OF THE TOWN OF MAMARONECK, HELD MAY 20th, 1959,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE

The Supervisor called the meeting to order at 8815 p. m.

APPROVAL OF MINUTES
The minutes of the special meeting of March 12th, 1959 and
the regular meeting of April 1st, 1959, were approved as pre-
sented. The minutes of the special meeting of April 4th, 1959,
were approved as corrected.
PUBLIC HEARING--APPLICATION OF EDWARD M. GEARY
AND HENRY MUNTER
After the Clerk presented the affidavit of publication on May
9th, 1959 in the official newspaper of the Town of Mamaroneck,
The Daily Times, of the Notice of Hearing on the application of
Edward M. Geary and Henry Munter, d/b/a Paramount Taxi
Service, for permission to operate a motor bus from the Ma-
maroneck Railroad Station to the Winged Foot Golf Club during
the period of the National Open Golf Tournament to be held
from June 11th to 13th inclusive, the Supervisor declared the
hearing open and inquired whether any one present wished to
be heard on the matter. Since there were none who wished to
be heard, on motion by Councilman Kane, seconded by Coun-
cilman Brush, it was unanimously .
RESOLVED that the public hearing be and it is
hereby declared closed,
And thereupon, on motion by Councilman Santoro, seconded
by Councilwoman Helwig, the following resolution was unani-
mously adopted.
WHEREAS, Edward M. Geary and Henry Munter,
doing business as Paramount Taxi Service, have
applied to this Board for permission to operate a
motor bus from the Mamaroneck Station of the
--- New York, New Haven & Hartford Railroad to the
Winged Foot Country Club, part of which route is
in the Town of Mamaroneck, as a contract carrier
of passengers for the period from June 11, 1959 to
June 13, 1959, both inclusive, for the accommo-
dations of persons going to and from the National
Open Golf Tournament to be held on said dates;
and
WHEREAS, the said Edward M. Geary and Henry
Munter have applied to the Public Service Com-
mission of the State of New York for a permit un-
der Section 160 of the Public Service Law;
and
WHEREAS, a notice was duly published for a pub-
lic hearing to be held this day by the Town Board
of the Town of Mamaroneck as provided in Section
64, paragraph 7 of the Town Law;
NOW, THEREFORE, BE IT
RESOLVED that permission is hereby granted to
Edward M. Geary and Henry Munter, doing bus-
iness as Paramount Taxi Service, for the opera-
tion of a motor vehicle or bus as a contract car-
rier for passengers for the period from June 11,
1959 to June 13, 1959, both inclusive, over that
part of Fenimore Road in the Town of Mamaro-
neck from the Village of Mamaroneck boundary
line to the Winged Foot Country Club, provided, '
however, that a permit be obtained from the
Public Service Commission for such operation
and that if the Public Service Commission au-
thorizes such operation that it be upon the terms
and conditions specified in the order or regula-
tion of the Public Service Commission pertaining
to such operation,
PUBLIC HEARING--PROPOSED AMENDMENT TO BUILDING CODE
The Clerk presented the affidavit of publication in the official
newspaper of the Town of Mamaroneck, The Daily Times, on
May 9th, 1959 of the Notice of Hearing on the adoption of an
amendment to the Building Code or Zoning Ordinance of the Town
of Mamaroneck by adding thereto a new Article to be known as
Article 23 entitled, "Family Swimming Pools", and the Supervi-
sor, after explaining briefly the purpose and reason for the pro-
posed amendment, declared the hearing open and inquired if
any one present wished to be heard on the matter.
Since there was no one who wished to be heard, on motion
by Councilman Brush, seconded by'Councilman Kane, it was
unanimously
RESOLVED that the hearing be and it hereby is
declared closed.
Whereupon, on motion by Councilman Santoro, seconded
by Councilman Brush, the following resolution was adopted
unanimously;
RESOLVED that the Building Code of the Town
of Mamaroneck originally adopted on April 27,
1937 and as last amended on October 19, 1955
is hereby amended so as to add thereto a new
article to be known as Article 23, entitled
FAMILY SWIMMING POOLS to read as follows.
ARTICLE 23 FAMILY SWIMMING POOLS
Section 1, The term, "Family Swimming Pools",
shall mean a non-commercial swim-
ming, bathing or wading pool to be
used solely by the owner or lessee
thereof and by his family and by
friends invited to use the pool with-
out payment of any fee,
Section 2, A family swimming pool may be con-
structed and maintained only after a
special permit therefor has been ob-
tained from the Town Board of the
Town of Mamaroneck.
Section 3. Application for such special permit
shall be made in the first instance to
the Building Inspector of the Town of
Mamaroneck who shall furnish the
necessary forms for such application
and specifications and data for the
construction of such swimming pool
shall be submitted with such applica-
tion including but not limited to
(1) A profile showing levels and
depths of water at all points;
(2) Cross sections showing scum
gutters or skimmers with all
structural details;
(3) Pipe diagram showing size
and location of all inlets, out-
lets, water lines, waste and
discharge lines, circulation
and other piping;
(4) Pool equipment showing detail of
filters, pumps, chlorinators,
strainers, hair and lint inter-
ceptors;
(5) Drains and drainage from the pool
structure to a sanitary sewer.
Section 4, The Town Board, upon receipt of the applica-
tion from the Building Inspector togetherwith
all plans, data and other material requiredby
him, may grant the permit after determining
(1) That the location of the pool is such that
it will not adversely affect any neigh-
boring premises, property or struc-
tures;
,(Z� That the lighting provided is installed
in such a way that it will not create a
nuisance or annoyance to adjoining
property owners;
(3) That suitable screening and/or land-
scaping has been provided between
the property or streets;
(4) That every outdoor pool shall be sur-
rounded by a fence or wall sufficient
to protect it from entry or trespass
by children or other persons when
the pool is not in use;
(5) That all equipment shall be so con-
structed that it may be used without
causing any noise or disturbance to
persons residing adjacent to or near
the pool;
(6) That in all other respects the pool
shall be free from any objection on
the ground of safety or health and
welfare of the community and the
surrounding neighborhood and it
complies with all provisions of the
Sanitary Code of the County of West-
chester and the Sanitary Code es-
tablished by the Public Health Coun-
cil of the State of New York so far as
any of the provisions of such Code
may be applicable.
Section 5. Except as otherwise provided in this article,
the provisions of the Zoning Ordinance of
the Town of Mamaroneck so far as they ap-
ply to structures with respect to front, rear
and side yards shall be applicable, except
that the Town Board may modify any such
provisions as it considers necessary in
order to make its determination under
Section 4 above.
Section 6, The special permit issued by the Town
Board for a family swimming pool shall
be subject to revocation if the pool is
maintained in such a way that it consti-
tutes a nuisance, or that it is not in the
best interests of the surrounding prop-
erty on the basis of health, safety or
welfare of the persons residing adjoin-
ing or near said pool. Before such rev-
ocation the Town Board shall give notice
to the owner or lessee that he may be
heard in connection with such revoca-
tion at a meeting of said Board to beheld
at a time and place to be specified in
said notice Such notice shall be served
on the owner or lessee personally at
least 10 days prior to such meeting.
Section 7. The special permit required by this ar-
ticle for family swimming pools shall be
in lieu of the permit otherwise required
by Article 1, Section 3 of this Code but
shall be subject to the payment of the
same fees required by Section 20 of Ar-
ticle 1 of this Code.
OLD BUSINESS
a. Report on Request to Erect Fence--Wilbur F. Burt, Jr.
4 Senate Place, Town
In connection with the request of Wilbur F. Burt, 1Tr, for
permission to erect a stockade type fence on his property
located at 4 Senate Place, Town, upon the Clerk's report
that there were no objections to this request, on motion by
Councilman Brush, seconded by Councilwoman Helwig, the
following resolution was adopted unanimously.
WHEREAS Wilbur F. Burt, Jr. heretofore re-
quested a permit for the erection of a 5-foot
high stockade type fence on the back side of
his property located at 4 Senate Place Town ex-
tending 49 feet from the rear between his prop-
erty and that of Mr. George Kollanse at 2 Sen-
ate Place, Town, which property is known as
Block 112, Parcel 638 on the Assessment Map
of the Town of Mamaroneck; and
WHEREAS the Building Inspector refused to
grant such permit on the ground that construc-
tion or erection of such fence violated the pro-
visions of Section 112, Article 21 of the Build-
ing Code; and

