CALL TO ORDER - The Supervisor called the meeting to order at 8.015 p.m. PRESENT- Supervisor Burchell Councilman Brush Councilman Kane Councilman Waterman Councilman Santoro ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr, Delius Town Attorney Mr. Friedlander - Town Engineer Mr, Orsino - Comptroller Mr. O'Brien - Superintendent of Highways Mrs, Brewer - Secretary APPROVAL OF MINUTES The minutes of September 4th, 1957 were approved as presented. PUBLIC HEARING--ORIENTA BUS COMPANY At the request of the Supervisor, the Clerk presented the notice of hearing and submitted the affidavit of publication of said notice in the official newspaper of the Town of Mamaroneck, The Daily Times, on September 27th, 1957. The Supervisor declared the hearing open and inquired whether any person present wished to be heard in connection with the application. The applicant, Mr. William Gauthier d/b/a Orienta Bus Company stated his request for permission to operate a bus line in the Town over the route described in the petition filed with the Town Clerk and presented at the September 18th meeting of the Board. The Supervisor again inquired whether any person present wished to address the Board either for or against the application and further inquired of the Clerk whether any communications had been received in connection therewith. As there were none present who wished to be heard either in favor of or opposed to the application and as there were no communications received, on motion by Councilman Brush, seconded by Councilman Kane, upon roll call, the following resolution was unanimously adopted: WHEREAS application has been made to the Town Board of the Town of Mamaroneck by WILLIAM GAUTHIER d/b/a Orienta Bus Company for the operation of omnibuses over certain streets, avenues and high- ways in said Town; and WHEREAS after due notice, a public hearing was held on such ap- plication to the said Town Board on the 9th day of October, 1957, at 8:15 osclockp.m. ; NOW, THEREFORE, BE. IT RESOLVED that the Town Board of the Town of Mamaroneck, hereinafter called the Board, pursuant to the provisions of Sections 66 and 67 of the Transportation Corporations Law, consents that the said WILLIAM G1iUTHIER d/b/a Orienta Bus Company, hereinafter called the Operator, subject to the provisions, conditions, requirements and limitations hereinafter set forth, may maintain and operate motorbuses and omnibuses for the transportation of passengers and prop- erty in, upon and along and across the following named streets, avenues, highways or portions thereof, in the Town of Mamar- oneck, as follows, to wit: BEGINNING at the westerly boundary line of the Village of Mamaroneck and the Town of Mamaroneck; thence westerly along Palmer Avenue to Richbell Road; thence southerly along Richbell Road to the boundary line between the Village of Mamaroneck and the Town of Mamaroneck And returning over the same streets, avenues and highways to the point or place of beginning, the same being part of a through route from Or- ienta Point in the Village of Mamaroneck to the Mamaroneck Village Railroad Station, FURTHER RESOLVED that this consent is subject to the following terms, conditions, requirements and limita- tions: 1. Nothing in this consent shall be deemed to grant or authorize any exclusive right, 2, The Operator shall obtain a certificate of convenience and ne- cessity from the Public Service Commission of the State of New York, and unless the same be grante d within 180 days of the date of this resolution, this consent shall lapse and become null and void, 3. Nothing herein contained shall be construed as permitting the Op- erator to take or discharge passengers within the Town of Mamar- oneck at any point along the route as hereinabove described, 4. This consent shall not be assigned or transferred, either in whole or in part, or leased, sublet, or mortgaged in any manner, nor shall title thereto, either legal or equitable, or any right, interest or property therein, pass to, or vest in any other person or corporation whatsoever, either by the act of the Operator or by operation of law, whether under the provisions of the statutes relating to the consolidation or merger of corporations or otherwise, without the consent of the Town evidenced by an instrument, under seal, anything herein contained to the contrary thereof in any wise notwithstanding; and the granting, giving, or waiving of any one or more of such consents shall not render unneces- sary any subsequent consent or consents, and no assignment, lease, sub- lease