HomeMy WebLinkAbout1959_06_17 Town Board Minutes , MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD NNE 17th, 1959, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8;15 p.m. PRESENT; Supervisor Burchell Councilman Santoro Councilman Kane Councilman Brush Councilwoman Helwig ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Friedlander - Town Engineer Mr. O'Brien Superintendent of Highways Mrs. Brewer - Secretary THE SUPERVISOR The Supervisor welcomed Tom Sprague, reporter for the paper who was covering the meeting in Arthur Dunn's ab- sence, and reported to the Board that he learned upon talking with Art, presently in the hospital a second time for cateract surgery, that the operation had been a complete success with Art well on the road to recovery. PUBLIC HEARING--AMENDMENT TO ZONING ORDINANCE The Clerk presented the affidavit of mailing and the affida- vit of publication of the Notice of Hearing in the official news- paper of the Town of Mamaroneck, The Daily Times, on May 23rd, 1959, to consider the adoption of an amendment to the zoning ordinance of the Town of Mamaroneck so as to provide that a family swimming pool be permitted in Residence "AA11 and "A" Districts as provided in Article 23 of the Building Code, and the Attorney reviewed the proposed amendment briefly. The Supervisor then declared the hearing open and inquired whether anyone present wished to be heard on the matter, and since no one wished to be heard, on motion by Councilman Brush, seconded by Councilman Santoro, it was unanimously a RESOLVED that the hearing be and it is de- clared closed. Whereupon, on motion by Councilman Brush, seconded by Councilman Santoro, the following resolution was unan- imously adopted and the Clerk directed to publish notice of adoption once in the official newspaper of the Town of Ma- maroneck, The Daily Times, and to post on the Town Clerk's bulletin board. RESOLVED that Article 1I, Section 3, Sub- division 7 of the Zoning Ordinance of the Town of Mamaroneck as last amended by resolution adopted June 4, 1947, is hereby amended to read as follows.- 7. Accessory uses customarily incident to the above uses, the term "accessory use" however, not including a business or any building or use not located on the same lot with the building or use to which it is ac- cessory. A garage or stable shall be per- mitted as per Section 7 of this Ordinance. Family swimming pools as defined in the Building Code shall be permitted in Resi- dence Districts AA and A in accordance with the provisions of Article Z3 of the Building Code of the Town of Mamaroneck. OLD BUSINESS 1. Report on Murdock Woods Association Request for Sign At the last meeting of the Board, the Clerk presented the request and a letter from Sidney J. Winkel of 1Z7 Griffen Avenue written in objection to the location of the "Murdock Woods" sign. The Clerk now presented a second letter from Mr. Winkel under date of June 10th signed by five neighbor- ing property owners on Griffen Avenue and himself objecting to the location of this sign, and also a petition signed by thirty property owners of the Town favoring the location of the sign. After some discussion between the members of the Board each of whom had inspected the site where the sign was lo- cated following the last Board meeting and Mr. Butcher, Pres- ident of the Murdock Woods Association, it was, on motion by Councilman Brush, seconded by Councilman Santoro, unani- mously RESOLVED that permission is hereby granted _ to the Murdock Woods Association, Inc. to erect and maintain a redwood sign approxi- mately 30" x 18" in size and bearing the words "Murdock Woods", on the Town-owned island located at the intersection of Murdock Roadand Griffen Avenue. 2, 65 Palmer Avenue (Revocation of Building Permit) In the mattes of the appeal for the revocation of the build- ing permit for premises known as No, 65 Palmer Avenue is- sued in 1955, Councilman Santoro read the opinion submitted by Lee Perry, architect engaged as Consultant by the Town. Following this, the Town attorney stated that he had ren- dered a lengthy opinion on this matter to the Town Board which he discussed briefly at this time, summarizing the points made therein and concluding his remarks by stating that he had advised the Board to deny the appeal made to itby the Howell Park Association and Peter G. Moore on April 8th, 1959. Both of the opinions referred to above and submitted by Mr. Perry and Town Attorney Delius were received and filed with the