APPROVAL, OF MINUTES
The minutes of July 3, 1957 were approved as presented.
OLD BUSINESS
There was no old business to come before the meeting.
NEW BUSINESS
a. Authorization for renewal of Certificate of Deposit ($50, 000.)
The Clerk presented the following memorandum dated August
7, 1957, from Mr. Finson, Town Accountant.
"Request for authorization for renewal of Certificate of De-
posit in the amount of $50, 000, with the First National Bank
in Yonkers from July 24, 1957, to December 24, 1957, at
2-1/2 Jo (Statutory limit in interest).
(Interest collected was $750. 00 on original Certificate ma-
turing on July 24, 1957.)"
Whereupon, on motion by Councilman Santoro, seconded by
Councilman Kane, it was unanimously

RESOLVED that the Supervisor be and he hereby is
authorized to deposit the sum of $50, 000. 00 with the
First National Bank in Yonkers for the period from
July 24, 1957, to December 24, 1957, at 2-1/2% as
a Time Deposit.
b. Authorization for collection of School Taxes (2 installments)
The Supervisor requested a resolution authorizing the Receiver
of Taxes to accept payment of School Taxes in two installments.
He explained that the Legislature had enacted a statute last
April permitting Towns the option of collecting school taxes in
installment payments with the provision that no installment pay-
ment carried a penalty of less than 2%. He further explained
that this new plan would differ from the plan which has been in
effect in the Town of Mamaroneck since 1934 allowing payment
of the school tax in Z installments of 5016 each bearing penal-
ties in accordance with the Westchester County Administrative
Code only in the degree of penalties and in the number of in-
stallments permitted.
For the Board's information; the Supervisor further advised
that in the Town of Mamaroneck last year only 35 out of a total
of 6, 500 taxpayers took advantage of installment payment and
pointed out that approximately 2, 500 of the Town taxpayers
- paid their taxes to a lending institution in advance of the ma-

turity date and therefore would not benefit from this plan at
all.
Mr. Robert Garlock, President of the Board of Education,
Union Free School District No. 1, then addressed the Board ad-
vising that if the new plan were to be put into effect it would en-
tail a loss of revenue to the school district in the amount of
some $22, 000. , which sum the Board of Education earned by
investment of school tax monies endin the time such funds

were needed. In addition, he stated that the Board of Educa-
tion had been informed by its financial advisors that in the
event the Town were to institute the new plan with the second
installment payable in February, it would necessitate the bor-
rowing of up to $250, 000. in order to meet current expenses.
This would entail considerable costs to the school district (the
loss of some $22, 000. earned in interest plus the interest costs
on the sum borrowed) which costs would then be reflected in the
school tax rate.
The Supervisor inquired of Mr. Leo N. Orsino, Deputy Re-
ceiver of Taxes, what administrative problems would need to be
met if the Board should put this new plan into effect at this time
and Mr. Orsino stated that there were at least three items which
would demand immediate attentions first, the revision of the tax
assessment roll; second, the revision of the tax bill itself; and
third, revision of the tax receipting machine.
Councilman Santoro and Councilman Kane questioned Mr. Garlock,
Mr. Or''sino, and Mr. Finson, Town Accountant, extensively with
respect to the possible effects of this new plan on the school dis-

trict and its tax rate, and the Supervisor stated that the Board
had given grave study and consideration to putting into effect.
the new plan for the current year and that it was only after
this consideration and deliberation that he recommended that
the Board postpone any action on the adoption of the new plan
for the current year in view of the monetary loss to the school
district and because past experience had not indicated any
great demand for installment payment on the part of the Town
taxpayers.
Councilman Waterman stated that he favored the adoption of
the new plan at this time if it would provide any relief to the
taxpayer in paying the ever-increasing school taxes and of-
fered the following motion which was seconded by Councilman
Santoro:
RESOLVED that the Town of Mamaroneck permit the
payment of school taxes at the option of the taxpayer
allowing payment of one-half the tax bill in September
with no penalty and the second half in February with
a penalty of Z Jo.
During the ensuing discussion, in response to the Comptroller's
reiteration of the administrative difficulty involved in putting the
new plan into effect for the current year, Councilman Waterman
stated that he would amend his motion by addition of the words
"to become effective for the year 1958-59" , which amendment
was seconded by Councilman Santoro.
In the discussion following on the amended motion, a question
- was presented by a Mr. Roger Sinclair of 20 Harrison Drive,
Town, as to the actual difference to the Town in dollars and
cents which was answered by the Supervisor quoting the figures
as stated and submitted by Mr. Garlock. The Supervisor then
raised the question of the legality of the present Board taking any
action committing a_future Board to apohcy.
Councilman Waterman stated that he would like his motion as
amended to stand and the vote was taken upon roll call on the
amended resolution as follows:
RESOLVED that the Town of Mamaroneck permit the
payment of school taxes at the option of the taxpayer
allowing payment of one-half the tax bill in September
with no penalty and the second half in February with a
penalty of Z Jo, to become effective for the year 1958-59.

