MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE
TOWN OF MAMARONECK HELD ON FEBRUARY 20, 2019, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Work Session was
unanimously opened at 5:00PM.

Additionally Present: Tracy Yogman
Mr. Altieri introduced Tracy Yogman as the candidate for Town Comptroller. Ms. Yogman gave a brief
summary of her credentials and experience. The Town Board asked Ms. Yogman some additional questions,
then thanked her for coming this evening to introduce herself to the Town Board.
Comprehensive Plan
The Town Board continued to review the scope of services for the Comprehensive Plan. The Town Board
discussed dividing the Comprehensive Plan into two phases. The first phase would be the engagement of the
community. “This process would help the Town Board determine the priorities that are seen by the residents
of the Town.” The Town Board reviewed a revised scope of services based on this new objective.
Supervisor Seligson feels the document needs to be improved to reflect the excitement of creating a vision
for the future of the community. She would also like to see the Town engage in some kind of kickoff event to
spark enthusiasm in the community. Supervisor Seligson stated that she and Mr. Altieri met with the new
member of the Housing Authority, Melissa Kaplan-Macey, who is an expert in this area. Ms. Kaplan-Macey
recommends a more specific timeline as well as a more policy driven document in order to have a better
guide moving forward.
The Town Board addressed the need to move forward developing a steering committee. The Town Board
reviewed the updated scope of services in detail, commenting that there were not enough projection trends
in the plan, and still too much verbiage about historical data. The Town Board emphasized that the physical
makeup of the Town has not changed much, but how people use the physical makeup of the Town has.
Additionally, the review of the Town Master Plan of 1986 should be cursory and the Introduction and Process
paragraph should be minimal. Supervisor Seligson questioned holding only three meetings in Phase 1. The
Board requested clarification between initial stakeholders and steering committee members. The Town
Board questioned the use of Town employees as facilitators for outreach, adding that doesn’t seem correct;
the consultants should be the facilitators. During review of Phase 3, Supervisor Seligson reemphasized the
need for a kickoff event, not just flyers, adding that we need to generate excitement and buzz. Mr. Altieri will
review with the consultant and generate another draft scope for review.

Update - DeLancey Cemetery
The Town Board discussed the proposal and request for matching funds made by the Mamaroneck Historical
Society for the restoration of the DeLancey Burial Grounds on Palmer Avenue in the Village of Mamaroneck.
The Town Board approved matching funds up to $2,500., with the understanding that this create a precedent
for future funding.
Parking Permit Fees / Parking Lot Enforcement
The Town Board reviewed a schedule of the parking permit fees the Town Board revised at the previous
meeting. The Town Clerk asked the Town Board to address policies with respect to prorating sales and
refunds. After receiving their feedback, the Town Clerk will finalize the policies for review at an upcoming
meeting. Additionally the Town is recommending a return to the ‘hard’ parking permit tags issued by the
Town Clerk and not permit tags that residents’ can print from home. The reason for this reversal is due to the
Police maintaining their current enforcement methods which does not provide for the intended integration
with the new parking permit software.
Discussion - 2019 Capital Plan
Supervisor Seligson stated that during review of the Capital Plan, the Town Board is reminded that even
though the Town Board approves the schedule, it still has decision making to move forward with a particular
project based on bids received or changes in plans or priorities. The Town Board reviewed the specific
projects, discussing in greatest detail, the traffic signal at Madison Avenue and New Jefferson Streets, the
Fifth Avenue corridor, and the Ice Rink locker rooms and bathrooms.
Supervisor Seligson stated that the County Executive, George Latimer, is seeking letters from municipalities in
support of his request for a 1% increase in the sales tax. The Town Board is in favor of offering a letter of
support.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:30 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening,
adding this is an open meeting that all residents are welcome to attend.
PROCLAMATION – Howard McMichael – Service Award - Coastal Zone Management Commission
Supervisor Seligson presented Howard McMichael with the following award, followed by a few words from
Mr. McMichael.
WITH SINCERE APPRECIATION FOR SERVICE TO THE COMMUNITY
HOWARD MCMICHAEL
For his outstanding service to the Town of Mamaroneck as a longtime member of the
Coastal Zone Management Commission (CZMC). Mr. McMichael was the senior member
of the CZMC having served since 1986. As a member of the CZMC, Howard, aka “Howie”,
helped write the original Local Waterfront Revitalization Plan (LWRP) and the 2018 update
that helps protect water quality of local rivers, streams and Long Island Sound, marine
habitat and the natural environment of the Town. Howie is the president of McMichael
Yacht Brokers and Yacht Yards, his family’s business since 1935. Howie brought the
important and unique perspective of a local waterfront business owner to the CZMC. A
former commodore of Larchmont Yacht Club, Howie has significant sailing and boating
experience in our local waters and beyond. The Town Board and I thank Howie McMichael
for his service and dedication to the CZMC and congratulate him on his retirement from
the board.

