MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD MARCH 4th, 1959,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

APPROVAL OF MINUTES
The minutes of the regular meeting of February 4th, 1959
were approved as presented.
PUBLIC HEARING--REPEAL OF CHAPTER II AND ENACT-
MENT OF NEW CHAPTER II, GENERAL
ORDINANCES
At the request of the Supervisor, the Clerk presented the
affidavit of publication of the notice of hearing as published
in the official newspaper of the Town of Mamaroneck, The
Daily Times, on February 21st, 1959.
The Town Attorney reviewed briefly the reasons for the
repeal of the present Chapter II and enactment of a new
Chapter II of the General Ordinances of the Town of Ma-
maroneck, stating that the enactment of Chapter 698 of the
Laws of 1957, effective July 1st, 1958, authorized the
transfer of certain powers to the Board of Police Com-
missioners with the exception of those powers pertaining
to full-stop signs, yield right-of-way signs, maintenance
of traffic control signs, and installation and operation of
parking meters. He further stated that in this Ordinance
all those matters which could be delegated to the Police
r ;
Commission had been so delegated; that the Ordinance
provided for full-stop signs and yield-right-of-way
signs; but that the matters of traffic control and park-
ing meters had been reserved.
The Supervisor then declared the hearing open and
inquired whether anyone present wished to be heard on
this matter.
As no one wished to be heard, on motion by Council-
man Brush, seconded by Councilman Santoro, it was
unanimously
RESOLVED that the hearing be and it is
hereby declared closed.
Whereupon, on motion by Councilman Brush which
was seconded by Councilman Kane, the following resolu-
tion was adopted unanimously:
RESOLVED that the present Chapter II (Use of
Streets and Highways) of the General Ordinances
of the Town of Mamaroneck is repealed and a
new Chapter II is hereby enacted which shall
read as follows:
CHAPTER II
Regulation of traffic, use of
streets and highways.
Section l - The Police Commission of the Town of Mamaro-
neck is hereby designated pursuant to subdivi-
sion "ell of Section 1603 of the Vehicle and Traffic Law of the
State of New York, with respect to highways outside of Villages,
to
1. Upon a roadway which is divided into three lanes, allo-
cate the center lane exclusively for traffic moving in a
specified direction.
2. Order signs erected directing slow-moving traffic,
trucks, busses or specified types of vehicles to use a
designated lane, or with signs, signals or markings
designate those lanes to be used by traffic moving in a
particular direction regardless of the center of the
roadway.
3, Designate no-passing zones and indicate such zones in
accordance with the standards, minimum warrants and
sign or marking specifications established by the state
traffic commission,
4. Regulate or prohibit processions, assemblages, or
parades. Whenever such a procession, assemblage or
parade authorized by said Commission will block the
movement of traffic on a state highway maintained by
the state, or on a highway which connects two state
highways maintained by the state to make a through
route, for a period in excess of ten minutes, said
Commission must, prior to such blocking, provide and
designate with conspicuous signs a detour adequate to
prevent unreasonable delay in the movement of traffic
on said state highway maintained by the state,
5. Prohibit or regulate the operation and the stopping,
standing or parking of vehicles in cemeteries and in
public parks.
6. Provide for the removal and storage of vehicles parked
or abandoned on highways during snowstorms, floods,
fires or other public emergencies, or found unattended
where they constitute an obstruction to traffic or any
place where stopping, standing or parking is prohibited
and for the payment of reasonable charges for such re-
moval and storage by the owner or operator of any such
vehicle.
7. Prohibit, restrict or regulate the operation of vehicles
on any controlled-access highway or the use of any con-
trolled-access highway by any vehicle, device moved by
human power or pedestrian.
8. Prohibit or regulate the turning of vehicles or specified
types of vehicles at intersections or other designated
locations.
9. Regulate the crossing of any roadway by pedestrians.
10. Designate any highway or any separate roadway thereof
for one-way traffic.