The motion was therefore defeated and lost by majority vote.
Thereupon, on motion by Councilman Kane, seconded by Coun-
cilman Santoro, it was unanimously

RESOLVED that; pursuant to Section 96A of Chapter
62 of the Laws of 1909 as amended, the Town Board
of the Town of Mamaroneck does hereby authorize
and empower the Receiver of Taxes of the Town of
Mamaroneck to collect the 1957 School Taxes for
Union Free School District No, 1 in the Town of Ma-
maroneck, and School District No, 2, Town of Scars-
dale, New York, which, under the provisions of The
-- Westchester County Tax Law, being Article 16 of the
Westchester County Administrative Code, become a
lien and are payable on September 1, 1957, in two
partial payments, each amounting to fifty per cent
(5076) of any such school tax as levied,
FURTHER. RESOLVED that the Receiver of Taxes of
the Town of Mamaroneck is authorized and empowered
to receive the payment of such partial payments or in-
stallments of the 1957 School Taxes for Union Free
School District No, 1 in the Town of Mamaroneck, and
School District No, 2, Town of Scarsdale, New York,
at any time, but subject to the same penalties as are
specified and provided in Section 542 of the Westchester
County Administrative Code, for neglect to pay the to-
tal amount of the School Taxes after the levy thereof.
FURTHER RESOLVED that the acceptance of any such
partial or installment payment of the 1957School Taxes
for Union Free School District No, 1 in the Town of Ma-
maroneck, and School District No, 2, Town of Scars-
dale, New York, shall not be deemed to affect, in any
manner, any right of the Town of Mamaroneck under
any general or special act, to enforce collection of the
unpaid balances of such taxes as may remain due and
owing to said Town, but such rights and powers shall
remain in full force and effect to enforce collection of
the unpaid balance of such school taxes, together with
interest, penalties, and other lawful charges.
And, on motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that this Board hereby designates "The
Daily Times", a daily newspaper published in the
Village and Town of Mamaroneck, for the purpose of
publishing the Notice of the Collection of the 1957
School Taxes as required by law; and be it
FURTHER RESOLVED that, in accordance with the
provisions of Section 550 of the Westchester County
Administrative Code, the Town Board do and hereby
does direct the Receiver of Taxes and Assessments
to mail to each taxpayer of the Town of Mamaroneck,
whose address is known to said Receiver of Taxes
and Assessments, a tax bill for 1957 School Taxes,
the expense thereof to be a Town charge.

e. Authorization of designation of Polling Places for 1957
The Clerk presented a list of polling places for the purpose
of designating a place in each election district in the Town
in which a meeting for the registration of voters, election,
and primaries shall be held in the year following the ensu-
ing first (1st) day of October.
On motion by Councilman Santoro, seconded by Councilman
Kane, it was unanimously
RESOLVED that, in accordance with the provisions
of Section 66 of the Election Law, being Chapter 17
of the Consolidated Laws of the State of New York
as amended, the Town Board of the Town of Mamar-
oneck hereby designates a place for each election
district in the Town at which a meeting for the reg-
istration of voters, election, and primaries shall
be held in the year following the ensuing first (1st)
day of October as follows.

