CALL TO ORDER - The Supervisor called the meeting to order at 8:15 p.m. PRESENT: Supervi or Burchell Councilman Brush Councilman Kane Councilman Waterman Councilman Santoro ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Friedlander - Town Engineer Mr. O'Brien - Superintendent of Highways Mrs. Brewer - Secretary APPROVAL OF MINUTES The minutes of September 18, 1957 were approved as presented. PUBLIC HEARING--GENERAL ORDINANCES At the request of the Supervisor, the Clerk presented the notice of hearing and submitted the affidavit of publication of said notice in the official newspaper of the Town of Mamaroneck, The Daily Times, on October 12, 1957. The Supervisor declared the hearing open and the Town Attorney, Mr. Delius explained that the proposed amendments were for clarifica- tion purposes through renumbering and correcting certain sections of the General Ordinances. The Supervisor inquired whether any person present wished to be heard either in favor of or opposed to the proposed amendments and since no one wished to be heard, on motion by Councilman Brush, seconded by Councilman Santoro, it was unanimously RESOLVED that the hearing be declared closed. Thereupon, on motion by Councilman Waterman, seconded by Coun- cilman Kane, it was unanimously RESOLVED that Section 12 of Chapter II of the General Ordinance of the Town of Mamaroneck (Use of streets and highways) as adopted May 12, 1956, be re- numbered so that the same will be known as Chapter II, Section 13, FURTHER RESOLVED that Chapter Il of the General Ordinance of the Town of Mamaroneck as adopted May 12, 1956, be amended by add- ing thereto a new section to be known as Sec- tion 14 which shall read as follows. Section 14, No person shall deface, in- jure, move or interfere with any sign, standard or signalling device in- stalled for the purpose of directing, re- stricting or regulating traffic, and no per- son shall place or display a sign of any sort attempting to regulate traffic or park- ing on a public streets The Board directed the Clerk to publish and post the foregoing resolution as provided in the Town Law, OLD BUSINESS a, Opening of Bids--Purchase of Voting Machines The Clerk presented the affidavit of publication of notice request- ing bids for the purchase of three Nine Party Row, 30 Office Column, Automatic Voting Machines as published in the official newspaper of the Town of Mamaroneck, The Daily Times, on October 18, 1957, and sub- mitted the following bid; Bidder Bid Automatic Voting Machine Corporation 2 machines - #97485 and 97459 $ 1, 345, 00 each less credit of 150. 00 " 1 new machine 1,412. 00 On motion by Councilman Brush, seconded by Councilman Water- man, it was unanimously RESOLVED that this Board hereby accepts the bid of Auto- matic Voting Machine Corporation, the only bidder, to fur- nish to the Town of Mamaroneck two (2) Automatic Voting Machines of the 9 party row, 30 office column size, New !, York State type, manually operated, serially numbered 97458 and 97459 and now under rental contract to the Town, at a price of $1, 345, 00 each less credit of $150,00 each, FURTHER RESOLVED that the Town also purchase one (1) new machine of the same type at the price of $1,412. 00 as submitted in your bid of October 21, 1957, FURTHER RESOLVED that the Supervisor be and he hereby is authorized to sign the contract for such purchase, J 4 b. Request for erection of fence--Maurice Austin The Clerk stated that Mr. Austin�s request for permission to erect a 6-foot 6-inch picket fence for a maximum distance of 50 feet along the rear part of the division line between his lot and the neighboring property had been presented at the last meeting of the Board, and that in accordance with usual custom, adjoin- ing property owners had been notified of the request and the Councilmen had personally inspected the site for the proposed fence, The Clerk stated that he had received no objections to this request. Thereupon, on motion by Councilman Brush, seconded by Councilman Santoro, the following resolution was adopted- WHEREAS, Mr. Maurice Austin heretofore requested a permit for the erection of a 6-foot 6-inch picket fence for a maximum distance of 50 feet along the rear part of the division line between his lot (No. 43 on the map of Murdock Woods) and the neighboring property located at 5 Split Tree Road (lot No. 44 on map) owned by Mr, and Mrs. V. Worsham, on his property located at 7 Split Tree Road, Town, and known as Block 305 - Parcel 1057 on the Tax Assessment Map of the Town of Mamaroneck; and WHEREAS, the Building Inspector refused to grant such permit on the ground that construction or erection of such fence violated the provisions of Section 112, Arti- cle 21 of the Building Code; and WHEREAS, Mr. Austin has appealed to this Board for modification of the Building Inspectorts decision, pursu- ant to Section 23, Article 1 of the Building Code, so as to allow erection of said fence; NOW, THEREFORE, BE IT RESOLVED that permission is granted to Mr. Austin to erect a 6-foot 6-inch picket fence for a maximum dis- tance of 50 feet along the rear part of the division line between his lot (No. 43 on the map of Murdock Woods) and the neighboring property located at 5 Split Tree Road (lot No. 44 on map) owned by Mr, and Mrs. V. Worsham, on his property located at 7 Split Tree Road, Town, and known as Block 305 - Parcel 1057 on the Tax Assessment Map of the Town of Mamaroneck. NEW BUSINESS AND COMMUNICATIONS Communications a. Richard