WHEREAS Mr. Burt has appealed to this Board
for modification of the Building Inspector's de-
cision pursuant to Section 23, Article 1 of the
_ Building Code so as to allow erection of said
fence;
NOW, THEREFORE, BE IT
_ RESOLVED that permission is granted to Wil-
bur F. Burt, Jr, to erect a 5-foot high stockade
type fence on the back side of his property lo-
cated at 4 Senate Place, Town, extending 49
feet from the rear between his property and
that of Mr, George Kollanse at 2 Senate Place,
Town, which property at 4 Senate Place is
known as Block 112, Parcel 638 on the Assess-
ment Map of the Town of Mamaroneck,
The Clerk was thereby directed to so notify Mr. Burt,
b, Report on Request to Erect Fence--Thomas M. Pierce
1 Bruce Road, Town
In connection with Mr. Pierc0s request presented at the
last meeting for permission to erect a 6-foot high stockade
fence around one-half of his property on the sides facing
Old -V,hite Plains Road and bordering the property of
Richard Tannous and a split rail fence on the side border-
- ing the property of Louis P. Heyman, said split rail fence
to be erected with chicken wire, the Clerk reported as
follows:
Objection -- Richard Tannous, 1036 Old White Plains Road
No objection provided chicken wire on Mr. Pierce's side
of proposed split rail fence -- LaDwis Kaye, 6 Bruce Road
In view of this report, the Board directed the Clerk to
put the matter over to the next meeting and to so notify Mr.
Pierce requesting him to try to effect a mutually agreeable
solution to the problems raised in the meantime,
NEW BUSINESS
a, Reappointment of William B. Arthur to Recreation Commission
Upon the Supervisor's advice of the expiration of Mr.
Arthur's term of office on the Recreation Commission and
of his willingness to again serve, on motion offered by
Councilwoman Helwig with highest commendation of Mr.
Arthur's work and seconded by Councilman Santoro with
added words of praise, it was unanimously
RESOLVED that William B. Arthur be and he

