MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK, HELD NOVEMBER 6, 1957, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE,
WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

APPROVAL, OF MINUTES
The minutes of October 9; 1957 were approved as presented.
OLD BUSINESS `
There was no old business to come before the meeting.
NEW BUSINESS AND COMMUNICATIONS
There was no new business to come before the meeting.
a. Communications --
1) County Department of Public Works--Snow removal, County Roads
The Clerk presented an agreement with the County of West-
chester, dated October 28, 1957, for the removal of snow on
County roads for the winter season of 1957-1958 at a flat rate
of $200. 00 per mile and requested a resolution authorizing the
Supervisor to sign the agreement.

Whereupon, on motion by Councilman,Santoro, sec-
onded by Councilman Kane, it was unanimously
RESOLVED that the Supervisor be and he
hereby is authorized to sign the agreement
with the County of Westchester for the re-
moval of snow on County roads within the
Unincorporated Section of the Town of Ma-
maroneck at a flat rate of $200, 00 per mile
for the winter season of 1957-1958,
COMMUNICATION NOT ON AGENDA
The Clerk presented a notice from the Public Service Commis-
sion referring to Case #18.575 regarding the increase of certain
one-way first class fares and certain one-way coach fares on the
New Haven Railroad,
This communication was received and filed and referred to the
Town Attorney,
REPORTS
The Clerk presented the following reports which were received
and placed on file.
Report of the Building Inspector for the month of October, 1957,
Report of the Receiver of Taxes and Assessments for the month
of October, 1957,
REPORT OF THE SUPERVISOR
1) Lease for County-owned land
The Supervisor presented a communication from the County
Park Commission enclosing lease for the coming year cover-
ing rental by the Town from the County of premises known as
aportion of Parcel 1B, Sheet 9, Pelham-Port Chester Park-
way at an annual rental of $1, 00,
Councilman Brush explained that the Town had leased this
land for at least the past twenty years and that its use as a
temporary nursery by the Park Department saves the Town
quite a sum of money as the purchase of large shrubs and
trees when necessary can be quite an expense.. Whereupon, on
motion by him and seconded by Councilman Kane, it was unan-
imously
RESOLVED that the Supervisor be and he hereby
is authorized to sign the lease between the Town
of Mamaroneck and the Westchester County Park
Commission covering the rental of premises
known as a portion of Parcel 1B, Sheet 9, Pelham

Port Chester Parkway for a period of one year
beginning November 1, 1957 at an annual ren-
tal of $1. 00.
2) Fixing of date for Preliminary Budget Hearing
The Supervisor called to the Board%s attention the fact that
the hearing on the Preliminary Budget must be held by law be-
tween the dates of November 10th and 15th pointing out that the
date of the next regular meeting did not fall within these dates.
He further advised the Board that the Larchmont League of
Women Voters had requested that the hearing be held on other
than Wednesday evening, November 13th, the date of the An-
nual Community Institute, and requested the Board to deter-
mine a date for the hearing.
Following a short discussion, on motion by Councilman
Waterman, seconded by Councilman Brush, it was unan-
imously
RESOLVED that the date for the next regular
meeting of the Board be changed from Wednes-
day evening, November 20th, to Thrusday even-
ing, November 14th, and that the Preliminary
Budget Hearing be held on that evening at 8:15
p.m. , in the regular meeting place, the Council
Room of the Weaver Street Firehouse,
3) Fixing of date for Budget Hearing
The Supervisor then requested the Board to fix a date for
the regular public hearing on the adoption of the budget in
compliance with the law and following a short discussion, the
Board tentatively fixed the date for this hearing on Tuesday
evening, December 10th, 1957, at 8;15 p.m.
4) Communication-Association of Towns
The Supervisor presented a communication from the Asso-
ciation of Towns of New York State under date of November 1,
1957, enclosing statement of dues for the year 1958 in the
amount of $250.00 and requested a resolution authorizing pay-
ment of same.
Whereupon, on motion by Councilman Kane, seconded by
Councilman Santoro, it was unanimously
RESOLVED that the Town of Mamaroneck continue
its membership in the Association of Towns of the
State of New York for the year 1958, and that the
annual dues in the amount of $250, 00 be paid.

5) Communication--Pinebrook Drainage Commission
The Supervisor presented a communication from Charles
A. Hughes, City Plan Engineer of New Rochelle, relative to
the reactivation of this: Commission and advising that he
would be glad to attend a meeting regarding this matter which
had been referred to him by the Mayor,
The Board directed the Supervisor to follow through with
arranging such a meeting and to communicate with Mr. Hughes.

1) Apportionments
Councilman Kane presented the following petitions re-
ceived from the Assessor for the correction of the assess-
ment roll so as to permit the apportionment of taxes, and on
motion by him, seconded by Councilman Waterman, the fol-
lowing resolution was unanimously adopted;
WHEREAS, the Assessor has presented petitions for the
correction of the assessment roll for certain years, pursu-
ant to the provisions of Section 557, Article 16, of the West-
chester County Administrative Code, known as the West-
chester County Tax Law; and
WHEREAS, after due consideration, this Board finds it
desirable to grant said petitions for the correction of said
assessment ,roll;
NOW$ THEREFORE, BE IT
RESOLVED that the assessment roll of 1957, taxes of
1958, which shows property now appearing on the role
as follows;

Councilman Santoro --
1) New Street Light
Councilman Santoro reported that the Superintendent
of Highways advised that the installation of a new mercury
vapor street light at Wood Street and Myrtle Boulevard had
been completed,
2) Fifth Avenue
Councilman Santoro reported that the reconstruction
and rebuilding work was coming along nicely and that the
the detour in connection therewith was proving to be very
satisfactory.
3) Recreation Commission Meeting
Councilman Santoro reported that he had attended the
meeting of the Recreation Commission on November 4th,
He further reported that although he had to miss the open-
'',, ing session tonight of the recreation study programs spon-
sored by the Westchester County Recreation Commission
and scheduled this evening, the 13th, 20th, 26th, and De-
cember 4th, he hoped now that the Town Board meetings
were fixed as they were, to be able to attend each of the
remaining sessions.
4) Larchmont Station
Councilman Santoro reported that two matters coming
to his and the Superintendent of Highways' attention had been
taken care of; first, the removal of a ladder left at the tem-
porary footbridge; and second, the placing of temporary
lights in the tunnel on Election Eve when all regular lights
were extinguished and he commended highly the Superinten-
dent of Highways who immediately rectified this condition at
that time,
5) Storms ash--Weaver Street Firehouse
Councilman Santoro reported that the new screen and
storm sash would be installed at the Weaver Street Firehouse
during the coming week.
REPORT OF THE TOWN ATTORNEY
1) 65 Palmer Avenue (Topping and OeDonnell vs. Town of Mamaroneck)
The Attorney reported that the Appellate Division upheld
the decision of the lower courts declaring the Town zoning at
65 Palmer Avenue valid.
Upon questioning, the Attorney explained that under this
decision, apartment house construction in conformance with
the zoning restrictions would be permitted.

There being no further business to come before the meeting, it
was adjourned at 8:45 p.m. , to reconvene on November 14, 1957.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the close of the Town Board Meeting,
COMMUNICATIONS
1) Fire Hydrant--Frank Levitan
The Supervisor presented a communication from George H.
Straub, Superintendent of the Westchester Joint Water Works,
relative to the condition of a fire hydrant called to his atten-
tion by Frank Levitan of 4 Crest Avenue, Town,
The communication was received and filed and the matter
referred to the Superintendent of Highways.
REPORTS
Commissioner Waterman presented the following reports which
were received and placed on file:
Fire Report for the month of October, 1957.
Report of the Fire Inspector covering the period up to Novem-
ber 1, 1957.
CLAIMS
Commissioner Waterman presented the following Fire Depart-
ment claims which had been audited by the Comptroller and ap-
proved by the Fire Chief.
On motion by Commissioner Waterman, seoonded by Commis-
sioner Kane, it was unanimously
RESOLVED that the following claims be
and they hereby are approved and the
Supervisor and Comptroller be and they
hereby are authorized to pay the same
out of the budget for the Fire Department:
