph Piampiano against the Building Inspector to compel him to issue
a permit for an archery range on premises known as Block 412 Parcel
436 (which permit had been denied by the Building Inspector and his
decision sustained by the Zoning Board of Appeals) had been dismissed
with costs .
The Supervisor reported that $100,000 is now on deposit in the County
Trust Company at 1% per annum.
There being no further business to come before the meeting, it ad-
journed at 11 P. M. to meet again on July 28th, and immediately re-
convened as the Board of Fire Commissioners.
Councilman Waterman submitted the Fire Report for June, 1954.
Councilman Waterman submitted the claims for the Fire Department which
had been approved by the Fire Chief and audited by the Comptroller, and
on motion by Councilman Waterman, seconded by Councilman Brush, it
was unanimously