Town Clerk, Councilman Brush then stated that, based on the advice of Counsel and the opinion submitted by the Consultant, it was his feeling that the Board should deny the appeal to revoke the building permit and offered the following resolution which was seconded by Councilman Santoro. RESOLVED that the appeal of Charles M. McCarty, as President of Howell Park Association (an unin- corporated association), and Peter G. Moore, each for himself, pursuant to Article 1, paragraph 23 of the Building Code of the Town of Mamaroneck, from the decision, dated March 31, 1959, of the Building Inspector, Maurice Friedlander, denying their ap- plications to revoke the building permit issued De- cember 2, 1955 for construction of a building at premises known as No. 65 Palmer Avenue in the Town on the grounds that the permit was issued er- roneously and illegally in violation of the Building Code and Zoning Ordinance, be and the same is hereby denied. During the discussion on this motion, the members of the Board made the following observations. Councilman Santoro stated that after reading and studying carefully all of the material submitted in connection with the matter, he felt the Board should deny the appeal. Councilman Kane stated that he had probably been with this matter longer than any other member of the Board since he dated back to 1953 and that much as he regretted seeing an apartment house on this property, he did not believe there was sufficient reason, either morally, or legally, to grant the appeal. Councilwoman Helwig stated that she regretted that these must be an apartment on this property and that she appreciated the concern of all to have as attractive a building as possible, adding that in this connection, she was impressed by Mr, Perry's statement that the interpretation given by the Building In- spector in 1955 would result "in a better building for this and the adjoining properties". However, she continued, after considering all the carefully presented evidence and the opinions of Mr. Perry and Mr. Delius, she did not see that this Board could reinterpret the Zoning Ordinancenow and believed the Board had no choice but to deny the appeal, Councilman Brush then said that every time he ran for office, he opposed apartments, but in this instance he felt he had no choice except to vote to deny the appeal, The Supervisor stated that the question before this Board was not whether there should be an apartment or no apart- ment on the property, but rather a more narrow one of whether the decision made by the Building Inspector back in 1955 should be revoked. He further stated that it appeared that the Building Inspector had not made any false, fraudu- lent, arbitrary decision in the matter but made certain in- terpretation of the Building Code after consultation with an architect, and it should be noted, he continued, that a lapse of four years has passed since the original decision with the owner expending some $75, 000 to $100, 000 on the property. It also appears, he further stated, that the architectural consultant has advised the Board of the validity and reason- ableness of the Building Inspector's decision and further, it is to be noted that the Town Attorney has submitted a long legal brief advising the Board that it should not revoke the - Building Inspector's decision of 1955. In view of all these foregoing facts and circumstances he stated that it was his opinion that the decision of the Building Inspector in 1955 should be upheld and the appeal dismissed. Whereupon the discussion concluded and a roll call vote was taken on the motion offered by Councilman Brush and seconded by Councilman Santoro which resulted as follows: Councilman Santoro - Aye Councilman Kane - Aye Councilman Brush - Aye Supervisor Burchell - Aye Councilwoman Helwig - Aye At this time, Robert B. White, attorney for the appellants, Charles M. McCarty, an appellant, and Frank X. O'Donnell, Jr, addressed the Board requesting. First - that the four letters listed below which were submitted by architects to the Board in connection with this matter be expunged from the record on the grounds that the writers had not appeared for cross-examination and their statements were ex-parteg 1. Letter from S. J. Kessler & Sons, Architects & Engineers, 551 Fifth Avenue, New York F 2. Letter from Harry M. Prince, Ar- chitect of 101 Park Avenue, New York 3. Letter from DeRose and Cavalieri _ Ar- chitacts of 384 East 149th Street, New York 4. Letter from George G. Miller, Architect of 125 West 45th Street, New York Second - that the record show the facts on which this Board relied in making its decision and the reasons given by each member of the Board in voting upon the resolution. 