PUBLIC HEARING--EXTENSION OF SEWER DISTRICT
PRYER MANOR ROAD
The Clerk presented the Affidavits of Publication and Posting of
Notice of Public Hearing; said Notice was published in the of-
ficial newspaper of the Town of Mamaroneck, The Daily Times,
on October 26, 1956, and posted in five (5) public places in the
Town of Mamaroneck located within the proposed extension on
October 26, 1956, and filed in the Office of the Town Clerk.
The Supervisor declared the Hearing open and asked Town At-
torney Delius to outline the proposition briefly.
Following the Attorney's presentation, the Supervisor inquired
whether anyone wished to be heard in favor of or in opposition to
this matter and it appeared there were none with the exception of
Bernard Kaplan and wife, the petitioners.
The Attorney then inquired of the Town Engineer whether the
deed or release for the street had been signed and delivered,
and Mr. Friedlander, the Engineer, replied that some signa-
tures were still missing. Thereupon, on motion by Councilman
Waterman, seconded by Councilman Kane, it was unanimously
RESOLVED that the Hearing be declared closed and
further action be postponed until receipt of the deed
to the street known as Pryer Manor Road in which
the Sewer Extension is to be installed is received.
OLD BUSINESS
EXTENSION OF WATER MAIN--FENIMORE ROAD
(.Application of Charles A. Newberghl
Mr. Joseph E. Muson, attorney, appeared before the
Board in behalf of his client, Mr. Charles A. New-
bergh, requesting approval for the extension of the 8"
water main on Fenimore Road for a distance of approx-
imately 280 feet to the house of his client. _
The Town Engineer submitted an estimate of $2, 065.85
covering the entire cost, including the installation of a
fire hydrant and excavation, backfill, and pavement
restoration.
After some discussion, on motion by Councilman Santoro,
seconded by Councilman Waterman, upon roll call, the
Board unanimously adopted the following resolution:
RESOLVED that the Town Board of the Town of
Mamaroneck hereby approves the application of
Charles A. Newbergh for the extension of the
-- 8-inch water main in Fenimore Road from dead-
end, west of Winding Brook Drive, for a dis-
tance of approximately 280 feet to the house of
Charles A. Newbergh, including the installation
of a fire hydrant on the south side of Fenimore
Road at the west end of the proposed extension,
at a total cost of $2, 065.85 including excava-
tion, backfill, and pavement restoration.
FURTHER RESOLVED that this approval is con-
tingent upon the deposit by the applicant, Charles
A. Newbergh, with the Westchester Joint Water
Works No. 1, of the sum of $1, 565.85 to cover
the costs of such extension except for the exca-
vation, backfill, and pavement restoration,which
is to be paid for by the applicant, Charles A.
Newbergh.
FURTHER RESOLVED that the Town Board ap-
proves the usual agreement between the West-
chester Joint Water Works No. 1, Charles A.
Newbergh, applicant, and the Town of Mamaro-
neck, providing that the amount deposited by
Charles .A. Newbergh, i.e. $1, 565. 85 plus
$500.00 for excavation, backfill, and pavement
restoration, shall be subject to refund up to 90%
from revenues derived from the sale of water to
customers along this line over a period of ten (101;
years from the date of this resolution, or until the
total amount of the deposit is refunded, whichever
event shall first occur.
Mr. Roger H. Harper, attorney, requested permission to
address the Board for his client, Mr. A. F. Beringer of
Fenimore Road, Town, who requested a further extension
of this same 8-inch water main in Fenimore Road for a
distance of approximately 390 feet from the point estab-
lished by the extension of said main to the house of Charles
A. Newbergh, which is approximately 28.0 feet from its
present terminus,so as to reach the property of his client.
The Supervisor asked Mr. Harper to present this: applica-
tion formally in writing for the consideration of the Board.
MATTERS NOT ON AGENDA
The Supervisor, explaining that it was the custom of the Board
to inquire whether anyone present wished to address the Board
on any matter not pn the agenda rather early in the evening,
asked Dr. Ahern, Superintendent of the Mamaroneck Schools,
whether he so wished to speak, stating that he noted his pres-
ence and was very much aware of the many demands on the
time of the Superintendent of Schools.
DR. T. JAMES AHERN --
Dr. Ahern thanked the Supervisor and advised the Council
that he was appearing on behalf of the Board of Education
in order to request that the summer recreation program
presently conducted by the Board of Education be placed
under the direction of the Town. He explained that in the
interest of economy to the taxpayer, since the Town em-
ployees a Superintendent of Recreation, this program could
be directed by him as a part of his duties and would thus
eliminate the engaging of a part-time Recreation Director
for this sole purpose by the Board of Education. This plus
the fact that the Town would be eligible for additional State
Aid from the New York State Youth Commission whereas
the School Board was not, would result in a saving to the
taxpayers of approximately 2016 of the cost of said program
or about $1, 500, 00.
In the ensuing discussion, the members of the Council
pointed out that the Board of Education had previously pre-
sented this matter to the Recreation Commission and that
that Commission, after serious thought, study, and consid-
eration had recommended to the Town Board as follows under
date of October 9, 1956:
"We do not at this time recommend consolidation of
the school recreation program into the program
- presently being conducted by this Commission."
A suggestion was then made from the floor that this item be
placed tentatively in the Preliminary Budget at this time so
that it could be discussed at the Budget Hearing as there was
no other opportunity to include the item since it is not pos-
sible to increase a budget at the Hearing but only to decrease it.
r,
The Board advised that this would be given consideration
and further discussion was reserved until presentation of
the Preliminary Budget as listed on the agenda,
OLD BUSINESS (continued)
RE: PROPOSED ACCEPTANCE OF ORMAND PLACE
At the request of the Supervisor, the Town Attorney pre-
sented a resume of this matter and submitted to the Board
the opinion requested of him at the last Town Board
meeting,
Mr, Jerome N. Wanshel, attorney for Bette W. Schapiro
and Dot Mort Holding Corporation, stated that he was not
in agreement with the opinion of the Town Attorney and
emphasized again certain points made by him at the pre-
vious Board meeting in connection with this matter.
The Supervisor then asked Mr. Roger H. Harper, attor-
ney representing Dr. Arnold Breakey, whether he wished
to speak further. Mr. Harper replied that he had pre-
sented his case at the past meeting and that he had nothing
new to add.
Whereupon, following some further discussion, on motion
by Councilman Brush, seconded by Councilman Santoro,
upon roll call, the Board unanimously adopted the follow-
ing resolution:

this Board the acceptance of a private street now known

The Supervisor thanked Mr. Levin and his colleagues for
all their work and stated that it was the feeling of the Board
that this question had not been either solved or resolved at
this time. He further advised that the Board had instructed
the Town Engineer to make further studies, particularly
with reference to the larger area concerned which might be-
come a separate sewer district and which might be self-
sustaining.
Councilman Waterman stated that he hoped these people
would not feel they were being turned down indefinitely,
Mr. Levin asked if he might say one further thing -- that in
any further consideration and deliberation on this matter,
the Board keep the element of "timeliness" in mind with
reference to the situation regarding the builders concerned
as of the present,

ADOPTION OF PRELIMINARY BUDGET FOR 1957
The Board took up the Proposed Tax Budget for 1957 and for
the information of those present, the Supervisor read the
letter of transmittal which accompanied the report of the
Budget Committee.
n F.,
In discussion of the budget report, the inclusion of the
item of $7, 500. 00 to cover the costs of the summer
recreation program as proposed earlier in the evening
was brought up for further consideration.
Dr. Francis McIntyre, President of the Board of Edu-
cation, stated that it would be most helpful if this item
could be placed in the Proposed Tax Budget at this
time pending further examination and consideration at
the Budget Hearing, He further explained that the re-
port had been presented only a short time before the
meeting of the Board of Education on the previous even-
ing that had not allowed sufficient time for a thorough.
study by the Board although it was understood that a
saving would be effected through this transfer.
Thereupon, the Board, on motion by Councilman Kane,
seconded by Councilman Santoro, upon roll call, adopted
the following resolutions
RESOLVED that there shall be included in the
Proposed Tax Budget for 1957 of the Town of
Mamaroneck an item in the amount of $7500.00

