MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON JANUARY 16, 2019, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Katz, seconded by Councilman King, the Work Session was unanimously
opened at 5:00PM.
Discussion – Comprehensive Plan
On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Board unanimously agreed to
enter into an Executive Session to discuss the employment history of a corporation with respect to a
comprehensive plan, and appointments to Boards and Commissions.

On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to resume
the Regular Meeting.
Fee Schedule
The Town Board reviewed the current Fee Schedule and noted some items that they would like further
clarification on. The Town Board deferred this item until February 6.
Vehicle and Traffic Resolutions
The Town Board reviewed two resolutions for insertion into the Vehicle and Traffic Chapter of the Town
Code. These resolutions are part of Sections §219-44 and §219-56. The Town Board added their approvals
to the regular agenda for this evening.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.

Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents are welcome to attend.
SUPERVISOR’S SUMMARY REPORT
It’s been a busy start to the New Year. We celebrated the swearing in of two new police officers and
the promotion of three others. I had the pleasure of congratulating them and their families. I had
the opportunity to meet with two groups of students in the past few weeks. The Mamaroneck
Avenue School Tigers and the Mamaroneck High School Civics Course students. The fourth grade
MAS Tigers came to talk about how they could help with Sustainability programs in the Town. They
were very cute with wonderful initiative and interest. The MHS students approached me with an
idea for improving municipal government communications. The HS sophomores were very
impressive in their understanding of and appreciation for local government.
Several volunteers are working on an application for a state funded food waste recycling grant. The
focus of the grant is on reducing food waste on the front end of consumption, not just recycling it.
The project would involve community-wide outreach and education, including the schools.
The Tri-Municipal Human Rights Coalition held its annual MLK event last Sunday. They honored MHS
Social Studies teacher, Shannon Turner Porter for her five decade teaching career and dedication to
her students. She has organized an annual MLK assembly at the HS for 30 years. The program was a
conversation between 2 men who produce a podcast called “Seeing White”. Yesterday I had the
privilege of addressing the Summit with Town Administrator, Steve Altieri, and Superstar Volunteer
Karen Khor about sanitation services in a program titled “Moving Toward Zero Waste”. I know it
sounds funny, but I love talking about garbage and sewage. We also had a TVS meeting yesterday
bringing together the three municipalities and two school districts to talk about community issues.
PRESENTATION - Superintendent of Schools – Mamaroneck School Bond Issue
Dr. Shaps the Superintendent of Schools addressed the audience. He spoke about the upcoming $49 million
capital improvement bond referendum on February 5, 2019. This bond will be for district-wide projects to
preserve infrastructure, maintain safe school buildings and improve educational spaces.
PUBLIC HEARING – “Assessment of Converted Condominiums” Law
The following Notice of Public Hearing is entered into the record as follows:

LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New
York, and pursuant to a resolution of the Mamaroneck Town Board adopted on December 17, 2018,
a Public Hearing will be held on Wednesday, January 16, 2019 at 8:00 PM or as soon thereafter as
is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider:
“Assessment of Converted Condominiums” Law.
Purpose
Pursuant to section 581 of the Real Property Tax Law, residential condominium units are assessed
at values that are significantly lower than the assessments of single-family homes of comparable
value. There is a real possibility that properties, including two-family homes, may be converted
into condominium ownership to avail themselves of this favorable tax treatment. If that occurs,
the tax burden will be shifted to the other taxpayers of the Town. Section 581 (1) (c) of the Real
Property Tax Law allows municipal corporations to adopt a local law that prevents properties that
are not condominiums from being converted to condominium ownership and receiving the benefit
of the favorable assessment treatment provided by Real Property Tax Law § 581. By this law, the
Town is availing itself of the power given to it by section 581 (1) (c) of the Real Property Tax Law to
prevent converted condominium units (defined in the new section 195-46 of the Code of the Town
of Mamaroneck) from being assessed in accordance with the provisions of section 581 (1) (a) of the
Real Property Tax Law or section 339-y of the Real Property Law.