11. Exclude trucks, commercial vehicles, tractors,
tractor-trailers and trucks in excess of a total gross
weight of 10, 000 pounds from designated highways.
12. Designate safety zones.
13. Prohibit, restrict or limit the stopping, standing or
parking of vehicles.
Section 2 - Section 1 of this ordinance shall not be effective
until signs or markings giving notice as provided
in Section 1683 of the Vehicle and Traffic Law are posted, such
!, --- signs or markings to conform in all respects with the provisions
of Section 1682 of the Vehicle and Traffic Law.
Section 3 - The following intersections are hereby designated
pursuant to Section 1660, subdivision 1 of the
Vehicle and Traffic Law as "stop intersections" and stop signs
conforming in all respects with the provisions of Sections 1682
and 1683 of the Vehicle and Traffic Law are hereby ordered
posted at such intersections;

Section 4 The following intersections are hereby designated
"yield intersections" and yield right-of-way signs
are hereby ordered posted at said intersections, which shall con-
form with the provisions of Sections 1682 and 1683 of the Vehicle
and Traffic Law:
Intersection of Preston Street and Myrtle Boulevard
Intersection of Eagles Knolls Drive and Hommocks Road
Intersection of Clover Street and Fernwood Road, both sides
Intersection of Hickory Grove Drive and Rocky Road
Intersection of Old Weaver Street and Palmer Avenue
On the northwest corner of the intersection of Dundee Road
and Avon Road
Intersection of Maple Hill Drive and Orsini Drive
Intersection of Sheldrake Avenue and Forest Avenue
Intersection of Winged Foot Drive and Rockland Avenue

Section 5 Violations of Sections 1 to 4 of this Chapter are
hereby declared to be traffic infractions and to be
punishable as provided in Section 1800 of the Vehicle and Traffic
Law.

Section 6 - TRUCKS: Every vehicle used to transport
dirt, manure, sand, gravel, ashes, mud, gar-
bage, swill, offal, etc. in the public streets of the Town of
Mamaroneck, outside of the Villages of Larchmont and Ma-
maroneck, shall be so constructed or loaded as to prevent any
portion of the contents from escaping therefrom. No vehicle
used to transport dirt or soil shall be operated or driven so
as to permit dirt or mud to adhere to the wheels and be de-
posited in the public streets of the Town of Mamaroneck, out-
side of the Villages of Larchmont and Mamaroneck. Anyper-
son, being the owner or operator of any such vehicle or truck,
shall at the end of each working day remove any dirt, manure,
sand, gravel, ashes, mud, garbage, swill, offal, etc. dropped
from any such vehicle or truck on the public street or highway.
Section 7 - COASTING: No person shall coast with hand
- sleds, bob sleds, carts or other vehicles on
wheels or runners upon any sidewalk.
Section 8 - CROSSWALK: No vehicles or animal or push-
cart, baby carriage or other device moved by
human power shall stop or stay on any crosswalk or driveway.
Section 9 - PARADES: All parades in the streets of the
Town of Mamaroneck outside of the Villages of
Larchmont and Mamaroneck, and the playing of bands of mu-
sic, and exhibitions of any kind in said streets are prohibited
without a written permit from the Town Board.
Section 10 No person shall deface, injure, move or inter-
fere with any sign, standard or signalling device
installed for the purpose of directing, restricting or regulating
traffic, and no person shall place or display a sign of any sort
attempting to regulate traffic or parking on a public street.
FURTHER RESOLVED that the foregoing
resolution shall be posted and published
as provided by law.
OLD BUSINESS
a. Report--Bids for Purchase of Tires
The Clerk presented the following memorandum addressed
to the Supervisor by Town Accountant Finson under date of
March 4th, 19590
"Re. Bids for Tires
I have reviewed the bids for tires submitted by Sound
Tire and Supply Company and Levitan.
