At the request of Mr. Peter Mosher of Mr. Wanshel's
office, this was deferred to later in the evening pend-
ing the arrival of Mr. Wanshel, the writer.
OPENING OF BIDS FOR GASOLINE
The Clerk presented the affidavit of publication of notice re-
questing bids for the purchase of gasoline by the Town of
Mamaroneck for the year 1957 as published in The Daily
Times, the official newspaper of the Town of Mamaroneck,
on February 8, 1957, and submitted the following two bids.

As a question of the ownership of equipment (tanks and pumps)
arose in connection with one bid, the matter was referred to
Mr. Finson, Accountant, for clarification and decision was
deferred to the next meeting of the Board.

OPENING OF BIDS FOR TIRES
The Clerk presented the affidavit of publication of notice
requesting bids for the purchase of tires by the Town of
Mamaroneck for 1957 as published in The Daily Times,
the official newspaper of the Town of Mamaroneck, on
February 8, 1957, and submitted the only bid as follows.
Federal Excise Tax is not included upon assumption satisfactory ex-
emption certificate is to be supplied.
Prices for Tires and Tubes not listed above will be charged for at
"STATE PRICES. "
On motion by Councilman Brush, seconded by Councilman Kane,
it was unanimously
RESOLVED that this Board hereby accepts the low bid,
to wit, the bid of Sound Tire & Supply Co. , Inc. , to
furnish to the Town of Mamaroneck for the }ear 1957
tires in accordance with the specifications as stated
and at the prices as submitted in said bid.

Upon questioning by the Board, the Police Chief advised
that he would like to have two of the cars equipped with
automatic transmissions and one with standard in order
to make a year's test as to which was the more efficient
for police patrol use.
Whereupon, on motion by Councilman Waterman, sec-
onded by Councilman Brush, it was unanimously
RESOLVED that this Board hereby accepts the
low bid, to wit, the bid of Hory Chevrolet Com-
pany to furnish to the Police Department of the
Town of Mamaroneck three (3) new 1957 Chev-
rolettwo-door sedans, 150 series, one of
which is to be equipped with standard transmis-
sion and two with automatic transmissions, and
in accordance with the specifications as stated,
for a total price of $4, 045. 35 less a credit in
the amount of $135. 50, which amount represents
the deletion of one automatic transmission, or
a net price of $3, 909. 85.
OPENING OF BIDS FOR A TOWN CAR
The Clerk presented the affidavit of publication of notice re-
questing bids for the purchase of a Town car as published in
the official newspaper of the Town of Mamaroneck, The
Daily Times, on February 8, 1957, and submitted the follow-

On motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that this Board hereby accepts the low
bid, to wit, the bid of Flinn Motor Corp. to furnish
to the Town of Mamaroneck one (1) new 1957
Ford Custom Tudor equipped in accordance
with the specifications as stated, for the
total price of $1, 715. 00.
DATE FOR SALE OF TOWN-OWNED LAND
__. The Supervisor advised the Board that a bid had been sub-
mitted on Town-owned property known on the Tax As-
sessment Map of the Town of Mamaroneck as Block 818,
Parcel 78, and requested a resolution setting the date for
the next public auction of such property.
On motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED that the date for the next public auction
of Town-owned property be set for March 20,
1957, at 8.00 p.m. , in the Council Room of the
Weaves Street Firehouse, Weaver Street, Town of
Mamaroneck.
COMMUNICATION--ORMAND PLACE
As Mr. Wanshel, the writer of this communication concern-
ing Ormand Place, was now present, the Supervisor re-
quested the Clerk to now present this communication deferred
at the request of Mr. Mosher earlier in the evening.
A rather lengthy discussion between the members of the
Board, the Town Attorney, Dr. Arnold S. Breakey, who was
present representing Mrs. Forbes, and Mr. Wanshel took
place as to whether or not this matter should be considered
by the Planning Board prior to the disposition of an action
now pending in Court concerning same.
On motion by Councilman Brush, seconded by Councilman
Santoro, it was
RESOLVED that Councilman Kane is hereby requested
to inform the Planning Board as to the situation re-
garding Ormand Place and its acceptance as a Town
highway, and particularly to advise the Planning Board
that an action is pending in Supreme Court demanding
judgment declaring the acceptance of this street to be
void and of no effect.