or mortgage of this consent, or of any part thereof or interest therein or of the route or routes mentioned herein, or of any part there- of, shall be valid or effective for any purpose unless the said assignment, -- lease, sublease or mortgage shall contain a covenant on the part of the assignee, lessee or mortgagee that the same is subject to all the provi- sions, conditions and limitations of the consent, and that the assignee, lessee or mortgagee assumes and will be bound by all of said provisions, conditions and limitations and especially said conditions prohibiting the taking or discharging of passengers in the Town of Mamaroneck, any- thing in any statute or in the charter of such assignee or lessee to the contrary notwithstanding, and that the said assignee, lessee, or mort- gages waives any more favorable conditions created by such statute or its charter, and that it will not claim by reason thereof, or otherwise, exemption from liability to perform each and all of the conditions of this consent. 5, The Operator shall at all times during the term of this consent op- erate over the routes herein described only the highest type of modern city buses. 6. All vehicles which may be operated pursuant to this consent shall be propelled by power generated or contained within the vehicle it- self or by storage battery, but no power shall be used which will in its generation or use, produce smoke or noxious odors sufficient, in the opinion of the Town Board of the Town, to constitute a nuisance, and no motor bus or omnibus shall be put in service unless it conforms to the specifications, rules and regulations of the Public Service Commission of the State of New York and unless it is authorized by the provisions of the Public Service haw or the Transportation Corporations Law of the State. 7. All vehicles which may be operated pursuant to this consent shall be so constructed that oil and grease cannot drop on the roadway. The maximum width shall not exceed eight feet over all. No double deck vehicles shall be operated without the consent of the Town. Each omni- bus shall be equipped at all times with a hand chemical fire extinguisher in good working condition and accessible and ready for use at all times. They shall be equipped with pneumatic tires, all other types, kinds and forms of tires being prohibited. All buses must be fitted with brakes capable of stopping and holding the same under all conditions. The dis- tribution of the weight on axles, length of wheel base and other features of design shall be such as to avoid skidding as far as possible and shall be such as to permit easy steering and control. The gasoline tank shall be located entirely outside the body of the, bus with an inlet for filling, which shall permit filling from the outside exclusively. The outlet of the exhaust shall be located beyond the rear line of the body of the bus. Each bus shall have an emergency exit door located at the op- posite end of the bus body from the regularly used entrance and exit, which emergency door shall be securely fastened in a manner which will prevent it being opened except when opened for emergency purposes, 8. All vehicles operated pursuant to this consent shall conform in all particulars with the requirements herein contained and shall be I 2 877 maintained in good and safe repair and in a manner which will in all ways and at all times render the vehicles fit for public service. The Operator shall permit the Town Board to inspect at all reasonable times, any or all the vehicles used by the Operator or upon order of the Town Board, shall submit any such vehicle to the Town Board for inspection. If, upon inspection, any vehicle shall be unfit for public service, then the Operator shall, upon notice, immediately withdraw such vehicle from service and shall cause it to conform with the re- quirements of the Town Board or shall remedy the defect before such vehicle shall be restored to service. All employees of the Operator while in service on any motor bus or omnibus, shall be in uniform and neat and tidy in appearance. All buses must be kept at all times well painted, neat and clean. The driver of a bus must not operate a bus to which a trailer is attached, The Operator shall not allow his operators to smoke or light a match while in or upon a bus, or to drink intoxicating liquors while on duty. No person shall operate any motor bus under this consent unless he shall be duly licensed under the laws of the State of New York to oper- ate the same. No person shall operate a bus who has, to the knowledge of the operator, been convicted of a felony or who has been convicted more than twice of any charge of reckless driving or violation of the Highway Law, or the Vehicle and Traffic Law or the ordinances of the Town, or who is not of good moral character. 