Excluding the 500x16 motorcycle tires, I find that of
the nine sizes listed, the bids were identical in three
of the sizes and that Sound Tire was lower for the
other six sizes.
While it would be preferable to deal with just one sup-
plier and that was the intent in the preparation of the
bid notice, no such specific condition was mentioned.
Therefore I would recommend that in all sizes where
the bid price is identical or lower, Sound Tire and
Supply Co. be authorized to furnish the tires and tubes.
As Levitan is lower on 500x16 size tires, I recommend
that he be authorized to supply that size tire at the bid
price of $10. 15."
Whereupon, on motion by Councilman Kane, seconded by
Councilman Brush, it was unanimously
RESOLVED that the bids for the purchase of
tires and tubes for the Town of Mamaroneck
for the year 1959 be awarded as follows at
the prices specified.

b. Bids for Purchase of Police Cars
After considerable discussion of the two bids submitted for
the purchase of police cars, since one of the bids contained
an exception on the generator item of the specifications, it
was the concensus of opinion of the Board that both bids be
rejected and that the Clerk be authorized to readvertise for
bids to be opened at the March 18th meeting of the Board.
Whereupon, on motion by Councilman Brush, seconded by
Councilman Kane, it was unanimously
RESOLVED that the bids for the purchase of
three 2-door 1959 Sedans for the Town of Ma-
maroneck Police Department as submitted at
the February 18th, 1959 meeting of this Board
be rejected; and be it
FURTHER RESOLVED that the Clerk be and
he hereby is authorized to readvertise for
such bids by publication of the following no-
tice in the official newspaper of the Town of
Mamaroneck, The Daily Times:

Notice is hereby given that sealed bids will be received by the
Town Board of the Town of Mamaroneck until 5 o'clock on the 18th
day of March, 1959 at the Town Offices, 158 West Post Road, Vil-
lage of Mamaroneck, Mamaroneck, N.Y. , or until 8:15 p. m. at
the Council Room of the Weaver Street Fire House, Weaver Street,
Town of Mamaroneck, N.Y, and will be publicly opened at a regu-
lar meeting of the Town Board on February 18, 1959, at 8:15p.m.

c. Report--Bids for Purchase of Highway Dump Truck
Councilman Santoro reported that after the Highway Super-
intendent and he had carefully examined and reviewed the bids
submitted for the purchase of the highway truck, it was their
recommendation that the bid of Chulew Motor Sales be ac-
cepted as only two bids were submitted, Chulew and Mamaro-
neck Garage, and only that of Chulew met the specifications
and was heavy enough to perform the duty required of such a
truck.
Whereupon, on motion by Councilman Santoro, seconded by
Councilman Brush, it was unanimously
RESOLVED that this Board, with the approval of the
Town and County Superintendents of Highways, here-
by accepts the bid of Chulew Motor Sales to furnish
to the Town of Mamaroneck Highway Department one
(1) new 1959 Highway Dump Truck with Body and
Plow (GMC Model 633-A Special) equipped in accor-
dance with the specifications and including additional
equipment as stated in the specifications on file in
the Town of Mamaroneck Offices and as publishedin
the notice for bids, for a gross delivered price of
$11, 750. 00, less trade-in allowance of $2, 850, 00,
or the net delivered price of $8, 900. 00.
FURTHER RESOLVED that the Town Superintendent
of Highways is hereby authorized, subject to the ap-
proval of the County Superintendent of Highways, to
surrender to the above-named vendor one (11 1947
Brockway Dump Truck, Engine No. 42BX8950,
Serial No. 32347, as part payment.