REAPPOINTMENT--ZONING BOARD OF APPEALS
The Clerk advised the Board of the expiration of the term of
Mr, A. E. Wullschleger as a member and Chairman of the
Zoning Board of tippeals, and upon motion by Councilman
Kane, seconded by Councilman Santoro, it was unanimously
RESOLVED that A. E. Wullschleger, 214 Hommocks
Road, Larchmont, be reappointed as a member of
the Zoning Board of Appeals and designated to serve
as its Chairman for a term of five (5) years, effec-
tive immediately and expiring on February 19, 1962.

(1) Request for transfer of funds in 1956 budget
The Clerk presented a letter, dated February 19,
1957, from Leo N. Orsino, Comptroller, requesting
authorization to transfer funds within the 1956 budget,
by departments, and upon motion by Councilman San-
toro, seconded by Councilman Kane, it was, upon
roll call, unanimously

The Clerk presented a letter, dated February 19,
1957, from the Village Clerk of the Village of Larch-
mont, requesting the use of the usual voting equipment
for the annual Village Registration and Election, and
upon motion by Councilman Kane, seconded by Council-
man Brush, it was unanimously
RESOLVED that the request of the Village of
Larchmont for use of the usual equipment for
Registration and Election purposes be granted.

similar request made by the Village of Mamaroneck,
upon motion by Councilman Kane, seconded by Coun-
cilman Brush, it was unanimously

J3) Request for Leave of Absence
The Clerk presented a letter from Miss Jean Corbia,
dated February 16, 1957, requesting a year's Leave of
Absence for health reasons and enclosing therewith her
doctor's opinion.
In connection therewith, the Comptroller reported that
he had checked the amount of sick leave due Miss Corbia
in accordance with the resolution adopted by the Town
Board on February 4, 1948, and found that she would be
entitled to sick leave at full salary for a period from
March 1, 1957, to September 15, 1957.
On motion by Councilman Brush, seconded by Council-
man Santoro, it was unanimously
RESOLVED that this Board hereby grants sick
leave at full salary to Miss Jean Corbia, to be
effective for the period from March 1, 1957,
to September 15, 1957.
The Comptroller requested that some provision be es-
tablished for replacement and the Supervisor advised that
this matter would be taken under consideration.
MATTERS NOT ON AGENDA
The Supervisor inquired whether there was any other matter not
on the agenda to come before the Board and the following persons
addressed the Board;
MR. C. W. MOODY --
Mr. Moody stated that he had appeared before the Board on
October 3, 1956, to request a Building Permit, after denial
by the Building Inspector, for the erection of a house on
Winged Foot Drive, approximately 700 feet from Fenimore
Road and fronting on a portion of the street not paved and
otherwise improved in accordance with the Planning Board
specifications as provided in Section 280-A of the Town
Law. He explained that he now desired to erect a second
house on this property and requested a permit for this house
in the same manner that the Board had granted his previous
request on October 3rd.
Upon inquiry by the Board, Mr. Friedlander, the Building
Inspector, advised that Mr. Moody had not filed formal
application nor plans for this second house and the Board
therefore requested Mr. Moody to file his application and
plans with the Building Inspector in accordance with the
usualprocedure.
MR. HUBERT FINNERTY --
Mr. Finnerty appeared at the invitation of the Board in con-
nection with his request regarding the installation of side-
walks and curbs in front of his property at Jobs #33 and #36
Blossom Terrace.
The Board thanked Mr. Finnerty for coming and the Super-
visor and members of the Board questioned Mr. Finnerty
about the sale by him or his organization of certain houses on
Blossom Terrace which were apparently built as two-family
houses although the area of the plots is of insufficient size
for such construction according to the Zoning Ordinance. The
Board called to Mr. Finnerty's attention the fact that two or
three persons had appeared at the last meeting of the Board
who found themselves in the predicament of purchasing two-
family houses where the Zoning requirements were for one-
family dwellings.
In reply, Mr. Finnerty stated that he had made no such sales;
- that all of the purchasers of his houses had been represented
legally and had had every opportunity to familiarize themsel-
ves with the Zoning regulations before completion of the sale
contract.
Following some general discussion with regard to Zoning regu-
lations and building practices in the Town, Mr. Finnerty ex-
plained that the Dime Savings Bank, the mortgagee on his
property, required another letter from this Board stating that
they could not install sidewalks and curbs at Jobs #33 and #36
Blossom Terrace as had been done with regard to his previous
request in connection with Job #32.
.After some discussion, on motion by Councilman Santoro, sec-
onded by Councilman Waterman, it was unanimously
RESOLVED that the Supervisor notify Hubert M.
Finnerty or his Corporation that the Town of Ma-
maroneck did not favor sidewalk and curb con-
struction on premises located on Blossom Terrace
at Jobs #33 and #36, which property is #9 and #15
Blossom Terrace, Mamaroneck, at this time.
REPORTS
The Clerk presented the following reports which were received and
placed on file:
Report of the Town Clerk for the month of January, 1957.
Report of the County Transportation Company, Inc. for
year ended December 31, 1956, prepared in accordance
with paragraph 25 of Franchise.
Report of the County Transportation Company, Inc. re
operation of buses for 6-months period ending Decem-
ber 3I, 1956, with check in the amount of $121. 13 cov-
ering gross earnings tax for that period.
REPORT OF THE SUPERVISOR
(1) Annual Report of the Supervisor
The Supervisor presented the Annual Report for the
year ended December 31, 1956, which was received
and placed on file.
(2) Policy re 9010 refund on water revenues
The Supervisor brought up for discussion the present
policy of the Town regarding contracts providing for
90% refunds of water revenues derived from water
extensions constructed and paid for by developers.
He pointed out that these developments were par-
tially responsible for the increasing consumption of
water which contributed to the necessity for the con-
struction of the new water supply line and yet do not
actually either pay for the actual cost of the water
consumed or any part of the costs of this pipe line for
a period of ten years.
A study of these developers refunds indicates a grow-
ing sum which together with increased costs can and
will result in a deficiency in the amount necessary to
meet the annual debt service obligations. This con-
ceivably could result in an increase in rates or a levy
against all property in the water district.
He noted that the Town of Harrison had abandoned this
form of subsidy and suggested that the members of
the Board study this situation to determine whether the
Town should continue or amend this policy for the
future.
(3) Association of Towns Convention
The Supervisor reported briefly on the very fine Asso-
ciation of Towns of the State of New York Convention
at Buffalo on February 12th through 14th attended by
-- Mr. Delius, Councilman Brush, Councilman Santoro,
Mr. Orsino and himself.