3. Report on Bids for Storm Drain in Old White Plains Road Councilman Santoro reported that the Town Engineer and he, after study and tabulation of the bids submitted for the construction of Storm Drain & Appurtenances in Old White Plains Road, Town of Mamaroneck, recommended that the bid be awarded to the low bidder, Gagliardi Bros. , Inc. , at the total price of $12, 144. 20 and that the deposit checks of the unsuccessful bidders be returned immediately. Whereupon, on his motion which was seconded by Council- man Kane, it was unanimously RESOLVED that this Board hereby accepts the low bid, to wit the bid of Gagliardi Bros. , Inc. , for the construction of Storm Drain & Appurtenances in Old White Plains Road, Town of Mamaroneck, in accordance with the Specifications and Proposal as stated and filed in the Office of the Town Clerk, at the total price of $12, 144. 209 and be it FURTHER RESOLVED that the Town Clerk be and he hereby is authorized to return to each bidder ex- cept the successful bidder, Gagliardi Bros., Inc., the deposit check submitted with bid as required in the Specifications and Proposal an file in the Office of the Town Clerk. NEW BUSINESS There was no new business to come before the meeting. COMMUNICATIONS 1. Fare Increase, New Haven Railroad--Village of Larchmont The Clerk presented a letter from the Board of Trustees of Lt the Village of Larchmont under date of June 3rd, 1959, quot- ing the resolution adopted at the June 1st meeting of that Board expressing the Board's opposition to the requested com- muter rate increase with the thought that the Council might consider taking similar action, The Supervisor then read the letter he wrote to the Public Service Commission for this Board under date of June 12, 1959, opposing the requested increase in view of the recenttax relief granted by legislation to railroads and requesting the Commission to hold a public hearing on the matter so that all municipalities affected could be heard. He also advised that he was in communication with the County Executive and County Attorney and that the Public Service Com- mittee of the Board of Supervisors, of which he was Chairman, ' and the attorney were preparing a resolution opposing the re- quested increase and requesting a public hearing which would be presented on the floor at the Special Meeting of the Board of Su- pervisors to be held next Monday, Councilman Santoro suggested that the Town Attorney repre- sent officially the Town of Mamaroneck at any hearing on this matter before the Public Service Commission and the Board so directed, 2. Request for Erection of Fence--Thomas P. MacDonnell 97 Madison Avenue, Town The Clerk presented a request from Thomas P. MacDonnell of 97 M-adison Avenue, Town, for permission to erect a 36- inch high split rail fence on Town-owned property, which the Clerk was directed to put over to the next meeting, meanwhile notifying any property owner concerned of the request and al- lowing time for the members of the Board to inspect the site proposed for the erection of the fence, 3e Petition re Sidewalks, Palmer Avenue The Clerk presented a petition, dated June 9th, 1959, under- signed by nineteen property owners on Palmer Avenue and Blossom Terrace, Town, requesting an unobstructed, safe walking area on the west side of Palmer Avenue between Rich- bell Road and Weaver Street, During the discussion on this matter, when the legal situation regarding the construction of sidewalks was explained, Mr, Al- fred Muller of 263 Palmer Avenue, spoke representing the pe- titioners explaining that the request was only for the removal of brush and rock so thatthere would be a safe and comfortable walk for children and other pedestrians. He also requested that consideration be given to moving the bus shelter located on Pal- mer Avenue opposite Richbell Road in order to give better and safer vision to the school children when using the walk light at this location, 4�? E This matter was referred to Councilman Santoro and the Superintendent of Highways for study and report with the Board suggesting that an appointment be arranged with Mr. Caputo of the West-Fordham Transportation Company, the Police Chief, Mr. Muller and themselves with regard to the request concern- ing the location of