Councilman Santoro reported that the Sanitation Survey,
made because of the complaints of the Sanitation men
with reference to the increase in the garbage load due
to the increased population, had been received, and upon
careful study, revealed that the garbage tonnage remains
practically the same in spite of the increased population.
The Councilman pointed out that he felt, upon study, that
this might well be due to the industrial engineering used
in today's food and commodity packaging,

TOWN CLERK

October 31, 1955
Members of the Town Board:
Presented herewith are the 19.56 departmental budget requests. After
carefuly study of the needs of the various Departments, there is also
presented my recommendations for your consideration.
In this era of rising costs for both labor and materials, it is gratifying
to report that based on the recommended budget, the 1956 tax rate would
decrease sixty-eight cents, from $16. 38 for 1955, to $15. 70 for 1956.
The available cash necessary to eliminate the General Town tax for
the ninth year amounts to $70, 526. 63.
Briefly this budget provides for the following:
1. Salary increases.
Z. Purchase of five new police cars.
3. New police radio at Headquarters.
4. School Guards.
5. Fire Chief's car.
6. Town Engineer.
7. Contingency Fund,
8. Recreation Director and Program.
9. Costs of alteration Sewer Pumping Stations.
10. Provision for planning consultant if needed.
11. Pryer Manor Bridge.
Generally speaking, there is recommended salary increases of $300, for
all employees. The problem of proper compensation is very vital and is
related to the quality of services rendered, comparable salaries paid by
bpth private and public employers, and length of service.
It is my feeling that the above mentioned increase is reasonable, proper,
and necessary when each of these factors are considered. The Town
personnel must be considered as career public servants by reason of
their untiring efforts and everlasting willingness to serve the public
in efficient fashion.
The re-establishment of the Engineering Department headed by a pro-
fessional engineer is recommended. There would appear to be sufficient
scope for his services. He can be of great assistance, also, to the Planning
Board, Zoning Board, and to the various Public Works Departments.
-2-
You will note the inclusion of $14, 000, in the Miscellaneous budget
for the Town's share of the Pryer Manor Bridge.
Th:6re is again included in the Town Budget, a contingency item which
would be available for any unanticipated emergency which might arise.
Any, portion of it remaining unused would become available for the re-
duction of future budgets.
I have recommended a salary for the Civil Defense Deputy Director.
The present Director, Mr. Edward S. Hartley, has generously spent
of his time, effort and money. He should be recompensed for these
contributions to the welfare of our citizens.
I have deliberately left the Recreation budget as it has been presented.
This does not necessarily indicate that I agree with their proposal. My
feeling has always been that this function is an educational one and should
be supervised and administered by the school authorities. However, I
feel that the Board should be guided by the wishes of the citizens, as
there probably will be an expression from them prior to and at the
public hearing.
The 1955 budget provided for the final payment on the Fenimore Road
Pumping Station. As you know, the County is shortly taking over the
two pumping stations resulting in a large annual saving to the Town
for their operation.
The item of $3, 676. in the Sewer budget represents the amount borrowed
to alter the Stations so that the County of Westchester would accept them
for operation.
The gross expenditures are estimated to be $19, 457. 30 greater than in
1955, including the above mentioned non-recurring, and new items. The
General Town expenditures are increased by $30, 162„ and the District
budgets are reduced by $10, 710. 70, The net levy increases from
$627, 307. 89 in 1955, to $631, 529. 69 for 1956, an increase of $4, 221. 80.
The talc decrease of sixty-eight cents of course applies only to the Unin-
corporated Area, as no tax is levied against properties in the two Villages.
On November 1, 1955, the General Town surplus amounted to $174, 183. 02.
It is anticipated that this will increase substantially as a result of budgetary
operations for 1955. Unexpended balances of appropriations and excess
revenues collected 'will account for this increase. For example, based
on past experience, the 1955 budget estimated mortgage tax revenue
at $20, 000. However, it is believed that due to favorable economic
-3-
conditions, the actual revenues to be received during this year will
be from sixty to one hundred per cent higher.
The usual schedules are included for the information of the Town
Board and our residents.
Respectfully submitted,
'z .I' d-
