APPROVAL OF MINUTES
The minutes of the regular meetings of February 5th, 19th, and
March 5th, and of the special meetings of February 8th and 13th,
1958, were presented and on motion by Councilman Kane, seconded
by Councilman Brush, approved unanimously as follows:

OLD BUSINESS
a. Report on Tabulation of Bids--Construction of Storm Drains in
Hommocks Property
Councilman Santoro reported that as directed by the Board at
its last meeting, Engineer Friedlander and he had tabulated the
bids submitted for the construction of storm drains and appur-
tenances in Town-owned land on the southerly side of Hommocks
Road in the Town of Mamaroneck, and found the low bid to be
that of Gagliardi Bros. of White Plains. He explained that the
bids were submitted on a unit basis and with allowance for the

Town, in accordance with the Specifications and Proposal as
stated under the section entitled, "Interpretation of Approxi-
mate Estimate of Quantities, " to increase, decrease, or
omit any of the quantities shown in the itemized proposal,
Councilman Santoro further stated that since the aggra-
gate total of this low bid was in the amount of $9, 676,00, and
that since there was available in the 1958 budget only the sum
of $5, 000. 00 for this work, Engineer Friedlander and he, in
view of this limitation, had discussed with Gagliardi Bros,
the question of whether said company had any objection to en-
tering into a contract for such construction within this limita-
tion. He advised that Gagliardi Bros, stated that there was
no objection to this proposal and that they would enter into
such a contract u p on authorization by
the Town Board, There-
fore he recommended that the Board authorize such contract
in a total amount not to exceed the sum of $5, 000.00, and on
motion by him and seconded by Councilman Kane, it was
unanimously
RESOLVED that the contract for the construction of
storm drains and appurtenances in Town-owned land
on the southerly side of Hommocks Road in the Town
of Mamaroneck be and it hereby is awarded to the
low bidder, to wit Gagliardi Bros, of White Plains,
New York, in_a total amount not to exceed the sum
of $5, 000, 00 and based on the following reduced
quantities in accordance with the section entitled,
"Interpretation of Approximate Estimate of ;Quanti-
ties, " in the Specifications and Proposal:

FURTHER RESOLVED that the Supervisor be and he
hereby is authorized to execute such contract be-
tween the Town of Mamaroneck and Gagliardi Bros.
of White Plains, New York.
Upon the Clerk's request for authorization to return the certified
or cashiers checks accompanying the bids submitted for the above-
described construction, on motion by Councilman Santoro and sec-
onded by Councilman Brush, it was una*+ymoizly
RESOLVED that the Town Clerk be and he hereby is
authorized to return to each bidder except the suc-
cessful bidder, the certified or cashiers check in the
amount of 510 of the total bid as submitted with each
bid in accordance with the Specifications and Pro-
posal under the section entitled, "Bid Security."
b. Report on Weaver Street Firehouse
Councilman Santoro and Town Engineer Friedlander reported
along the following lines with respect to the condition of the Wea-
ver Street Firehouse.
First -- with reference to the weight that could be safely car-
ried on the Auditorium floor, he reported that a part of this floor
had been removed in an effort to determine the exact construc-
tion thereof so that based upon the information thereby disclosed
it would be possible to compute the load that could be safely sup-
ported by such construction. In this connection, it was recom-
mended that certain structional reinforcements at an estimated
cost of some $1, 500.00 be undertaken at the front of the building
as such would increase the safety factor and, in the Engineer2s
opinion, make the entire center section of the building adequate
to support any load which might be placed thereupon.
Second -- with regard to the weight capacity of that section of
the main floor housing the apparatus, he reported that an audeo-
visual test had been conducted by having the Engineer, Mr. Kee-
ler, Insurance Agent for the Town, and himself stationed in the
basement while the apparatus was driven in and out of the Fire-
house several times. He advised that no vibration whatsoever
was observed or detected at this time but he further advised that
the Engineer had made certain engineering computations verify-
ing these observations and that a written report thereof would be
- submitted at the next meeting of the Board for the purposes of
the record.
Third -- in relation to the settling of the west wing, he re-
ported that the footings and foundation had been exposed so that
a study and soil test and examination could be made. Since a
large crack was found in the foundation on the southerly side of
the building which extended right through the footings, he recom-
mended that the New Rochelle Testing Laboratory be retained to
make test borings so that an accurate determination could be
made as to just what remedial measures would be required to
insure the restoration of this wing to proper and safe condition.
Councilman Santoro informed the Board that the cost of such
tests was about $125.00 per day and'-that he believed at least two
days would be required for this work. Upon receipt of the Lab-
oratoryls report, further recommendations as to exactly what
would be necessary for the restoration of the wing would be sub-
mitted to the Board.
In conclusion, Councilman Santoro requested the Board to
authorize the expenditure of a sum of money not to exceed the
amount of $2, 000.00 to cover the cost of the reinforcement work
on the center section of the building and also the cost of test bor-
ings to be taken along the west wing, and on his motion to this
effect, which was seconded by Councilman Waterman, the Board
unanimously
RESOLVED that in accordance with the report
and recommendation of Councilman Santoro
and Town Engineer Friedlander, the expendi-
ture of am amount of money not to exceed the
sum of $2, 000.00 be and it hereby is author-
ized to cover the cost of the necessary rein-
forcement of the center section of the Weaver
Street Firehouse and also the cost of the test
borings to be taken by the New Rochelle Test-
- ing Laboratory along the footings of the west
wing of the building; and be it
FURTHER, RESOLVED that there is hereby
authorized the transfer of the sum of $2, 000.
from Fire District No. , 1 surplus to the 1958
Fire Department budget, line item #401, en-
titled, "Repair & Building Maintenance. "
Councilman Santoro and each of the members of the Board spoke
of the great help and assistance given the Town by Mr. Keeler in
connection with this matter and on motion by Councilman Waterman,
seconded by Councilman Kane, it was unanimously
RESOLVED that there be spread upon the min-
utes of this meeting an expression of the grati-
tude and appreciation of this Board for the
time, knowledge, and invaluable assistance
given to the Town of Mamaroneck by Mr. Ed-
ward A. Keeler of Larchmont in conducting
the examination of the Weaver Street Fire-
house .
Mr. Keeler, who was present at the meeting, addressed the
Board stating that he was very happy to assist with this work and
expressed his thanks to the members of the Board for their gra-
cious acknowledgement of his assistance.
c. Report on Martin Sewer Matter--70 Howell Avenue, Larchmont
With reference to a request presented by S.F. Martin of 70
Howell Avenue, Larchmont, for reimbursement for plumbing ser-
vices performed at his home at 70 Howell Avenue, Larchmont, un-
der exceptional circumstances on October 29, 1957, and in accor-
dance with the written report submitted to the Town Board by
Councilman Santoro under date of March 19, 1958 and filed in the
office of the flown Clerk, on motion by Councilman Santoro, sec-
onded by Councilman Kane, it was unanimously
RESOLVED that S. F. Martin be reimbursed in the
amount of $35.00 for expenditure for plumbing ser-
vices in clearing the Town section of the house con-
nection sewer line at his home at 70 Howell Avenue,
Larchmont, on October 29, 1957 due to exceptional
circumstances as stated in Councilman Santoross re-
port to the Town Board under date of March 19, 1958,
filed in the office of the Town Cl erk.
NEW BUSINESS
a. Resolution--Authorization for Collection of State and County Taxes
The Supervisor requested the usual resolution approving col-
lection of taxes by the Receiver of Taxes for the 1958 State,
County, and Town taxes in two installments.
Whereupon, on motion by Councilman Brush, seconded by Coun-
cilman Waterman, it was unanimously
RESOLVED that pursuant to Section 96-A of Chapter
60 of the Consolidated Laws as amended, known as
the Tax Law, the Receiver of Taxes and Assessments
of the Town of Mamaroneck is authorized to collect
the 1958 State, County, Town, and District taxes and
water rents, which become a lien January 1, 1958, in
two partial payments, each amounting to fifty per cent
(50%). of the total of said taxes and water rents.
FURTHER RESOLVED that the Receiver of Taxes and
Assessments is authorized and empowered to receive
such partial payments or installments of taxes and
water rents at any time prior to the sale of tax liens
but subject to the same penalties as are specified and
provided in Section 542 of the Westchester County Ad-
ministrative Code for the neglect to pay the total
amount of said taxes and water rents.
FURTHER RESOLVED that the acceptance of any such
partial payments or installments of the 1958 taxes and
water rents shall not be deemed to affect in any man-
ner any right of the Town of Mamaroneck under any
general or special law to enforce collection of any un-
paid balance of such taxes and water rents as may re-
main due and owing to the Town of Mamaroneck, but
such rights and powers shall remain in full force and
effect to enforce the collection of the unpaid balances
of such taxes and water rents together with interest,
penalties, and other lawful charges.
And on motion by Councilman Brush, seconded by Councilman
Waterman, it was unanimously
RESOLVED that in accordance with the provisions of
Section 550 of the Westchester County Administrative
Code, "The Daily Times, " the official newspaper pub-
lished in the Village and Town of Mamaroneck, be and
it hereby is designated as the newspaper in which the
Receiver of Taxes and Assessments shall publish the
Notice of the Collection of State, County, Town, and
District Taxes and Water Rents; and be it
FURTHER RESOLVED that said publication be made
on March 21, 1958, in The Daily Times; and be it
FURTHER RESOLVED that in accordance with the pro-
visions of Section 550 of the Westchester County Ad-
ministrative Code, the Town Board does hereby direct
the Receiver of Taxes and Assessments to mail to each
taxpayer of the Town of Mamaroneck, whose address
is known to said Receiver of Taxes and Assessments,
a tax bill for all taxes and water rents, the expense
thereof to be a Town charge,
-- COMMUNICATIONS
1, State Traffic Commission--Full-stop Signs
The Clerk presented a communication from the State Traffic_
Commission under date of March 7, 1958,. concerning Stop sign
control on a number of public highways at their intersection with
state highways and enclosing formal order of the Commission
covering same for the Town records.

