CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. Regular meeting of June 3, 1959 -- Approved as corrected. Special meeting of June 17, 1959 -- Approved as corrected. Special meeting of June 29, 1959 -- Approved as presented. Regular meeting of July 1, 1959 -- Approved as presented. OLD BUSINESS There was no Old Business to come before the meeting. NEW BUSINESS 1. Authorization for Collection of 1959 School Taxes Upon request of the Comptroller, on motion by Councilman Kane, seconded by Councilwoman Helwig, the Board unani- mously adopted the following resolution authorizing the o. A# Receiver of Taxes to accept payment of school taxes for the year 19590 WHEREAS, Section 96A of the Tax Law as amended by Chapter 635 of the Session Law of 1957 empowers a Town Board in the County of Westchester by resolution to authorize the Receiver of Taxes to accept partial payments for or on account of taxes with provision for the reduction of penalties not below 2% on installments subsequent to the first (1st) installment, NOW, THEREFORE, BE IT RESOLVED that pursuant to the provisions of Section 96A of the Tax Law as so amended, the Receiver of Taxes is hereby authorized and directed to acceptfrom any taxpayer partial payments for or on account of the 1959 school tax in two installments in the manner set forth below and to apply such installment payments on account of said school tax: 11 One-half of the 1959 school tax during the month of September, 1959; 2) The remaining one-half of the 1959 school tax during the month of January, 1960, when such installment shall become due; and be it FURTHER RESOLVED that the Schedule of Penalties for the non-payment of the first (1st) and second (2nd) installments shall be as follows. First Installment During September No Penalty During October 210 During November 576 During December and January 776 During February and March 1010 During April and to date of sale 1210 Second Installment During January 210 During February and March 1010 During April and to date of sale 1210 and be it FURTHER RESOLVED that notwithstanding any provi- sions of this resolution, the Receiver of Taxes of the Town of Mamaroneck may accept the payment of the second (2nd) installment of school taxes at the option of the taxpayer during the months of October, November, and December with a penalty of 21b; and be it FURTHER RESOLVED that notwithstanding any provi- sions of this resolution, the Receiver of Taxes of the Town of Mamaroneck may accept the payment of the total amount of school taxes at the option of the tax- , payer during the month of September without penalty; and be it FURTHER RESOLVED that the acceptance of any such partial or installment payment of the 1959 school taxes for Union Free School District No. 1 in the Town of Ma- maroneck, and School District No, 2, Town of Scarsdale, New York, shall not be deemed to affect in any manner, any right of the Town of Mamaroneck under any general or special act, to enforce collection of the unpaid bal- ances of such taxes as may remain due and owing to the said Town, but rights and powers shall remain in full force and effect to enforce collection of the unpaid balance of such school taxes, together with interest, penalties, and other lawful charges, 2. Bond Resolution--New Water Supply Line Action on this resolution was omitted following a statement by the Supervisor that the resolution would be brought before the Board at a special meeting later in the month, 3. Designation of Polling Places--1959, 1960 The Clerk presented a list of polling places for the purpose of designating a place in each election district in the Town in which a meeting for the registration of voters, election, and primaries shall be held in the year following the ensuing first day of October, and on motion by Councilman Santoro, sec- onded by Councilman Kane, it was unanimously RESOLVED that in accordance with the provisions of Section 66 of the Election Law, being Chapter 17 of the Consolidated Laws of the State of New York as amended, the Town Board of the Town of Mamaroneck hereby designates a place for each election district in the Town at which a meeting for the registration of voters, election, and pri- maries shall be held in the year following the en- suing first (lst) day of October as follows: District No, 1 Mamaroneck Avenue School, Mamaroneck Avenue, Mamaroneck, N.Y. Gleicher Co., Inc, (Glen Rock Estates) The Town Attorney presented two bonds #217193 and #217194 of the Joseph W. Gleicher Co. , Inc. with the Continental Casualty Company in the amounts of $6, 800 and $34, 000 respectively covering completion of street improvements and utilities in the Glen Rocks subdivi- sion and recommended approval of same pursuant to Section 277 of the Town Law. Whereupon, on motion by Councilman Kane, seconded by Councilman Santoro, it was unanimously RESOLVED that pursuant to Section 277 of the Town Law this Board hereby approves as to sufficiency of surety and also as to form bonds #217193 and #217194 of the Joseph W. Gleicher Co. , Inc, of 55 Liberty Street, New York City, New York, covering completion of street im- provements and utilities in the Glen Rocks subdivision, with the Continental CasualtyCom- pany of 76 William Street, New York City, New York, dated July 1st, 1959, in the amounts of $6, 800. 00 and $34, 000. 00 respectively as fixed by the Planning Board of the Town of Mamaro- neck; and be it FURTHER RESOLVED that the Town Clerk be and he hereby is authorized to endorse such ap- proval upon the same. COMMUNICATIONS 1. State Traffic Commission Order The Clerk noted receipt of an order from the State Traffic Commission under date of July 22nd, 1959, which the Board ordered received and filed. Z. Petition Requesting Paving of Portion of York Road The Clerk read a letter, dated July 7, 1959, from Clark, Gagliardi, Gallagher & Smyth, Attorneys & Counselors At Law of White Plains, New York, enclosing and presenting a petition addressed to the Town Board by the residents of York Road, west of Durham Road, under date of June 26, 1959, requesting the Board "to take such action and adopt such measures as may be necessary and proper in order to require Soundview Woods, Inc, to grade and pave in accordance with the specifications of the Town of Mamaroneck that portion of York Road which ex- tends from Durham Road westerly to the bridge which spans Sheldrake River. " In connection with this matter, the Town Engineer read a letter received from Larchmont Hills, Inc, and dated August 4, I i 1959, advising that completion of paving on York Road would be started within the next 10 days, Mr. Frank Gagliardi, representing the petitioners, described in some detail the discomforts and inconven- iences suffered by the residents of this portion of York Road as a result of the unfinished road condition but added that if work on completion of the paving was to be- gin in the next 10 days, there was nothing further to be said about the matter, The Board directed Engineer Friedlander to keep in close touch with Larchmont Hills, Inc, and to follow- through on this matter. The following residents of York Road who were present at the meeting then addressed the Board to request assis- tance in extending the paving on the other side of the bridge and it was explained to them that there were two perfor- mance bonds covering this development, a small one to in- sure completion of the improvement-of York Road from Durham Road westerly to the bridge and another in the amount of $150, 000 to cover all other improvements in the development. It was further explained that there was nothing the Town could do unless it-,'was voluntary on the part of Soundview Woods, Inc, to expedite the completion of the remaining improvements,, Mrs. Jan Stanton Mrs. William D. Fisher Mr. Lester S. Sparrell Mr. Peter Shuebruk 3. Letter from M. K. Bretzfelder The Clerk presented a letter from M. K. Bretzfelder, dated July 7th, 1959, thanking the Board on behalf of the radio ama- teurs in the Town for entertaining their suggestion in respect to the new zoning law, which the Board ordered received and filed, 4. Letter from Howard B. Pritz The Clerk presented a letter from Howard B. Pritz, dated July 28, 1959, thanking the Board for granting,permission to him to park his Mobile Home behind the home of his parents at 55 Harmon Drive, Town, during the month of June. This communication was ordered received and filed, 5. Notice of Meeting of Larchmont Village Zoning Board The Clerk read a notice of a meeting of the Zoning Board of Appeals of the Village of Larchmont on Wednesday, July 15th, 1959, which was ordered received and filed. 6. Report of Inspection of Town Lockup The Clerk presented a letter from the State Commission of Correction, dated July 17, 1959, stating that the State Commission of Correction had approved the report of in- spection of the Town of Mamaroneck Lockup dated June 8th, 1959, which was received and filed. OTHER BUSINESS 1. Mr. Lloyd Harris Mr. Harris who was present at this time addressed the Board and requested the Board's decision in connection with the issuance of a building permit to him, which matter he had placed before the Board at the previous meeting. The Supervisor reviewed briefly Mr. Harris' request for the issuance of two building permits for construction of houses on the rear of his property and facing Cargill Road, an access roadway from Palmer Avenue to Cargill Park. The Town Attorney then advised that Cargill Road was not a public street as it was simply an easement which the Town had acquired in order to gain access to the sewer pumping station and which now was used as an access roadway to Car- gill Park and the Highway garages, He further advised that under the law, the Building Inspector had no authority to grant building permits except where there was access to either a public street or a street as shown on a filed map, and that as this road is not in either category, the question resolves itself to