1959, IN THE COUNCIL ROOM OF THE WEAVER STREET

CALL TO ORDER
The Supervisor called the meeting to order at 8.15 p, m.

APPROVAL OF MINUTES
The minutes of the regular meeting of January 21st, 1959 were
approved as presented.
OLD BUSINESS
a. Report on Bids for Purchase of Tires
In accordance with the Board's direction, the Clerk presented
a tabulation of the bids submitted for the purchase of tires at
the last meeting of the Board.
Due to some question concerning certain items, in the ab-
sence of the Town Accountant and upon ascertaining that there
was no immediate need for tires, the Board directed that the
awarding of this contract be put over to the next meeting,
b. Opening of Bids for Purchase of Police Cars
The Clerk presented the affidavit of publication of the notice
for bids for the purchase of three two-door 1959 Sedans for the
Town of Mamaroneck Police Department as published in The
Daily Times, the official newspaper of the Town of Mamaro-
neck, on February 6th, 1959, and submitted the following bids-

C. Opening of Bids for Purchase of Highway Dump Truck
The Clerk presented the affidavit of publication of the
notice for bids for the purchase of one 1959 Dump Truck
with Body and Plow for the Town of Mamaroneck High-
way Department as published in The Daily Times, the of-
ficial newspaper of the Town of Mamaroneck, on Febru-
ary 6th, 1959 and submitted the following bids:

a. Authorization for Transfer of Funds in 1958 Budget
The Clerk presented a memorandum from the Comp-
troller, dated February 11th, 1959, requesting authori-
zation for the transfer of funds in the 1958 budget, and
on motion by Councilman Santoro, seconded by Council-
man Waterman, it was unanimously

visor be and they hereby are directed to make

COMMUNICATIONS
a. Letter re Zoning Violation--Daniel J. Ciaffoletti
The Clerk read the following letter addressed to the Town
Board by Daniel J. Cioffoletti of 7 Ferndale Place, Town,
under date of February 12th, 1959, which was referred to
the Building Inspector for investigation and report.
'=Honorable Sirs:
I own the premises known as No, 7 Ferndale Place in
the unincorporated section of the Town of Mamaroneck, and
reside there with my wife and children.
My premises are located within an "A` Residence
Zone, which Zone, according to the Zoning Ordinance of the
Town of Mamaroneck, is limited to one-family residences.
Within my immediate area, there are some nine ap-
parent violations of the Zoning Ordinance of the Town of Ma-
maroneck. These are the following:

nance of the Town of Mamaroneck.
I respectfully request that these apparent violations be
investigated, and if found to exist, that the Town of Mamaro-
neck take the appropriate steps to terminate any such violations.

b. Letter from Fuerst 8i Tanenbaum--Request to Purchase
Town-owned Property
The Clerk presented the following communication addressed
to the Town Board by Fuerst & Tanenbaum, Attorneys at Law,
under date of February 4th, 1959, Re: Rudolf Novak:
"Please be advised that on behalf of my client, Mr.
Rudolf Novak of 1331 Boston Post Road, Larchmont,
who is the owner of property fronting on the Post
Road and along Hommocks Road, you are hereby in-
formed that he is desirous of purchasing any prop-
erty that the Town has for sale in rear of his present
premises on the Hommocks Road side. Mr. Novak
would be interested in purchasing the property up to
the drain pipe running under Hommocks Road which
is approximately 200 feet in depth from the end of
the rear of his property.
If the Town Board is willing to sell same, we would
be pleased to make a bid for same assuming, of
course, that the Town is desirous of selling at this
time. In the event that the Town is not desirous of
selling at this time, but would sell at some future
date, will you kindly accept this letter as an invita-
tion to notify us so that we may be in a position to
bid on the property.