REPORTS OF THE COUNCILMEN
Councilman Brush --
(1) Civil Defense
Councilman Brush presented a claim from the
Deputy Director of Civil Defense in the amount of
$63. 90 for expenses from October 1, 1956, to Jan-
uary 1, 1957, and requested a resolution authoriz-
ing payment of same.
On motion by Councilman Brush, seconded by
Councilman Kane, it was unanimously
RESOLVED that the claim of Edward S.
Hartley, Deputy Director of Civil De-
fense, for car, gas, and miscellaneous
expenses from October 1, 1956, to Jan-
uary 1, 1957, in the amount of $63. 90,
be approved; payment to be made from
the item in the budget for such purpose.
(2) Association of Towns Convention
Councilman Brush also reported on the Conven-
tion stating that it was his first attendance and that
he had found it to be a most informative and worth
while meeting. He spoke of the proposed Social
Security legislation and commented most favorably
on a very fine talk given by Mr. Delius at one of
the sessions.
(3) Re Monthly Town Board Meetings
Councilman Brush stated that in connection
with his study of this matter, at this time he was
inclined to favor holding only one meeting a month.
Councilman Kane --
(1) Apportionments
Councilman Kane presented the following petitions
received from the Assessor for the correction of the
assessment roll so as to permit the apportionment of
taxes.