whether the Board wishes to accept or dedicate this roadway as a public street or highway. Councilman Santoro then stated that as the Town had plans for further development of Cargill Park and for the erection of a new highway garage, he was fearful that if houses were constructed facing on this roadway, there would be a. con- siderable increase of traffic danger to the children using this road to reach Cargill Park and therefore that it was his feeling that this road should be kept as an access road only. Mr. Harris then inquired as to what he was supposed to do with the rear of his property and further stated that at the present time there.were two garages of private homes with access to this road. He also pointed out the shortage of small homes existing in the Town, stating that construction of small houses such as he proposed to build would help to alleviate this shortage. He then demanded that the Board make a decision and stated that if the decision were negative, he would resort to legal action. Whereupon, since there was no further discussion on this matter, on motion by Councilman Santoro, seconded by Coun- cilwoman Helwig, it was unanimously A i RESOLVED that the request of Mr. Lloyd Harris that the decision of the Building In- spector be reversed is denied, REPORTS The Clerk presented the following reports which were received and placed on file: Report of the Town Clerk for the month of July, 1959. Affidavit of publication of notice of adoption of resolution amend- ing the General Ordinances of the Town of Mamaroneck by add- ing thereto anew chapter to be known as Chapter II-A entitled, "Parking Meter Ordinance", in the official newspaper of the Town of Mamaroneck, The Daily Times, on July 10th, 1959. Affidavit of posting of the above resolution on July 10th, 1959 as provided in Section 133 of the Town Law. REPORT OF THE SUPERVISOR 1. Death of Edward F. Watson The Supervisor spoke of the unfortunate premature death of Edward F. Watson on July 23rd, paying high tribute to the out- standing contribution he rendered this community through his service as a former member of this Board and in many other responsible government and civic posts. Each of the members of the Board personally expressed his regret and appreciation of all Mr. Watson gave the community throughout his many years of service, and on motion by the Supervisor, seconded by Councilman Santoro, it was unani- mously RESOLVED that the Town Board of the Town of Mamaroneck herewith expresses its deep regret at the death of Edward F. Watson and its recognition and appreciation of his out- standing service to this community as a former member of this Board and in various other re- sponsible civic and government posts; --- and be it FURTHER RESOLVED that this expression of appreciation be sent to the family of Mr. Watson and spread upon the minutes of this meeting, 2) Inspection of County Park and Recreational Facilities The Supervisor reported that the two-day inspection tour of the County Park and recreational facilities was most re- warding and informative. He stated that a detailed briefing had been presented on the particular problems of each area and that in spite of the vast amount of undeveloped area in the County, if the present population growth continued, the available areas would be inadequate within a period of fifty years. He also reported that most of the development of the present facili- ties had been done during the 1920s with nothing much done since due to the war and depression with the result that all of the present facilities were badly in need of improvement and expansion, 3) Letter--Winged Foot Golf Club The Supervisor read a letter from Thomas F. Farley, Manager of the Winged Foot Golf Club, dated July 2, 1959, thanking the Council for the outstanding cooperation and help received during the U.S. G.A. Open and particularly mentioning Mr, B. J. Santoro in this respect, The Board directed that this communication be received and filed, 4,} Letter--Mr, Maurice Rosenfeld The Supervisor read a letter of congratulation and corn- mendation on the 1958 Annual Report received from Maurice Rosenfeld under date of July 16, 1959 and copy of his reply thereto, The Board directed that this correspondence be received and filed, Councilman Santoro -- 1) Installation of Drain--Old White Plains Road In connection with this installation, Councilman Santoro reported that the contractor had encountered considerably more rock than estimated, and that therefore the cost of the installation would be increased, Z) Hommocks Drain Councilman Santoro reported that this installation had been completed outside of the backfill around the manhole, 3) Parking Lots Councilman Santoro reported that construction of the lots was progressing nicely and that the walkway had been completed, 4) Gardens Lake Leakage Councilman Santoro stated that because of the rain during the summer months it was almost impossible to determine at this time whether the leakage condition resulting from con- struction of the Thruway had been corrected. In this connection, the Town Attorney informed the Board - that the time limit for the filing of a claim against the Thru- way Authority expired on August Uth and recommended that such claim be filed with the Court of Claims in order to pro- tect the Town in the event of the reappearance of the leakage condition. The Board directed that such claim be filed. 