PUBLIC HEARING--EXTENSION OF SEWER DISTRICT NO. 1 At the request of the Supervisor, the Clerk read an Order of the Town Board calling a Public Hearing in relation to the creation of the proposed extension to Sewer District No. 1 in the Town of Mamaroneck, to be held May 2, 1956, at 8:15 p.m. , in the Council Room of the Weaver Street Firehouse, Weaver Street and Edgewood Avenue in the Town of Mamaroneck, and reported that a certified copy of said Order had been duly published and posted as re- quired by law. The Supervisor thereupon declared the Hearing open and asked if there were any persons present who desired to be heard in connection with the proposed extension of Sewer District No. 1, as requested in the petition filed in the Office of the Town Clerk on April 18, 1956. There being no persons who desired to be heard, the Su- pervisor declared the Hearing closed. Councilman Santoro introduced the following resolution: RESOLVED by the Town Board of the Town of Mamaroneck, County of Westchester, State of New York, as follows: Section 1. The following Order and Determin- ation is hereby adopted and approved, and when signed by members of this Board present at this meeting, constituting a majority of the entire Board, the same shall constitute an Order and Determination of this Board: STATE OF NEW YORK COUNTY OF WESTCHESTER JTOWN yy JJOyyFJ.�yyMyAyyMyyyAyyRyyOyyNyyEyy JCJWWKyy JJ..JJyyyyyy44yyyy WW{{JJ T.TTT+1`TTTTTTTTTTTTTTTTTTTTTTTTTTTTTfj IN THE MATTER. of the proposed ORDER AND Extension of Sewer District No. 1 m DETERMINATION of the Town of Mamaroneck, County of Westchester, State of New York WHEREAS, on the 18th day of April, 1956, a petition, together with a map and plan, was filed in the office of the Town Clerk of the Town of Mamaroneck, purporting to be signed by the requisite number of property owners as re- quired by Article 12 of the Town Law, petitioning the Town Board of said Town to create an extension designated as Section "M" to Sewer District No. 1 of the Town of Mamar- oneck and the construction of a sewer system therein; and WHEREAS, the said Town Board, on the 18th day of April, 1956, adopted an Order and caused the same to be entered in the minutes of its proceedings, reciting in general terms the filing of said petition, the boundaries of the proposed extension, the improvements and services proposed and the estimated expenses thereof, and specify- ing the 2nd day of May, 1956, at 8:15 p.m. , in the Council Room of the Weaver Street Firehouse, Weaver Street and Edgewood Avenue in the Town of Mamaroneck, as the time when and the place where said Board would meet to con- Sider said petition, and hear all persons interested in the subject matter thereof and concerning the same; and WHEREAS, said Town Board caused a copy of said Order, certified by the Town Clerk, to be published and posted according to law; and WHEREAS, said hearing was duly held at the time and place so fixed in said Order; and WHEREAS, the said Town Board has caused a copy of the aforesaid Map and Plan to be submitted to the State Department of Health; and WHEREAS, said Map and Plan was approved by the State Department of Health and as so approved, was duly filed in the office of the State Department of Health and in the office of the Town Clerk of the Town of Mamaroneck, NOW, THEREFORE, IT IS HEREBY ORDERED AND DETERMINED as follows: (1) The petition referred to in the recitals hereof is signed and acknowledged or proved as required by law, and is otherwise sufficient. (2) All the property, property owners and interested persons within said Sewer District Extension will be benefitted by the construction of the proposed extension and all the property and property owners who will be benefitted by said construction are in- cluded in said extension. (3) It is in the public interest to grant the relief sought by the petition referred to in the recitals hereof and the relief sought by said petition shall be granted. (4) An extension to Sewer District No. 1, designated as Section "M" is hereby created and established in the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of Article 12 of the Town Law of the State of New York as amended, said Extension to include the lands and 271 premises described in said petition and shown on a map entitled, "Boundary of Proposed Ex- tension to Sewer District No. 1 and Plan for Improvements, Glen Rock Estates, Town of Mamaroneck, Westchester County, New York, December 23, 1955, ", made by Ralph Cron- quist and Chester Cronquist, professional en- gineers, Mamaroneck, New