HomeMy WebLinkAbout1958_02_08 Town Board Minutes MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD FEBRUARY 8, 1958, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 9:15 a.m. explaining that this meeting had been called for the purpose of further consider- ing the matter of the installation of water distribution mains in the property known as Soundview Woods, Inc. PRESENT: Supervisor Burchell Councilman Brush Councilman Kane Councilman,Santoro Councilman Waterman ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mrs. Brewer - Secretary INTRODUCTION OF HONORARY SUPERVISOR The Supervisor presented John Brunner of the Larchmont Boy Scouts who had been elected to serve as Honorary Supervisor this year. John was heartily welcomed and greeted by the members of the Board and all those attending the meeting. CONTRACT--SOUNDVIEW WOODS, INC. The Supervisor presented the contract authorizing the installation of water mains in the property known as Soundview Woods, Inc. as pre- pared by Town Attorney Delius in accordance with the resolution adopted by this Board on January 22nd, 1958, and upon his invitation for com- ments from any person present who wished to speak, the following per- sons addressed the Board: George E. Mills, Jr., who spoke on behalf of the Larchmont Democratic Club. Phil E. Gilbert, Jr., who spoke as Counsel to the Club and as a taxpayer. Mr. Gilbert, at this time, presented a let- ter addressed to the Board by the Larchmont Democratic Club under the signatures of George E. Mills, Jr. , Frank X. O'Donnell, Jr. , and himself, containing seventeen ques- tions relating to this issue, which communication was re- ceived and filed with the Town Clerk following verbal sum- marization by Mr. Gilbert at the Supervisor's request. d YIN, Edward P. Meehan, who spoke for the Club and as a tax- payer. Owen A. Mandeville, who spoke as a taxpayer, Benedict Ginsberg, who spoke for the Club and as a taxpayer. Charles A. Newbergh, who spoke as the President of Sound- view Woods, Inc. Joseph E. Muson, who spoke as the attorney for Soundview Woods, Inc. Frank X. O'Donnell, Jr., who spoke for the Club and as a taxpayer. All of the persons named above spoke in protest to the Town's au- thorization of the proposed contract with the exception of Mr, New- bergh, President of Soundview Woods, Inc„ and his attorney, Mr. Muson. At this time, the Town Attorney, Mr. Delius, explained and re- viewed in some detail for the information of the members of the Board and those present at the meeting, the basic thinking leading to his opin- ion submitted to this Board under date of January 20th, 1958, and con- cerning the original agreement under date of November 29, 1929 be- tween:Caroline L. Bill and the Westchester Joint Water Works No, 1. Councilman Waterman then expressed for the Board its thanks to those attending the meeting who had presented their views in connec- tion with this matter and suggested that the Board meet again before acting upon this matter. The Board unanimously agreed with Council- man Waterman's suggestion and on his motion, seconded by Council- man Kane, it was unanimously RESOLVED that this Board hold a special meeting .on Thursday evening, February 13, 1958, at 8;15 P.M* in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck. OTHER BUSINESS In response to the Supervisor's inquiry as to whether there was any other business to come before the meeting, the Town Attorney stated that he had one matter he would like to put before the Board at this time and was directed to proceed therewith. BILL TO AMEND TOWN LAW The Town Attorney presented and described a bill introduced by the Joint Legislative Committee on Town and Village Fiscal and Tax Re- lationships to amend the Town Law and recommended that if the Board favored this bill, such approval be expressed in resolution so stating with certified copies thereof directed to Senator Frank McCullough, The Honorable Hunter Meighan, Assemblyman, and Edward F. N. Uthe, Executive Secretary of The Association of Towns of New York State. Whereupon, following a short discussion, on motion by Council- man.Santoro, seconded by Councilman Kane, it was unanimously - - RESOLVED that the Town Board of the Town of Mamaroneck approves the bill introduced by the State of New York Joint Legislative Committee on Town and Village Fiscal and Tax Relationships to amend the Town Law by adding a new subdivision to Section 64 pro- viding that any Town may contract with any Village situated therein for any service which it may render, such contract to be ap- proved by the Town and Village and to be for a period not to exceed five (5) years. The Board directed the Clerk to forward certified copies of this resolution to Senator McCullough, Assemblyman Meighan, and Mr. Uthe in accordance with the Attorney's recommendation. ADJOURNMENT There being no further business to come before the meeting, it was adjourned at 10:45 a.m., to reconvene at 8.15 p.m. on February 13, 1958. 7 T,d' n G irk f