5) Report of Hommocks Committee Councilman Santoro advised the Board that Mr. Hardesty, Chairman of the Hommocks Committee, had advised him that the Committee was now working on its report and that it would be ready in the early fall, 6) Provision of Decal Parking Area On the matter of providing a decal area for the use of Town residents, Councilman Santoro reported that it would be diffi- cult to determine the exact number of parking spaces needed until after Labor Day, He advised that the parking lots were scheduled to open on August 15th and suggested that discussion of this matter be deferred until after that date and possibly un- til after Labor Day when normal commuting would be resumed, The Board concurred with this suggestion and stated that the matter would be considered at a later date, Councilman Kane -- 1) Apportionments Councilman Kane presented the following petitions re- ceived from the Assessor for the correction of the assess- ment roll so as to permit the apportionment of taxes, and on his motion, which was seconded by Councilwoman Helwig, the following motion was unanimously adopted- WHEREAS the Assessor has presented petitions for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Ar- ticle 16 of the Westchester County Administrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Boardfinds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1958, school taxes of 1959, and the assessment roll of 1959, taxes of 1960, which show property now appearing on the rolls as follows. Sierad 100 100 Councilwoman Helwig -- 1) Park Commission Report Councilwoman Helwig reported in detail on the rehabilitation of Station Park and informed the Board that the Thruway Au- thority had agreed that the Town restore and maintain the slopes on either side of the ramp in the future, JL Z) Recreation Report Councilwoman Helwig reported in detail on the Summer Rec- reation Program reciting attendance figures and advising that her observations would be forwarded to the Commission. She particularly mentioned the Music School as outstanding and called to attention the Final Concert to be held on the evening of August 20th. In connection with this program, Councilwoman Helwig pre- sented a communication from the Commission under date of August 5th requesting authorization for the following Summer Recreation salary expenditures: Lyne Corby Rec. Assistant $35. 00 wk. Dana Mambelli Spec. in music (5 wks) 15. 00 wk. pt. time and on her motion, seconded by Councilman Kane, it was unanimously RESOLVED that the Town of Mamaroneck employ the following persons for the Summer Playgrounds to be paid at the rate of compensation listed here- with: Name Classification Salary Lyne Corby Rec. Dana Mambelli Spec. in music 15. 00 wk. part time (5 wks) Councilwoman Helwig also reported that the drinking fountain in Cargill Park had been broken again and that the part neces- sary to its repair had been ordered. Councilwoman Helwig further reported in detail on a meeting held in the Supervisorts office with Dr. Prezioso, Mr. Pomeroy and Mr. Schulman of the County and Mr. Kronenberger and her- self to discuss the Towns request for a survey of the land next to Carl°s Restaurant in the event all or part of such land were available for recreational use. As a result of this conference, it was suggested by the rep- resentatives from the County Commissions that an overall sur- vey of all lands and facilities in the Town be made by the Plan- ning, Park and Recreation Commissions of the County jointly rather than a survey of any one spot. Since there had been some thinking that it might be advisable for this Board to request the Town Planning, Park and Recrea- tion Boards to work together to draw-up a plan for the long range development of all Town Park and Recreational lands and facilities if such were the pleasure of these Boards, and since such a project had been discussed tentatively with the Chairmen of these Boards, it was recommended by Councilwoman Helwig that if this plan found favor with all concerned, the County Planning, Park and Recreation Commissions be requested to prepare such an overall study, working closely with the local Boards during its preparation and development. Whereupon, after some further discussion, on motion by `,rs' Gbuncilwoman Helwig, seconded by Councilman Kane, it was unanimously RESOLVED that the Supervisor be and he hereby is directed to request the County Planning, Park and Recreation Commissions to prepare an overall study of the park and recreation lands and facilities in the Town of Mamaroneck, including the County- owned lands lying within the Town. REPORT OF THE TOWN ATTORNEY 1) Arthur Goldfinger vs. Town of Mamaroneck The Attorney reported that a legal action commenced by Arthur Goldfinger against the Town of Mamaroneck to set aside a variance granted to G. W. Moody had been adjourned to September. 