9. All laws and ordinances affecting the operation of motor buses or omnibuses and all traffic regulations applicable thereto now in force or which may be in force in the Town during the term of this consent shall be complied with by the Operator. The Operator shall also comply with and enforce the carrying out of any orders or regu- lations which may be issued by the Town designed for the protection and safety of persons or property or for the comfort, health or con- venience of the public. 10. In case of any violation or breach or failure to comply with any of the provisions, conditions or limitations herein contained or with any orders of the Town Board, acting under the powers granted by law or herein reserved, this consent may be declared cancelled and revoked by said Town Board; provided, however, that such action by the Town Board shall not be taken until it shall give notice to the Operator to appear before it on a certain day not less than ten days af- ter the date of such notice, to show cause why this consent should not be cancelled and revoked. After such notice and opportunity to be heard, even in case the company shall fail to appear, action may be taken by the Town, forthwith. 11. The Operator shall assume all liability for damage to persons or property occasioned by reason of the operation or maintenance of the motor bus or omnibus route or routes herein mentioned, and it is a condition of this consent that the Town shall be under no liability whatso- ever either to persons or property on account of the same, and the Op- erator shall fully indemnify and repay to the Town, any damages, costs and/or expenses which the Town shall be compelled to pay by reason of 2 any acts or defaults of the Operator, The Operator shall take out and at all times during the term of this :con- sent, maintain, in full force and effect, public liability insurance satis- factory to the Town Board as to form and sufficiency, at least $100/300, 000 for each bus, or provide self insurance or bonds or other assurance in such amount and in such form as may be fixed or approved by the Pub- lic Service Commission or other public body upon which the power to regulate and perscribe in respect thereto is at present or may hereafter - be conferred by the laws of the State of New York, and conditioned for the payment of all judgments that may be recovered by any person or persons on account of the operation by the Operator of its buses. Pol- icies evidencing such insurance shall be exhibited to the Town on demand and certificates thereof shall be filed with the Town Clerk, 12, The Operator promises, covenants and agrees on his part and be- half to conform to and abide by and perform all of the terms, con- ditions and requirements in this consent fixed and contained, and the Op- erator hereby expressly waives any and all objections as to the reason- ableness or legality of any of the provisions of this consent or any part thereof or as to any legal right or authority of the Town to impose any terms and conditions herein contained, and the Operator will not at any future time set up as against the Town the claim that any of the provi- sions of this consent are ultra vires, unreasonable or void. 13. The Operator agrees that he shall not acquire or claim any vested right hereunder but that the foregoing instrument shall be con- strued as a consent under the provisions of Sections 66 and 67 of the Transportation Corporations Law of the State of New York and revocable by the Town according to the terms and conditions herein expressed, OLD BUSINESS a. Request for erection of fence--Louis J. Garcia The Clerk stated that Mr. Garcia®s request for permission to erect a six (6) foot high stained red-wood fence for a distance of 20 feet along the back of his property located at 27 West Brookside Drive, Larchmont, had been presented at the last meeting of the Board, and that in accordance with usual custom, adjoining prop- erty owners had been notified and the Councilmen had personally inspected the site for the proposed fence. The Supervisor asked Mr. Garcia, who was present, whether he had been able to reach any agreement with his neighbors who objected to the fence and was advised by Mr. Garcia that he had not been able to reach any agreement whatever and that he had nothing further to say regarding the situation. Whereupon, following a short discussion, Councilman Water- man offered the following resolution, which was seconded by Councilman Brush: I WHEREAS, Mr. Louis J. Garcia heretofore requested a permit for the erection of a six (6) foot high stained red- wood fence for a distance of 20 feet along the back of his property located at 27 West Brookside Drive, Larchmont, and known as Block 218 - Parcel 372 on the Tax Assess- ment Map of the Town of Mamaroneck; and WHEREAS, the Building Inspector refused to grant such permit on the ground that construction or erection of such fence violated the provisions of Section 112, Article 21 of the Building Code; and WHEREAS, Mr, Garcia has appealed to this Board for modification of the Building Inspector's decision, pursu- ant to Section 23, Article 1 of the Building Code, so as to allow erection of said fence; NOW, THEREFORE, BE IT RESOLVED that permission is granted to Mr. Garcia to erect a six (6) foot high stained red-wood fence for a distance of 20 feet along the back of his property located at 27 West Brookside Drive, Larchmont, and known as Block 218 - Parcel 372 on the Tax Assessment Map of the Town of Mamaroneck. I The Supervisor requested the Clerk to call the roll and the follow- ing vote was recorded- Roll Call. Councilman Brush - No Councilman Kane - No Supervisor Burchell - No Councilman Waterman - Aye Councilman Santoro - No The motion was defeated by a majority vote of 4 noes to 1 aye, Mr. Garcia requested a recount of the vote and inquired as to the reasons for the no votes. The Supervisor explained that this vote was a matter of discretion to each individual Councilman and each stated that he had voted as he saw fit. NEW BUSINESS AND COMMUNICATIONS a. Communications 1. Miss Jean Corbia--Resignation The Clerk presented the following letter addressed to the Town Board by Miss Corbia under date of September 27, 1957: "Gentlemen. I herewith tender my resignation effective Octo- ber 1, 1957. Sincerely, /s/ Jean Corbia'r G�f k�i Following a short discussion, on motion by Councilman Water- man, seconded by Councilman Santoro, it was unanimously RESOLVED that the resignation of Miss Jean Corbia as Intermediate Account Clerk and Stenographer, effective October 1, 1957, be and it hereby is accep- ted with regret, The Board directed the Supervisor to write Miss Corbia ex- -- pressing the Board's regret at her decision to resign from the staff of the Town Offices and thanking her for her many years of loyal service to the Town of Mamaroneck, 2, Assessor--Petition for correction of Assessment Maps The Clerk presented a petition from the Assessor, dated Octo- ber 3, 1957, requesting approval of corrections to the Assessment Roll Maps as of June 1, 1957, Whereupon; on motion by Councilman Santoro, seconded by Councilman Waterman, it was unanimously RESOLVED that the Town Board hereby approves the changes made in the Assessment Maps of the Town of Mamaroneck as of June 1, 1957, and said maps are hereby corrected and rectified as of June 1, 1957, in the following places. Request was granted and the following were presented: 1. Communication--Mr. Maurice Austin The Clerk presented a letter from Mr. Austin of 7 Split Tree Road, Town, dated October 7, 1957, requesting per- mission to erect a 6-foot --6-inch picket fence for a maxi- mum distance of 50 feet along the rear part of the division line between his lot (No. 43 on the map of Murdock Woods) and the neighboring property located at 5 Split Tree. Road (lot No. 44 on map) owned by Mr. and Mrs, V. Worsham, in order to improve the appearance of his property and the drain- age condition resultant from the contour of the land and to pro- vide some degree of privacy. In accordance with the usual procedure, the Board directed the Clerk to place the matter on the agenda for the next meeting, to allow time for the notification of adjoining property owners of the request and for the Councilmen to view personally the site for the proposed fence. 2. Communication--Planning Board The Clerk presented the following communication from the Planning Board under date of October 9, 1957; "Gentlemen. The Planning Board at its meeting on October 7, 1957, approved the proposed subdivision map of Briar Dell Homes, Inc, but only on the condition that the Town of Mamaroneck obtain at no cost from the Westchester County Park Commission the necessary sewer easement as indicated thereon and recommended that the Town Board make the necessary application for such easement. Attorney to make such application to the Westchester County Park Commission. REPORTS The Clerk presented the following reports which were received and placed on file. Report of the Westchester Shore Humane Society, Inc. for the months of August and September, 1957. Report of the Building Inspector for the months of August and September, 1957. Report of the Town Clerk for the month of September, 1957. Report of the Receiver of Taxes and Assessments for the month of September, 1957 with the following note attached thereto. "Total collected:diringpenalty free period.- $2, 284, 949. 64 or 92. 5616 of total levy of $2, 468, 705. 00 Number of installment payments - 285 Total paid by installments - $67, 128.00 Percentage paid by installments to the total collected for the period - Z. 9416" Affidavit of publication of Registration Notice in the official newspaper of the Town of Mamaroneck, The Daily Times, on September 21st and 28th, 1957. 11 Affidavit of publication of notice of receipt of examination reports of the accounts and fiscal affairs of the Town of Mamaroneck and the Police Pension Fund and of the filing of same in the Office of the Town Clerk as public records available for public inspection as published in the official newspaper of the Town of Mamaroneck, The Daily Times, on October 3, 1957, REPORT OF THE SUPERVISOR No report. REPORTS OF THE COUNCILMEN Councilman. Brush -- 1) Park Board Meeting Councilman Brush reported that the last meeting of the Park Board had been devoted entirely to the preparation of the 1958 budget requests, Councilman Kane -- No report, Councilman Waterman -- No report. Councilman Santoro -- 1) Recreation Commission Councilman Santoro reported that work had been completed on the Recreation budget requests for 1958 and had been submitted. 2) Communication--Supt. of Highways Councilman Santoro presented the following memorandum from the Supt. of Highways, dated October 2, 1957' "As per instructions of the Town Board, 525 feet of Winged Foot Drive has been cleared, grubbed, filled, graded and paved. 't This communication was received and filed. 3) Murray Avenue Manholes Councilman Santoro reported that the Supt. of Highways advised that the correction of the manhole level on Murray Avenue was about completed. 4) Murray Avenue Stairway Councilman Santoro reported that construction of the stairway had started today and would be completed within a week thus affording a further convenience to commuters, 5) Thruway Meeting Councilman Santoro and the Supervisor reported on a meeting with Thruway officials held last Saturday. The Su- pervisor stated that such meetings were held as often as needed in order to expedite Thruway construction, The Supervisor then presented a recommendation from the Police Chief and the Superintendent of Highways for the installation of a mercury-vapor lamp at the intersection of Wood Street with Myrtle Boulevard and requested authoriza- tion thereof. Whereupon, on assurance from the Superintendent of Highways that funds were available in the budget for such in- stallation, on motion by Councilman Waterman, seconded by Councilman Brush, it was unanimously RESOLVED that the Superintendent of Highways be and he hereby is authorized to install a mercury- vapor lamp at the intersection of Wood Street with. Myrtle Boulevard at a total cost not to exceed the sum of $185.00. MR. MAURICE AUSTIN At this time, Mr. Austin addressed the Board commending the Board for being up to the minute in taking care of the situation at the parking lots. He further stated that he had intended to raise this question of lighting but now found it unnecessary due to the action taken by the Board, REPORT OF THE TOWN ATTORNEY 1) Bond--Edna A, Forbes The Town Attorney presented the bond of Edna A. Forbes for her subdivision adjacent to Ormand Place, The bond is for $15, 000, and is given pursuant to Section 277 of the Town Law for the com- pletion of street improvements and utilities in this development. The amount was fixed and the bond approved by the Planning Board sub- ject to approval by the Town Board as to surety. The surety on the bond is the Hartford Accident and Indemnity Company. The Attorney recommended the approval of this bond. Whereupon, on motion by Councilman Kane, seconded by Coun- cilman Brush, it was unanimously RESOLVED that the bond of Edna A. Forbes, dated the li 26th day of September, 1957, to cover the subdivision S of her property, be approved as to sufficiency of the surety and