NEW BUSINESS
a, Authorization for Collection of State and County Taxes
The Supervisor requested the usual resolution approving
collection of taxes by the Receiver of Taxes for the 1959
State, County, and Town taxes in two installments, andon
motion by Councilman Kane, seconded by Councilman Brush,
it was unanimously
RESOLVED that pursuant to Section 96-A of
Chapter 60 of the Consolidated Laws as amended,
known as the Tax Law, the Receiver of Taxes and
Assessments of the Town of Mamaroneck is au-
thorized to collect the 1959 State, County, Town,
and District taxes and water rents, which become
a lien January 1, 1959, in two partial payments,
each amounting to fifty per cent (5016) of the total
of said taxes and water rents,
FURTHER RESOLVED that the Receiver of Taxes
and Assessments is authorized and empoweredto
receive such partial payments or installments of
taxes and water rents at any time prior to the
sale of tax liens but subject to the same penalties
as are specified and provided in Section 542 of the
Westchester County Administrative Code for the
neglect to pay the total amount of said taxes and
water rents,
FURTHER RESOLVED that the acceptance of any
such partial payments or installments of the 1959
taxes and water rents shall not be deemed to af-
fect in any manner any right of the Town of Ma-
maroneck under any general or specific law to en-
force collection of any unpaid balance of such
taxes and water rents as may remain due and ow-
ing to the Town of Mamaroneck, but such rights
and powers shall remain in full force and effectto
enforce the collection of the unpaid balances of
such taxes and water rents together with interest,
penalties, and other lawful charges.
And, on motion by Councilman Kane, seconded by Council-
man Brush, it was unanimously
RESOLVED that in accordance with the provisions
of Section 550 of the Westchester County Adminis-
trative Code, "The Daily Times", the official news-
paper published in the Village and Town of Mamaro-
neck, be and it hereby is designated as the news-
paper in which the Receiver of Taxes and Assess-
ments shall publish the Notice of the Collection of
State, County, Town, and District Taxes and Water
Rents; and be it
FURTHER RESOLVED that said publication be made
on March 18th, 1959 in The Daily Times; and be it
FURTHER RESOLVED that in accordance with the
provisions of Section 550 of the Westchester County
Administrative Code, the Town Board does hereby
direct the Receiver of Taxes and Assessments to
mail to each taxpayer of the Town of Mamaroneck,
whose address is known to said Receiver of Taxes
and Assessments, a tax bill for all taxes and water
rents, the expense thereof to be a Town charge.
COMMUNICATIONS
a, Request of Receiver of Taxes for Cancellation of 1958 Town
Tax on Block 131 - Parcel 53, Acquired by the Thruway
The Clerk presented a communication from Henry R.
Dillon, Receiver of Taxes, dated February 25th, 1959,
requesting cancellation of the Town tax on property ac-
quired by the New York State Thruway prior to April 1,
- 1958, the lien date of the 1958 taxes, and on motion by
Councilman Kane, seconded by Councilman Brush, it
was unanimously
RESOLVED that the 1958 Town tax in the
amount of $26.79, which became a lien on
April 1, 1958 upon premises known as
Block 131 - Parcel 53 on the Tax Assess-
ment Map of the Town of Mamaroneck,
which property was acquired by the New
York State Thruway Authority prior to
April 1, 1958, be cancelled,
COMMUNICATIONS (Not on Agenda)
a. Communication from Hory Chevrolet Co,
The Clerk read the following communication from Thomas
J. Hory of Hory Chevrolet Co„ dated March 4th, 1959°
"Recently I was granted a variance to erect a car port,
which is a temporary open structure which acts as a
cover for a row of used cars, to be erected in the
front of our dealership on the Boston Post Road.
This structure is to run approximately 160 feet in
length and I respectfully request your approval to al-
low this to extend on to the Town property, which we
are now renting from the Town and on which we are
presently displaying used cars, As I stated, it is a
temporary structure and I would be very willing tore-
move any or all part of such structure within 30 days
if the Town needed the property.
I regret that I can not be at this meeting in person
due to a previous commitment which I could notbreak.
I would have made other arrangements to be present
if I had known in time that this question was to arise.