2) 65 Palmer Avenue The Attorney reported that the Howell Park Association and Peter G. Moore had commenced a legal action against the Town Board for review and reversal of its decision in the matter of 65 Palmer Avenue, 3) Tennyson Nursery Zoning Violation--Legal Action The Attorney reported that since the Tennyson Nursery at the corner of Palmer Avenue and Weaver Street had been discon- tinued and the property restored , he felt the legal action could be discontinued. However, he suggested that he discuss the matter with the Howell Park Association, which had first brought the matter to the Board's attention, before formal discontinuance was made. The Board so directed the Attorney and requested him to re- port further thereon. 4) Zoning Violation--7 Ferndale Place In connection with this matter, the Attorney reported that he was attempting to obtain a stipulation from Daniel Cioffoletti, Jr. that his house at 7 Ferndale Place would not be used as a two- family house. 5) Harrison Drive Zoning Violations The Attorney reported as follows on the status of the legal ac- tions brought by the Town in the matter of zoning violations on Harrison Drive; John Roma - 12 Harrison Drive -- Entered denial of violation Vincent Nesci - 14 Harrison Drive -- Attorney requested postponement until October. O. F. Ciofrone - 23 Harrison Drive -- Replied apartment vacant; requested discontinuance of injunction after inspection by Building Inspector. OTHER BUSINESS 1) John B. Forest Mr. Forest addressed the Board representing the Larchmont Community Chest to request permission for the Chest to con- duct a parade on certain streets in the unincorporated area of the Town of Mamaroneck on Sunday, October 11th, 1959, at 2 p.m. , and permission for a car with loud speaker to adver- tise and announce said parade. Whereupon, after discussion, on motion by Councilman San- toro and seconded by Councilman Kane, it was unanimously RESOLVED that permission is hereby granted to the Larchmont Community Chest pursuant to Section 9, Chapter I1 of the General Ordi- nances of the Town of Mamaroneck as amended on March 4th, 1959, to hold a parade from the Murray Avenue School on Murray Avenue along Murray Avenue and Chatsworth Avenue to the Larchmont Village line at 2 p.m, on Sunday, October 11th, 1959, subject to such regulations as the Police Commission of the Town of Ma- maroneck may make. 2) George E. Mills, Jr. Mr. Mills addressed the Board to request reconsideration of the decision in the request of Mr. Lloyd Harris. The Board reminded Mr. Mills that it had acted upon the demand of Mr. Harris for an immediate decisions and that this matter could be brought up again at any future meeting. 3) Mrs. Virginia Paige Mrs. Paige, President of the Larchmont League of Women Voters, complimented the Supervisor and Town Board on the - Annual Report for the year 1958. She also commended the Board heartily on the mention and consideration given to civic groupsy particularly in connec- tion with the manner of presentation and consideration of the new Zoning Ordinance. ADJOURNMENT There being no further business to come before the meeting, it was declared adjourned at 9:25 p.m., to reconvene on September 2nd, 1959. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Communications There were no communications to be presented. 2. Reports There were no reports to be submitted at this meeting. 3. Claims In Commissioner Brushts absence, Commissioner Kane pre- sented the following Fire Department claims, which had been audited by the Comptroller and approved by the Fire Chief, and --- on his motion, seconded by Councilwoman Helwig, it was unan- imously RESOLVED that the following claims be and they hereby are approved and the Supervisor and Comp- troller be and they hereby are authorized to pay the same out of the budget for the Fire Department: Atlantic Service Center $ 50.60 R. Other Business The Fire Inspector called to the Commissions attention the 0Y the many calls received in complaint of the burning outside the Incinerator, stating that he felt much of the material so burned on the grounds could be burned in the Incinerator and that he did not believe such had been the practise in the past, The Town Engineer advised in connection with this mat- ter that the materials being burned on the grounds outside the Incinerator were too large to burn in the Incinerator and that a study was now being made regarding provision of an additional burner large enough to accommodate all such materials, The Supervisor stated that many persons in the unincor- porated area had complained of this same type of problem in connection with the burning at the Village of Larchmont dump.