Councilman Waterman --
(1) Police Sergeant Examination
Councilman Waterman reported that nine men had
passed the Police Sergeant's Examination, and com-
mented favorably on this fine record in the department.
Councilman Santoro --
(1) Laurel Avenue Street Light
Councilman Santoro reported that the new street
light at the dead end of Laurel Avenue had been in-
stalled.
(2) Sewer--Burton Road
Councilman Santoro reported that the funds were
available in the budget for the extension of this sewer
and that the Engineer was preparing the specifications
for bids for this work.
(3) Association of Towns Convention
Councilman Santoro added his word about the fine
Convention meeting and stated that when it was in
New York City next year he hoped as many as possible
would attend from the Town of Mamaroneck.
(4) Purchase of Compressor
Councilman Santoro reported that the Superintendent
'
of Highways was ready to advertise for bids for the
purchase of a new Comp ressor and requested a
resolution authorizing him to do so.
On motion by Councilman.Santoro, seconded by Coun-
cilman Kane, it was unanimously
RESOLVED that the Superintendent of Highways
be and he hereby is authorized to publish in the
official newspaper of the Town of Mamaroneck,
The Daily Times, notice for bids for the pur-
chase of a Compressor in accordance with the
specifications as stated.
FURTHER RESOLVED that sealed bids will be
publicly opened in the Office of the Superinten-
dent of Highways, Town of Mamaroneck, at
4:00 p.m. , on Tuesday, March 5, 1957.
REPORT OF THE TOWN ATTORNEY
(1) Communication--Frank M. Gagliardi
The Attorney stated that a communication from Mr.
Gagliardi of Clark, Gagliardi, Dillon and Gallagher,
dated February 19, 1957, in connection with the
United States Women's Open Golf Tournament to be
played at Winged Foot Golf Club had been referred
to him by the Supervisor. He advised that this com-
munication stated that it might be necessary to have
the play-off on the first day of the week in the case
of a tie, and that Section 2145 of the Penal Law of
the State of New York prohibits all public sports on
Sunday unless expressly permitted by local law or
ordinance of the legislative body of the community
in which the game or sport is played. The Attorney
stated that he had just received this communication
and that he would like to defer any action or rec-
ommendation thereupon until the next meeting of the
Board.
(2) Zoning Violation--Harrison Drive
The Attorney reported that the Engineer had served
notice on certain residents of Harrison Drive claim-
ing violation of the Zoning Ordinance of the Town of
Mamaroneck. Further report on this matter will be
submitted at the next meeting of the Board.
THRUWAY CONSTRUCTION--WEAVER STREET
Councilman Kane brought up the matter of Thruway construction
in connection with Weaver Street and stated that he felt it neces-
sary to have an alternate vehicular route provided during the

construction period.
Mr. Edward Van Hook addressed the Board on this subject,
reading a letter he had received from the Thruway Authority
in connection with this matter.
After some further discussion, upon motion by Councilman
Kane, seconded by Councilman Waterman, it was unanimously
RESOLVED that the Supervisor is directed to write
a letter to C. H. Lang of the New York State Thru-
way Authority stating the necessity for an alternate
crossing near the Weaver Street bridge for both
vehicular and pedestrian traffic, during the time of
Thruway construction at this location.
ADJOURNMENT
There being no further business to come before the meeting,
it was adjourned at 9:55 p.m. , to reconvene March 6, 1957.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.

Commissioner Waterman presented the following reports
which were received and filed:

Annual Report of the Fire District Treasurer for the
period (Fiscal Year) ending December 31, 1956.
REPORT- 24th ANNUAL FIRE DEPARTMENT MEETING
Commissioner Waterman presented the report of the Twenty-
fourth Annual Meeting of the Fire Department on February
18th, 1957, and requested the Board's approval of the mem-
bers nominated to hold office for the year 1957 at that time.
On motion by Commissioner Waterman, seconded by Com-
missioner Santoro, it was unanimously
RESOLVED that this Board hereby approves
the election of the following officers for the
Town of Mamaroneck Fire Department for
1957:

Commissioner Waterman presented the following Fire De-
partment claims which had been audited by the Comptroller
and approved by the Fire Chief.
On motion by Commissioner Waterman, seconded by Com-
missioner Kane, it was unanimously
RESOLVED that the following claims be and they
hereby are approved and the Supervisor and
Comptroller be and they hereby are authorized
to pay the same out of the budget for the Fire