York, which map is attached to the petition and filed in.the office of the Town Clerk of the Town of Mamaroneck. The lands and premises included in said exten- sion hereby granted and established are more particularly bounded and described as follows: ALL those certain lands situate, lying and being in the Town of Mamaroneck, County of Westchester, and State of New York, which lands are more particu- larly bounded and described as follows: BEGINNING at a point on the westerly boundary of the (Incorporated) Village of Mamaroneck, -distant 150 feet northward from the northerly sideline of Fenimore Road and which point is on the northerly boundary of the Town of Mamaroneck Sewer District as extended (and which ex- tension was approved by the State Depart- ment of Health on.October 7, 1936); run- ning thence through Lot 5, across Country Road and through Lots 4, 3, 2, and 1, North 52° 59' 40" West 790. 04 feet, which lots and road are shown on County Clerk Map 8887 of "****Section One Glen Rock Estates ***"; running then along the boundary of said Lot 1, North 39° 19' 42" West 102.73 feet to the easterly boundary of the Cross County Parkway lands of the County of Westchester; running then in a general northeasterly direction along the southeasterly boundary of said lands (which are identified as Parcel 5 Sheet 14 on County Clerk Map 2736 of "Cross County Parkway") a distance of about 2122 feet to the westerly boundary of the Village of Ma- maroneck; running then in a general south- westerly direction about 245 feet along said Village boundary to the easterly boundary of Lot 9, Section Two as shown cn-County Clerk Map 9103 of "***Glen Rock Es tates****"; running then along the easterly boundary of Lots 9 and 7 as shown on said map of ''***Glen Rock Estates***" in a general southwesterly direction, a dis- tance of about 815 feet and returning to the westerly boundary of the (incorporated) Village of Mamaroneck aforesaid; running then along said westerly boundary, South 360 56' 10" West 828. 16 feet to the point or place of beginning. The said premises are also known as part of Lots 1, 2, 3, 4, & 5 on a certain map entitled "****Section One Glen Rock Es tates***", filed in the County Clerk's Of- fice, Division of Land Records as Map No. 8887, and as Lots 6, 7, 8, 9, 10, 11, & 12, on map entitled "Subdivision Map for Sections 2 and 3, Glen Rock Estates in the Town of Mamaroneck, Westchester County, New York, " made by Ralph Cron- quist, dated April 23, 1954, and filed in the County Clerk's Office, Division of Lsn.d Records on July 1, 1954, as Map No. 9103. (5) A sewer System shall be constructed in said extension substantially in accordance with the map and plan prepared by Ralph Cronquist and Chester Cronquist, professional engineers, and approved by the State Department of Health of the State of New York, on April 10, 1956, and filed in the office of the State Department of Health, and recorded in the Office of the County Clerk of Westchester County, Division of Land Records on April 13, 1956, and there- after filed in the Office of the Town Clerk of the Town of Mamaroneck on April 18, 1956, but all such construction shall be without cost or expense to the Town of Mamaroneck and shall be paid by the owners and/or developers of the property to be added to the Sewer District. Dated: May 2, 1956. Supervisor Councilmen Section 2. A signed or certified copy of said Order and Determination shall be duly recorded in the Office of the Clerk of the County of Westches- ter as provided by Section 195 of the Town Law. Section 3. This resolution shall take effect immed- iately, - On motion by Councilman Santoro, seconded by Councilman Waterman, the foregoing resolu- tion was adopted by the following vote: AYES: Supervisor Burchell Councilman Santoro Councilman Waterman Councilman Kane Councilman Brush NOES: None PUBLIC HEARING--AMENDMENTS TO THE GENERAL. ORDINANCES At the request of the Supervisor, the Clerk presented the Affidavit of Publication in the Daily Times, the official newspaper of the Town of Mamaroneck, of a Notice of a Public Hearing to be held May 2, 1956, in the Council Room of the Weaver Street Firehouse, Weaver Street and Edge-wood Avenue, Town of Mamaroneck, to consider amendments to the General Ordinances of the Town. Mr, Delius, the Town Attorney, explained the amendments briefly, pointing out that while these were amendments re- garding parking, pavement markings, and a few other mat- ters, the changes were principally those that affected areas of heavy congestion, such as around