Tannous--Retaining wall The Clerk presented a communication from Mr. Richard Tannous of 1036 Old White Plains Road, Town, under date of October 11th, 1957, relating to a retaining wall erected on his property. In his letter, Mr. Tannous stated that he understood a com- plaint about the height of this wall had been registered by Mr. Albert Gould. He explained in detail the reasons for the height, which var- ies with the contour of the land and where the filling-in has not as yet been completed, and requested an inspection by any one of the Town officials. Councilman Santoro advised the Board that he and the Town En- gineer had inspected the wall and that, in their opinion, any complaint about its erection or appearance would be unjustified. This wall, he stated, conforms with the contour of the land, being higher than the official height requirement only where the land fall off and has not as yet been filled, and will beautify the land when completely landscaped and finished as was stated by Mr. Tannous. Since no action on the part of the Board was required in this matter, the Supervisor thanked Councilman Santoro and the Engineer for taking care of the matter in a satisfactory manner, and the com- munication was received and filed. b. A.F. Beringer--Easement The Clerk presented a communication from Mr. A. F. Beringer, dated October 16, 1957, 900 Fenimore Road, Larchmont, relative to the granting of an easement to the Town from Fenimore Road across the Beringer property for a-tie-in water main and advising that since the Town Board had not acted prior to April 1, 1957, which was a con- dition to the granting, the offer was hereby withdrawn. For the Boards information, the Supervisor and Town Engineer reviewed the matter briefly and the communication was received and filed. c. County Personnel Department--Permanent appointment of Superintendent of Recreation The Clerk presented a communication from the County Personnel Department, dated October 9, 1957, enclosing certification from the open-competitive eligible list #6462, Superintendent of Recreation, Town of Mamaroneck, established 7. 31. 57., and requesting permanent ap- pointment of James W. Kronenberger to such position. On motion by Councilman Santoro, who speaking for the Recrea- tion Commission, attested to his fine record of service, and seconded by Councilman Waterman, it was unanimously RESOLVED that James W. Kronenberger be and he hereby is permanently appointed as Superintendent -- of Recreation of the Town of Mamaroneck, effective immediately and to be compensated at the rate of $5, 500. 00 per annum. A3 1 d, County Department of Public Works--Snow removal contract for State Highways The Town Clerk presented a communication, dated October 7, 1957, from the Westchester County Department of Public Works, stating that the County had extended for the year 1957- 1958 its contract with the State Department of Public Works for the control of snow and ice on State Highways and requesting, if the Town Board approves of the Town handling this work with Town forces, that a resolution so stating be adopted. On motion by Councilman Santoro, seconded by Councilman Kane, the following resolution was unanimously adopted; WHEREAS, Section 12 of the Highway Law, as amended by Chapter 305 of the Laws of 1946, provides that if the re- moval of snow and ice from the State Highways is taken over by the County, the County can arrange with the Town Super- intendents of the various towns in the County of Westchester and/or the villages therein for the removal of the snow from such State Highways as are within their municipal boundaries, and the entire cost of such work will be reimbursed by the State, and WHEREAS, the Town of Mamaroneck under date of November 8, 1946 entered into a contract with the County of Westchester for the removal of snow and ice from the State Highways with- in this Town, including the Villages of Mamaroneck and Larch- - wont, in accordance with the provisions of Section 12 of the Highway Law as amended, and under date of November 14, 1956 extended this contract for the season 1956-1957, NOW THEREFORE BE IT RESOLVED, that the Town of Ma- maroneck extend the above mentioned contract with the County of Westchester for an additional year, and be it further RESOLVED, that a certified copy of this resolution be forwarded to the Westchester County Commissioner of Public Works, MATTERS NOT ON. :AGENDA 1) Note from Mr, Louis J. Garcia The Clerk presented a note from Mr. Garcia mailed from Paris advising that he would conform with the ruling of the Board regarding adjustment of the height of his fence immediately upon his return from this business trip, 2) Letter from Murdock Woods Association, Inc, -- The Clerk presented a letter written under the signature of Mr, Maurice Austin, President of the Murdock Woods Association, Inc. under date of October 22, 1957, on behalf of the members of that As- sociation. The letter requested that in connection with the re-zoning study of the Town now in process, study and consideration be given by the proper body to retaining the area restrictions and minimum standards during development of the now undeveloped portions of that area. On motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that the communication from the Murdock Woods Association, Inc„ dated Oc- tober 22, 1957, be referred to the Planning Board for study and consideration, The Clerk was directed to forward a copy of this communication to the