CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. PRESENT: Supervisor Burchell Councilman Brush Councilman Kane Councilman Waterman Councilman Santoro ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Finson - Accountant Mr. Orsino - Comptroller Mr. Yerick - Chief of Police APPROVAL OF MINUTES The minutes of March 21, 1956, were approved as presented. THE SUPERVISOR The Supervisor, before proceeding with the regular order of business, inquired whether there were any matters not on the agenda to come before the Board. PETITION FOR EXTENSION OF SEWER DISTRICT Mr. Delius, the Town Attorney, presented Mr. William A. Glaser of Cabilane Road, Mamaroneck, and Mr. Joseph W. Gleicher of 27 Cushman Road, Scarsdale, New York, who filed a formal petition for the Extension of Sewer District No. 1 of the Town of Mamaroneck to include Glen Rock Es- tates, east of Fenimore Road, which petition has attached to it topographical maps and map showing the boundaries of the extension, which is to be known as Section M. Mr. Glaser and Mr. Gleicher stated that the permit from the New York State Department of Health, Bureau of En- vironmental Sanitation and Water Pollution Control Board, approving these plans had been issued and duly recorded in the County Clerk's Office, County of Westchester, and that a copy had been filed in the Office of the Town Clerk of the Town of Mamaroneck. Upon advice from the Attorney that this required a Public Hearing, on motion by Councilman Santoro, seconded by Councilman Brush, the following resolution was unani- mously adopted: WHEREAS, a petition purporting to be signed by the requisite number of property owners as re- quired by Section 191 of the Town Law, petition- ing the Town Board of the Town of Mamaroneck to create an extension designed as "Section M to Sewer District No. 1 of the Town of Mamaroneck" and to construct a sewer system therein, said pe- tition describing the boundaries of the proposed extension and stating the amount to be expended for the proposed sewer system to be constructed in said extension, together with a map and plan prepared by Ralph Cronquist and Chester Cron- quist, professional engineers, entitled "Boundary of Proposed Extension to Sewer District No. 1 and Plan for Improvements, Glen Rock Estates, Town of Mamaroneck, Westchester County, New York, December 23, 195511, showing the boun- daries of the proposed extension, a general plan of the proposed sewers to be constructed therein including all outlets and the terminus, course and the profiles of each proposed sewer or drain and showing the manner in which said sewer system will connect with and drain into trunk sewers of the Westchester County Sanitary Sewer Commis- sion (Mamaroneck Valley Sewer District) has been filed in the office of the Town Clerk of the Town of Mamaroneck on April 18, 1956, and has been duly presented to this Board, now, there- fore, THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, HEREBY RESOLVES AS FOLLOWS: Section 1, The following order is here- by adopted and approved, and when signed by the members of this Board present at this meeting, the same shall constitute an order by this Board: ORDER CALLING A HEARING ON MAY 2, 1956 IN THE MATTER OF THE EXTENSION OF Sewer District No. 1 of the Town of Ma- maroneck, County of Westchester, State of New York. WHEREAS, a petition purporting to be signed by the requisite number of property owners as re- quired by Section 191 of the Town Law, petition- ing the Town Board of the Town of Mamaroneck to create an extension designated as Section M, to Sewer District No. 1 of the Town of Mamar- oneck, and to construct a sewer system there- in, said petition describing the boundaries of the proposed extension and stating the maximum amount to be expended for proposed sewer sys- tem to be constructed in said extension, to- gether with a map and plan prepared by Ralph Cronquist and Chester Cronquist, professional engineers, entitled, "Boundary of Proposed Ex- tension to Sewer District No. 1 and Plan for Im- provements, Glen Rock Estates, Town of Ma- maroneck, Westchester County, New York, De- cember 23, 195511, showing the boundaries of the proposed extension, a general plan of the proposed sewers to be constructed therein, in- cluding all outlets and the terminus, course, and the profiles of each proposed sewer or drain and showing the manner in which said sewer sys- tem will connect with and drain into the trunk sewers of the Westchester County Sanitary Sewer Commission (Mamaroneck Valley Sewer Dis- trict) has been filed in the Office of the Town Clerk of the Town of Mamaroneck on the 18th day of April, 1956; and WHEREAS, the boundaries of said proposed ex- tension of Sewer District No. 1 of the Town of Mamaroneck are as follows: ALL those certain lands situate, lying and being in the Town of Mamaroneck, County of Westchester, and State of New York, which lands are more par- ticularly bounded and described as follows: BEGINNING at a point on the westerly boundary of the (Incorporated) Village of Mamaroneck, distant 150 feet north- ward from the northerly sideline of Fenimore Road and which point is on the northerly boundary of the Town of Mamaroneck Sewer District as ex- tended (and which extension was ap- proved by the State Department of Health on October 7, 1936); running then through Lot 5, across Country Road and through Lots 4, 3, 2, and 1, North 52° 59' 4011 West 790. 04 feet, which lots and road are shown on County Clerk Map 8887 of "****Section One Glen Rock Estates ***"; running then along the boundary of said Lot 1, North 39° 19' 42" West 102. 73 feet to the easterly boundary of the Cross County Parkway lands of the County of Westchester; running then in a general northeasterly direction along the south- easterly boundary of said lands (which 2373 are identified as Parcel 5, Sheet 14 on County Clerk Map 273.6 of "Cross County Parkway"), a distance of about 2122 feet to the westerly boundary of the Village of Mamaroneck; running then in a general southwesterly direction about 245 feet along said Village. boundary to the easterly boundary of Lot 9, Section Two, as shown on County Clerk Map 9 10 3 of *** Glen Rock Estates ***"; running then along the eas- terly boundary of Lots 9 and 7, as shown on said map of "*** Glen Rock Estates ***" in a general southwesterly direction, a distance of about 815 feet, and returning to the westerly boundary of the (Incorpor- ated) Village of Mamaroneck aforesaid; running then along said westerly boundary, South 360 56' 1011, West 828. 16 feet to the point or place of beginning. The said premises are also known as part of Lots 1, 2, 3, 4, & 5, on a certain map entitled, "*** Section One Glen Rock Es- tates ***", filed in the County Clerk's Of- fice, Division of Land Records, as Map No. 8887, and as Lots 6, 7, 8, 9, 10, 11, & 12, on map entitled, "Subdivision Map for Sections 2 and 3, Glen Rock Estates in the Town of Mamaroneck, Westchester County, New York", made by Ralph Cron- quist, dated April 23, 1954, and filed in the County Clerk's Office, Division of Land Records, on July 1, 1954, as Map No. 9103; and WHEREAS, said proposed extension is situated in the Town of Mamaroneck wholly outside of any incorpor- ated Village; and WHEREAS, the estimated amount to be expended in constructing and completing the improvements pro- posed is $15, 000. 00, to be 'borne exclusively by the petitioner; IT IS ORDERED AS FOLLOWS: At a meeting of the Town Board to be held on the 2nd day of May, 1956, at 8:15 p.m. , in the Council Room of the Weaver Street Firehouse, corner of Edgewood Avenue and Weaver Street, Town of Mamaroneck, the Town Board of the Town of Mamaroneck will meet to consider the said petition for the extension of Sewer District No. 1 of the Town of Mamaroneck, lying in the said Town of Mamaro- neck, outside of incorporated Villages of Larchmont and Mamaroneck, and to hear all persons interested in the subject thereof, concerning the same. 289 TOWN BOARD OF THE TOWN OF MAMARONECK BY George D. A copy of such Order together with a Certificate by the Town Clerk show- ing the date of the adoption of the same, shall be published once, i. e. on the 21st day of April, 1956, which is not less than 10 nor more than 20 days before the date set therein for the Hearing, in the Daily Times, the official newspaper in the Town of Mamaroneck, and shall be posted in 5 public places within the proposed extension to Sewer District No. 1, and also on the Bulletin Board at the Town Clerks Office, 158 West Bos- ton Post Road, in the Village of Mamaroneck, not less than 10 nor more than 20 days before the date of said Hearing. Section 3. This resolution shall take effect im- mediately. REQUEST RE PAVING OF MAXWELL AVENUE Mr. Delius introduced Mr. Benjamin Jaffe of 32 Forest Park Avenue, Larchmont, who requested the Board to give con- sideration to a 50-foot wide paving of Maxwell Avenue from the corner of Maxwell Avenue and Madison Avenue along Max- well Avenue for a distance of some 300 feet. Mr. Jaffe ad- vised that he would be willing to make a donation toward the cost of such pavement. After hearing Mr. Jaffe and following some discussion, the Board referred this matter to the Superintendent of Highways for investigation and report to this Board as to recommen- dations and cost. The Supervisor suggested that, in the meantime, the Council- men familiarize themselves with this area in the event that they were not already familiar with it. REQUEST--PRINCE WILLOWS ASSOCIATION Mr. John C. Marbach, Attorney for the Prince Willows Association, appeared before the Board to request that the Board designate the person or persons to work with their engineer in connection with the extension of the sewer district in the Prince Willows area. The Board so designated Councilman Santoro and Mr. Friedlander. OLD BUSINESS APPLICATION HAMPSHIRE COUNTRY CLUB--ERECTION OF DIKE Incompliance with the request of Mr. Jerome N. Wanshel of 6 Beverly Place, Larchmont, Attorney for the Club, the Board deferred this matter to the meeting of May 16, 1956. NEW BUSINESS COMMUNICATION--BOARD OF EDUCATION RE REQUEST FOR USE OF ELECTION EQUIPMENT The Clerk presented a letter under date of April 10, 1956, from J. J. Barbieri, District Clerk of the Board of Education, Union Free School District No. 1, Mamaroneck, New York, requesting the use of one voting machine for the election of School Trustees to the Board of Education at the Mamaroneck Junior High School on May 2, 1956. On motion by Councilman Brush, seconded by Council- man Kane, it was unanimously RESOLVED that the request of the District Clerk of Union Free School District No. 1, Mamaroneck, New York, for the use of one voting machine at the election of School Trustees to the Board of Education at the Mamaroneck Junior High School on May 2, 1956, be and it hereby is granted. COMMUNICATION--VILLAGE OF MAMARONECK RE SALE OF BLOCK 812 - PARCEL 136 The Clerk presented a communication, dated April - - 11, 1956, from the Village Manager of the Village of Mamaroneck, requesting approval of the sale of Block 812 Parcel 136 to Florence Cofino. On motion by Councilman Kane, seconded by Coun- cilman Brush, the following resolution was unani- mously adopted by the Board: WHEREAS, the Village of Mamaroneck, through the institution of foreclosure proceedings in rem, has become and now is the owner of a number of parcels of real estate situate in the Village of Ma- maroneck and Town of Mamaroneck; and WHEREAS, both the Village of Mamaro- neck and the Town of Mamaroneck held -- tax liens on said parcels of real prop- erty; and WHEREAS, pursuant to Section 165-H of the Tax Law, an agreement was entered into between the Village of Mamaroneck and the Town of Mamaroneck, which, among other things, set forth the interests of said municipalities in the properties be- ing foreclosed, the manner of the sale of said properties, and the manner of the distribution of the proceeds received from said sales; and WHEREAS, the Village of Mamaroneck has, pursuant to an agreement had with the Town of Mamaroneck, advertised for and has heretofore received bids on certain properties owned by the Town of Mamaro- neck, as well as on certain properties owned by the Village of Mamaroneck in the Town of Mamaroneck; and WHEREAS, the Board of Trustees of the Village of Mamaroneck has given considera- tion thereto and after due deliberation, ac- cepted the bid hereinafter listed as to price and terms set forth; and WHEREAS, since receipt of said bid, this Board has given careful consideration there- to, and after due deliberation, it is RESOLVED that the bid hereinafter listed be accepted at the price and terms therein set forth: BID ACCEPTED IN SECTION 8 Town Village Blk. Cash A RESOLUTION--SALARY ADJUSTMENT FOR SUPERINTEN- DENT OF HIGHWAYS The Clerk presented a memorandum, dated March 22, 1956, from Mr. Finson, Accountant, with re- gard to adjustment of salary for Mr. Frank R. O'Brien, Superintendent of Highways. On motion by Councilman Waterman, seconded by Councilman Kane, it was unanimously RESOLVED that, effective as of May 1, 1956, the compensation of Frank R. O'Brien, Superintendent of Highways, shall be at the rate of $6, 720. 