2. League of Women Voters of Larchmont--Invitation to Meeting
on County Charter Study
The Clerk presented a letter from the League of Women Vo-
ters of Larchmont under the signature of Mrs, Lionel Robbins,
President, and dated March 13, 1958, inviting the Supervisor
and members of the Town Council to attend a meeting on April
15th at 9:45 a.m, at the Mamaroneck Methodist Church to dis-
cuss the results of the County League study.
The Board authorized the Supervisor to represent the Town
at this meeting and the Supervisor stated that he would attend
the meeting and added that should any member of the Board be
free on that day, he hoped he would attend with him.
3. West Fordham Transportation Corp. --Application for Consent to
Operate Bus Route
The Clerk presented a letter under date of March 14, 1958,
from Samuel Weiss, Attorney, enclosing application of the West
Fordham Transportation Corp, for consent to operate an omnibus
line or route in the Town of Mamaroneck over, upon, and along
certain streets, avenues, and public places in said Town.
The Supervisor informed the Board in some detail regarding
complaints from citizens about the service on this line from a
report of a meeting held by the City of New Rochelle Transit Com-
mission with representatives of the West Fordham Transportation
Corp, advising that said company was taking measures to meet
each of the complaints registered.
Upon the Clerk's advice that Mr. Rukin of the West Fordham
Company would be at the meeting at 10 p.m, to answer any ques-
tions any member of the Board might wish to ask in connection
with the application, the Board put this matter over until Mr.
Rukin's arrival.
4. Letter from Owen A. Mandeville (Not on Agenda)
The Clerk read a letter from Owen A. Mandeville under date
of March 4. 1958, enclosing a copy of a letter sent to the Su-
pervisor under date of February 17th and requesting that said
letter be read at this meeting.
At the Board's direction, the Clerk read the letter of Feb-
ruary 17th pertaining to the matter of laying water distribution
mains in the property of Soundview Woods, Inc., and after some
discussion of this matter during which the Supervisor and each
of the Councilmen strongly asserted his complete confidence in
the Town Attorney and in his position in connection with the
above mentioned matter, the Board directed the Clerk to ac-
knowledge Mr. Mandevillels letter and to advise him that a
copy of his letter of February 17th had been given to each of
the Councilmen for his personal file, that the letter had been
read and the subject matter thereof discussed at this meeting.