Following discussion, the Board agreed unanimously that
it was not interested in considering the sale of this property
at the present time and directed the Supervisor to notify
Fuerst & Tanenbaum to this effect.
COMMUNICATIONS (Not on Agenda)
1. Larch Motors Lease-Sales, Inc.
The Clerk read the following letter addressed to the Town
Board by Larch Motors Lease-Sales, Inc. under date of
February 18th, 1959:
"We are engaged in the leasing of automobiles, operating
at the above address (Boston Post Road at Weaver Street)
in the Town of Mamaroneck.
We do not want to cause any inconvience by our cus-
_ tomer's cars parking on Post Road or Weaver Street. We
understand from our landlord, Bose & Parker, that inthe
past they have rented property for this purpose from the
Town.
The property involved is at the continuation of Weaver
Street. We would be interested in space for fifteen to
twenty cars. Either a lease, or a month-to-month basis,
will be satisfactory. Incidentally, we would in no way in-
terfere with the right-of-way on the property.
We would appreciate your replying to this request as soon
as possible."
The Board referred the matter to the Town Attorney and
Assessor for report at the next meeting with direction that
the Assessor appraise the property in question.
Z. Requests for Use of Election Equipment
The Clerk presented a request received from the Village
of Larchmont under date of February 16th, 1959 for the use
of the voting equipment for the annual Village registration
and election. He also advised that a similar request would
be presented by the Village of Mamaroneck and requested
the Board to authorize the granting of these requests as
presented.
Whereupon, on motion by Councilman Santoro, seconded
by Councilman Brush, it was unanimously
RESOLVED that the requests of the Villages of
Larchmont and Mamaroneck for the use of the
usual voting equipment for registration and
election purposes be granted.
3. Appointment of Deputy Town Clerk
The Clerk requested the Board's approval of his appoint-
ment of Mrs. Donna Wiedemann as Deputy Town Clerk and
on motion by Councilman Santoro, seconded by Councilman
Brush, it was unanimously
RESOLVED that in accordance with the recom-
mendation of the Town Clerk, this Board hereby
approves the appointment of Mrs. Donna
Wiedemann as Deputy Town Clerk of the Town of
Mamaroneck for the term of office ending De-
cember 31st, 1959.
REPORTS
The Clerk presented the following report which was received

Report of the Westchester Shore Humane Society, Inc. for the
month of January, 1959.
Report of the Town Clerk for the month of January, 1959.
REPORT OF THE SUPERVISOR
1) Hommocks Committee
The Supervisor reported on a recent meeting of the Hom-
mocks Committee with a committee of this Board and stated
that the Committee at that time expressed its approval of
the drainage installations, the type of fill and method recom-
mended for use in the proposed reclamation of land in the
Hommocks area.
He also advised that upon receipt he would submit to this
Board Mayor Dalfonso°s recommendations to fill the vacancy
on the Committee due to the death of Mr. Jerome Heffer of
Mamaroneck Village.
2) Legislation--Cornell and Meighan Bills
In connection with the matter of overlapping town and village
taxes, the Supervisor reported that the bill introduced by Sen-
ator Cornell had met with the disapproval of the Westchester

County Village Officials Association primarily due to
its inclusion of Highway Item 1 charges under General
Town since this item is presently chargeable only out-
side of villages. This bill has been followed by a bill,
he continued, introduced by Assemblyman Meighan,
which applies to first-class towns, excludes Highway
Item 1 from General Town charges, and provides that
Highway Items 3 and 4 may be charged under General
Town at the discretion and direction of the Town Board
of each town concerned,
The Supervisor further informed the Board that he,
along with the Supervisors of the other towns con-
cerned, would meet with representatives of the Vil-
lage Officials Association at a special meeting of the
Legislation Committee of the Board of Supervisors to-
morrow afternoon to discuss this bill.
REPORTS OF THE COUNCILMEN
Councilman Brush --
1) Park Commission Meeting
Councilman Brush reported that the Park Commission
paid tribute to the Superintendent of the Park Department,
Thomas Aitchison, at its meeting Tuesday evening, the
exact date of Mr. Aitchison°s twenty-fifth anniversary of
service as a member of the Town of Mamaroneck staff.
He stated that the Supervisor and several former Com-
missioners were present in honor of the occasion.
After each of the members of the Board personally
commended Mr. Aitchison on his fine record of service
with the Town, on motion by Councilman Brush, seconded
by Councilman Santoro, it was unanimously
-RESOLVED that there be spread upon the minutes
of this meeting a record of this Board's recogni-
tion of the twenty-fifth anniversary of outstanding
service of Thomas Aitchison, Superintendent of
the Park Department, with the Town of Mamaro-
neck; and be it
FURTHER RESOLVED that the Supervisor be and
he hereby is directed to write Mr. Aitchison on
behalf of the Board expressing the Board's sin-
cere appreciation of the outstanding performance
of his duties during his twenty-five years of af-
filiation with the Town of Mamaroneck.