I hope this request may be granted and thank you for
_ your consideration in the matter. "
The Board, after discussing the matter and consulting with
the Town Attorney, on motion by Councilman Santoro, sec-
onded by Councilman Brush, unanimously
RESOLVED that the Town Attorney be and he
he hereby is authorized to negotiate an agreement
with Thomas J. Hory granting permission to
Thomas J. Hory to occupy the portion of the street
known as Ferndale Place adjoining your property
to the east for a used car lot including the con-
struction of a shed or car-port in accordance with
plans submitted to and variance granted by the
Board of Appeals on February 25th, 1959, subject
to the following conditions:
1) This permit is revocable on thirty (30) days no-
tice in writing addressed to Thomas J. Hory,
Hory Chevrolet Co. , Boston Post Road at Wea-
ver Street, Larchmont, New York.
2) Payment of the sum of $50. 00 per month shall
be made by the lesee, Thomas J. Hory, to the
Town of Mamaroneck on the first (1st) day of
each month.
3) Upon revocation of this permit, the lesee,
Thomas J. Hory, shall remove all structures
on the premises which are the subject of this
permit.
b. Report on Zoning Violations--Town Engineer
The Attorney presented a report submitted by the Town
Engineer under date of March 3rd, 1959, in connection with
the alleged violations of the Zoning Ordinance stated in a
letter from Daniel Ciofoletti of 7 Ferndale Place which was
referred to him.
The Board ordered the report received and placed on
file and directed the Engineer to continue his investigation
and to submit a full report thereon as soon as completed.
REPORTS
The Clerk presented the following reports which were re-
ceived and placed on file:
Report of the Westchester Shore Humane Society, Inc. for
the month of February, 1959.
Report of the Receiver of Taxes and Assessments for the
month of February, 1959.
Report of the Building Inspector for the month of February,
- 1959.
Report of Receipts and Disbrusements, Town of Mamaro
neck, for the period from January 1 to January 31, 1959.
REPORT OF THE SUPERVISOR
1) Ralph A. Gamble and Paul W. Euiler
The Supervisor spoke with deep feeling of the passing of
Ralph A. Gamble and Paul W. Euiler stating that in
Mr. Gamble the community and country had lost a distin-
guished statesman and dedicated public servant who, inhis
long service to his fellow-citizens including his past ser-
vice to this Town, had always given far more than duty
called for; and in Mr. Euiler the Town had lost a former
devoted police officer who, through his years of service as
a Lieutenant on the Town Police force, had contributed
much to the well-being of his community.
The Supervisor further remarked on the custom of the
Board of Supervisors -- to adjourn its meeting as a mark
of homage in honor of the memory of those who had left its
ranks, and suggested that this Board so adjourn the meet-
ing this evening in honor of Mr. Gamble and Mr. Euiler.
Whereupon, on motion by Councilman Kane, seconded
by Councilman Santoro, it was unanimously
RESOLVED that this Board, convened in regular
session, adjourn this meeting of March 4, 1959
in honor of the memory of Ralph A. Gamble and
Paul W. Euiler.
After each of the Councilmen added his personal words
to those of the Supervisor, the Board directed the Super-
visor to write expressing its sympathy and deep regret of
the great loss incurred by this community through the pas s-
ing of Mr. Gamble and Mr. Euiler.
2) Appointment of Philip G. Corby to Zoning Boad of Appeals
The Supervisor after presenting a brief resume of the
qualifications of Philip G. Corby of 69 Vine Road, Town,
and advising that Mr. Corby came from that part of the
Town now without representation on the Board due to
Mr. Parson's resigning, recommended his appointment
to the Board of Appeals to fill the vacancy created by
the resignation of Robert L. Parsons, and on motion by
Councilman Kane, seconded by Councilman Brush, it
was unanimously
RESOLVED that Philip G. Corby be and he
hereby is appointed a member of the Zoning
Board of Appeals to fill the vacancy created
by the resignation of Robert L. Parsons and
to serve for a term of five years, effective
_ immediately and to expire on February 19th,
1964.