hereby is reappointed as a member of the
Town of Mamaroneck Recreation Commis-
sion to serve for a term of five years, ef-
fective immediately and to run until May
20th, 1964,
COMMUNICATIONS
a, Request of Village of Larchmont for Town to Adopt Sign Or-
dinance Comparable to That of Larchmont Village
and
b, Letter Referring to Village of Larchmont Sign Ordinance Re-
quest--John W. Sherman, 61 Echo Lane, Town
The Clerk read a communication from the Board of Trus-
tees of the Village of Larchmont, dated May 6th, 1959, re-
questing that the Town give immediate attention to adopting
a sign ordinance comparable to that in effect in the Village
of Larchmont, and a communication from John W. Sher-
man, dated May 12th, 1959, written in reference to this
request and favoring the present Town ordinance and its
continued use.
Following discussion, the Board directed that these com-
munications be referred to the Planning Board for study
and report.
c. Request for Permission to Erect Fence--Alton S. Tobey
296 Murray Avenue, Town
The Clerk presented a request from Alton S. Tobey of
296 Murray Avenue, Town, for permission to erect a
7 -foot high fence as shown on sketch and plot plan en-
closed around a patio at the back of his home.
The Board directed the Clerk to follow the usual pro-
cedure, scheduling the matter on the agenda for the next
meeting and meanwhile notifying adjoining property ow-
ners of the request and allowing time for the members of
the Board to view the site of the proposed fence.
d. Request for Permission to Erect Fence--Joseph V. Santoro
31 Harmon Drive, Town
The Clerk presented a request from Joseph V. Santoro
of 31 Harmon Drive, Town, under date of May 14th, 1959,
for permission to erect a stockade fence 5 feet high along
the easterly property line of his premises.
The Board directed the Clerk to follow the usual pro-
cedure putting the matter on the agenda for the next meet-
ing and notifying the neighboring property owners of the

of the Board to view the site of the proposed fence,
e. Letter from Pinebrook District Property Owners
Association--Enforcement of Zoning Laws in Harrison
Drive Area
- The Clerk read a letter dated May 11, 1959 written
under authorization by resolution of the board of direc-
tors of the Pinebrook District Property Owners Asso-
ciation, Inc, favoring vigorous and immediate enforce-
ment by the Town of the Zoning Ordinance in the Har-
rison Drive area, which the Board ordered received
and placed on file,
f. Notice of Approval of Petition of West-Fordham Trans-
portation Corp. --Public Service Commission
The Clerk announced receipt of a Notice from the Pub-
lic Service Commission granting and approving petition
of West-Fordham Transportation Corp, for the temporary
operation of an omnibus line between New Rochelle and
Port Chester, Westchester County, which was received
and placed on file,
COMMUNICATIONS (Not on Agenda)
1) Request to Erect Fence--Mrs. Kalter E. Godfrey
202 Hickory Grove Drive, Town
The Clerk presented a request from Mrs. Kalter E. God-
frey, dated May 18, 1959, for permission to erect a solid
type fence, 6 to 7 feet high along the property line of her
property parallel to the Thruway and located at 202 Hickory
Grove Drive, Town.
The Board directed the Clerk to follow the usual pro-
cedure putting the matter on the agenda for the next meet-
' ing, notifying the adjoining property owners of the request
and allowing time for the members of the Board to viewthe
site of the proposed fence.
2) Request to Erect Fence--Casper J. Fishback
42 Colonial Avenue, Town
The Clerk presented a request from Casper J. Fishback,
dated May 18th, 1959, for permission to erect a fence of
six foot louvered sections, 6 feet high, mounted on 4 x 4
posts along part of the back line of his property at 42 Co-
lonial Avenue.

The Board directed the Clerk to follow the usual pro-
cedure putting the matter on the agenda for the next
meeting, notifying the adjoining property owners of the
request, and allowing time for the members of the Board
to view the site of the proposed fence,
3) Salary Increments --Memorandum from Accountant
The Clerk presented a memorandum from the Town Ac-
countant, dated April 19th, 1959, requesting authorization
for payment of salary increases to the employees listed
in accordance with the Townts Compensation Plan,
Whereupon, on motion by Councilman Kane, seconded
by Councilman Brush, it was unanimously
RESOLVED that this Board hereby authorizes
payment of salary increases to the following
employees in accordance with the Compensa-
tion Plan of the Town of Mamaroneck and to
be effective as of the various dates shown
below:

REPORT OF THE SUPERVISOR
1) Request to Thruway (Construction of Walk by Mancini Garage)
The Supervisor reported that the Thruway Authority had
written the Town Engineer requesting certain papers and
documents in connection with the Town's request for per-
mission to construct a pedestrian walk along Mancinits
Garage and stated that if it were the Board's pleasure,
said papers would be filled out and returned for formal
consideration of the request,
The Board so directed the Supervisor.
2) Communication from Town Democratic Committee re Rent
Control
The Supervisor read a communication received from
Edward P. Meehan, Chairman of the Town of Mamaroneck
Democratic Committee, under date of May 18, 1959, en-
closing a resolution adopted by that Committee requesting
retention of residential rent controls.
Upon inquiry by the Supervisor, the Town Attorney ad-
vised the Board that no action was required since such con-
trols had been frozen by legislation,
3) Parking Plaza
The Supervisor reported that Mr. Bozell had informed
him that only the connection of a fire hydrant was holding up
the opening of the plaza.

1) Apportionments
Councilman Kane presented the following petitions received
from the Assessor for the correction of the assessment roll
so as to permit the apportionment of taxes, and on motion by
him, seconded by Councilman Brush, the following resolution
was adopted unanimously.
WHEREAS the Assessor has presented petitions for
the correction of the assessment roll for certain
years pursuant to the provisions of Section 557, Ar-

Councilman Brush --
1) Letter from Police Commission
Councilman Brush presented a letter from the Police Com-
mission, dated May 19, 1959, requesting authorization for
payment of the expenses of Police Officers James Knox
and Nicholas Giacomo while attending a refresher course
in maintenance and repair of the Dual parking meter in
Hempstead Village Hall on May 21st and 22nd, and on
his motion, seconded by Councilwoman Helwig, it was
unanimously
RESOLVED that this Board hereby authorizes
the payment of expenses in an amount not to
exceed the sum of $8, 00 for Police Officers
James Knox and Nicholas Giacomo while at-
tending a refresher course in maintenance
and repair of the Dual parking meter at the
Hempstead Village Hall on May 21st and 22nd,
1959: said expenses to be paid from the item
in the Police budget established for such
purpose,
2) Report on Police Action
Councilman Brush paid tribute to Lt, Waterbury, Det,
Lovely, and Officers Welsh and Celestino for their fine job
in arresting three mental institution escapees who had
robbed a Mamaroneck gasoline service station in the early
hours of yesterday morning and stated that he felt such ser-
vice merited commendation,
The Supervisor thanked Councilman Brush for bringing
this before the Board and said he would discuss the matter
of commendation with the Police Chief,
Councilwoman Helwig --
1) Letter from Recreation Commission
Councilwoman Helwig read the following letter addressed
to the Town Council by the Recreation Commission under
date of May 18, 19590
"We write to advise you that at the meeting of May 11th,
1959, the Recreation Commission adopted the following
resolution:
RESOLVED, that the Recreation Commission recom-
mend to the Town Council that the area on the north
side of Myrtle Boulevard, adjacent to Carl's Restau-
rant, now being used as a temporary parking lot, be
reserved and set aside for the establishment of a
recreational facility by the Town of Mamaroneck.
We have directed the Superintendent of Recreation to take
advantage of the available free services of the Westchester
County Recreation Commission to make a survey and pre-
liminary diagram showing how this area can best be utilized
as a year-round recreation facility. We shall of course keep