Councilman Waterman stated that he had no report to present
other than that pertaining to Fire matters.
Councilman Santoro --
lj Request to Advertise for Bids for Hommocks Drain
Councilman Santoro reported that the Engineer had pre-
pared the plans and specifications for the construction of
extension of storm drain in the Hommocks property and
requested that the Town Clerk be authorized to advertise
for bids thereon to be opened at the March 18th meeting.
Whereupon, on motion by him and seconded by Council-
man Brush, it was unanimously
RESOLVED that the Town Clerk be and he
hereby is authorized to publish the follow-
ing notice in the official newspaper of the
Town of Mamaroneck, The Daily Times,
not less than five 0) days before the date
of the March 18th, 1959 Town Board meet-
ing:
NOTICE TO BIDDERS
Notice is hereby given that sealed bids will be received by
the Town Board of the Town of Mamaroneck, Westchester
County, New York, until 5:00 o'clock p, m, on Wednesday,
March 18th, 1959, at the Office of the Town Clerk, 158 West
Boston Post Road in the Village of Mamaroneck, New York,
and opened and read aloud at a regular meeting of the Town
Board to be held at 8:15 p. m. on Wednesday, March 18th,
1959, in the Council Room of the Weaver Street Firehouse,
corner of Weaver Street and Edgewood Avenue in the Town
of Mamaroneck, for the construction of extension of storm
drain and appurtenances in Town-owned land on the sou-
therly side of Hommocks Road in the Town of Mamaroneck,
Westchester County, New York, in accordance with the
plans and specifications drawn and prepared by Maurice
Friedlander, Town Engineer, and now on file in the Office
of the Town Clerk.
Copies of the plans, specifications and proposals for the
work proposed may be obtained at the Town Clerk's office
upon deposit of $5. 00, which deposit will be refunded when
plans and specifications are returned in good condition
within thirty days after the award or rejection of the bids.
The Town of Mamaroneck reserves the right to waive any
informalities in the bids or to reject any bid which does not
comply with the specifications. No bidder may withdraw
his bid within forty-five days after the actual date of the
opening thereof dated.
The Town of Mamaroneck may make such investigation as
it deems necessary to determine the ability of the bidder to
perform the work, and the bidder shall furnish all such in-
formation and data for this purpose as may be requested.
The Town of Mamaroneck reserves t'ie right to reject any
bid if the evidence submitted by, or the investigation of such
bidder fails to satisfy the Town of Mamaroneck that such
bidder is properly qualified to carry out the obligation
of the contract and to complete the work contemplated
therein.