On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the Public Hearing was
unanimously opened.
Mr. Maker explained the purpose of the law.
Supervisor Seligson asked if anyone wished to comment on the proposed Local Law, and there was not.
On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Public Hearing was
unanimously closed.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following Local law was
approved:
Local Law No. 1 - 2019
This local law shall be known as the “Assessment of Converted Condominiums” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:

Section 2 – Addition of a new Article to a chapter of the Mamaroneck Code:
Chapter 195 of the Code of the Town of Mamaroneck hereby is amended by adding the following
chapter thereto:
Article XI Taxation of Converted Condominiums
§ 195-45 Purpose
Pursuant to section 581 of the Real Property Tax Law, residential condominium units are assessed
at values that are significantly lower than the assessments of single-family homes of comparable
value. There is a real possibility that properties, including two-family homes, may be converted

§ 195-46 Definition

“Converted Condominium Unit” means a dwelling unit in condominium form of ownership that (a)
prior to May 1, 2019 was assessed as a dwelling unit in other than condominium form of ownership
and (b) has not been previously subject to the provisions of section 581 (1) (a) of the Real Property
Tax Law or section 339-y of the Real Property Law.
§ 195-47 Assessment of a Converted Condominium Unit
A Converted Condominium Unit shall not be assessed in accordance with the provisions of section
581 (1) (a) of the Real Property Tax Law or section 339-y of the Real Property Law but shall be
assessed in accordance with the provisions of Article 3 of the Real Property Tax Law.
Section 3 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

CITIZEN’S COMMENTS
Supervisor Seligson asked if anyone in the audience would like to address the Board.
Kevin Crowe, representing the Larchmont Gardens’ Civic Association, addressed the Town Board. Mr.
Crowe asked if the Town was planning to install a sidewalk along East Hickory Grove Drive. Supervisor
Seligson said that, yes, this project is included in the Town’s 2019 capital project plan which is scheduled to
be adopted very soon.
BOARD OF FIRE COMMISSIONERS
The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind
Eney, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared
open.

2. Salary Authorization – Fire Department
On motion of Commissioner Elkind Eney, seconded by Commissioner King, it was
RESOLVED, that the Town of Mamaroneck Fire Commissioners hereby promotes Keith
Napolitano to the position of Fire Lieutenant, at an annual salary of $111,839, effective
February 1, 2019.

3. Other Fire Department Business
Fire Chief Russo and Deputy Fire Chief Shawn Hughes were present. Chief Russo addressed the Commission
and reported that the installation of the new Chiefs took place, and he is happy to report that the
Department is fully staffed with 14 career Firefighters. Chief Russo also stated, if the Commission agrees,
he would like to reinstate the quarterly reporting by the Fire Chief. The Commissioners responded , yes.

RESOLVED, that Diane Blum be reappointed as Member A of the Board of Architectural Review,

shall expire on December 31, 2021, and

RESOLVED, that Edward Jacobson be reappointed as Member B of the Board of Architectural
Review, said term shall expire on December 31, 2021, and

COASTAL ZONE MANAGEMENT COMMISSION
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was

RESOLVED, that Matthew Teisch be reappointed as a Member of the Coastal Zone Management
Commission, said term shall expire on August 31, 2021, and

RESOLVED, that Alan Mason be reappointed as a Member of the Coastal Zone Management

RESOLVED, that Robert Herbst be reappointed as Member A of the Town of Mamaroneck Traffic
Committee, said term to expire on December 31, 2021, and

RESOLVED, that Doris Block shall serve as the Chairperson of the Traffic Committee for the

ZONING BOARD OF APPEALS
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was unanimously
RESOLVED, that Jonathan Sacks be reappointed as Member A of the Zoning Board
of Appeals, said term to expire on December 31, 2023, and
BE IT, FURTHER
RESOLVED, that Robin Nichinsky be reappointed as Member B of the Zoning Board
of Appeals, said term to expire on December 31, 2023, and
BE IT FURTHER
RESOLVED, that Arthur Wexler shall serve as Chairperson of the Zoning Board of
Appeals for the year 2019.

SUPERVISOR’S APPOINTMENT
I, Supervisor Seligson, hereby appoint Councilwoman Elkind Eney as Deputy
Supervisor for the year 2019.
2. Vehicle and Traffic Resolutions
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was unanimously
approved,
WHEREAS, the Town of Mamaroneck Vehicle and Traffic Chapter 219, § 219-56
stipulates that from time to time by resolution or local law, the Town Board shall
establish the fee, days, times and methods of payment for parking on designated
public highways.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby establish the following
fees, days, times and methods of payment for parking on designated public highways
as follows:
Twenty six (26) parking spaces on Myrtle Boulevard (i) designated and limited to three
(3) hour parking from 8:00 am to 6:00 pm, Monday through Saturday, except holidays
(ii) a fee of $.05 for four minutes, $.10 for eight minutes, and $.25 for twenty minutes.
Twenty six (26) parking spaces on Madison Ave (i) designated and limited to three (3)
hour parking from 8:00 am to 6:00 pm, Monday through Saturday, except holidays (ii)
a fee of $.05 for four minutes, $.10 eight minutes, and $.25 for twenty minutes.
Ten (10) parking spaces on Maxwell Avenue (i) designated and limited to ten (10) hour
parking, 24 hours a day/7days a week (ii) for a fee of $.05 for six minutes, $.10 for twelve
minutes, and $.25 for thirty minutes.

Eight (8) parking spaces on Baldwin Avenue (i) are designated and limited to six (6) hour
parking from 8:00 am to 4:00 pm, Monday through Friday, except holidays (ii) a fee of
$1.00 per hour (iii) to be paid via the pay stations located in Lot A.
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was
unanimously approved,
WHEREAS, the Town of Mamaroneck Vehicle and Traffic Chapter 219, § 219-44 stipulates that
from time to time by resolution or local law, the Town Board shall establish the fee, days, times
and methods of payment for permitted use of the parking lots.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby establish the following fees, days,
times and methods of payment for Town Lots A through G as follows:
Lot A (formerly Lot1) (i) a Daytime Parking Permit is established and required from June 1, 2018
through May 31, 2019 for a fee of $725.00 per year (ii) a Meter Parking Permit is established
from June 1, 2018 through May 31, 2019 for a fee of $ 80.00 per year (iii) for Meter Permit
holders a meter fee of $.60 per hour is required Monday through Friday between the hours of
5:00 am and 6:00 pm (iv) no parking is allowed from 3:00 am to 5:00 am Tuesday through
Thursday (v) no permit or fee is required beginning Fridays at 6:00pm until Sundays at 10:00
pm.
Lot B (formerly Lot 3) (i) a 24 Hour Parking Permit is established and required from June 1, 2018
through May 31, 2019 for a fee of $825.00 and $675.00 for Seniors 65 years of age and over (ii)
24 Hour Parking Permit holders may park 24 hours per day, 7 days per week, including all
holidays (iii) an Area Business Permit is established from June 1, 2018 through May 31, 2019 for
a fee of $575.00 per year.
Lot C (formerly Lot 4) (i) an Overnight Parking Permit is established and required from June 1,
2018 through May 31, 2019 for a fee of $450.00 per year (ii) Overnight Parking Permit holders
may park beginning at 7:30 pm Monday and must vacate the following morning by 7:30 am,
Monday through Thursday (iii) Parking is permitted weekends beginning at 7:30 pm on Friday
and ending Monday at 7:30 am.
Lot D (formerly Lot 5): (i) a 24 Hour Parking Permit is established and required June 1, 2018
through May 31, 2019 for a fee of $825.00 per year, and $675.00 for Seniors 65 years of age
and over (ii) 24 Hour Parking Permit holders may park 24 hours per day, 7 days per week,

through May 31, 2019 for a fee of $825.00 per year, and $675.00 for Seniors 65 years of age
and over (ii) 24 Hour Parking Permit holders may park 24 hours per day, 7 days per week,
including all holidays.
Lot F (formerly Lot 7): (i) designated for Town of Mamaroneck Highway Employees and
Larchmont Mamaroneck Joint Garbage Disposal Commission Employees only (ii) parking is
allowed at all times.

NOW BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby establish (i) annual parking permits
to be issued semiannually (except for Meter Parking Permits) for a service fee of $35.00 (ii)
established a permit replacement fee of 10.00, and
BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby allow parking except when said
Lots are being, in whole or in part, closed for repairs, maintenance and/or improvement, upon
reasonable notice being given to the permit holders.

3. Authorization - Intermunicipal Agreement - Westchester County Clerk
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal Agreement
between the Town of Mamaroneck and the Westchester County Clerk, regarding access to various
records in the County Clerk’s Office, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf
of the Town.
4. Authorization – Adjustment of Ambulance District Fees
On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the
2019 Ambulance District Fee Schedule as follows:

Administrative Intern in the Town Administrator’s Office, with the effective date for the part-time

time position beginning February 19, 2019, at an annual salary of $64,000.