the Railroad Station, the schools, and the apartment houses. The Supervisor asked if there were any persons present who desired to be heard in connection with the proposed amend- ments. Mr. Vincent A. Marinello-- Mr. Marinello of 7 Leafy Lane, Larchmont, stated that all the residents of Leafy Lane were present with the exception of one, whom he had been authorized to repre- sent, and requested the Board to prohibit parking on both sides of all of Leafy Lane for the sake of the safety of the children who resided in this area and in the best interest of adequate fire protection. Mr. Richard D. Friedman-- Mr. Friedman of Larchmont Acres Apartments, Larch- mont, addressed the Board in behalf of a number of ten- ants of said building and pointed out that since the parking restrictions remained the same for Richbell Road in the ` '. proposed amendments, no relief would be available for those tenants now completely deprived of parking space due to the new construction on Palmer Avenue on the property formerly used by some 40 residents for over- night parking. Mr. Friedman, as spokesman for this group, earnestly requested the Board to reconsider the ban on overnight parking on that part of Richbell Road in the Unincor- porated section of the Town. Councilman Waterman called attention to the State Law prohibiting parking overnight, without lights, on any street from sun-down to sun-up and Councilman Santoro stated that he felt the time had come for the Town to get in step with both the Village of Mamaroneck and the Vil- lage of Larchmont and acquire property for off-street parking use, Mr, Peter Mosher-- Mr. Mosher of 72 Vine Road, Larchmont, suggested that any changes made with reference to parking on Richbell Road be temporary in character so no perm- anent retrogression would be made in the progress the Town has made over the past decade. Following a lengthy discussion, the Board decided to adopt the amendments as. published, with the exception of Chapter 11, Section 7, Subdivision B, and directed that this section be further studied by the members of the Board and also by the Police Department. On motion by Councilman Waterman, seconded by Coun- cilman Brush, upon roll call, it was unanimously RESOLVED that Chapter II, Section 7 of the General Ordinance of the Town of Mamaro- neck (USE OF STREETS, HIGHWAYS, ETC. ) Subdivisions A, C, and D, as last amended December 17, 1953, be amended so as to read as follows: Section 7. The following regulations regard- ing limitation of parking in congested areas in the Town of Mamaroneck, outside of the Villages of Larchmont and Mamar- oneck, are hereby established, provided suitable signs are pasted: A. AREA SURROUNDING THE NEW HAVEN RAILROAD (LARCHMONT STATION) 1. MYRTLE BOULEVARD (a) On either side - No parking 50 feet west of the corner of North Chatsworth Avenue. (b) One hour parking from 8 a.m. to 1 p.m. , except Saturdays, Sundays and Holidays: On the north side from Preston Street to Weaver Street. On the south side from Wood Street to Weaver Street. (c) No parking on the north side from Murray Avenue to Cabot Road. (d) No parking on the south side from Depot Way to Vine Street. Z. FURTHER RESOLVED, that Chapter II of the General Ordinance of the Town of Mamaroneck (USE OF STREETS, HIGHWAYS, ETC. ) Section 12, as added by resolution adopted October 20, 1954, be amended so as to read as follows: Section 12. The system of pavement markings, duly adopted by the State Traffic Commission for State highways, is hereby adopted, and shall apply to the following streets or parts of streets in the Town of Mamaroneck outside of incorporated villages: From the corner of Edgewood Avenue at Judson Street, for a distance of 225 feet, on Edgewood Avenue. On Myrtle Boulevard from Murray Avenue east for a distance of 250 feet. At Myrtle Boulevard and North Chatsworth Avenue intersection, starting east and curving south into North Chatsworth Avenue - - for a distance of 150 feet, At Myrtle Boulevard and Madison Avenue, extending around the corner for a distance of 250 feet. On Murray Avenue from Myrtle Boulevard, north for a distance of 125 feet. On Murray Avenue, from Homer Avenue to Forest Avenue, On Murray Avenue from Weaver Street south for a distance of 200 feet. On North Chatsworth Avenue from the town line near the railroad bridge, north for a distance of 150 feet. On North Chatsworth Avenue from Myrtle Boulevard north for a distance of 250 feet. On Harrison Drive from Palmer Ave- nue south for a distance of 100 feet. which streets, or parts of streets, shall