REPORT OF THE SUPERVISOR
(1) Board of Supervisors
The Supervisor reported briefly on the many matters before the
Board on which he had been spending a great deal of his time and
spoke particularly of the County-wide transportation problems now
confronting the Board.
REPORTS OF THE COUNCILMEN
Councilman Brush --
(1) Planting of Shade Trees
In connection with a request for the planting of shade trees
along the brook, Councilman Brush reported that some six Scarlet
Maples had been ordered for such planting along the west side of

the brook, each about 2 1/211 in diameter and having a spread of
about forty feet,
Councilman Kane --
(1) Petition--George Forbes (Change in Zoning--Weaver Street)
Councilman Kane reported that this petition presented to this
Board by Mr. Forbes and referred to him for referral to the
Planning Board would be taken under consideration by that Board
as part of the new zoning plan now under study,
Councilman Kane suggested that the Clerk so advise Mr. For-
bes and the Board directed him to do so,
(2) Apportionments
Councilman Kane presented the following petitions received
from the Assessor for the correction of the assessment roll so as
to permit the apportionment of taxes, and on his motion, seconded
by Councilman Santoro, the following resolution was unanimously
adopted;
WHEREAS, the Assessor has presented petitions for
the correction of the assessment roll for certain years
pursuant to the provisions of Section 557, Article 16 of
the Westchester County Administrative Code, known as
the Westchester County Tax Law; and
WHEREAS, after due consideration, this Board finds
it desirable to grant said petitions for the correction
of said assessment roll;

Councilman Waterman --
Councilman Waterman stated that he had no report at this time,
Councilman Santoro --
(1) Recreation Commission Meeting
Councilman Santoro reported that he had been unable to attend
the last meeting of the Commission as he had served as a mem-
ber of a panel on the program of a. Rotary meeting at Bear Moun-
tain that evening. However, he advised that he had been asked
to present a communication from the Commission under date of
March 14, 1958, approving the Superintendent of Recreation's
request to attend the New York State Recreation Conference to
be held in Niagara Falls from April 26 through April 30, 1958,
with expenses in an amount not to exceed the sum of $100.00 and
requesting the Board's authorization thereof. Whereupon, on
motion by him and seconded by Councilman Waterman, it was
unanimously
RESOLVED that James Kronenberger, Superintendent
of Recreation, be and he hereby is authorized to at-
tend the New York State Recreation Conference to be
held in Niagara Falls, New York, from April 26 th
through April 30th, 1958, with expenses in an amount
not to exceed the sum of $100.00; said expenses to be
paid from the fund in the 1958 budget for such purpose,
(2) Lighting--Station Parking Lots
Councilman Santoro reported that he had consulted with the Su-
pervisor as to the possibility of eliminating or lessening some of
the lighting in the parking lots by using only one section after 10
o'clock at night. He stated that he had two thoughts in mind with
respect to this suggestion -- first, the matter of economy, and
second, the accommodation this might afford to those residents
whose homes were near these brightly lighted areas and thus af-
fected by such lighting. He advised that it was his thinking that
this might be accomplished by erecting signs in each lot request-
ing those who were going to be returning late in the evening to use
one certain section, that section to be the only one which would be
kept lighted after 10 p.m. He had requested that the Police De-
partment make an hourly check from 10 p.m. to 7 a.m. of the
number of cars in the parking lots and presented the tabulation as
submitted in accordance with this request.