The Board directed the Clerk to notify Mr. Corby of
his appointment.
3) Retirement of Miss Pearl Day
The Supervisor spoke of the retirement of Miss Pearl
Day as Librarian of the Larchmont Public Library highly
commending her devoted and faithful service to the resi-
dents of this community both in the Village and the unin-
corporated area, and on motion by Councilman Santoro,
seconded by Councilman Brush, it was unanimously
RESOLVED that the Supervisor be and he
hereby is directed to write to Miss Pearl
Day expressing this Board's appreciation
of her devoted and outstanding service to
the community during the years she
served as Librarian of the Larchmont
Public Library and extending all good
wishes for a pleasant retirement and a
happy future,
4) Library Bill
The Supervisor reported that the Attorney, Mr, Platt
Wiggins, a Trustee of the Larchmont Public Library, and
he had conferred with Mr. Hunter Meighan on several oc-
casions with reference to legislation which would enable
an unincorporated area to have representation on the Board
of Trustees of a Public Library where such area contrib-
utes to the financial support of the Library and that such a
bill had been introduced in the Legislature, remarking how-
-- ever, that its disposition, of course, remains to be seen,
5) Meighan Bill
The Supervisor explained with reference to the so-called
"Cornell" and "'Meighan" bills having to do with the over-
lapping taxes between Towns and Villages, that a "Hold"
had been placed on the "Cornell' bill and that the "Meighan"
bill was ready for vote in the Legislative Committee with
favorable vote anticipated,
6) Parking Lots
The Supervisor reported that the requested five-year lease
without cancellation clause for the County-owned property
used as parking lots in the vicinity of the Larchmont Railroad
Station had been acted upon favorably by the County ParkCom-
mission, subject to approval by the County Board of Ac-
quisition and Councilman Santoro suggested in the interest of
time that the Town Engineer be directed to proceed with the
preparation of plans and specifications for the work to be un-
dertaken to improve these areas,

Whereupon, on motion by him and seconded by Coun-
cilman Kane, it was unanimously
RESOLVED that the Town Engineer be and he
hereby is authorized and directed to proceed
with the preparation of plans and specifica-
tions for the improvement of the parking lots
located in the vicinity of the Larchmont Rail-

1) Offer of Federal Civil Defense Administrator
Councilman Brush outlined briefly an offer of the Fed-
eral Civil Defense Administrator to the State of New York
providing for a 50% contribution by the federal govern-
ment for certain specified organizational equipment with
the remaining 5010 to be paid by the municipality buying
the equipment, and on his motion, seconded by Council-
man Kane, it was unanimously
RESOLVED that the Supervisor be and he here-
by is authorized to sign the papers and docu-
ments necessary to accept an offer submitted
by the Federal Civil Defense Administrator
through the State of New York providing for a
5010 contribution by the federal government
for certain specified organizational equipment
for the local Civil Defense in the Town of Ma-
maroneck when and if the Town of Mamaroneck
purchases such equipment.

1} Apportionments
Councilman Kane presented the following petitions re-
ceived from the Assessor for the correction of the as-

Councilman Santoro --
1) Culvert on Route #'125
Councilman Santoro read a letter addressed to the Super-
intendent of Highways by the State of New York Department
of Public Works in reply to his request for the State to take
over maintenance of the culvert on Route #125 stating that
the State assumed all future maintenance as of the date of
the letter, February 27, 19590
2) Traffic lights
Councilman Santoro reported that the new traffic lights
installed on Chatsworth Avenue at the square were in
operation,
3) Curbs around poles of new traffic lights
Councilman Santoro reported that several cars had hit
the curbing around the new traffic light poles, denting the
poles, The Board referred this to the Engineer and Super-
intendent of Highways for investigation and study,
4) Application for extension of water main -- Mrs, Ann Claps
Councilman Santoro presented an application filed by
Mrs. Ann Claps for the extension of a water main from the
end of the existing main on Thompson Street to a point on
Laurel Avenue in front of a house proposed to be erected on
the property known as Block 124, Parcel 304 on the Tax As-
sessment Map of the Town of Mamaroneck together with an
estimate of total cost submitted by the Westchester Joint
Water Works for such extension in the amount of $718, 14,
not including excavation, backfill or pavement restoration.