d. Communications
1. Request for erection of fence--Church of Sts. John and Paul
The Clerk presented a letter under date of July 20,
1957, from John J. Flynn, Pastor of the Church of
Sts. John and Paul, 280 Weaver Street, Larchmont,
requesting permission to erect on the Church prop-
erty at the rear of the newly constructed parish
rectory and running along the line of said prop-
erty, a cedar fence not more than six (6) feet in
height for the purpose of shielding from view the
cemetery located a few feet distant from the new
building.
The Board directed the Clerk to place the matter
on the agenda for the next meeting, notifying the
adjoining property owners of the request and al-
lowing time for the Councilmen to view personally
the site of the proposed fence in accordance with
the usual procedure.
Z. Request for erection of fence--Mrs, Thomas W. Ashton
The Clerk presented a letter under date of July 28, 1957,,
from Mrs. Thomas W. Ashton, 59 Harrison Drive, Larch-
wont, requesting permission to erect a close-woven fence,
approximately six (6) feet in height, enclosing the back-
yard area of their property.
The Board directed the Clerk to follow the customary pro-
cedure, notifying the adjoining property owners of the re-
quest and permitting time for the Councilmen to view the
site of the proposed fence before the next meeting of the
Board when the matter will be listed on the agenda.
3. Commendation of Highway Department--Colin F. Campbell
The Clerk presented the following communication, addressed
to the Town Board and dated July 4, 1957, commending the
Highway Department:
"Gentlemen:
I would like to commend you for the attention
given to the ladies of my family by Mr. O'Brien of the High-
way Department during the repair of our street this week.
I would also like to take this opportunity to
bring to your notice the excellent service given to this house-
hold by the garbage collectors during these past eight years.
They are quiet, clean, and efficient.
A compliment when it is due, I feel, should be
given -- complaints, I am sure, come quickly enough.

The Board commended Mr. O'Brien, the Superinten-
dent of Highways, and his Department upon its per-
formance and at the suggestion of Councilman.Santoro,
directed that a copy of Mr. Campbell`s letter be posted
in the Town Yard for the information of the Highway De-
partment and the Supervisor reply to Mr. Campbell.
4. Request for purchase of Town-owned property--Meighan &
Necarsulmer for Dr. Haralambie
The Clerk presented a communication, dated July 26, 1957,
addressed to the Supervisor and the Town Board and signed
by Meighan & Necarsulmer, Counselors at Law representing
Dr, and Mrs. James Q. Haralambie of 32 Bonnie Way, Town,
submitting an offer for the purchase of a portion of the Town-
owned property adjoining their premises and known on the Tax
Assessment Map of the Town of Mamaroneck as Block 104 -
Parcel 551 and Block 105 - Parcel 900 and requesting notifica-
tion of the time and place as set by the Board for holding the
next public auction sale of Town-owned property.
For the Board's information, the Supervisor advised that a
Mr. Jacob Oliner as Attorney for Mrs. Sarah Oliner had sub-
mitted an offer to purchase this entire piece of Town-owned
property at a previous date and that the Town Attorney, Mr.
Delius, in accordance with the Board's direction, had met
with the interested parties in an attempt to work out an agree-
ment satisfactory to both. Since such an agreement could not
be reached, the Supervisor requested a resolution setting the
date for a public sale and upon motion by Councilman Santoro,
seconded by Councilman Waterman, it was unanimously
RESOLVED that the date for the next public auction
of Town-owned property be set for September 4,
1957, at 8:00 p.m. , in the Council Room of the Wea-
ver Street Firehouse, Weaver Street, Town of Ma-
maroneck.
The Board directed that a Notice of said sale be published in
The Daily Times and that the Clerk notify the parties con-
cerned of the time and place for such sale.
5. Request for installation of water line in Soundview Woods, Inc. --
Superintendent of Westchester Joint Water Works No. 1
The Town Engineer advised the Board that Mr. Charles New-
bergh of Soundview Woods, Inc. , had requested the Board to
authorize the installation of a 2" main on York Road from
Ridgeway Road easterly to service 3 houses on the south side
of the street with the usual 9010 refund agreement and presented
a cost estimate for such installation in the amount of $379. 13,
not including excavation, back-fill, and pavement restoration,
as submitted by George H. Straub, Superintendent of the West-
chester Joint Water Works under date of June 19, 1957.
Whereupon, on motion by Councilman Santoro, seconded
by Councilman Kane, it was unanimously
RESOLVED that the Town of Mamaroneck hereby
authorizes the installation of a 2" water main in
York Road from Ridgeway Road easterly to ser-
vice 3 houses on the south side of the street at a
cost of $379. 13 to be paid by the applicant, Mr.
Charles Newbergh of Soundview Woods, Inc.
FURTHER RESOLVED that the applicant, Mr.
Newbergh, shall deposit with the Westchester
Joint Water Works No. 1, the sum of $379. 13,
and in addition, shall pay the cost of excavation,
back-fill, and pavement restoration, and shall
comply in all respects with the Ordinance of the
Town of Mamaroneck regarding street opening
permits.
FURTHER RESOLVED that the Town Board ap-
proves the usual agreement between the West-
chester Joint Water Works No. 1, Charles New-
bergh, and the Town of Mamaroneck, providing
that the amount deposited by the applicant, Mr.
Newbergh, for the cost of installation of said
water main shall be subject to a refund of 90ojo of
the revenues derived from the sale of water to
customers connected to this main for a period of
ten (10) years, or until the total amount of their
deposit is refunded, whichever event shall first
occur.
6. Improvement of Fifth Avenue--Board of Police Commissioners
The Clerk presented a communication from Chief of Police,
Paul A. Yerick, under date of August 5, 1957, submitting a.
traffic count taken on Fifth Avenue on July 5th from 8 a.m,
to 8 p.m. and advising that the Police Commission at its
meeting on July 20th recommended the improvement of this
street in the interest of safety, including road resurfacing
with correction of drainage and the installation of a side-
walk for pedestrian protection.
The Supervisor informed the Board that an appropriation had
been placed in the budget for such improvement as part of the
Townes long-range capital improvement plan and upon motion
by Councilman Santoro, seconded by Councilman Kane, it
was unanimously
RESOLVED that the Town Engineer be and he hereby
is authorized and directed to prepare specifications
for the improvement of Fifth Avenue including road
resurfacing and sidewalk installation, said specifi-
cations to be presented at the next Town Board
meeting.

MATTERS NOT ON AGENDA
In accordance with usual custom, the Supervisor inquired whether
anyone present wished to address the Board on any mattes other
than those presented on the prepared agenda and the following per-
sons were heard:
1. Mr, Vincent J. Ciardullo
Mr. Ciardullo of 4 Cabot Road, Town, as spokesman for a
group of residents of Cabot Road, called to the Board's atten-
tion the unsatisfactory conditions caused by Thruway construc-
tion and the use of the "new" temporary railroad station. He
described in detail first, the danger and inconvenience caused
by commuting traffic on Cabot Road and suggested that an exit
road be built across the unpaved new parking area coming only
slightly into Cabot Road from the station and turning left across
the parking area to Wood Street and thus to Myrtle Boulevard in
order to provide relief to this situation; second, he described
the dust condition in the entire area resulting from the use of
said unpaved parking lots; and third, the still unrectified drain-
age conditions in the back yards and cellars of Cabot Road
properties,
Councilman Waterman stated that he felt this gentleman had a
very real complaint regarding the traffic condition on Cabot Road
and that he was in favor of asking the Thruway to build this exit
road as suggested.
Mr. G. William Capedanno of 6 Cabot Road, Town, proposed
as an immediate relief at least over weekends that Cabot Road be
closed to station traffic on Saturdays and Sundays as all such traf-
fic on these two days could be handled by using Wood Street, which
had been built by the Thruway to reach the temporary station from
Myrtle Boulevard, as a two-way street.
The Board was unanimous in its accord with this suggestion and
stated that this would be done providing there was no legal restric-
tion barring the closing of this street,
Mr. Friedlander, Town Engineer, informed the Board that he
had been advised that the Thruway was about ready to put a tempor-
ary surfacing on the parking lots and that this, of course, would
eliminate the dust condition completely, Mr. Friedlander further
advised that Councilman Santoro and he had been working with the
Thruway Engineering Staff with regard to the drainage conditions
referred to and that they would continue to do so .
2. Mr. Edmund B. Van Hook
" Mr. Van Hook of 198 Weaver Street, Town, urged the Board to
take further action in order to control the speeding which was still
-- continuing in connection with the detouring of traffic through Myrtle
Boulevard and adjacent area from Harmon Drive.
3. Mr. Harold Blass
Mr. Blass, Attorney for Briar Dell Homes, Inc,, referred to
his communication of August 6th and inquired as to whether
a
the Board had reached a decision on paving Winged Foot
Drive.
The Supervisor advised that Councilman Santoro would
cover this matter when he made his report later in the
meeting.
4, Mrs, Vincent Nesci
Mrs. Nesci, a resident of 14 Harrison Drive, stated that
she had been notified last February that the use of her
house as a two-family dwelling was in violation of the zon-
ing ordinance and that she had therefore agreed to remove
her tenant. This she had delayed doing, she continued, be-
cause of the conduct of a nursery business with constant
trucking back and forth on a so-called "paper street's lo-
cated along the side of her property and immediately ad-
jacent thereto, the storage of these trucks, the dumping
of rubbish, and the existance of an unsightly and unsani-
tary shack on the property of a neighbor and adjoining her
property to the rear. Mrs. Nesci further stated that she
was unable to enjoy the use of her home and property in
the manner to which she felt she was entitled and requested
that steps be taken to rectify these conditions.
The Board referred this matter to the Building Inspector
for investigation and, if the alleged violations were found
to exist, directed him to consult with the Town Attorney.
5. Mr. William Eipel
At Mr. EipelFs request, the Clerk presented a communica-
tion addressed by him to the Supervisor under date of Au-
gust 7, 1957, stating the request of The Larchmont Com-
mittee for Contributing to the Development of a Storm Haven
for Small Craft, Inc. to fill a portion of the Towns low land
property, parallel to Hommocks Road, with hydraulic fill
subject to the conditions listed in the communication.
After a short discussion, Councilman Santoro stated that
under the conditions set forth in Mr. Eipel$s communica-
tion and contingent to securing the consent of the adjoining
property owners, he offered the following resolution, which
was seconded by Councilman Kane and unanimously adopted:
RESOLVED that this Board hereby grants permission
to The Larchmont Committee for Contributing to the
Development of a Storm Haven for Small Craft, Inc.
to fill a portion of Town-owned low land property,
parallel to Hommocks Road, with hydraulic fill sub-
ject to the following conditions-
1. The Larchmont Committee and the Hamp-
shire Country Club will provide the dikes
necessary to retain the fill.
2. The dikes will be so arranged and constructed to
meet with other dikes on adjoining private prop-
erty so as to provide flood protection along Hom-
mocks Road,
3. Insurance coverage for Public Liability and Prop-
erty Damage will be provided by the contractor,
policies to be submitted to the Town Attorney for
approval before work is commenced.
--- 4. All filling, dikes, methods of work, and quantity
of fill shall be subject to approval by the Town En-
gineer before work is commenced.
5. The permission hereby granted shall expire on No-
vember 15, 1957, and no land is to be filled there-
after.
6. Mr. Roger Sinclair
Mr. Sinclair of 20 Harrison Drive, Town, questioned the ne-
cessity of garbage collection at 5:30 a.m, and asked whether it
would be possible to have this collection at a more reasonable
hour, which matter was referred to the Superintendent of High-
ways for his attention.
COMMUNICATIONS NOT ON AGENDA
The Clerk presented the following two communications not included
on the prepared agenda:
1. A communication under date of August 5, 1957, from Ralph H.
Brackett, Associate Examiner of Municipal Affairs, State of
New York Department of Audit and Control, enclosing a copy
of the Report of Examination, Fire District #1, Town of Ma-
maroneck, Westchester County, and stating that the Clerk was
requested by law to publish a notice of the receipt of said re-
port.
The Board directed the Clerk to publish such notice in com-
pliance with the law.
Z. A copy of a communication written by Herbert Spencer Leman,
Attorney, to the New York, New Haven. Railroad Company under
date of August 5, 1957, complaining of conditions in connection
with Thruway construction and the Larchmont Station.
The communication was received and filed.

REPORT OF THE SUPERVISOR
(1) Hearing on discontinuance of Bus Lines
The Supervisor reported that he had attended the August
1st session of the Hearing, adjourned from July 17th
and 18th, acting as Counsel in the absence of Mr. Delius
and that the highlight of the session had been the filing of
a petition carrying the signatures of some 2, 000 Larch-
mont residents protesting the discontinuance of bus ser-
vice by Mr, John T. Breunich, Executive Secretary of
the Larchmont Chamber of Commerce,
The Hearing was declared closed and decision reserved.
(2) Westchester Joint Water Works
The Supervisor reported that the Water Board was still
negotiating to obtain the necessary easements for the lay-
ing of the line and that the Board had retained the ser-
vices of John L. Delius as Special Counsel in this con-
nection.
The Supervisor also reported that the matter of the loss
of revenue to the Water Company was before the Board
and that the question of rates and the continued granting of
the 9010 refunds to developers on the installation of new
water lines was being considered.
(3) Board of Supervisors
The Supervisor reported that the Board of Supervisors had
adopted resolutions at its last meeting granting salary in-
creases to all County personnel and authorizing the pur-

Councilman Kane presented the following petitions re-
ceived from the Assessor for the correction of the assess-
ment roll so as to permit the apportionment of taxes, and
on motion by Councilman Kane, seconded by Councilman
Waterman, the following resolution was unanimously adopted:

pursuant to the provisions of Section 557, Article 16, of

(2) Communication--Barney Epstein
Councilman Kane presented a communication under date
of July 3, 1957, addressed to the Supervisor and Coun-
cilmen by Mr. Epstein of Barney Epstein, Inc. , Real
Estate Insurance, re 1957 Assessed Valuations for 1958
Taxes, referred to him as the Councilman responsible
for assessment.
The Board directed Councilman Kane to communicate
with Mr. Epstein and arrange to discuss with him the
matters with which he is concerned and to report there-
' on to the Board.

(3) Speeding in Town of Mamaroneck
Councilman Kane reported that he had received several
calls regarding the matter of speeding in the Town of
Mamaroneck and requested that this be brought to the
attention of the Chief of Police with a request for
stricter enforcement of the speed laws throughout the
Town.
The Board referred this matter to Councilman Water-
man for the attention of the Police Commission and
Police Chief.
Councilman Waterman --
(1) Compensation Increase--Patrolmen McGinley and O'Rorke
Councilman Waterman presented a memorandum under
date of August 7, 1957, from Mr. Finson, Town Ac-
countant, requesting a resolution authorizing an in-
crease in compensation for Patrolmen McGinley and
O'Rorke in accordance with the Town of Mamaroneck
Compensation Plan, and upon motion by Councilman
Waterman, seconded by Councilman Kane, it was
unanimously
RESOLVED that this Board hereby authorizes
an increase in the compensation of Patrolmen
McGinley and O'Rorke of the Town of Mamar-
oneck Police Department, from $4, 695. 00 per
annum to $4, 870. 00 per annum, effective as of
August 1, 1957 in accordance with the Town of
Mamaroneck Compensation Plan.
(2) Starting Salary for Patrolmen
Councilman Waterman presented a communication from
Chief of Police, Paul A. Yerick, dated August 7, 1957,
stating that the Board of Police Commissioners recom-
mended that the starting salary for patrolmen in the
Town Police Department be increased from the present
rate of $4, 520,00 per annum to $4, 620. 00 per annum
with yearly increments of $150. 00 until first-grade pay
is reached (i.e. $5, 220. 00 per annum) in order for this
Department to compete with other Police Departments
offering higher starting salaries to new patrolmen.
Whereupon, on motion by Councilman Waterman, sec-
onded by Councilman Santoro, it was unanimously

(3) Reply to request of residents of Myrtle Boulevard,
Harmon Drive, etc,
Councilman Waterman presented a communication
addressed to the Supervisor and Town Board by
Chief of Police_Yerick under date of August 5,
1957, in reply to the request submitted by resi-
dents of Myrtle Boulevard, Hannon Drive, etc,
regarding traffic conditions in that area, which
report was received and filed.
Councilman Santoro --
(1) Request for installation of 6" water main--Ormond Place
and request for 411 main--Larch Road
Councilman Santoro advised the Board that Dr, Arnold
Breakey representing Mrs, Edna Forbes, owner of the
property to be developed, had requested the Board to
authorize the installation of a 6" water main for a dis-
tance of 180 feet in Ormond Place and a 4" water main
for a distance of 120 feet in a new street to be known
as Larch Road with the usual 9010 refund agreement
and presented a cost estimate for such installations in
the amount of $996. 12, not including excavation, back-
fill, and pavement restoration, as submitted by Stanley
A. Longhurst, Assistant Superintendent of the West-
chester Joint Water Works No, 1, under date of August
6, 1957.
Whereupon and following a short discussion by the mem-
bers of the Board, on motion by Councilman Santoro,
seconded by Councilman Kane, it was unanimously
RESOLVED that the Town of Mamaroneck hereby
authorizes the installation of a 61, water main for
a distance of 180 feet in Ormond Place and a 4"
water main for a distance of 120 feet in a new
street to be known as Larch Road at a cost of
$996. 12 to be paid by the applicant, Dr. Arnold
Breakey as representative for the owner of said
property, Mrs. Edna Forbes,
FURTHER RESOLVED that the applicant, Dr. Arnold
Breakey, shall deposit with the Westchester Joint
Water Works No, 1 the sum of $996. 12 and, in addi-
tion, shall pay the cost of excavation, back-fill, and
pavement restoration, and shall comply in all res-
pects with the Ordinance of the Town of Mamaroneck
regarding street opening permits,
FURTHER RESOLVED that the Town Board approves
the. usual agreement between the Westchester Joint
Water Works No, 1, Dr. Arnold Breakey, and the
Town of Mamaroneck, providing that the amount de-
posited by the applicant, Dr. Breakey, for the cost
of installation of said water mains shall be subject to
a refund of 9016 of the revenues derived from the sale
of water to customers connected to said mains for a
period of ten (10) years, or until the total amount of
deposit is refunded, whichever event shall first occur.
(2 Re Policy of 9010 refunds on water revenues
At this time, Councilman Santoro brought up for the Board's
consideration the Town's policy in connection With the grant-
ing of 907o refunds on water revenues derived from water
main installations constructed and paid for by the developer.
He reminded the Board that the Supervisor had presented
this matter sometime ago requesting the members of the
Board to study the matter to determine whether the Town
_ should continue or amend this policy.
The Supervisor informed the Board that the actual refunds be-
ing paid by the Westchester Joint Water Works were seriously
affecting the revenues which the Town received and which were
used primarily for the payment of outstanding bonds and in-
terest. He also pointed out that this refund policy had been in-
itiated many years ago by a previous Board presumably with
the intent of inducing builders to develop property in the Unin-
corporated area. He further pointed out that since such un-
developed property was at a premium at the present time and
that since such developments were partially responsible for
the increasing consumption of water and thus contributed to
the necessity for the construction of the new water supply line
without actually paying for the actual cost of the water con-
sumed or any part of the costs of this pipe line for a period of
ten (10) years, it would seem that this policy was no longer re-
alistic for the Town.
Following some further discussion by the members of the
Board during which Mr. George Schuler, present at the meet-
ing, stated that he believed the Town should take this step at
- this time in view of the existing circumstances and conditions,
it was, upon motion by Councilman Santoro, seconded by
Councilman Waterman, unanimously
RESOLVED that this Board authorize the installation
of water mains in the Town of Mamaroneck at the ex-
pense of the applicant and without refund other than in
exceptional cases presenting unusual and special cir-
cumstances or conditions,
At this time, Mr. Harold Blass, Attorney for the Briar
Dell Homes Development, questioned the adoption of this
policy with regard to precluding Briar Dell from receiving
refunds since plans had been filed for the development
prior to this date.
The Supervisor advised that such refunds could be
granted in the case of special circumstances and suggested
that if such applied to Briar Dell, the application be so pre-
sented for the Board's consideration.
(3) Paving of Winged Foot Drive
Councilman Santoro presented the cost estimate in the
amount of $5, 800. 00 as submitted for improving that portion
of Winged Foot Drive presently unimproved and recommended
that the Superintendent of Highways be authorized to proceed
with this work.
Following a short discussion in which it was explained that
the Town was obligated to improve this section of Winged Foot
Drive and that the work would consist of clearing, rough-
grading and temporary surfacing, upon motion by Councilman
Santoro, seconded by Councilman Kane, it was unanimously
RESOLVED that the Superintendent of Highways be
and he hereby is authorized to proceed with the im-
provement of that portion of Winged Foot Drive
presently unimproved at a total cost not to exceed
the sum of $5, 800. 00.
(4) Requested sewer installation--Winged Foot Drive
Councilman Santoro reviewed the matter of the requested
sewer installation in Winged Foot Drive and recommended
that the request for the Town to install this sewer be denied.
He pointed out that the original developer had purchased this
property from the Town at a very low price because of the
necessity of the developer installing all utilities, etc. and
stated that he felt the developer should pay the cost of such
installations in this case as is the case in all other develop-
ments in the Town.
During the ensuing discussion, Mr. Anthony Gagliardi,
who is under contract to purchase a plot in the proposed sub-
division, again strongly expressed his opinion that the Town
had an obligation to install this sewer at Town expense since
the property was in the Sewer District and since, when de-
veloped, this installation cost would be entirely repaid to the
Town over a period of years. The Board agreed that while
this might be so, it would take a great many years of sewer
taxes to repay the Town and that at the present time, it was
not feasible to make an exception in the case of this develop-
ment, and on motion by Councilman Santoro, seconded by
Councilman Kane, upon roll call, it was unanimously

RESOLVED that the request for the installation
of a sewer in Winged Foot Drive from the
southerly side of the property of the Westches-
ter County Park Commission to Briar Dell Circle,
a distance of approximately 750 feet, be and it
hereby is denied.
(5) Compensation--Highway Department
Councilman Santoro presented a memorandum , dated
August 7, 1957, from Town Accountant Finson, recom-
mending a modification of the Town of Mamaroneck Com-
pensation Plan for laborers and labor foreman, and on
motion by him, seconded by Councilman Kane, it was
unanimously
RESOLVED that this Board hereby rescinds the
resolution adopted on April 3, 1957 fixing the
Compensation Scale for per diem employees of
the Town of Mamaroneck; and be it
FURTHER RESOLVED that this Board hereby
fixes the Compensation Scale for per diem em-
ployees of the Town of Mamaroneck for the
year 1957 for all departments as follows:
Laborers - $ 1. 90 per hr.
Labor Foreman - 2. 15 "
Sewer Maintenance Man - 1. 90
(6) Thruway
Councilman Santoro stated that he would like to suggest
for the Board's consideration the construction of a walk
and staircase from Murray Avenue over the right-of-way
of the old Pelham-Port Chester Parkway to Myrtle Boule-
vard directly in the rear of Station Park in order to shor-
ten the trip to the new Station for those commuters who
walk via Murray Avenue.
The Board felt this suggestion had merit and recommended
that it be studied further. The Supervisor was directed to
request the Police Department to make a survey of the num-
ber of persons who would be affected by such a convenience
and should the Town desire to proceed with this plan, to
consult with Commissioner Harding, the County Superinten-
dent of Public Works, and the County Park Commission, in
order to secure permission for such construction on County
property.
In this connection, Councilman Santoro also stated that
he had observed a dangerous drop-off located at the point
of the erection of said proposed staircase and suggested that
the Town consult with the County Public Works Department
regarding the erection of a barricade in the interest of safety
and the Supervisor was directed to do so.

The meeting of the Board of Fire Commissioners was convened im-
mediately upon the adjournment of the Town Board meeting.

COMMUNICATIONS
Commissioner Waterman presented a communication from
Arthur M. Brown, Secretary of the Fire Council, dated
August 7, 1957, recommending that Frank J. Felice be ap-
pointed a Paid Fire Truck Driver of the Town of Mamaro-
neck Fire Department, and requested authorization of this
appointment.
On motion by Commissioner Waterman, seconded by Com-
missioner Santoro, it was unanimously
RESOLVED that an additional position of Paid Fire
Truck Driver be and it hereby is established in the
Town of Mamaroneck Fire Department; and
FURTHER RESOLVED that Frank J. Felice of 81
Taylor Place, Larchmont, be and he hereby is ap-
pointed as Paid Fire Truck Driver in the Town of
Mamaroneck Fire Department, effective August
16, 1957, at the rate of $4, 200. 00 per annum.
