BOSTON POST ROAD, MAMARONECK, NEW YORK. PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilman King, the Work Session was unanimously opened at 5:00PM. Discussion - Comprehensive Plan Supervisor Seligson reminded the Town Board that the two Comprehensive Plan Consultants will meet again with the Town Board at the January 2 worksession. Supervisor Seligson suggested the Town Board focus on what would be the best process for resident involvement. She recommended adding municipal services to the Comprehensive Plan as well. Additionally, she stated the importance of incorporating the report received from the parking consultants into the Comprehensive Plan. The Town Board discussed utilizing the Pace Land Use Center for outreach, and Supervisor Seligson will reach out to them to see what types of services they could offer Final Review – 2019 Town Budget The Town Board received a memo from Mr. Altieri outlining revisions to the Preliminary Budget. Mr. Altieri stated that a nice benefit was the reduction in health care costs. Mr. Altieri’s memo detailed the three areas where changes in the Preliminary Budget occurred, those being: medical insurance, Police Department salaries and new positions in the Senior Center and Hommocks Ice Rink. Mr. Altieri will explain these changes to the public this evening. Mr. Altieri stated that the Town Board still needs to address the salaries of the Prosecutors as well as the various consultants i.e. the Land Use Attorney. Councilwoman Katz noted in the news of the financial shenanigans within the Portchester Fire Department. The Town Board discussed having an outside financial audit of the Fire Departments records to ensure all is in compliance. Appointments to Boards and Commissions On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss appointments to Boards and Commissions and Collective bargaining with the Police Department. EXECUTIVE SESSION Appointments to Boards and Commissions and Collective Bargaining with the Police Department. On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to resume the Regular Meeting. 1 December 17, 2018 Councilwoman Katz gave an update on the recent Traffic Committee meeting. She has informed the Traffic Committee that the Town Board will be looking the left turn from Edgewood Avenue onto N. Chatsworth Avenue again. Mr. Altieri noted that Lt. Maher made recommendations for Old White Plains Rd which were well received by the traffic committee RECONVENE EXECUTIVE SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Board unanimously agreed to enter into an Executive Session to discuss appointments to Boards and Commissions and Collective bargaining with the Police Department. EXECUTIVE SESSION Appointments to Boards and Commissions and Collective Bargaining with the Police Department. Update – Parking Consultant The Town Board reviewed a proposal from Barton & Loguidice to conduct a commuter parking analysis. If approved work should begin within the next two weeks and will include a public meeting. The Town Board discussed the ¾ mile radius for analysis as well as the specifics of the two-day sampling and site analysis. Discussion – Proposed Assessment Legislation The Town Board reviewed draft legislation prepared by Mr. Maker that addresses assessment of properties converted to condominiums. In the purpose of the law Mr. Maker writes ”there is a real possibility that properties, including two-family homes, may be converted into condominium ownership to avail themselves of this favorable tax treatment”. The setting of a public hearing on this legislation was added to the regular agenda for this evening. ADDED ITEMS Supervisor Seligson explained that it has come the Town’s attention that all municipalities, who are part of the Urban County Consortium, are required to appoint a member to the Community Development Advisory Group. This appointment is on the regular agenda for this evening. Councilwoman Elkind Eney updated the Town Board on the recent Zoning Board of Appeals meeting, at which they discussed, among other items, applications that continue to appear on the agenda without applicants showing up for the meetings. The Zoning Board of Appeals is discussing how these applications should be handled moving forward, specifically, whether they should be removed from the agenda and required to begin again. Councilwoman Elkind Eney asked Mr. Maker if this is a decision for the Zoning Board of Appeals, or for the Town Board. Mr. Maker responded that he thinks the Zoning Board of Appeals can make their own decisions. He also stated that he will follow up with the Attorney for the Land Use Boards, Lisa Hochman. Additionally, Mr. Maker will add the Planning Board to the discussion, as both Boards should be consistent. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. 2 December 17, 2018 SUPERVISOR’S SUMMARY REPORT We will continue our public hearing for the 2019 Town Budget this evening. The Town Board and staff have been finalizing the budget details. It has been a nice celebratory holiday season in the Town. We had a fun and well attended Town staff holiday party with a visit from Santa. Congratulations to the Community Resource Center for 20years of service to the community. They had their gala event December 6th and honored Reverend Bill Crawford who recently retired from Larchmont Avenue Church. The Mamaroneck Historical Society had an afternoon of holiday cheer at the school house in Harbor Island Park. It’s very interesting and fun to step into the school house and step back in time. I attended a County conference on Climate Change last week and went to the WMOA dinner in Pelham Village. I was also interviewed by an MHS student who is participating 4-year Civics Class. PUBLIC HEARING – Adjourned from December 5, 2018 – Preliminary 2019 Town Budget & Preliminary Town of Mamaroneck Fire District # 1 Budget The following Notice of Public Hearing is entered into the record as follows: TOWN OF MAMARONECK, NEW YORK PUBLIC HEARING PRELIMINARY 2019 TOWN BUDGET and PRELIMINARY TOWN OF MAMARONECK FIRE DISTRICT #1 BUDGET NOTICE IS HEREBY GIVEN, that the Public Hearing held by the Town Board and the Fire Commission of the Town of Mamaroneck, on Wednesday, December 5, 2018, was adjourned until Monday, December 17, 2018, at 8:00 PM, at the Town Center, 740 West Boston Post Road, Mamaroneck, New York, to consider the Town’s Preliminary Budget and the Mamaroneck Fire District Preliminary Budget for the calendar year commencing January 1, 2019 and ending December 31, 2019. Altieri Budget Officer To be published: November 30, 2018 On motion of Supervisor Seligson, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously opened. Supervisor Seligson asked Mr. Altieri to address the positive changes to the Preliminary Budget since the first Public Hearing on December 5, 2018. Mr. Altieri explained these in detail, hereby entered into the record as follows: Memorandum To: Supervisor and Town Board Re: Revised 2019 Preliminary Budget Date: December 15, 2018 3 December 17, 2018 Subsequent to the 2019 Preliminary Budget hearing held on December 5, changes are proposed to the Budget for your consideration. These changes are the result of changes in circumstances that result in the budget document being more up to date as we move into 2019. There is a $25,000 increase in the application of surplus. The changes however do not result in changes to the tax rates for the various budget funds. Proposed Budget Revisions 1. Medical Insurance: Subsequent to the Budget hearing the Town did receive official word that the final increase in health insurance would be on average 3%. The rate change is on average because, there are different plans that apply: family coverage, individual coverage and retiree coverage. Since the number of insureds is different for each class of coverage the total cost must be calculated for each class. As a result the Town was able to further reduce the expenditures in the Townwide and Part Town Fund by a total of $110,000. There were reductions in the other funds however the amounts were relatively insignificant; some in the hundreds of dollars. The recommendation is to leave the medical insurance appropriations unchanged in the special districts. 2. Police Department Salaries: Subject to final ratification by the Town Board, the Town and the PBA have reached a tentative agreement to extend the existing labor contract that expires in December of 2018. For 2019, the proposed contract extension calls for a 2% increase in salaries. The increase is consistent with the change in the regional consumer price index over the last twelve months. Should the Board approve the contract extension, the impact is reflected in the revised 2019 Preliminary Budget. The impact of the proposed change in Police salaries results in a total increase of $63,807 increase in salary appropriations on a base of $5,447,917. The actual cost increase is 1.2%. The new salary total will be $5,181,724. Should the Town Board prefer not to approve the collective bargaining agreement the salary line will be changed back to the schedule reflected in the original version of the Preliminary Budget. 3. Proposed New Positions- Senior Center and Hommocks Ice Rink: The 2019 Preliminary Budget includes two new positions; one for the Senior Center and a second for the Hommocks Ice Rink. In the Preliminary Budget the proposal was to fill the positions in September of 2019 resulting in a savings of approximately $72,806. In calculating the starting date for these positions, we had neglected to realize that to minimize the impact of the costs for the new positions, part time positions in both programs were deleted from the budget. Consequently, the September start date poses staffing shortages at the Senior Center and the Ice Rink which will effect programming. Therefore the proposal is to have the new employee start dates moved up to April instead of September. As a result the original estimated savings of $72,806 is reduced to $44,000. To 4 December 17, 2018 compensate for a portion of the change the proposal is to add $25,000 to surplus application in the Townwide budget. With the changes proposed here, the 2019 Proposed Town Budget remains a responsible budget meeting the needs of the community. Although the tax levy exceeds the New York State Tax Cap guideline by 1.3% the property tax implications are quite reasonable considering the environment in which the Town is operating. Our financial strength and stability remains in place. This is evidenced by the recent confirmation of the Town’s Aaa credit rating and the upgrade in the Fire District credit rating from Aa2 to Aa1. Attached is a revised budget summary page and a budget summary by Fund and Department. ________________________ Stephen V. Altieri Town Administrator/Budget Officer Supervisor Seligson noted that she should have included in her Supervisor’s Report that Moody’s Investor Services confirmed and renewed the Town’s triple A rating, the highest financial rating given, and has improved the rating for the Fire District to a double A rating. Adding this is certainly good news and thanked the Town Administrator and Town Comptroller for their stewardship. Supervisor Seligson stated that the Town has been discussing the 2019 Budget since October. Multiple meetings, all open to the public, have been held. She believes this is a responsible budget. It accomplishes keeping the high-level services in place, while planning for the future, and keeping us in a good financial position. Supervisor Seligson believes the Town Board is prepared adopt it. Supervisor Seligson asked if anyone in the audience wished to comment, and there was none. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was unanimously closed. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business Commissioner Elkind Eney wanted to thank the Fire Department and the Recreation Department. Yesterday they held their Skate with Santa and Toys for Tots. This was well-attended, and always a wonderful event in our community. There being no further business to come before the Commission, on motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN TAKEN OUT OF ORDER 2. Authorization – Stipulation of Agreement – Police Benevolent Association Mr. Altieri explained that on December 31, 2018 the Town’s collective bargaining agreement with the Police Benevolent Association expires. Mr. Altieri discussed various details of the proposed stipulation of settlement, outlined in Mr. Altieri’s memo titled Ratification – Contract Extension Town of Mamaroneck Police, and dated December 14, 2018. On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was 6 December 17, 2018 RESOLVED, that the Mamaroneck Town Board does hereby ratify the Stipulation of Settlement between the Town of Mamaroneck and the Police Benevolent Association pursuant to the terms described in the memo from Mr. Altieri to the Town Board dated December 14, 2018, and BE IT, FURTHER RESOLVED, the Town Administrator be authorized to execute a renewal agreement between the parties on behalf of the Town. 1. Adoption – 2019 Town Budget and 2019 Town of Mamaroneck Fire District #1 On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby adopt the 2019 Preliminary Town Budget and the 2019 Preliminary Town of Mamaroneck Fire District #1 Budget, as amended, as the 2019 Town Budget and Town of Mamaroneck Fire District #1 Budget. Authorization – Consultant Services – Parking Mr. Altieri explained that the Town is experiencing, and hearing extensive feedback, from residents regarding commuter parking on residential streets. Although this is something the Town will address in the upcoming Comprehensive Plan update, the current situation warrants a more immediate review. The Town proposes to engage a consultant to conduct a commuter parking analysis. On motion of Councilwoman Katz, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the proposal submitted by Barton & Loguidice for a commuter parking study at a cost not to exceed $16,700.00, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – Replacement of Heating System – Maxwell Avenue Highway Garage – CP-2017-38 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved WHEREAS, improvements to the heating, ventilation and cooling (HVAC) infrastructure at the Maxwell Avenue Highway Garage were approved as part of Capital Project CP-2017-38, and 7 December 17, 2018 WHEREAS, engineering plans and specifications were developed by engineering consultants for combined HVAC modifications at the Highway Garage and Hommocks Ice Rink, and were bid as part of Contracts TA-18-03/03A, and WHEREAS, those bids were rejected by the Town Board based upon significant exceedance of bid pricing compared to the original approved capital project amount, and WHEREAS, the Engineering Department has solicited an alternative HVAC project proposal through the Gordian EZIQC Job Order Contracting Services, an alternative to the public bidding process, that is provided through an existing contracting services agreement entered into by the Town of Greece, New York, and recognized by the New York State Comptroller’s Office. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the project proposal provided by Gordian EZIQC Job Order Contracting Services’ designated regional contractor “John W. Danforth Company” for a total cost, not to exceed cost for all items covered by the tailored project scope, in the amount of $79,537.00. Approval – Amendment – Westchester Joint Water Works Project A-1310 On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the amendment to Westchester Joint Water Works (WJWW) Project A-1310 Barry Avenue / Macy Road Transmission Main as per the request of the WJWW. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby authorize the additional $74,000, which represents the Town’s share of the project, to be funded through the surplus funds of the Town’s Water District Fund. Salary Authorizations – Police Department On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby promote Police Officer Amy LaRosa to the position of Youth Detective at an annual salary of $120,112 (subject to change according to the 2019 PBA contract), effective January 3, 2019. Write off Unpaid Penalty and Interest Charges On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved WHEREAS, in September 2018, the Town Attorney advised the Town Board that the property known as SBL 8-3-51-2, was sold at public auction, and WHEREAS, the Town was unable to collect the full amount of taxes due, and WHEREAS, of the total amount of taxes due of $121,296.77, the Town received $112,826.86, thereby leaving a shortfall of $8,469.96. NOW THEREFORE, BE IT, RESOLVED, that the Mamaroneck Town Board does hereby approve the write off of unpaid property tax for SBL 8-3-51.2 as follows: Town Property Tax, including accrued penalties and interest in the amount of $8,469.89 2006 Town and County Taxes in the amount of $3,374.41 2006 Mamaroneck School Taxes in the amount of $5,095.48 The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye 9. Appointment – Community Development Advisory Group On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was unanimously approved WHEREAS, the Town of Mamaroneck has rejoined the Urban County Consortium and with participation is the requirement to appointment a member to their advisory group. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby appoint Rick Cherry, the current Chair of the Town of Mamaroneck Housing Authority, as a member of the Community Development Advisory Group, and BE IT FURTHER RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law. 10.