00 per annum. RESOLUTION--PAYMENT OF OUTSTANDING SCHOOL TAXES, LEVIES OF 1955, DISTRICT 1 AND 2 At the request of Mr. Orsino, Comptroller, on motion by Councilman Santoro, seconded by Councilman Kane, the Board unanimously passed the following resolution: RESOLUTION AUTHORIZING THE ISSUANCE OF TAX ANTICIPATION NOTE OF THE TOWN OF MAMARONECK IN AMOUNT NOT EXCEED- ING $20, 79Z. 70, IN ANTICIPATION OF THE COLLECTION OF UNPAID SCHOOL TAXES FOR THE FISCAL YEAR, JULY 1, 1955, TO JUNE 30, 1956. RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK IN THE COUNTY OF WESTCHESTER, STATE OF NEW YORK, AS FOLLOWS: Section 1. In anticipation of the receipt of un- paid school taxes for the fiscal year beginning July 1, 1955, and ending June 30, 1956, and for the purpose of providing moneys to pay to the Treasurers of Union Free School District No. 1 and School Dis- trict No. 2, the amount of unpaid school taxes, the Supervisor is hereby authorized and directed to issue a Tax Anticipation Note of the Town in a total principal amount not exceed- ing $20, 792. 70, pursuant to Section 555 of Chapter 852 of the Laws of 1948 of the State of New York, and pursuant to Section 24.00 of the Local Finance Law of the State of New York. Section 2. It is hereby determined and declared: (a) The total -amount of school taxes levied in said Town for said fiscal year is: School District No. 1 $2, 005, 414.87 School District No. 2 46, 558. 81 J f k,d (b) The total amount of said taxes due and unpaid is: School District No. 1 $20, 011.42 School District No. 2 781. 28 (c) The total amount heretofore borrowed and outstanding in anticipation of the collection of said taxes is none. Section 3. The note issued under this resolu- tion shall be dated April 1, 1956, and shall mature on September 1, 1956, and the date of maturity of such note or any re- newal thereof shall not extend beyond the close of the applicable period provided in Section 24. 00 of the Local Finance Law of the State of New York for the maturity of such notes. Section 4. The Supervisor is hereby authori- zed to determine the interest rate and all other matters in connection herewith not determined by this or subsequent resolu- tion, and his signature upon said note shall be conclusive as to such determination. The note issued hereunder shall be substantially in the form of "Model Form of Note Payable to Borrower" set forth in Schedule B of the Local Finance Law of the State of New York and shall be signed by the Supervisor and counter- signed by the Town Clerk, and shall have the seal of the Town affixed thereto. '- -- Section 5. The Supervisor is hereby further authorized to issue said note and to borrow the principal amount thereof as hereby determined from the reserve fund re- sulting from moneys received from the redemp- tion of transfers of tax liens as provided in Sec- tion 556 of Chapter 852 of the Laws of 1948 as amended. Section 6. The faith and credit of the Town of Mamaroneck are hereby pledged for the punctual payment of the principal of and interest on said note and unless otherwise paid or payment provided for, taxes shall be levied on all of the taxable property in said Town in an amount sufficient to pay said principal and interest. RECOMMENDATION--APPOINTMENT OF SUPERINTENDENT OF RECREATION The Clerk presented a communication, addressed to the Supervisor under date of April 18, 1956, from Walter E. Warner, Jr. , Chairman of the Recreation Commission, recommending that James William Kronenberger be employed as Superintendent of Rec- reation of tlh.e Town of Mamaroneck. Councilman Santoro outlined something of Mr. Kronenberger's educational background and experience, and suggested that the Board ap- prove the recommendation as submitted by the Recreation Commission. On motion by Councilman Santoro, seconded by Councilman Brush, upon roll call, the Board unanimously adopted the following resolution: RESOLVED that Mr. James William Kronenberger be and he hereby is ap- pointed as Superintendent of Recrea- tion of the Town of Mamaroneck, ef- fective as of June 1, 1956, at an an- nual salary of $5, 500. 00. FURTHER RESOLVED that Mr. Kronenberger be compensated for the use of his personal automobile at a rate of eight cents (8�) per mile for all mileage actual and necessary to the discharge of his duties, provided that the maximum amount allowable in any one month shall not exceed $25. 00. FURTHER RESOLVED that the 1956 Budget of the Recreation Department be and it hereby is amended by the transfer: From: "Maintenance Ball Fields and Other Recreational Expense" - $3, 383. 31 To: Recreation Director - $3, 208. 31 Travelling Expense - 175. 00 FURTHER RESOLVED that Mr. Kronenberger is authorized to pre- pare such Recreational Project Application Forms as are described by the New York State Youth Com- mission and forward same to that Commission for approval for State Aid purposes. COMMUNICATION--VILLAGE OF LARCHMONT RESALE OF BLOCK 601 - PARCELS 121 and 127 The Clerk presented a communication, dated April 18, 1956, from the Village Clerk of the Village of Larchmont, requesting approval of the sale of Block 601 - Parcels 121 and 127. On motion by Councilman Kane, seconded by Councilman Brush, the Board unanimously adopted the following resolution: WHEREAS, the Village of Larchmont, through the institution of foreclosure proceedings in rem, has become and now is the owner of a number of par- cels of real estate situate in the Vil- lage of Larchmont and Town of Ma- maroneck; and WHEREAS, both the Village of Larch- mont and the Town of Mamaroneck held tax liens on said parcels of real prop- erty; and WHEREAS, pursuant to Section 165-a of the Tax Law, an agreement was entered into between the Village of Larchmont and the Town of Mamaroneck, which, among other things, set forth the inter- ests of said municipalities in the prop- erties being foreclosed, the manner of the sale of said properties, and the man- ner of the distribution of the proceeds received from said sales; and WHEREAS, the Village Treasurer, pur- suant to authorization of the Board of Trustees of the Village of Larchmont on March 19, 1956, advertised for bids and held a public auction on April 16, 1956, and received bids on certain parcels owned by the Village of Larchmont in the Town of Mamaroneck; and WHEREAS, the Board of Trustees of the Village of Larchmont has given consider- ation thereto, and after,due deliberation, accepted the bid hereinafter listed as to price therein set forth: Village Block Parcels Highest Bidder Upset Price Price Bid .;Assessment 601 121 & 127 Frederick Altman $1, 600 NOW, THEREFORE$ BE IT RESOLVED that the price bid for the par- cels of real property listed above is here- by approved, and that all consents and ap- proval by the Town Board of the Town of Mamaroneck for the sale of the aforesaid parcels of real property by the Village of Larchmont required under the provisions of the aforesaid agreement between the Village of Larchmont and the Town of Ma- maroneck, dated May 20, 1946, are here- by granted and allowed. $1, 600. $1, 600. RE PRESTON STREET In respect to the matter of Preston Street becoming a one-way street, the Supervisor requested the Police Chief to give the Board the story of conditions from his point of view. Chief Yerick stated that the street had been under ob- servation by Lt. Waterbury, Officer Mancusi, and him- self for a period of some three years and that seven ac- cidents and several near-accidents had occurred during that time. He further stated that 26 residents of Edge- wood Avenue had petitioned for changing the street to a one-way street on the grounds of safety to children and motorists. On the basis of such observation by the Police Depart- ment and said petition, the recommendation to make Preston Street a one-way street in the best interest of public safety was made to the Board of Police Commis- sioners. Mr. Lee Gagliardi, as attorney for Richard Woitack of 82 Myrtle Boulevard, stated his client is faced with the same hardship as Mr. Zegers of 31 Edgewood Avenue, who, at the last Town Board meeting, explained that this ruling exercised great hardship on him in taking his car from his garage in the rear of his property down Preston Street, along Myrtle Boulevard, up Weaver Street and along Edgewood Avenue in order to reach the front of his house. The Supervisor pointed out that jurisdiction for the crea- tion of one-way streets was under the Board of Police Commissioners and suggested that both Mr. Zegers and Mr. Woitack appeal to that Board. REPORTS The Clerk presented the following reports which were received and filed: Report of the Westchester Shore Humane Society, Inc. for March, 1956. Report of the Supervisor--January 1 to March 31, 1956. REPORT OF THE SUPERVISOR Re: Leasing of property from Westchester County Park Commission The Supervisor reported that he had been ad- vised by the General Superintendent of the Westchester County Park Commission, Mr. George S. Haight, that the Commission, at the meeting of April 11, 1956, had given consideration to the request of the Town to lease County-owned lands, and felt that since such projects for which this land was bought by the County are still under con- sideration, it would be unwise to recommend the release of any such areas at this time. Mr. Haight further advised that the County would be glad to consider leasing to the Town for a nominal rental any parcels along the right-of-way of the New England Thruway not taken for Thruway construction, for such civic use as the Town might wish. Councilman Waterman suggested that the Town keep in touch with the County Park Commis- sion regarding this situation. Re: Extension of Water Works System The Supervisor reported that an estimate of the cost of a new water line from Shaft 22 in Yonkers had been submitted by Hazen and Sawyer, Engineers, and that the Water Board waited the decision of the Village of Larchmont, pending report of an engineering firm engaged by that Village, as to participation by the Vil- lage of Larchmont with the Village of Mamaro- neck and the Towns of Harrison and Mamaro- neck in the matter of such extension. Re: Proposed Increase--New Haven Railroad In the matter of the proposed rate increases by the New Haven Railroad, the Supervisor reported that the Board of Supervisors had appointed a Committee to investigate and study the proposal. Mr. Delius, the Town Attorney, stated that he had received a very lengthy communication ex- plaining the proposition in some detail and calling a meeting for discussion purposes in Room 6o6, County Office Building, White Plains, on Thurs- day, April 26, 1956. Councilman Brush suggested that the Attorney be officially delegated to cover all meetings in connection with this matter and report to this Board thereon. On motion by Councilman Brush, seconded by Councilman Kane, it was unanimously RESOLVED that Mr. John L. Delius, the Town Attorney, be and he hereby is des- ignated and authorized as the official rep- resentative of the Town of Mamaroneck to attend all meetings in connection with the proposed application of the New York, New Haven, and Hartford Railroad for an increase in commutation rates. REPORTS OF THE COUNCILMEN Councilman Brush -- No report. Councilman Kane -- Re: Apportionments Councilman Kane presented the following pe- tition, received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. On motion by Councilman Kane, seconded by Councilman Brush, the following resolu- tion was unanimously adopted: WHEREAS, the Assessor has pre- sented a petition for the correction of the assessment roll for certain years, pursuant to the provisions of Section 557, Article 16, of the Westchester County Administra- tive Code, known as the Westches- ter County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petition for the correc- tion of said assessment roll: NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1955, taxes of 1956, which shows property now appearing on the roll as follows: Block Parcel Name Land only 206 70 & 129 Charles G. Williams Re: Planning Board Land only $ 2, 500 6, 500 Councilman Kane reported that Mr. Delius and he had attended one regular and two special meetings of the Planning Board this month and commended that Board highly. Councilman Waterman -- No report other than Fire matters. Councilman Santoro -- Re: Tree on Cooper Lane Councilman Santoro reported that the tree on Cooper Lane had been removed in ac- cordance with the directions of the Board at the meeting of April 4, 1956. Re: Incinerator Councilman Santoro reported that some temporary repairs were in process at the Incinerator at this time. REPORT OF THE ATTORNEY Re: 65 Palmer Avenue The attorney reported that the complaint had been dismissed and decision handed down in favor of the Town and apartment house builder. Re: Amendments to General Ordinances The Board again discussed the proposed amend- ments to the General Ordinances with Chief Yerick, who was present at the meeting, and following this discussion, it was upon motion by Councilman Waterman, seconded by Councilman Brush, unanimously RESOLVED that a Public Hearing be held at the regular meeting of the Town Board on May 2, 1956, for the purpose of considering amendments to the General Ordinances of the Town of Mamaroneck regarding pavement markings, parking regulations, and a provision that dirt and refuse spilled on the streets of the Town must be removed. FURTHER RESOLVED that the Town Attorney be instructed to prepare the necessary Notice of Public Hearing and the Town Clerk be authorized to publish said notice in the Daily Times, the official newspaper of the Town of Mamaroneck. ADJOURNMENT There being no further business to come before the meeting, it was adjourned at 9:30 p.m. , to reconvene May 2, 1956.