2} Memoranda from Superintendent of Highways
For the Board's information, Councilman Santoro pre-
sented the following memoranda addressed to him by the
Superintendent of Highways:
a. Street Light
'New mercury vapor street light at the intersec-
tion of Station Way and Myrtle Boulevard is now
energized.^
Councilman Santoro also added that the light at
Murdock Road and Griffen Avenue had been in-
stalled in accordance with the Board's direction.
b. Murray Avenue Steps
"Request survey from the Police Department as
to the advisability of continued use of the
stairs. "
The Board directed that such survey be made.
c. Harmon Drives
"For your information the Town now has two Har-
mon Drives -- request the Town Board to con-
sider changing the name of these streets. "
The Board directed that suggestions be presented
at the next meeting.
d. Town-owned Bridge--Route #125
"Request resolution to District Engineer Rauer,
State of New York, to accept town culvert
crossing Sheldrake River.on Route x#125. "
The Board, after some discussion of this request
with Mr. O'Brien, on motion by Councilman San-
toro, seconded by Councilman Brush, unanimously
RESOLVED that the Superintendent of
Highways be and he hereby is directed
to write K. G. Rauer, District Engineer,
New York State Department of Public
Works, requesting the State to acceptthe
culvert crossing the Sheldrake River on
Route #125.
3) Traffic Lights at Square
- Councilman Santoro reported that the Superintendent of
Highways had informed him that the guards around the new
traffic lights had been installed and that the Town work
was completed.
REPORT OF THE TOWN ATTORNEY
1) Publication of Notice for Public Hearing on Chapter II, (Use
of Streets and Highways) of the General Ordinances
The Town Attorney reported that he had conferred with the
Police Commission regarding certain requests submitted by
the Commission pertaining to Chapter II of the General Or-
dinances of the Town of Mamaroneck and suggested that a
public hearing be held thereon at the next meeting of the
Board and that the Clerk be authorized to publish notice for
such hearing in the form herewith submitted.
Whereupon, on motion by Councilman Waterman, seconded
by Councilman Santoro, it was unanimously
RESOLVED that the Town Clerk be and he hereby
is authorized to publish the following notice inthe
official newspaper of the Town of Mamaroneck,
The Daily Times.
PUBLIC NOTICE
PLEASE TAKE NOTICE THAT THE TOWN BOARD OF THE
TOWN OF MAMARONECK WILL HOLD A PUBLIC HEARING
ON THE 4th DAY OF MARCH, 1959, IN THE COUNCIL ROOM
OF THE WEAVER STREET FIREHOUSE ON WEAVER STREET,
AT 8.15 P. M. FOR THE PURPOSE OF CONSIDERING THE RE-
PEAL OF THE PRESENT CHAPTER li OF THE GENERAL OR-
DINANCES OF THE TOWN OF MAMARONECK AND THE EN-
ACTMENT OF A NEW CHAPTER II OF SUCH GENERAL OR-
DINANCES, WHICH NEW CHAPTER IS TO READ AS FOLLOWS;
CHAPTER II
Regulation of traffic, use of streets
and highways.
Section 1 - The Police Commission of the Town of Mamaro-
neck is hereby designated pursuant to subdivision
"e°` of Section 1603 of the Vehicle and Traffic Law of the State of
New York, with respect to highways outside of Villages, to
1. Upon a roadway which is divided into three lanes, allo-
cate the center lane exclusively for traffic moving in a
specified direction,
Z. Order signs erected directing slow-moving traffic,
trucks, busses or specified types of vehicles to use a
designated lane, or with signs, signals or markings
designate those lanes to be used by traffic moving in a
particular direction regardless of the center of the
roadway,
3. Designate no-passing zones and indicate such zones in
accordance with the standards, minimum warrants and
sign or marking specifications established by the state
traffic commission,
4. Regulate or prohibit processions, assemblages, or
parades. Whenever such a procession, assemblage or
parade authorized by said Commission will block the
movement of traffic on a state highway maintained by
the state, or on a highway which connects two state
highways maintained by the state to make a through
route, for a period in excess of ten minutes, said
Commission must, prior to such blocking, provide and
designate with conspicuous signs a detour adequate to
prevent unreasonable delay in the movement of traffic
on said state highway maintained by the state.
5. Prohibit or regulate the operation and the stopping,
standing or parking of vehicles in cemeteries and in

public parks.
6. Provide for the removal and storage of vehicles parked
or abandoned on highways during snowstorms, floods,
fires or other public emergencies, or found unattended
where they constitute an obstruction to traffic or any
place where stopping, standing or parking is prohibited
and for the payment of reasonable charges for such re-
moval and storage by the owner or operator of any such
vehicle.
7. Prohibit, restrict or regulate the operation of vehicles
on any controlled-access highway or the use of any con-
trolled-access highway by any vehicle, device moved by
human power or pedestrian.
8. Prohibit or regulate the turning of vehicles or specified
- types of vehicles at intersections or other designated
locations.
9. Regulate the crossing of any roadway by pedestrians.
10. Designate any highway or any separate roadway thereof
for one-way traffic.
11. Exclude trucks, commercial vehicles, tractors,
tractor-trailers and trucks in excess of a total gross
weight of 10, 000 pounds from designated highways.
12. Designate safety zones.
13. Prohibit, restrict or limit the stopping, standing or
parking of vehicles.
Section 2. - Section 1 of this ordinance shall not be effective
until signs or markings giving notice as provided
in Section 1683 of the Vehicle and Traffic Law are posted, such
signs or markings to conform in all respects with the provisions

of Section 1682 of the Vehicle and Traffic Law.
Section 3. - The following intersections are hereby designated
pursuant to Section 1660, subdivision 1 of the
Vehicle and Traffic Law as "stop intersectionsp1 and stop signs
conforming in all respects with the provisions of Sections 1682
and 1683 of the Vehicle and Traffic Law are hereby ordered
posted at such intersections:

Section 5. - Violations of Sections 1 to 4 of this Chapter are
hereby declared to be traffic infractions and to
be punishable as provided in Section 1800 of the Vehicle and Traffic
Law,
Section 6. - TRUCKS: Every vehicle used to transport dirt,
manure, sand, gravel, ashes, mud, garbage,
swill, offal, etc, in the public streets of the Town of Mamaroneck,
outside of the Villages of Larchmont and Mamaroneck, shall be so
constructed or loaded as to prevent any portion of the contents from
escaping therefrom. No vehicle used to transport dirt or soil shall
be operated or driven so as to permit dirt or mud to adhere to the
wheels and be deposited in the public streets of the Town of Ma-
maroneck, outside of the Villages of Larchmont and Mamaroneck.
Any person, being the owner or operator of any such vehicle or
truck , shall at the end of each working day remove any dirt, manure,
sand, gravel, ashes, mud, garbage, swill, offal, etc, dropped from
any such vehicle or truck on the public street or highway.
Section 7. - COASTING: No person shall coast with hand sleds,
bob sleds, carts or other vehicles on wheels or run-
ners upon sidewalk.

Section 8. - CROSSWALK: No vehicles or animal or push-
cart, baby carriage or other device moved by
human power shall stop or stay on any crosswalk or driveway.
Section 9. - PARADES: All parades in the streets of
the Town of Mamaroneck outside of the Villages
of Larchmont and Mamaroneck, and the playing of bands of mu-
sic, and exhibitions of any kind in said streets are prohibited,
without a written permit from the Town Board.
Section 10. - No person shall deface, injure, move or inter-
fere with any sign, standard or signalling device
installed for the purpose of directing, restricting or regulating
traffic, and no person shall place or display a sign of any sort
attempting to regulate traffic or parking on a public street.
TAKE FURTHER NOTICE that all persons present at said
hearing will be given an opportunity to be heard.

2} Town of Mamaroneck vs. Cioffoletti
The Town Attorney reported that the decision of Judge Bailey
handed down on February 11th, 1959, denied the defendant's
motion to dismiss the injunction action to restrain the use of
#7 Ferndale Place as a two-family house on the grounds that
the tenant had vacated the property and that the decision would
probably be appealed.
3) Requests to Clean-up Vacant Property
The Attorney reported that he had received several requests
that certain property , vacant land located in the Town, be
cleaned-up of rubbish, etc, and that he had ascertained the
ownership of such property and would communicate with
the owners requesting that the property be cleaned-up in
accordance with the provisions of the Ordinance pertaining
thereto.
4) Soundview Woods Pipe Line
Upon questioning by Frank X. O'Donnell, the Attorney re-
viewed the status of the Soundview Woods Pipe Line matter,
advising that the appeal taken by the Westchester Joint Water
Works No. 1 should be heard sometime in March.
ADJOURNMENT
There being no further business to come before the meeting, it

Commissioner Waterman presented a communication from
the Fire Department, dated February 16th, 1959, requesting
the Commission's approval of the election of officers for the
year 1959, and on his motion, seconded by Commissioner
Brush, it was unanimously

Chief Deshensky requested that in the interest of time in
case of a fire the Fire Department be given permission to
make left-hand turns from Weaver Street to New Harmon
Drive.
The Commission requested him to forward such re-
quest to the Police Commission in writing.
2) Reclassification of Fire Truck Drivers
Upon question as to the status of the Town's request
that 60Fire Truck Drivers" be reclassified "Firemen"
the Commission stated that the request was pending
awaiting decision by the County Personnel Department,
3) Firehouse--Basement Work
Commissioners Waterman and Santoro reported that
the work in the basement had been completed and that
upon inspection had been found to be well done,