SUPERVISOR’S SUMMARY REPORT
I have had a busy two weeks representing the interests of the Town of Mamaroneck as Town
Supervisor and Westchester municipalities as the President of the Westchester Municipal Officials

Association. On February 8, the Westchester State Senate representatives held a hearing on the
Governor’s draft budget. On behalf of the 45 municipalities in Westchester County, I expressed
strong objection to the Governor’s budget proposal to eliminate AIM funding to municipalities.
AIM funding is the state aid to municipalities. The Governor has proposed to eliminate the aid to
most towns and villages. For the Town of Mamaroneck, the loss of $142,000 from its general fund
creates a funding gap that might have to be made up with property taxes. Although AIM funds
may represent a small portion of a municipal budget, it often represents a large portion of the
non-tax revenue. It is unfair for the State to ask municipalities to operate within a tax cap and
then eliminate aid to these same municipalities.
On behalf of the Town of Mamaroneck, I testified about the proposed plastic bag legislation. I
noted that we are thrilled with the idea of statewide plastic bag legislation, but want to see the
most effective legislation enacted. The Town of Mamaroneck is currently working on establishing
plastic bag legislation. We have determined that the best plastic bag legislation bans the use of
plastic bags and requires a fee to be charged for the use of paper bags or the purchase of
reusable bags.
I then went to Albany for the NYCOM conference and to meet with our state legislators about the
legislative priorities of the WMOA.
The same week, the Westchester County Executive asked municipal leaders for their support of a
1% increase in the sales tax for Westchester County. The County of Westchester needs to resolve
a budget gap created by the previous County Executive who refused to adequately fund County
government by not raising taxes for 8 years. No one likes to raise taxes, but increasing the County
sales tax by 1% will put Westchester on par with several other counties and cities and will provide
Towns and Villages with badly needed revenue as well. I attended the County Executive’s press
conference last Thursday.
We had a WMOA dinner meeting in Rye Brook last Thursday as well where we heard from a
speak about the NY Health Act. This week I attended the Association of Towns annual meeting in
NYC with Jaine and Sabrina. It’s a large meeting with many concurrent programs and vendors. I
always find that I learn something and am pleased I got to attend a couple of sessions on
Comprehensive Plans.
CITIZEN’S COMMENTS
Supervisor Seligson asked if anyone in the audience would like to address the Board.
George Roniger, representing the Larchmont Gardens Civic Association addressed the Town Board. He noted
that the Larchmont Gardens Civic Association is working with the Town Historian and Director of the
Larchmont Historical Society, Lynn Crowley, to gather historical information on the history of Larchmont
Gardens Civic Association. This a very interesting project that will gather and organize this historic
information.