Planning Board for attention at its next meeting. Fisher 5, 700 13, 000 18, 700 222 40 Mary Louise Devlin 2, 500 2, 500 FUR THER..RESOLVED that the assessment roll of 1957, __. taxes of 1958, which shows property now appearing on the roll as follows: Block Parcel Name Land Imp Total 202 110 & 180 Rosemont Farms Inc 30, 600 30, 500 61, 100 ar be corrected as follows in accordance with the provisions of subdivision 5 of Section 557: Block Parcel Name Land Imp Total 202 110 Rosemont Farms Inc $ 26, 100 $ $ 26, 100 180 200 202 190 William Terner & W 4, 500 30, 500 35, 000 Councilman Kane (continued) -- Councilman Kane reported on the County series of meetings being held on Problems in Planning and stated that he was very proud to report that Mamaroneck accounted for 3 of the 17 rep- resentatives attending these sessions with Mr, Maggini , Mr, Sansone and himself present, Councilman Waterman -- No report, Councilman Santoro -- 1) Purchase of Snow Plow Councilman Santoro reported that the Superintendent of High- ways requested authorization to purchase an additional snow plow to supplement present equipment before the winter season at a cost not to exceed,the sum of $1, 000.00, and on his mo- tion, seconded by Councilman Kane, it was unanimously RESOLVED that the Superintendent of Highways be and he hereby is authorized to purchase for the Town of Mamaroneck Highway Department one (1) snow plow at total cost not to exceed the sum of $1, 000.00. 2) Stairway--Murray Avenue to Baldwin Street Councilman Santoro reported that the new stairway was com- pleted and in working order at a cost of $1, 152. 00, a little less than the $1, 200.00 cost authorized by the Town. He thanked the Engineer and the Superintendent of Highways for their splen- did cooperation and effort on this projectq stating that it was due to these gentlemen that this stairway had been so quickly and ef- ficiently erected. 3) County-owned lands Councilman Santoro read the article by Mrs. Flora Chudson, Democrat candidate for the position of Town Councilwoman, ap- pearing in The Daily Times of this date, and questioned the Su- pervisor as to the authenticity of her statements with regard to the County-owned Thruway residual land parcels within the Town. I �I The Supervisor, after stating that he was loathe to interject politics into a Town Board meeting, answered Councilman San- toro by replying to each of the points raised by Mrs. Chudson in turn, and set forth the following facts: first, that the Town had been notified of these residual parcels in a letter written under the signature of County Executive James D. Hopkins on Septem- ber 4, 1957 and enclosing list; second, that the lands listed were not now available as the matter of their disposition had been brought before the Board of Supervisors and referred by that ---- body to the Board's Budget Committee for study and recommen- dation and that the Board of Supervisors, which must act prior to disposition of these lands, was at present awaiting the report of said Budget Committee; third, that the written request of this Town's desire to obtain all of the various County-owned lands located within the Town in the event the County did not make use of them for County purposes is and has been on file with the County Park Commission since March Z4, 1956; as authorized by this Board at its meeting on March ZI, 1956; and fourth and last, that the County Park Commission has assurred the Town that it will be given prior consideration at any time the County should decide to dispose of any or all County-owned lands located in the Town of Mamaroneck, Councilman Santoro thanked the Supervisor; stating that he just wanted to be certain the record was as it was and as he had understood it to be with regard to not only the residual parcels but all County-owned lands lying within the Town. REPORT OF THE TOWN ATTORNEY No report. ADJOURNMENT There being no further business to come before the meeting, it was adjourned at 9:00 p.m. , to reconvene November 6, 1957. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immed- iately upon the close of the Town Board meeting. ANNUAL INSPECTION AND DINNER The Commission highly commended the Fire Department on its Annual Inspection and Dinner held on October Z3rd, 1957, and on motion by Com- missioner Waterman, seconded by Commissioner Brush, it was unani- mously i RESOLVED that a note be sent to the Fire Depart- ment expressing the Commission's pleasure and congratulating and complimenting the Department on its fine Annual Inspection and Dinner held on the evening of October 23rd, 1957, COMMUNICATIONS Commissioner Waterman presented a communication from the Fire Chief under date of October 17, 1957, reporting that an in- spection of property belonging to a Mrs. Messer and to be used as a Nursery School was made in compliance with the owner's request and reported the property as favorable for such use, The Commission referred this mattes to the Town Attorney for legal adviceg and the communication was received and filed. CLAIMS Commissioner Waterman presented the following Fire Depart- ment claims which had been audited by the Comptroller and ap- proved by the Fire Chief. Whereupon, on motion by Commissioner Waterman, seconded by Commissioner Brush, it was unanimously RESOLVED that the following claims be and they hereby are approved and the Supervisor and Comp- troller be and they hereby are authorized to pay the same out of the budget for the Fire Department; R.G.