be marked with a double white line, with the same meaning, force, and effect, as provided for such markings upon State high- ways, and a violation of this Ordinance shall be subject to the same penalties as provided for the violation of such markings upon State highways, by the Vehicle and Traffic Law. FURTHER RESOLVED, that Chapter 11 of the General Ordinance of the Town of Mamaroneck (USE OF STREETS, HIGHWAYS, ETC. ), Section 9, as added by resolution adopted July 1, 1953, be amended so as to read as follows: Section 9. TRUCKS: Every vehicle used to transport dirt, manure, sand, gravel, ashes, mud, garbage, swill, offal, etc. in the public streets of the Town of Mamaroneck, outside of the Villages of Larch- mont and Mamaroneck, shall be so constructed or loaded as to prevent any portion of the contents from escaping therefrom. No vehicle used to transport dirt or soil shall be operated or driven so as to permit dirt or mud to adhere to the wheels and be deposited in the public streets of the Town of Mamaroneck, outside of the Villages of Larchmont and Mamaroneck. Any person, being the owner or operator of any such vehicle or truck, shall at the end of each working day remove any dirt, manure, sand, gravel, ashes, mud, garbage, swill, offal, etc. dropped from any such vehicle or truck on the public street or highway. mm SEWER VIOLATION Mr. Robert E. Thompson of 49 Dillon Road, Town of Mamaroneck, reported to the Board that he had been served with notice of a sewer violation by the County Health Department due to a break in a sewer line from his home. The Board referred this matter to the Town Engineer for immediate investigation and report. REQUEST OF HOWELL PARK ASSOCIATION Mr. Frank X. O' Donnell, Jr. , President of the Howell Park Association, called attention to the re- quest of that Association to establish speed limits of 15 to 20 miles per hour in the Howell Park area as stated in a communication addressed to the Supervisor under date of April 30, 1956. The Supervisor advised the Board that he had received this communication and had referred it to the Chief of Police for study and recommendation. REQUEST FOR PERMISSION TO ERECT FENCE Mr. E. H. Burdick of 96 Edgewood Avenue, Larchmont, applied for permission to erect a 6' 61' woven wood fence along the rear of his property for a distance of some 80 feet for the sake of privacy. The Supervisor requested the Clerk to follow the usual proceedure and notify the adjoining property owners of this application. He also advised Mr. Burdick that the members of the Board would view the site of the proposed fence in accordance with the regular custom followed in such applications. OLD BUSINESS EXTENSION OF WATER MAIN ON FENIMORE ROAD With reference to the request of Mr. M. P. Medwick of 1000 Fenimore Road, Larchmont, presented at the meeting of April 4, 1956, that the Town share in the cost of installing an 8" water main on Fenimore Road from Cornell Street easterly, which request was sub- sequent to the application for such installation origin- ally presented at the meeting of March 7, 1956, by Thomas J. Quinn as Attorney for W. H. Aldridge of Fenimore Road, Scarsdale, Councilman Santoro pre- sented an estimate in the amount of $3, 353. 26 plus $15. 00 additional per yard for any rock excavation, tt which estimate was submitted by Mr, George H. Straub, Superintendent of the Westchester Joint Water Works No. 1, under date of April 17, 1956. The Supervisor was directed to advise Mr. Med- wick that the Board, after considerable delibera- tion and consultation with the Superintendent of the Westchester Joint Water Works, decided that it should not share in the cost of the construction as requested, but would be in favor of approving the usual agreement between the Westchester Joint Water Works, the applicant, and the Town, pro- viding for a refund of 9016 of the revenues derived from the sale of water to customers connecting with the proposed main for a period of 10 years, or until the total amount deposited by the applicant is refunded, whichever event occurs first, if the ap- plicant pays for the cost of the construction. REQUEST FOR PAVING OF MAXWELL AVENUE With reference to the request of Mr. Benjamin Jaffe of 32 Forest Park Avenue, Larchmont, for the pav- ing of Maxwell Avenue to the width of 50 feet, as presented at the last meeting of the Town Board, Councilman Santoro advised that he would prefer to wait and actually see how much traffic was to be in- volved when the new shopping center project was com- pleted before making any recommendation to the Board concerning this matter. Mr. O'Brien, Superintendent of Highways, stated that more than widening the street was involved, since were this widening to be done, the traffic would then be discharged into the incinerator yard present- ing an added problem, and suggested that Mr. Jaffe submit a plan for further study. Mr. Jaffe submitted such plan and the matter was re- ferred to the Engineer and Superintendent of Highways for additional study and recommendation. NEW BUSINESS CANCELLATION OF TAXES ON BLOCK 815 - PARCEL 323 The Clerk presented a communication from Henry R. Dillon, Receiver of Taxes, requesting cancellation of School Tax on property known as Block 815 - Parcel 323 on the Tax Maps of the Town of Mamaroneck, which property was acquired by the New York State Thruway Authority prior to September 1, 1955. On motion by Councilman Brush, seconded by Coun- cilman Kane, it was unanimously RESOLVED that the following School Tax, which became a lien September 1, 1955, upon premises acquired by the New York State Thruway Authority prior to Septem- ber 1, 1955, be cancelled: 1955 School Tax Block Parcel Name District No. 1 815 323 Anna Hagen $110.49 AUTHORIZATION TO MAKE TIME DEPOSITS OF FUNDS ON HAND At the suggestion and request of Mr, Orsino, Comp- troller, and Mr. Finson, Accountant, and in accor- dance with a memorandum to the Supervisor under date of April 27, 1956, relative to making time de- posit or deposits of funds on hand: On motion by Councilman Santoro, seconded by Coun- cilman Kane, upon roll call, it was unanimously RESOLVED that the National Bank of West- chester, Larchmont Branch, is hereby designated as a depository for General Town funds and the following undertaking and de- pository agreement between said National Bank of Westchester and the Town of Mamar- oneck is hereby approved, and the Supervisor authorized and directed to sign same on be- half of the Town. UNDERTAKING WHEREAS, NATIONAL BANK OF WESTCHESTER, a banking institution of White Plains, New York, has been duly designated by the Town Board, Town of Mamaroneck, State of New York, pursuant to statute, to receive and keep on deposit funds and moneys in and for the Town of Mamaroneck, State of New York, and is required to exe- cute and file in the Office of the Town of Mamaroneck, State of New York, an undertaking. NOW, THEREFORE, the said National Bank of West- chester of White Plains, New York, for value received and in consideration of such deposit of funds and moneys in and for such Town as may be made with such banking in- stitution, does hereby undertake, covenant and agree to and with the Town of Mamaroneck, State of New York, in the penal sum of Two Hundred Thousand ($200, 000. 00) Dollars, that the said National Bank of Westchester shall well and faithfully do and perform all things required by law to be done and performed on its part in reference to funds and moneys thus deposited either prior or subsequent to such designation; that it will accept and safely keep and well and faithfully account for all such moneys that may be deposited in, or are now held on deposit by such banking institution in and for the Town of Mamaro- neck, State of New York, or for which it may be- come liable as such depository, and will pay over and deliver such funds and moneys to the Town of Mamaroneck, State of New York, or its official representative, or any person or persons entitled thereto, on legal demand therefor. That as collateral hereto, the National Bank of Westchester has assigned to the Supervisor of the Town of Mamaroneck the bonds and/or se- curities on the attached schedule, marked "A", such securities and any substitutions or additions thereto to be held in trust for the National Bank of Westchester, subject to the rights of the Town of Mamaroneck and the Supervisor of the Town of Ma- maroneck. It is hereby agreed that said National Bank of Westchester shall and does hereby deposit said bonds and securities with the custody division of the trust department of The Chase Manhattan Bank of New York, New York, for safe-keeping, upon condition and for the purpose of saving harmless and indemnifying the Town of Mamaroneck from and against all loss, also all cost, damages and ex- penses that may be incurred for or on account of funds and moneys heretofore or hereafter deposited with the National Bank of Westche'sterby the Town of Mamaroneck, or for funds which it shall in any way become liable. It is hereby agreed that the custody division of the trust department of The Chase Manhattan Bank shall