also as to its form, Z) Additions to General Ordinances In connection with the printing and publishing of the General Ordinances, the Attorney reported that there were certain errors and omissions and recommended that certain new amendments be added thereto in order to clarify such errors and omissions. He requested that a public hearing be held thereon at the next meeting of the Board and that the Clerk be authorized to publish notice for such hearing in the form submitted. Thereupon, on motion by Councilman Brush, seconded by Councilman Kane, it was unanimously RESOLVED that the Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, the following notice; PUBLIC NOTICE PLEASE TAKE NOTICE that the Town Board of the Town of Mamar- oneck will hold a public hearing on the 24th day of October, 1957, at 8015 p.m. , in the Council Room of the Weaver Street Firehouse, corner of Edgewood Avenue and Weaver Street in the Town of Mamaroneck, to con- sider certain amendments to the General Ordinance of the Town of Mamar- oneck as follows. (a) To renumber Section 12 of Chapter II (Use of Streets and Highways) as adopted May 12, 1956, so that the same will be known as Section 13, (b) To add to Chapter II a new Section to be known as Section 14 which shall read as follows. Section 14. No person shall deface, injure, move or interfere with any sign, standard or signalling device in- stalled for the purpose of directing, restricting or regulating traffic, and no person shall place or display a sign of any sort attempting to regulate traffic or parking on a public street, TAKE FURTHER NOTICE that all persons present at such public hearing will have an opportunity to be heard. MEETING The Supervisor called to the Board's attention the fact that the Town�s:Annual Fire Inspection and Dinner fell on the regular date of the next Town Board meeting and requested the Board to fix a date for this meeting since the Firehouse would be unavailable on Wednesday evening, October 23rd, After a short discussion by the members of the Board, on mo- tion by Councilman Santoro, seconded by Councilman Waterman, it was unanimously RESOLVED that because of conflict with the Town of Mamaroneck's Annual Fire Inspection and Dinner to be held on Wednesday evening, October 23, 1957, the date for the next regular meeting of the Town Board be moved to Thrusday evening, October 24, 1957, at 8015 p.m., in the regular meeting place, ADJOURNMENT There being no further business to come before the Board, the meet- ing was adjourned at 9000 p.m. , to reconvene on October 24, 1957, I BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened im- mediately upon the adjournment of the Town Board meeting, COMMUNICATIONS 1) Appointment of "Head of Shift" with salary increase--Fred Moll In accordance with the recommendation of the Fire Chief, Com- missioner Waterman requested a resolution authorizing the appoint- ment of Fred Moll, Fire Truck Driver, as "Head of Shift", to be of- fective as of November I, 1957, with compensation increase of $180, 00 per annum in accordance with the Town of Mamaroneck.Com- pensation Plan. Whereupon, on his motion, seconded by Commissioner Brush, it was unanimously RESOLVED that Fred Moll, Fire Truck Driver, be and he hereby is appointed "Head of Shift" to be ef- fective as of November 1, 1957, and his compensa- tion thereby increased effective on that date by the amount of $180, 00 per annum in accordance with the Compensation Plan of the Town of Mamaroneck, s 2) Bids for Hose--Fire Chief Commissioner Waterman presented a communication from the Fire Chief under date of October 7, 1957, submitting the fol- lowing bids for the purchase of 1000 feet of inch and a half hose and recommending purchase from the low bidder; Bidder Bid Wesco Fire Equipment and Service 95¢ per foot Fabric Fire Hose Company 1, 32 & 1.21 per foot Eureka Fire Hose 97¢ per foot Fire-End Products 98� per foot On motion by Commissioner Waterman, seconded by Com- missioner Kane, it was unanimously RESOLVED that this Board hereby accepts the low bid, to wit, the bid of Wesco Fire Equip- ment and Service, to furnish to the Town of Ma- maroneck Fire Department 1000 feet of inch and a half hose at the price of 95� per foot, or a to- tal price of $950, 00. REPORTS Commissioner Waterman presented the following report which was received and filed: Fire Report for the month of September, 1957. CLAIMS Commissioner Waterman presented the following Fire Department claims, which had been audited by the Comptroller and approved by the Fire Chief.
