CALL TO ORDER The Supervisor called the meeting to order at 8:15 p, m. PRESENT: Supervisor Burchell Councilman Santoro Councilman Kane Councilman Brush Councilwoman Helwig ABSENT: None ALSO PRESENT; Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Friedlander - Town Engineer Mr, Orsino - Comptroller Mr. Finson - Accountant Mrs. Brewer - Secretary APPROVAL OF MINUTES The minutes of the regular meetings of October 21st and No- vember 4th, 1959, and the special meeting of November 12th, 1959, were approved as presented. PUBLIC HEARING--ADOPTION OF 1960 BUDGET The Supervisor declared the hearing open and the Clerk presented the affidavits of publication and posting of the notice of hearing which appeared in the official newspaper of the Town of Mamaroneck, The Daily Times, on November 20th and 27th, 1959, and was posted in seven public places in the Town of Mamaroneck located within the said Town, and filed in the Office of the Town Clerk, together with a certified copy of the list of water arrears for the year 1959 as sub- mitted by the Westchester Joint Water Works No. 1. The Supervisor, noting the presence of certain dignataries, in- quired whether they wished to be heard in connection with the budget. Whereupon, Mayor John B. Coffinberry and Trustee Albert Gaynor of the Village of Larchmont and Village Manager William H. Johnson, Corporation Counsel Anthony Sansone and Treasurer-Clerk Armand Gianunzio of the Village of Mamaroneck testified warmly to the work of the Supervisor and Town Board in correcting certain inequitable Town and Village charges, particularly thanking the Supervisor for his leadership in the achievement of the necessary legislation to make such apportionment possible. On behalf of each of the Councilmen and himself, the Supervisor thanked the gentlemen for their kind words and for taking the time and trouble to attend the hearing and express their appreciation to the Town, and turning to the budget stated that he would present it by department, requesting that questions pertaining to a particular department be raised at the time that department is being discussed. The following persons were heard- --- George B. Butcher, President of the Murdock Woods Association Mr. Butcher requested the inclusion in the budget of ex- penditure figures to date in addition to the appropriation figures. He also queried the Recreation Department budget, recommending that this expense be watched very closely, William Fernschild -- Mr. Fernschild commended the Recreation Department on its program, observing that such activity promoted a les- sening of delinquency in a community. Mrs, Virginia Paige, President, Larchmont League of Women Voters Mrs. Paige commented on Permanent Personal Registration and the question of more Election Districts, Edward E. Meehan -- Chairman, Democratic Town Committee Mr. Meehan commented on the State Aid item, Whereupon, since no one else wished to be heard, on motion by Councilman Brush, seconded by Councilman Kane, it was unan- imously RESOLVED that the hearing be declared closed. And the following resolution was then offered by Councilman Brush and seconded by Councilwoman Helwig. Appointment of Officer to be in Charge of Bingo Following explanation by the Town Attorney and recommen- dation thereupon, on motion by Councilman Santoro, seconded by Councilman Brush, it was unanimously RESOLVED that Paul A. Yerick, Chief of Police, be and he hereby is appointed as the Officer au- thorized to execute and sign the findings and de- terminations for a Bingo license biled by the Veterans of Foreign Wars and to certify same to the Town Clerk, and to supervise the conduct of all games conducted by virtue of such license when issued. COMMUNICATIONS 1. Request of Samuel L. Apter to Construct Play Area The Clerk presented a letter from Samuel L. Apter of 20 Avon Road, Town, dated November llth, 1959, requesting _ permission to black top the area between the street and his property for 40 linear feet, on the Lancia Lane side of said property, such area to be utilized for a play area only. A memorandum to the Supervisor from the Superintendent of Highways under today's date stated that the area concerned was Town-owned property and that he did not feel he could recommend the granting of this request as the construction of such an area would spoil the appearance of this street. It was suggested that each member of the Board personally view the area in question and that the neighboring property owners be advised of this request and their feelings about same obtained. The Clerk therefore was directed to write the necessary letters and to advise Mr. Apter of the Board's ac- tion in this matter. 