be the depository for said securities and that it may make withdrawals, substitutions or ad- ditions thereto only upon written authorization of the National Bank of Westchester, approved by the Supervisor of the Town of Mamaroneck. It is agreed that the purpose and intent of this depository agreement is that there shall be always on deposit with the said The Chase Manhattan Bank for the protection of the Town of Mamaroneck and the Supervisor thereof, sufficient first-class federal or municipal securities, equivalent in par value to the amount of any lawful deposit that the Town of Ma- maroneck may have with the National Bank of West- chester. In the event of a default in the payment of any such deposits, the collateral mentioned in the at- tached schedule or any substitutions therefor, or ad- ditions thereto, shall be turned over by The Chase Manhattan Bank to the Supervisor of the Town of 29� Mamaroneck, upon a receipt given therefor, for the purpose of protecting the Town in reference to its deposits. On motion by Councilman Santoro, seconded by Coun- cilman Kane, upon roll call, it was unanimously RESOLVED that the Supervisor is hereby authorized to deposit Town funds not ex- ceeding the amount of $500, 000. 00 in de- positories designated by resolution of this Board for the deposit of Town moneys upon Certification of Deposit bearing interest at the rate of 216 per annum for a period not exceeding five (5) months. AUTHORIZATION TO REFUND DUPLICATE PAYMENT OF 1954 SCHOOL TAX The Clerk presented a memorandum from the Accountant, _- dated April 27, 1956, requesting authorization for pay- ment to Mr. Bernardo Fraioli of the sum of $128. 30, which sum represents duplicate payment of the 1954 School Tax. On motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that the Town of Mamaroneck refund to Bernardo Fraioli the sum of $128. 30, repre- senting an amount paid on May 25, 1955, for the School Taxes on premises known as Block 806 - Parcel 6, on the Tax Maps of the Town of Ma- maroneck, for the year 1954, which was a dup- licate payment of such taxes. FURTHER RESOLVED that such payment be charged to General Town Surplus, to which such duplicate payment was transferred in closing the books for the year 1955. REQUEST FOR USE OF VOTING MACHINES The Clerk read a letter from the Board of Education of Union Free School District No. 1, signed by Dr. Sheldon Evans, Business Manager, dated April 23, 1956, stating that a request for the use of three voting machines for the annual General Association elections at Mamaroneck High School on May 11, 1956, had been received from that Association. 0 On motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that the request of the Mamaroneck Board of Education for permission to use three voting machines in connection with the General Association elections at Mamaroneck High School to be held on May 11, 1956, be and it hereby is granted. REQUEST FOR LEAVE OF MISS MARION SWEATLAND, PUBLIC HEALTH NURSE - AND APPROVAL. OF TEMPORARY EMPLOY- MENT OF MRS. ANNA LYNCH The Clerk presented a memorandum from the Accountant under date of April 27, 1956; requesting approval of the request for leave of Miss Marion Sweatland, Public Health Nurse, for the periods stated, and approval of the tempor- ary employment of Mrs. Anna Lynch to replace Miss Sweatland. On motion by Councilman Waterman, seconded by Council- man Santoro, it was unanimously RESOLVED that leave without pay is hereby granted to Miss Marion Sweatland for the pur- pose of completing the work required for a Bachelor of Science degree at Syracuse Univer- sity, Syracuse, New York, such leave to be for the periods from July 2 through August 10, 1956, and from October 1, 1956, through January 31, 1957. FURTHER RESOLVED that Mrs. Anna Lynch be employed as Public Health Nurse in the place of Miss Marion Sweatland during the period of Miss Sweatland's leave from July 2 through August 10, 1956; at the rate of $4, 140.00 per annum, pro- vided, however, that Mrs. Lynch's qualifications as Public Health Nurse are approved by the Westchester County Department of Health. REAPPOINTMENT OF MR. WALTER E. WARNER, JR. AS A MEMBER OF THE RECREATION COMMISSION When the matter of Mr. Warner's reappointment as a - member of the Recreation Commission came up, Councilman.Santoro stated that he served as the liason person to the Commission while Mr. Warner was Chairman and he wished to go on record as testifying to the splendid contribution Mr. Warner has made to the work of this Commission, and recommended, therefore, most