Some question was raised by the Board as to whether such signs
would be observed and followed by the residents and upon consulta-
tion with Chief Yerick, who was present and who seemed to have
some doubt on this point, the Board requested that a further study
be made on this matter with a report thereon submitted at the next
meeting.
(3) Drainage on Fenimore Road
- Councilman Santoro brought to the attention of the Board a drain-
age condition which exists on Fenimore Road where that road bor-
ders the Beringer property and the Board referred this mattes to
Town Engineer Friedlander for study and report.
(4) Murray Avenue Sewer
Councilman Santoro informed the Board that the specifications
for the Murray Avenue Sewer were being completed and that he
expected them to be ready for presentation at the next meeting of
the Board.
REPORT OF THE TOWN ATTORNEY
(1) Communication from Young, Seacord and Lane--Tax Lien
The Attorney stated that he had received a letter from Young,
Seacord and Lane, Attorneys for Charles Heywood who was for
many years a resident of 18 Edgewood Avenue in the Town of Ma-
maroneck together with an affidavit from Mr. Heywood stating
that in May of 1936 and while he was the owner of said property
he purchased Tax Lien #819 in the amount of $13.01 representing
1935 Town and School taxes on Lot 4, Block 51 on the Tax Map of
the Town of Mamaroneck, now known as Lot 541, Block 130, Sec-
tion 1. This was the property in which he resided at that time
and he had assumed that purchase of this lien by himself, as ow-
ner, would constitute a merger and thus cancel the tax lien. Mr.
Heywood stated further that he now resides in Bethel, Maine, and
in 1958 sold this property to Samuel G. Carriero.
When the title closing took place, the title company insisted
that this lien be produced and satisfied, but in spite of all efforts
made by him, he has not been able to find the lien. In the affi-
davit, he requested the Town to authorize the issuance of a dup-
licate so that it might be surrendered and satisfied in the Office
of the Receiver of Taxes in accordance with the provisions of the
Westchester County Tax Act. The affidavit also indemnifies the
Town against any loss that may occur arising from the production
of the original tax lien.
The Town Attorney recommended that this request be granted,
and on motion by Councilman Santoro, seconded by Councilman
Kane, it was unanimously
RESOLVED, it appearing that Tax Lien No. 819 sold
in May, 1936, covering premises known as Lot 4,