2. Notice--Public Service Commission (Con Edison Electric Ratesi The Clerk presented a notice from the Public Service Com- mission concerning the rates and charges of Con Edison for electric service, which was referred to the Town Attorneyfor his information and attention, and ordered received and filed. COMMUNICATIONS (Not on Agenda) The Clerk presented a letter from Dr. Victor J. Curtis, dated November 14th, 1959, stating that Mr. Frank O'Brien, Superintendent of Highways, had been under his care for the past three years suffering from a Duodenal Ulcer. He further stated that the type of work in the Town of Mamaroneck Mr, O'Brien performed for the Town with its attendant aggra- vation played a major part in the recurrence of the ulcer and recommended that a 30 to 60 day sick leave be granted to Mr, 011ki en and that if there were not real improvement at the expiration of this leave, Mr. OOBrien seek another type of employment permanently, Councilman Santoro then presented a communication addres- sed to him by Mr. OaBrien on December 2nd, 1959, reading as - follows; "On the basis of a letter from my physician, Victor J. Curtis, M. D. , of which you have a copy, I would ap- preciate your presenting my application for sick leave with pay for a period not to exceed thirty (30) days to the Town Board, Thanking you, I am" Whereupon, on motion by Councilman Santoro, seconded by Councilman Kane, it was unanimously RESOLVED that Frank Os Brien, Superintendent of Highways of the Town of Mamaroneck, be hereby granted sick leave with pay effective from Decem- ber 3rd, 1959 through December 31st, 1959. REPORT OF THE SUPERVISOR 1. Request for Engineering Study of Channel--Hommocks Area The Supervisor informed the Board that Councilman San- toro, the Town Engineer and he had visited with Congress- man Dooley to discuss the possibility of the Townes obtain- ing federal assistance for the proposed harbor improvement at the Hommocks area and requested, at Mr. Dooley's sug- gestion, that the Board authorize this request by resolution. Whereupon, on motion by Councilman Santoro, seconded by Councilwoman Helwig, it was unanimously RESOLVED that this Board hereby requests the .Honorable Edwin B. Dooley, M.G. , to assist the Town of Mamaroneck in obtaining the ap- proval of the proper Congressional Commit- tees for an engineering study of the feasibility and cost of extending a navigable channel to certain Town-owned property as shown on the attached map, _The Board directed the Supervisor to write Congressman Dooley on its behalf requesting him to use his good offices to further this request in every way possible 2) Change of Date for Organization.Meeting The Supervisor advised the Board that he would be leaving at noon on Wednesday, January 6th, and therefore that he would not be here for the Organization Meeting on that date. It was suggested that this meeting be held on Tuesday evening, January 5th, 1960 rather than on the 6th, and on motion by Councilman Santoro, seconded by Councilman Kane, it was unanimously RESOLVED that this Board hold the first regular meeting in January on Tuesday evening, January 5th, 1960, at 8:15 p.m. in the Council Room of the Weaver Street Firehouse. 3) Bus Service--Unincorporated Area The Supervisor, after advising the Board that he had been requested to look into the possibility of the operation of a franchise bus service in the unincorporated area, presented applications and schedules of Josephine Mastocciolo, doing business as Leonts Taxi Service, and Lindsay Charter Ser- vice, Inc, for the operation of such a service. .After discussion, the date of December 16th, 1959 was fixed for holding a public hearing on said applications, and on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED that the Town Clerk be and he hereby is authorized to publish notice of public hearing to consider the applications of Josephine Mastoc- ciolo, doing business as Leonzs Taxi Service, and Lindsay Charter Service, Inc, in the official newspaper of the Town of Mamaroneck, The Daily Times, at least ten (10) days prior to the date of hearing pursuant to Section 64, Paragraph 7 of Chapter 62 of the Consolidated Laws known as the Town Law and Sections 66 and 67 of Chap- ter 63 of the Consolidated Laws, known as the Transportation Corporations Law of the State of New York. SJ PC The Board directed that each member be furnished with a copy of the applications and schedules for his study, 4) Approval of Specifications for County Recreation Study The Supervisor requested the Board's pleasure regarding approval and acceptance of the specifications for the pro- - posed Land and Outdoor Facility Recreation Study for the un- incorporated area of the Town of Mamaroneck forwarded to him by Dr, Sal J. Prezioso, Superintendent of Recreation of the County, under date of November 13th, 1959, a copy of which was sent to each Board member for his consideration and study. Whereupon, on motion by Councilwoman Helwig, seconded by Councilman Brush, it was unanimously RESOLVED that this Board hereby approves and accepts the specifications for the proposed Land and Outdoor Facility Recreation Study for the un- incorporated area of the Town of Mamaroneck as presented by Dr. Sal J. Prezioso, Superintendent of Recreation of Westchester County, and hereby authorizes Dr. Prezioso to proceed with such study in accordance with the specifications as submitted. The Board directed the Supervisor to so notify Dr. Prezioso, commending him on the excellence of the said specifications. 51, Safe Deposit Box for the Town The Supervisor presented a memorandum addressed to him by the Accountant recommending that the Town procure a Safe Deposit Box, and on motion by Councilman Santoro, seconded by Councilman Brush, it was unanimously RESOLVED that the Town of Mamaroneck, Mamaro- neck, New York, be and it is hereby authorized and directed to procure a safe deposit box in The County Trust Company, Mamaroneck office, and that any two officers of said municipality shall have full ac- cess to said safe deposit box and full power in regard thereto as to the contents thereof.