Further, for the Board's information, the Councilman read
the following letter written by the applicant and submitted
with the application;
R°I am ready to start construction of my house on
Laurel Ave, on Lot #304 - Block 124 which is the
corner of Thompson and Laurel Ave,
I have been given to understand that the Townpro-
poses to replace the existing 211 line on Thompson
Street with a 611 main. However this will be only
1801 in length and will fall short of my property
by some 1501 - 1604, Mr. Straub tells me that I
cannot tap the 6" main and run a 111 line to my
house, that I must have a continuation of the 6"
main to a point in front of my house.
I do not feel that I should be responsible for the
cost of extending the 61, main when a 11' will be
sufficient for my needs. If the Town insists on
61F extension I would be willing to advance part of
_ the cost of the 6A1 extension in the same amount
it cost me to put in a 1" line from the end of the
1801 to a point in front of my house (app. $300. )
which as I have pointed out before should be ap-
proximately 1501 - 1601.
Is this proposal in accordance with Town laws
and if so will the Town accept my proposition?"
Following discussion during which Mr. Claps ad-
dressed the Board at some length with regard to his position
in connection with this application, the matter was put over
to the next meeting pending further investigation and study.
REPORT OF THE TOWN ATTORNEY
1) Request for sale of Town-owned property
The Attorney advised of the receipt of a letter from
Meighan & Necarsulmer, Counselors at Law, renewing, on
behalf of clients, Dr. and Mrs. Haralambie of 32 Bonnie
Way, Town, an offer previously submitted on July 26, 1957
to purchase certain town -owned property known as Block
104, Parcel 551 and Block 105, Parcel 900 on the Tax As-
sessment Map of the Town of Mamaroneck, and requesting
the Board to advise when an auction would be held to dis-
pose of the property in question.
The Attorney also presented a memorandum from the
Town Assessor naming $1, 000, as a fair price for this
property.
After some discussion, the Board directed the Town Ac-
countant to communicate with Meighan & Necarsulmer and
Jacob Oliner, attorney for Sarah Oliner, the other party
previously interested in purchasing this property, advising
that the Board, upon receipt of an offer meeting the upset
price, now based on appraisal of the property in accordance
the recently adopted policy of the Board, would proceed to
fix a date for holding an auction.
2) Bill in State Legislature
The Attorney explained that a bill providing for compensa-
tion by the State of New York for property of municipalities
acquired by the state for purposes other than the use to
which they were put prior to taking by the State of New
York had been introduced by Senator George W. Cornell
and Assemblyman Robert J. Trainor, and recommended
that this Board adopt a resolution strongly supporting
such bill. He further recommended that copies of such
resolution be forwarded to the introducers of the bill,
the Chairman of the Assembly Ways and Means Com-
mittee, Senator McCullough, Assemblyman Meighan,
the Legislative Committee of the Board of Supervisors,
and the Association of Towns of the State of New York.
Whereupon, on motion by Councilman Santoro and
seconded by Supervisor Burchell, the following resolu-
tion was unanimously adopted:
RESOLVED that this Board approves a bill
entitled, "An Act to amend the Condemna-
tion Law in relation to public lands acquired
by eminent domainp0 (Senate Introductory 2709,
Print 2830, Assembly Introductory 3279, Print
3359), which provides for compensation by the
State of New York for property of municipali-
ties acquired by the state for purposes other
than the use to which they are put prior to tak-
ing by the State of New York, and urges the in-
troducers of this bill, to wit, Senator George
W. Cornell and Assemblyman Robert J.
Trainor to use all honorable means to secure
its passage by the Senate and Assembly,