the bus shelter, -- COMMUNICATIONS (Not on Agenda) 1. Letter from Judge Sirlin The Clerk presented a letter from Judge Reuben Sirlin, dated June 15th, 1959, advising that he had been retained by forty-two residents of the Stonewall Lane, Prince Willow and Bruce Road areas to request the Town Board to authorize a preliminary en- gineering report for the purpose of establishing a sewer district extending from the Village of Mamaroneck line to the Stonewall' Lane area. After discussion, this matter was referred to the Town At- torney for discussion with Judge Sirlin as to definition of dis- trict, etc, and report thereon to the Board. Z. Letter from Mrs. L. Werner Knoke The Clerk presented a letter from Mrs. L. Werner Knoke of 75 Lovell Road, New Rochelle, N. Y. , dated June 14th, 1959, addressed to the Village of Larchmont and forwarded to the Town, requesting that climbing roses be planted around the big rock on Rockingstone Avenue, which was ordered received and filed. REPORTS The Clerk presented the following report which was received and placed on file- Report of the Town Clerk for the month of May, 1959. REPORT OF THE SUPERVISOR The Supervisor advised that he had no report at this time. REPORTS OF THE COUNCILMEN Councilman Santoro -- 1. Letter from Dr. Arnold S. Breakey Councilman Santoro presented a letter addressed to the Su- perintendent of Highways by Dr. Arnold S. Breakey under date ;3 of June 16th, 1959, requesting that Larch Road be accepted as a Town Street, and on his motion, seconded by Council- man Kane, the Board unanimously adopted the following res- olution: WHEREAS the Superintendent of Highways has rec- ommended to this Board the acceptance of a private street now known as Larch Road; NOW, THEREFORE, BE IT RESOLVED that the Town of Mamaroneck hereby accepts as a Town street or highway the street now known as Larch Road and shown on map known as "Subdivision Map of Property Belong- ing to Edna A. Forbes, Town of Mamaroneck, Westchester Co„ N. Y„ dated July 6, 1957", and filed in the County Clerk's Office, Division of Land Records, formerly Register @s Office, Westchester County, New York, on October 17, 1957, as Map No, 11283, 2, Hommocks Drain Councilman Santoro reported that the installation of the drain in the Hommocks land had been completed, 3. Murray Avenue Sewer Councilman Santoro reported that the extra work in con- nection with this project was now under way and that the contractor would soon complete same, Councilman Kane -- 1, Apportionment Councilman Kane presented the following petition received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes, and on motion by him and seconded by Councilman Brush, the following reso- lution was adopted unanimously: WHEREAS the Assessor has presented a petition for the correction of the assessment roll for cer- tain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Admin- istration Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petition for the correction of said assessment roll: NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1958, School Taxes of 1959, and the assessment roll of 1959, taxes of 1960, which show property now appearing on the roll as follows; Block Parcel Name Land only 506 96 Marguerite Kean $ 2, 700 be corrected as follows in accordance with the provisions of subdivision 5 of Section 557; Block Parcel Name Land only 506 96 Marguerite Thomas 2, 300 506 304 Marguerite Kean 400 Councilman Brush -- 1, Larchmont Acres Fire Councilman Brush reported on the extraordinarily fine work of the Police and Fire Departments at the recent Larchmont Acres fire suggesting that a letter be sent re- marking the meritorious duty performed by each of the departments. The Board directed that the Supervisor write to the Po- lice Commission, with a copy to Chief Yerick, commending the fine performance of duty of the police force and es- pecially mentioning Sergeant Cunningham and Officer Staro- poli, and also to the Fire Department commending that de- partment on its handling of the fire. Z. National Open Golf Tournament Councilman Brush remarked on the fine work of the Police Department in connection with traffic at the National Open Golf Tournament at Winged Foot Golf Club during unusual and difficult weather conditions, particularly commenting on the fine job done by Councilman Kane at this time, Councilwoman Helwig -- to Summer Recreation Program Councilwoman Helwig presented a letter addressed to the Town Council by Walter E. Warner, Jr„ Chairman