heartily and with a great deal of pleasure, Mr. Warner's reappointment. Councilman Waterman requested the pleasure of seconding Councilman Santoro's recommendation, adding his commendation of Mr. Warner's fine work and pointing out that he felt particularly pleased since he had originally recommended Mr. Warner for appointment to this Commission. On motion by Councilman Santoro, seconded by Councilman Waterman, it was unanimously RESOLVED that Walter E. Warner, Jr. be and he hereby is reappointed as a member of the Recreation Commission for a term of five (5) years, to expire May 20, 1961. PURCHASE OF DUPLICATING MACHINE AND SUPPLIES The Clerk explained the need for purchasing a duplicating machine and necessary supplies, presented information on such machines, and requested approval for such purchase. On motion by Councilman Santoro, seconded by Council- man Kane, it was unanimously RESOLVED that the Town Clerk be and he hereby is authorized to spend an amount not exceeding $300. 00 for the purchase of a duplicating machine and supplies for same, which sum is hereby appropriated from the Contingency Fund in the Budget. EXTENSION OF WATER MAIN ON SPLIT TREE ROAD The Supervisor presented an estimate in the amount of $1, 204. 20, not including excavation and backfill, for the cost of laying an additional 320 feet of water main on Split Tree Road, dated April 18, 1956, as requested by the G. B. & E. M. Realty Company of 21 East 40th Street, New York City, and as prepared and submitted by the Superintendent of the Westchester Joint Water Works No. 1. On motion by Councilman Santoro, seconded by Council- man Brush, upon roll call, it was unanimously RESOLVED that the Town Board hereby ap- proves the usual agreement between West- chester Joint Water Works, No. 1, the G. B. & E. M. Realty Company, and the Town of Mamaroneck, for the installation of an additional 320 feet of water main to be laid in Split Tree Road, at a total cost not to exceed $1, 204. 20, provided that applicant furnish an easement satisfactory to the Town Attorney. FURTHER RESOLVED that the agreement provide that refund up to 9010 of revenues derived from the sale of water to customers along this line or extension, be made for a period of ten (10) years, or until the total amount of the deposit is refunded, which- ever event shall first occur. REQUEST FOR PERMISSION TO ERECT A FENCE Mr. Harry P. Miltner, 9 Rosewell Road, Scarsdale, New York, fence contractor representing his client, Mr. James C. Di Giacomo of 20 South Ridge Road, Larchmont, (Block 206 - Parcel 107 on the Assessment Map of the Town of Mamaroneck) appeared to request permission for his client to erect a Westshire Fence about 3 or 4 feet in from his rear property line with a 10-foot return on both ends, run- ning for a distance of approximately 190 feet, to serve as a back-drop for planting and to provide screening from ad- joining properties. The Supervisor requested the Clerk to follow the usual pro- cedure, notifying the adjoining property owners of this ap- plication. He also advised Mr. Miltner that the members of the Board would view the site of the proposed fence in accordance with the custom followed in such applications, — COMMUNICATION--JOSEPH E. MUSON RE SOUNDVIEW WOODS, INC. - (BLOCK 227 - PARCEL 1) The Clerk presented a_letter from Mr. Musson, dated May 1, 1956, requesting an adjournment of the closing of title, set for May 14, 1956, to June 14, 1956. On motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that the closing of title on Soundview Woods, Inc. , known as Block 227 - Parcel 1 on the Assessment Map of the Town of Mamaroneck, be and it hereby is adjourned to June 14, 1956, provided all adjustments be met as of February 13, 1956. REQUEST--FBI ANNUAL POLICE CONFERENCE The Clerk presented a communication from the Chief of Police, dated May 1, 1956, stating the Chief's request, as approved by the Board of Police Commissioners, for two (2) members of the Police Department to attend the FBI Annual Police Conference at Bear Mountain on May 10, 1956, with expenses of $12. 00. On motion by Councilman Waterman, seconded by Coun- cilman Brush, it was unanimously RESOLVED that Detective Sergeant Chauncey Smith and Detective Christopher Loveley be and they here- by are authorized to attend the FBI Annual Police Conference at Bear Mountain on May 10, 1956. FURTHER REOLVED that the Comptroller be and he hereby is authorized to audit their claims for ex- ---- penses of the trip not to exceed $12. 