The following resolution was offered by Councilwoman Fiddelman, who moved its adoption, seconded

BOND RESOLUTION DATED FEBRUARY 20, 2019.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $248,000 BONDS OF THE TOWN OF
MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF A COMPREHENSIVE
MASTER PLAN, FOR SAID TOWN.
WHEREAS, said capital project hereinafter described, as proposed, has been determined to be a Type
II Action pursuant to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act, which regulations state that Type II
Actions will not have any significant adverse impact on the environment; and
WHEREAS, it is now desired to authorize the financing thereof; NOW, THEREFORE,

BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the
Town Board of the Town of Mamaroneck, Westchester County, New York, as follows:
Section 1. The development of a Comprehensive Master Plan, including incidental expenses in
connection therewith, in and for the Town of Mamaroneck, Westchester County, New York, is hereby
authorized at a maximum estimated cost of $248,000.
Section 2. It is hereby determined that the plan for the financing of the aforesaid maximum
estimated cost is by the issuance of $248,000 bonds of said Town, hereby authorized to be issued therefor
pursuant to the provisions of the Local Finance Law.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific
object or purpose is five years, pursuant to subdivision 64 of paragraph a of Section 11.00 of the Local Finance
Law. It is hereby further determined that the maximum maturity of the bonds herein authorized will not
exceed five years.
Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are
hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same
respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay
the principal of and interest on such bonds becoming due and payable in such year. There shall annually be
levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such
bonds as the same become due and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance
of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized,
including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes
shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance Law.
Section 6. All other matters, except as provided herein relating to such bonds, including
determining whether to issue such bonds having substantially level or declining annual debt service and all
matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds,
prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for
said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the
name of the Town by the facsimile signature of the Supervisor, providing for the manual countersignature of a
fiscal agent or of a designated official of the Town), the date, denominations, maturities and interest payment
dates, place or places of payment, and also including the consolidation with other issues, shall be determined
by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in section
52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to
those required by section 52.00 of the Local Finance Law, as the Supervisor shall determine.
Section 7. This resolution shall constitute a statement of official intent for purposes of Treasury
Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies are, or are reasonably
expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent
funding of the object or purpose described herein.
Section 8. The validity of such bonds and bond anticipation notes may be contested only if:
1) Such obligations are authorized for an object or purpose for which said Town is not authorized to
expend money, or
2) The provisions of law which should be complied with at the date of publication of this resolution
are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such
publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 9. This resolution, which takes effect immediately, shall be published in summary form in
the official newspaper of said Town for such purpose, together with a notice of the Town Clerk in substantially
the form provided in Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which
resulted as follows:

BOND RESOLUTION DATED FEBRUARY 20, 2019.
A RESOLUTION AUTHORIZING, SUBJECT TO PERMISSIVE REFERENDUM, THE ISSUANCE OF
$424,000 BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO
PAY THE COST OF THE PURCHASE OF VEHICLES AND EQUIPMENT FOR THE HIGHWAY
DEPARTMENT, FOR SAID TOWN.
WHEREAS, acquisition of the capital items hereinafter described, as proposed, has been determined to
be a Type II Action pursuant to the regulations of the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality Review Act, which regulations state
that Type II Actions will not have a significant adverse effect on the environment; and
WHEREAS, it is now desired to authorize the financing of such capital items; NOW, THEREFORE,
BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the
Town Board of the Town of Mamaroneck, Westchester County, New York, as follows:
Section 1. The purchase of vehicles and equipment for the Highway Department, each item of
which is $30,000 or more, a class of objects or purposes, in and for the Town of Mamaroneck, Westchester
County, New York, is hereby authorized at a maximum estimated cost of $424,000, including incidental
equipment and expenses in connection therewith.
Section 2. It is hereby determined that the plan for the financing of said class of objects or
purposes is by the issuance of the $424,000 of bonds of the Town hereby authorized to be issued therefor
pursuant to the provisions of the Local Finance Law.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of
objects or purposes is fifteen years pursuant to subdivision 28 of paragraph a of Section 11.00 of the Local
Finance Law. It is hereby further determined that the maximum maturity of the bonds herein authorized will
exceed five years.
Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are
hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same

AND INSTALLATION OF COMPUTER SOFTWARE FOR VARIOUS DEPARTMENTS, IN AND FOR
SAID TOWN.
WHEREAS, all conditions precedent to the financing of the object or purpose hereinafter described,
including compliance with the provisions of the State Environmental Quality Review Act, have been performed;
and
WHEREAS, it is now desired to authorize the financing thereof; NOW, THEREFORE,

BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the
Town Board of the Town of Mamaroneck, Westchester County, New York, as follows:
Section 1. The purchase and installation of computer software for various departments, in and

prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for

by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in section
52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to
those required by section 52.00 of the Local Finance Law, as the Supervisor shall determine.
Section 7. This resolution shall constitute a statement of official intent for purposes of Treasury
Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies are, or are reasonably
expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent
funding of the object or purpose described herein.
Section 8. The validity of such bonds and bond anticipation notes may be contested only if:
1) Such obligations are authorized for an object or purpose for which said Town is not authorized to
expend money, or
2) The provisions of law which should be complied with at the date of publication of this resolution
are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such
publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 9. Upon this resolution taking effect, the same shall be published in summary form in the
official newspaper of said Town for such purpose, together with a notice of the Town Clerk in substantially the
form provided in Section 81.00 of the Local Finance Law.

P.M., Prevailing Time.
The meeting was called to order by Supervisor Seligson, and upon roll being called, the following were

The following resolution was offered by Councilman King, who moved its adoption, seconded by
Councilwoman Elkind Eney to-wit:
BOND RESOLUTION DATED FEBRUARY 20, 2019.
A RESOLUTION AUTHORIZING, SUBJECT TO PERMISSIVE REFERENDUM, THE ISSUANCE OF
$1,238,000 BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO
PAY PART OF THE COST OF THE CONSTRUCTION OF IMPROVEMENTS TO THE HOMMOCKS ICE
RINK, IN AND FOR SAID TOWN.
WHEREAS, the capital project hereinafter described, as proposed, has been determined to be a Type II
Action pursuant to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act, which regulations state that Type II
Actions will not have any significant adverse impact on the environment; and
BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the
Town Board of the Town of Mamaroneck, Westchester County, New York, as follows:
Section 1. The construction of improvements to Hommocks Ice Rink, in and for the Town of
Mamaroneck, Westchester County, New York, including planning and design, and original furnishings,
machinery, equipment, apparatus, appurtenances, and incidental improvements and expenses in connection
therewith, is hereby authorized at a maximum estimated cost of $1,313,000.
Section 2. The plan for the financing of the aforesaid maximum estimated cost is as follows:
a) by the issuance of $1,238,000 serial bonds of said Town, hereby authorized to be issued
therefor pursuant to the provisions of the Local Finance Law; and
b) by the expenditure of $75,000 other monies hereby appropriated therefor.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific
object or purpose is twenty-five years, pursuant to subdivision 12(a) of paragraph a of Section 11.00 of the
Local Finance Law. It is hereby further determined that the maximum maturity of the bonds herein authorized
will exceed five years.
Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance
of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized,
including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes
shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance Law.
Section 5. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are
hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same
respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay
the principal of and interest on such bonds becoming due and payable in such year. There shall annually be
levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such
bonds as the same become due and payable.
Section 6. All other matters, except as provided herein relating to such bonds, including
determining whether to issue such bonds having substantially level or declining annual debt service and all
matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds,
prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for
said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the
name of the Town by the facsimile signature of the Supervisor, providing for the manual countersignature of a
fiscal agent or of a designated official of the Town), the date, denominations, maturities and interest payment
dates, place or places of payment, and also including the consolidation with other issues, shall be determined

by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in section
52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to

with Earthkind Energy to procure and install Electric Vehicle Charging Stations, and
to manage the grant agreement and file the necessary submission on behalf of the Town,and

Hearing on an “Elimination of Seasonal Employees from the List of Employees Required

Position of Deputy Town Administrator” Law, for March 6, 2019 at 8:00PM at the Town

10. Appointment of Town Comptroller / Receiver of Taxes
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby appoint Tracy Yogman
to the position of Town Comptroller and Receiver of Taxes, under the terms and conditions of
employment as presented by Mr. Altieri in his February 14, 2019 memo to the Town Board, at
an annual salary of $164,000, effective March 18, 2019.