of the Rec- reation Commission, requesting the Board's authorization for payment of compensation to the personnel listed therein in con- nection with the operation of the Summer Recreation Program, and on her motion which was seconded by Councilman Kane, it was unanimously RESOLVED that the Town of Mamaroneck employ the following persons for the Summer Play- grounds for a period of seven (7) weeks, from July 6th through August 21st, 1959, to work five (5)days a week from 9:00 a.m. to 4.00 p.m. , with the exception of the Pre-School groups which are open from 9:00 a.m. to 12:00 noon only, and to be paid at the rate of compensation listed here- with: Name of Employee Job Classification Salary Flint Park Mrs. Louise Hood Rec. Annual Town Golf Tournament Councilwoman Helwig reported that the annual Golf Tourn- ament held this year on June 8th at the Bonnie Briar Country Club had been most successful and well attended with all who participated reporting it to be a most enjoyable event, The Supervisor, noting the presence of Mr, Warner, Chair- man of the Recreation Commission, asked him whether he - would care to supplement Mrs. Helwigts remarks and Mr. Warner replied that he thought the letter Mrs. Helwig had presented spoke for itself with regard to the Summer Recrea- tion program and that he felt the Golf Tournament was indeed excellent this year, 3. Park Commission Councilwoman Helwig stated that the Park Commission had requested her to inform the Board of the recent correspon- dence between the Garden Club of Larchmont and the West- chester County Park Commission and read the following let- ters which she requested be incorporated in the minutes of this meeting: lj Letter addressed by Mrs, George E. Stewart, President of the Garden Club of Larchmont, Inc, to Mr. Charles Pound, General Superintendent of the Westchester County Park Commission, under date of May 27th, 1959 -- "We refer to our letter to the Westchester County Park Commission, dated January 11, 1954, and to its reply of February 18, with reference to a petition, forwarded by us at that time and endorsed by numerous other or- ganizations, for the permanent maintenance as a "for- est park" of the Cross County Parkway right-of-way from Pine Brook Boulevard in New Rochelle to Saxon Woods Park in Mamaroneck. While undoubtedly you have become acquainted with the full file on the subject, we take this occasion, in view of the passage of time and current development of the County, to bring the matter to your attention, enclosing copies of the original correspondence and of a reportto supporting organizations which supported the position. We wish again to record with you and with the appro- priate authority having cognizance of the situation our continuing and intense interest in maintaining undistur- bed the natural beauty of the area and to express our confidence that, in the event of a possible, contem- plated change in status; the Commission would notifyus through you in advance in the manner in which Mr. Haight stated it would do. We will appreciate your assurance of this. " A carbon copy of this letter was sent to the Honorable George Burchell, Supervisor, Town of Mamaroneck. 2) Letter addressed to Mrs, George E. Stewart by Charles E. Pound, General Superintendent, Westchester County Park Commission, under date of June 2, 19590 "We acknowledge your letter of May 28, 1959 enclosing a copy of your letter dated January 11, 1954 pertaining to the maintenance of Cross County Parkway right-of-way in New Rochelle and Mamaroneck as a "forestpark". As you request, we will be very happy to in- form you of the proposed future of this area at such time as this decision is made," 3) Letter addressed to Supervisor Burchell by Mrs. George E. Stewart, President of the Garden Club of Larchmont, under date of June 14, 1959. "Enclosed is a copy of a letter from Mr. Pound, in response to my letter of May 28th, re. Cross County Parkway right-of-way in New Rochelle and Mamaroneck. Thought you might like to have this for your file. " REPORT OF THE TOWN ATTORNEY 1. Parking Meter Ordinance The Attorney reported that the new ordinance was ready and recommended that a public hearing on amending the General Ordinances by adding such ordinance thereto be held at the next meeting of the Board. Whereupon, the Board directed that the hearing be held at the July 1st meeting with notice of hearing published and on motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that the Town Clerk be and he