00, said expenses to be paid out of the item in the Budget for this purpose. REPORT OF THE SUPERVISOR Re: Town Engineer The Supervisor introduced and welcomed the new Town Engineer, Mr. Maurice Friedlander. Re: Water Supply The Supervisor reported that this matter had been put over to the next meeting of the Water Board due to the absence of Mr. Landis and to the fact that the Board was waiting the decision of the Village of Larchmont in this matter. Re: Board of Supervisors The Supervisor stated that the Board of Supervisors, now meeting only once a month, would meet on the following Monday, May 7, 1956. REPORTS OF THE COUNCILMEN Councilman Brush-- Re: Park Commission Councilman Brush reported that the Park Com- mission met on April 23, 1956, and studied the latest Thruway plans which showed the parking lot to be exactly as per the recommendations made. Re: Flower Beds Councilman Brush reported that in lieu of the flower beds at the station, new beds were being planted in Memorial Park along Vine Street. Councilman Kane-- Re: Apportionments Councilman Kane presented the following pe- titions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. Re: Drainage - Mr. Albert Gould In connection with the drainage matter concerning Old White Plains Road and the property of Mr. Gould, Councilman Santoro reported that Mr. Gould s was willing to grant an easement but not to supply any labor or materials for the in- stallation thereof. This matter was referred to the Engineer and the Superintendent of Highways for further study. REPORT OF THE ATTORNEY Re: Request for adjournment of closing The Attorney recommended that the request of Mr. Carl A. Guglielmo of 635 Halstead Avenue, Mamar- oneck, for an adjournment of closing on property known as Block 218 - Parcel 643 on the Assessment Map of the Town of Mamaroneck, from May 4, 1956, to June 5, 1956, be granted. On motion by Councilman Santoro, seconded by Coun- cilman Waterman, it was unanimously RESOLVED that the closing of title on property known as Block 218 - Parcel 643 on the Assessment Map of the Town of Mamaroneck, be and it hereby is ad- journed to June 5, 1956, provided all adjustments be met as of May 4, 1956. Re: Thruway The Attorney suggested that the Engineer inquire from the Thruway Commission as to the exact plans for the property around the Lake and report back to this Board. The Supervisor suggested that Mr. Aitchison join the Engineer at any conferences referring to this area with a view to checking the plans for the finished condition of this property, re landscaping, etc. Re: New York, New Haven & Hartford Railroad The Attorney reported his attendance at a recent meeting of officials in connection with the matter of the proposed railroad fare increases..and stated that it was the con- census of opinion of those attending said meeting that the County should engage experts to analyse the materials exhibited in connection with this matter. He further re- ported that a subcommittee had been appointed consisting of Mr. Murray C. Fuerst, Mr. Anthony Sansone, and himself, and that another meeting was scheduled for May 11, 1956, to consider and study further developments. MEETING--BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was con- vened immediately upon the adjournment of the Town Board meeting. RE: AREA COVERAGE Councilman Waterman presented the report received from Fire Chief Edward L. Leone under date of March 4, 1956, giving information on running tests to the Dillon Park area, the Premium Point area, and the Prince Willows and Old White Plains Road area, and advising that the Fire Council feels the depart- ment provides adequate fire protection in the areas specified. On the basis of this report, Councilman Waterman recommended that no change be made in the fire pro- tection arrangement at the present time. Considerable discussion followed with Councilman Kane voicing his objection to not making a change with regard to the Dillon Park area, stating that in his per- sonal thinking he failed to be able to see any reason why the Town Fire Department should cover that area since it had to pass the Larchmont Village Fire De- partment in order to reach the area in question. On motion by Councilman Waterman, seconded by Coun- cilman Santoro, upon roll call, it was RESOLVED that the request of the Village of Larchmont, made by the Village At- torney in behalf of the Board of Trustees at the Town Board meeting on January 4, 1956, for consideration of a proposition to enter into a contract between the Village and the Town Fire Departments for fire coverage be and it is hereby denied.