Block 51 on the Tax Map of the Town of Mamaroneck,
now known as Lot 541, Block 130, Section 1, has been
lost and cannot with due diligence be found, and that
the owner of the premises, Charles Heywood, has in-
demnified the Town against any loss which may result
from the production of the original lien, that a dupli-
cate lien be issued to Charles Heywood, the holder of
record of the same, in order that it may be surren-
dered with his satisfaction to the Receiver of Taxes,.
(2) Litigation Report
The Town Attorney reported as follows on Town litigation;
First -- On Town of Mamaroneck against Ferndale Center
This case, which was brought to obtain an injunction
against Ferndale''s maintaining the access road from
Weaver Street to the First National Store and which
was decided against the Town by Judge Schmidt, was
affirmed by the Appelate Division without opinion.
Second -- On Topping and O¢Donnell against the Town of
Mamaroneck
This case, which was for a judgment declaring the
zoning of 65 Palmer Avenue illegal and which was
decided in the favor of the Town of- Mamaroneck by
Judge Supple and unanimously affirmed by the Ap-
pelate Division, has been appealed to the Court of
Appeals on unconstitional grounds. The Town and
the other defendants will move to dismiss the ap-
peal.
Third -- On Sarah Oliner against the Town of Mamaroneck
This case was brought by the plaintiff to obtain an
injunction to prevent the Town from selling at public
auction certain property in the Bonnie Way section.
Mrs. Oliner claimed that she purchased certain
property upon a representation and promise by the
Town to make this parcel which is now to be sold in-
to a street thereby providing access to her property.
Dr. Haralambie, whose property adjoins this land,
is also desirous of purchasing the property in ques-
tion.
The Order and Complaint were served on the Town
on the evening of September 4, 1957, just before a
scheduled auction sale, and the property was with-
drawn from sale. After trying to settle the matter
between the parties concerned, the Town moved for
a summary judgment disallowing the complaint,
which motion was granted by Judge Gallagher.
William H. Fernschild, Larchmont realtor, addres-
sed the Board at this time explaining in some de-
tail that he had been trying to settle the matter
with the interested parties and was still endeavor-
ing to do so. Mr. Fernschild expressed his ap-
preciation to the Supervisor for the assistance
he and the members of his staff had given to him
in his efforts in connection with this matter.
The Town Attorney advised that the plaintiff's at-
torney had notified him of his client's intent to ap-
peal this case.
OTHER BUSINESS
Upon the Supervisor's inquiry as to whether there was any further
business to come before the meeting, the following matters were
called to the Board's attentions
(1) Collapse of wall on Falls Road
Mr. Edmund B. Van Hook of 198 Weaver Street, Town, ques-
tioned the Board with regard to a wall which had collapsed on
Falls Road and Town Engineer Friedlander advised that this mat-
ter was being investigated by his office and subject to any facts
which a survey might disclose, it was his opinion that this wall
was on private property.
After some discussion, the Engineer was directed to determine
whether or not the Town had any responsibility for this wall and to
reportthereon.
(2) County Sewer Line
Upon inquiry as to the actual starting date for the construction
of the County sewer line running from Valley Stream Road to
Falls Road on the east side of the brook, Engineer Friedlander
was directed to contact the County Department of Public Works
and obtain any information available.
(3), Cleaning of Streets
Mr. Fernschild again addressed the Board to express high
compliment and commendation of the Town Highway Department
for its splendid job this winter in keeping the streets open.
APPLICATION--WEST FORDHAM TRANSPORTATION CORP.
As Mr. Rukin, representative of the above-named company, was
now present, this matter which had been put over earlier in the even-
ing pending his arrival., was brought up at this time and the Clerk
read the letter from Samuel Weiss, Attorney for West Fordham
Transportation Corp., dated March 14, 195$, and enclosing said com-
pany¢s application for consent to operate an omnibus line in the
Town of Mamaroneck.
Following a short discussion, in which the members of the
Board questioned Mr. Rukin in regard to service, rates, time-
tables, etc., and upon advice by the Town Attorney that a pub-
lic hearing must be held on this application and that same could
be held of the next meeting of the Board, on motion by Council-
man Santoro, seconded by Councilman Waterman, it was unan-
imously
RESOLVED that the Town Clerk be and he hereby is
authorized to publish the following notice in the offi-
cial newspaper of the Town of Mamaroneck, The
Daily Times, not later than ten (10) days prior to the
date of the hearing:

Town Board of the Town of Mamaroneck on the 2nd day of April, 1958,
at 8:15 p.m. in the Council Room of the Weaver Street Firehouse, Wea-

plication of West Fordham Transportation Corp. for the consent of the
Town of Mamaroneck, under the provisions of Sections 66 and 67 of the

The meeting of the Board of Fire Commissioners was convened im-
mediately upon the adjournment of the Town Board meeting.
COMMUNICATIONS
1. Letter from Fire Chief--Report of Accident
Commissioner Waterman read a communication from the Chief,
addressed to the Board of Fire Commissioners, reporting in detail
on an accident damaging the aerial ladder of truck 1 occurring at
the drill held on March 18, 1958, at the Hampshire House, Wash-
ington Street, Larchmont,
Commissioner Waterman further advised the Board that the
Larchmont Fire Department had been alerted to stand by and that
all necessary steps were already under way regarding insurance
coverage, inspection, repair of damage, etc, in connection with
the accident. The report was received and placed on file,

CLAIMS
Commissioner Waterman presented the following Fire Department
claims which had been audited by the Comptroller and approved by
the Fire Chief, and on his motion which was seconded by Commis-
sioner Kane, it was unanimously

troller be and they hereby are authorized to pay

Commissioner Waterman spoke of the matter of a possible re-
classification of paid firemen which had been brought to his at-

a later date.