hereby is authorized to publish the following notice in the official newspaper of the Town of Mamaroneck, The Daily Times, not less than five days prior to the date fixed in the notices PLEASE TAKE NOTICE that the Town Board of the Town of Mamaroneck will hold a public hearing in the Council Room of the Weaver Street Fire House on Weaver Street at 8;15 p.m, on the 1st day of July, 1959 for the purpose of considering anamend- went to the General Ordinances of the Town of Mamaroneck, add- ing a new article to be known as the "Parking Meter Ordinance"; amending Chapter 11 of the General Ordinances as last amended March 4, 1959 and also the repeal of the parking meter ordi- nance adopted by resolution of the Town Board on November 24, 1954. The new parking meter ordinance shall contain in sub- stance provisions for the following; 1. Designate two off-street parking areas in the Town of Mamaroneck, the first of such areas being on the east side of Myrtle Boulevard approximately 228 feet between Vine Street and Wood Street extending southeast on Vine Street approximately 140 feet and southeast on Wood Street approx- imately 400 feet; and the second being on the northeast side of Wood Street approximately 182 feet from Myrtle Boule- vard and approximately 200 feet long between Wood Street and Cabot Road. These two parking areas are included in a lease between the County of Westchester and the Town of Ma- maroneck dated March 1st, 1959 for a term of 5 years from said date and were established as commuter parking areas by resolution of the Town Board adopted at a meeting held on October 3, 1956, which resolution was adopted subject to permissive referendum. 2. Provide for the installation regulating control, oper- ation and use of parking meters in these areas by designat- ing spaces within which motor vehicles may park, includ- ing placing on the surface, of lines or marks and placing parking meters next to the individual parking spaces. 3. Provide that such meters shall display a signal or sign showing legal parking upon the deposit therein of the sum of 25� for a period of 12 consecutive hours; and in the alternative upon the deposit therein of the sum of 5� for a period of 2 consecutive hours, such regulations to be in force from 7 a,m. to 7 p.m. , except Saturdays, Sundays and holidays, 4. Establish parking meter zones upon certain streets or highways in the Town of Mamaroneck adjacent to the New York, New Haven & Hartford Railroad station at Larchmont, i, e, on Myrtle Boulevard between Preston Street and Cabot Road and on Myrtle Boulevard between Wood Street and nine Street and on the south side of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue; provided parking on the south side of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue shall be angle parking; and provided that the parking meters where parking is provided on the streets shall display a signal or sign showing legal park- ing upon the deposit therein of 5� for a period of 2 hours, except Sundays and holidays, 5. Provide that all parking meters shall display a signal or sign showing illegal parking if the owner or operator of an automobile shall allow his vehicle to re- main parked beyond the parking time limit allowed for the coin inserted in the meter and that in such event the motor vehicle shall be considered to be parked in viola- tion of the ordinance. 6. Notice from Public Service Commission of public hearing on June 18, 1959 at 10:00 a.m. on West-Fordham Transportation Corp. petition for permission to extend routes between New Rochelle and Port Chester. OTHER BUSINESS Councilman Santoro -- Councilman Santoro suggested that the West-Fordham Trans- portation Corp, be requested to correct the poor condition of its signs on the poles along the bus route through the Town. Councilman Santoro further reported that the Engineer was working on the matter of the erection of the canopy at the Rail- road Station. Councilwoman Helwig -- Councilwoman Helwig reported that Mrs. Wright was re- moving shrubbery located near the fence along the Thruway at the dead end of Old Harmon Drive, And at this time, Councilman Santoro reported that the Town Engineer was working with Mr. Rauer, Engineer con- nected with the Thruway Authority, on the matter of the cor- ner of Laurel Avenue. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. U.S. Open Golf Tournament Commissioner Brush commended the Fire Department on its fine work at the U. S. Open at the Winged Foot Golf Club.