you advised of the progress of the survey.
We are aware that legal problems may exist in that the
Town has only a five year lease. Accordingly, we be-
lieve that this matter should also be referred to the Town
Attorney, John Delius, Esq., for his opinion and are en-
closing an extra copy of this letter. "
The Board, at the suggestion of Councilman Kane,
directed that the County Recreation Commission be re-
quested to prepare a survey containing two plans; one based
on the use of the whole property for recreational purposes
and one based on the use of only a part of such property for
such purpose.
Z) Golf Tournament
Councilwoman announced that the annual Golf Tournament
would be held on June 8th and that a large attendance was
anticipated.
3) Park Commission
Councilwoman Helwig reported that the Park Foreman, at
the last meeting of the Commission, had stated that he was
still dissatisfied with the grading done by the Thruway. The
Supervisor referred this matter to the Town Engineer for
attention.
Councilwoman Helwig also advised that the Commission
called to the Board's attention the now completed replanting
of the two plots of ground at the Weaver Street and Myrtle
Boulevard entrance to Larchmont Gardens.
REPORT OF THE TOWN ATTORNEY
lj Zoning Violations--Harrison Drive
The Attorney reported that property owners on Harrison
Drive had been formally notified that if existing violations of
the zoning ordinance were not remedied in ten days, civil
action would be brought by the Town.
Z) Lease--Larch Motor Sales, Inc.
The Attorney reported that the lease for the rental of cer-
tain Town-owned property to Larch Motor Sales, Inc. was
ready and requested that the Supervisor be authorized to ex-
ecute the same.
Whereupon, on motion by Councilman Kane, seconded by
Councilman Brush, it was unanimously

RESOLVED that the Supervisor be and he here-
by is authorized to execute the lease between
the Town of Mamaroneck and Larch Motor Sales,
Inc, covering the rental of part of the premises
known and described as Block 411, Parcel 76 on
the Tax Assessment Map of the Town of Mamar-

3) Amendment of Zoning Ordinance
The Town Attorney, explaining that it was necessary to
amend the Zoning Ordinance so that it would conform with
the Building Code in providing for the construction and
maintenance of family swimming pools in "AA'' and "A"
Residence Districts, requested that the Clerk be author-
ized to publish the Notice for a public hearing to be held
at the next meeting of the Board for the consideration of
such amendment.
Whereupon, on motion by Councilman Santoro, seconded
by Councilman Kane, it was unanimously
RESOLVED that the Town Clerk be and he here-
by is authorized to publish the following notice
in the official newspaper of the Town of Mamar-
oneck, The Daily Times.
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that the Town Board of the Town of
Mamaroneck will hold a public hearing on the 3rd day of June,
1959, at 8.15 P.M. in the Council Room of the Weaver Street
Firehouse on Weaver Street and Edgewood Avenue in the Town
of Mamaroneck, Westchester County, New York, to consider
an amendment to the Zoning Ordinance of the Town of Mamaro-
neck with particular reference to Article II, Section 3, Subdi-
vision 7 (accessory uses) so as to provide under this subdivi-
sion that a family swimming pool shall be permitted in Resi-
dence Districts "AAp1 and "A°` as provided in Article 23 of the
Building Code of the Town of Mamaroneck,
PLEASE TAKE FURTHER NOTICE that all persons inter-
ested will be given an opportunity to be heard,

4) Parking Areas QParking Meter Ordinance)
The Town Attorney advised with reference to the construe-
tion of the parking areas at the Station that it would be neces-

sary to adopt a new parking meter ordinance which, un-
der the law, came under the jurisdiction of this Board
rather than the Police Commission. He further stated
that he had written to the Police Department requesting
its suggestions and recommendations and that he would
report further at the next meeting of the Board,
OTHER BUSINESS
Upon the Supervisor's inquiry as to whether there was any
further business to be brought before this meeting, Mr,
Richard Murphy of 31 Edgewood Avenue, Town, addressed the
Board with reference to the following two matters:
First -- The flag not flying on Saturdays and Sundays at
Town Park,
The Supervisor advised that he would inquire
of the Park Department immediately regarding
this and report thereon,
Second -- The broken windows at the Incinerator which
had not been replaced and were unsightly and
ill looking,
The Town Engineer advised that this matter
was under correction at this time.
ADJOURNMENT
There being no further business to come before the meeting,
it was declared adjourned at 9:00 p.m. , to reconvene on June
3rd, 1959,

Commissioner Brush presented the following Fire De-
partment claims which had been audited by the Comp-
troller and approved by the Fire Chief, and on his motion
which was seconded by Commissioner Helwig, it was
unanimously
RESOLVED that the following claims be and
they hereby are approved and the Supervisor
and Comptroller be and they hereby are au-
thorized to pay the same out of the budget
for the Fire Department:
