MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD JANUARY 7, 1959,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

THE SUPERVISOR
Before proceeding with the first item of business, the Super-
visor welcomed Councilman Santoro who had been absent the past
two meetings due to illness and informed the Board that Council-
man Waterman had been called out of town on business and would
be unable to be present this evening.
The Supervisor also stated that he had returned from a very
pleasant cruise feeling well rested and ready to resume his
duties.
ORGANIZATION MATTERS
The Supervisor presented the organization matters for the
year 1959 in accordance with the prepared agenda and after due
consideration, the following resolutions were adopted:
1. Salaries of Elected Officials
On motion by Councilman Brush, seconded by Council-
man Kane, it was unanimously
RESOLVED that the salaries of all elected
officials of the Town of Mamaroneck for the
year 1959 are to be the salaries stated and
appropriated in the annual budget or estimate
for the year 1959 as follows:

On motion by Councilman Kane, seconded by Council-
man Santoro, it was unanimously
RESOLVED that the salaries of all appointed
officials of the Town of Mamaroneck for the
year 1959 are to be the salaries stated and
appropriated in the annual budget or estimate
for the year 1959 as follows;

On motion by Councilman Santoro, seconded by Council-

RESOLVED that a bond be required for the

stated, with sufficient surety to be ap-
proved by this Board, and the form to be
approved by the Town Attorney.

4) Salaries, Competitive Class
On motion by Councilman Brush, seconded by Council-
man Kane, it was unanimously

RESOLVED that the following positions in the
Competitive Class of the Civil Service shown
in the budget or estimate are hereby con-
tinued and the annual compensation for the
same in the year 1959 is hereby fixed and
shall be paid from the amounts appropriated
in the annual budget or estimate for the year
1959, or so much thereof as shall be suffi-
cient to pay such annual compensation to be
effective as of January 1, 19599

FURTHER RESOLVED that the employment of
the last named persons to the aforesaid posi-
tions is in accordance with the classifications
made by the County Personnel Officer, under
the provisions of the Civil Service Law of the
State, and any vacancies which now exist or
which may from time to time occur in said
positions are to be filled at salaries set inac-
cordance with the provisions of the salary
scale adopted by the Town Board and in con-
formity with the Civil Service Rules and
amendments thereto, for towns, villages, and
special districts in Westchester County, New
York.
5) Salaries, Non-competitive Class
On motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that the following positions in the
Non-competitive Class of the Civil Service
shown in the budget or estimate are hereby
continued and the annual compensation for the
same in the year 1959 is hereby fixed and
shall be paid from the amounts appropriated
in the annual budget or estimate for the year
1959, or so much thereof as shall be suffi-
cient to pay such annual compensation to be
effective as of January 1, 1959°

FURTHER RESOLVED that the employment of the
last named persons to the aforesaid positions is
in accordance with the classifications made by the

6) Salaries, Exempt Class
On motion by Councilman Santoro, seconded by Coun-
cilman Brush, it was unanimously
RESOLVED that the following persons are
hereby appointed to positions classified as
exempt under the Civil Service Law, such
appointments to be made as of January 1,
1959, and to continue at the pleasure of
the Town Board at the annual salary or rate
of compensation hereinafter stated, which
is to be paid from amounts appropriated in
the annual budget or estimate for the year
1959, or so much thereof as shall be suffi-
cient to pay the salary or compensation as
hereby fixed:

7) Fixing Payment of Salaries
On motion by Councilman Brush, seconded by Councilman
Kane, it was unanimously
RESOLVED that the salaries of all officers,
- elected and appointed, and all employees be
paid semi-monthly on the first and fifteenth
days of each month.
FURTHER RESOLVED that these resolutions
are effective as of January 1, 1959.
8} Approval of Appointment of Deputy Receiver of Taxes
and of Persons Authorized to Receive Tax Money and
Give Receipt Therefor
The Clerk presented letters addressed to the Board
by the Receiver of Taxes under date of December 31,
1958, requesting approval of the appointment of Leo N.
Orsino as Deputy Receiver of Taxes and the designation
of Alexander Finson and Donna Wiedemann as persons
authorized to receive tax money and give receipt therefor.
Whereupon, on motion by Councilman Kane, seconded
by Councilman Santoro, it was unanimously
RESOLVED that in accordance with the re-
quest of the Receiver of Taxes, this Board
hereby approves the appointment of Leo N.
Orsino, Senior Account Clerk, as Deputy
Receiver of Taxes, and of the designation
of Alexander Finson, Accountant; and Donna
Wiedemann, Intermediate Account Clerk, as
persons authorized to receive tax money,
give proper receipt therefor in his name, en-
ter such payments upon the records, and de-
posit tax money in the bank for the year end-
ing December 31, 1959.
9} Approval of Appointment of Deputy Town Clerks
The Clerk presented a Certification of his appointment
of Wilhelmina Schroeder and Lavenia Brewer as Deputy
Town Clerks of the Town of Mamaroneck for the term of
office ending December 31, 1959 pursuant to Subdivision
10 of Section 30 of the Town Law, State of New York, and
upon motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED that the appointment by the Town
Clerk of Wilhelmina Schroeder and Lavenia
Brewer as Deputy Town Clerks in accordance
with his Certificate dated December 31, 1958'
and presented to the Board on January 7, 1959
is hereby approved,
10} Setting Dates for Town Board Meetings
The Supervisor requested the Board's pleasure in the
matter of scheduling the dates for the Town Board meet-
ings for the year 1959, and on motion by Councilman
Brush, seconded by Councilman Kane, it was unanimously
RESOLVED that regular meetings of this Board
be held on the first and third Wednesdays of
each month with the exception of the months of
June, July, August, and September, during
which months meetings shall be held on the
first Wednesday of each month only at 8:15
P.m. in the Council Room of the Weaver
Street Firehouse, Weaver Street, Town of
Mamaroneck.
11) Designation of Official Newspaper
On motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that "The Daily Times" of Ma-
maroneck be and it hereby is designated as
the official newspaper of the Town of Ma-
maroneck for the purpose of publishing
notices,
12) Appointment of Auditors for 1959
On motion by Councilman Santoro, seconded by Council-
man Brush, it was unanimously
RESOLVED that the firm of Glick-Freedman,
Certified Public Accountants, New Rochelle,
New York, be and it hereby is appointed to
audit the records of the Town of Mamaroneck
for the year 1959.
FURTHER RESOLVED that the compensation
for this service be in the amount of $2, 700. 00
which is the amount in the 1959 budget,
13) Appointment of Constables
On motion by Councilman Brush, seconded by Councilman
Kane, it was unanimously
RESOLVED that the following be and they hereby
are appointed Constables of the Town of Mamar-
oneck to serve for the term beginning January 1,
1959 and ending December 31, 1959, without
salary.

14) Setting Bonds for Constables
On motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that the appointed Constables,
Rocco V. Migliaccio, Joseph R. Tezzi,
Frank Herz, and Dominick Faillace each
file a bond in the sum of $2, 500. 00 for the
faithful performance of their duties, said
bond to be for one year and to be approved
by the Town Attorney and the premiumfor
the same to be paid out of Town funds.
15) Appointment of Trustee for Police Pension Fund
On motion by Councilman Santoro, seconded by Councilman
Brush, it was unanimously
RESOLVED that Town Councilman Jeremiah
C. Waterman be and he hereby is appointed
a member of the Board of Trustees of the
Police Pension Fund for the term beginning
January 1, 1959 and ending December 31,
1959.
16) Appointment of Member of the Examining Board of Plumbers
The Supervisor, in accordance with Article 2, Section 12
of the Plumbing Code of the Town of Mamaroneck, appointed
Victor J. Kriss to the Examining Board of Plumbers to serve
until December 31, 1959.
Whereupon, on motion by Councilman Brush, seconded by
Councilman Kane, it was unanimously
RESOLVED that this Board approves the ap-
pointment by the Supervisor of Victor J. Kriss
of 613 Fenimore Road, Town, to the Examin-
ing Board of Plumbers for the term beginning
January 1, 1959 and ending December 31, 1959.
17) Appointment of Member of Park Commission
Councilman Brush stated that it was with great pleasure
that he recommended the reappointment of John W. Oliver
as a member of the Park Commission, and on his motion,
seconded by Councilman Kane, it was unanimously
RESOLVED that John W. Oliver, 41 Glenn
Avenue, Town, be and he hereby is re-
appointed as a member of the Board of Park
Commissioners for a term of three years
beginning January 1, 1959 and ending Decem-
ber 31, 1961.

18) Designation of Depositories for 1959
On motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that the following banks and trust
companies are hereby designated as deposi-
tories of funds of the Town of Mamaroneckfor
the year 1959 and the escrow agreements be-
tween these banks and the Town of Mamaro-
neck presently in effect shall be continued.

FURTHER RESOLVED that all withdrawals from
the above mentioned accounts shall be upon the
signature of the Supervisor of the Town of Ma-
maroneck and the counter-signature of the
Comptroller of the Town of Mamaroneck.
19) Approval of Contract with the Westchester Shore
Humane Society, Inc, ($1, 900. )
The Clerk presented the contract between the Town of
Mamaroneck and the Westchester Shore Humane Society
Inc. for the year 1959, and upon motion by Councilman
Santoro, seconded by Councilman Brush, it was unan-
imously
RESOLVED that the Supervisor be and he here-
by is authorized to sign the contract between
the Town of Mamaroneck and the Westchester
Shore Humane Society, Inc, for the year 1959
in the amount of $1, 900, 00 as provided in the
1959 budget.
20) Approval of Contract with Larchmont Public Library
($26, 777. )
The Clerk presented the contract between the Town of Ma-
maroneck, the Village of Larchmont, and the Larchmont
Public Library in the amount of $26, 777. 00 as provided in
the 1959 budget, and upon motion by Councilman Brush,
seconded by Councilman Kane, it was unanimously
RESOLVED that the Supervisor be and he here-
by is authorized to sign the contract betweenthe
Town of Mamaroneck, the Village of Larch-
mont, and the Larchmont Public Library in
the amount of $26, 777, 00 for the year 1959,
which amount is provided in the 1959budget.
21) Approval of Lease for Town Offices
(1 year at $4, 200, 00)
The Clerk presented a lease for one year covering the
rental of the premises at 158 West Boston Post Road,
Mamaroneck, used for the Town Offices, and on motion
by Councilman Kane, seconded by Councilman Santoro,
it was unanimously
RESOLVED that the Supervisor be and he
hereby is authorized to sign the lease for
the rental of the premises used for the
Town of Mamaroneck Offices and located
at 158 West Boston Post Road, Village of
Mamaroneck, said lease being in the
amount of $4, 200, 00 for the year 1959.
22) Authorization of 1959 Membership in the Association
of Towns of New York State
On motion by Councilman Santoro, seconded by Council- ,
man Brush, it was unanimously
RESOLVED that the Town of Mamaroneck
continue its membership in The Associa-
tion of Towns of the State of New York for
the year 1959.
23) Authorization of 1959 Membership in the Municipal
Finance Officers Association of the United States
and Canada
On motion by Councilman Brush, seconded by Councilman
Kane, it was unanimously
RESOLVED that the Town of Mamaroneck
continue its membership in The Municipal
Finance Officers Association of the United
States and Canada for the year 1959.
24) Approval of Compensation for Confidential Clerk to
the Supervisor
The Elerk presented a letter from the Supervisor under
date of December 31st, 1958 requesting the Board to fix
the compensation for his clerk, appointed by him in accor-
dance with the authority given him under the Town Law, at
$4, 774.00 per annum, effective as of January 1st, 1959.
Whereupon, on motion by Councilman Brush, seconded
by Councilman Kane, it was unanimously
RESOLVED that the compensation for the Con-
fidential Clerk to the Supervisor be and it is
hereby fixed at the sum of $4, 774, 00 per annum
beginning January 1st, 1959.
25) Amendment of Compensation Plan
On motion by Councilman Kane, seconded by Councilman
Santoro, it was unanimously
RESOLVED that the salary scale of Civil Ser-
vice employees of the Town of Mamaroneck,
adopted January 8th, 1958, is hereby amended
as follows:

THE SUPERVISOR
At this time the Supervisor announced that John L. Delius was
beginning his twenty-sixth year as Attorney for the Town of Ma-
maroneck and on behalf of the Board, highly commended Mr. Del-
ius on his outstanding service and unfailing loyalty and devotion to
the Town during these past twenty-five years.
The Supervisor further remarked on how fortunate the Town of
Mamaroneck was to have the services of this man who was heldin
highest esteem throughout the State and reputed to be "second to
no one" in his knowledge and understanding of municipal law.
Each of the Councilmen congratulated Mr. Delius and extended
his personal words of commendation and the Supervisor directed
that there be spread upon the official minutes of this meeting a
record of the Board's appreciation and recognition of the Attorney's
service to the Town.

There was no old business to be brought before the meeting.
NEW BUSINESS
There was no new business to be brought before the meeting.
COMMUNICATIONS
a. Request for Erection of Fence
The Clerk presented a letter from Harry P. Miltner,
President of Westshire Fences, dated December 15, 1958,
requesting permission for his client, Mrs. Lewis P. Stan-
ton of 10 York Road, Town, to erect a 6-foot solid vertical
smooth picket fence for a distance of 50 feet along the nor-
therly side line of her property near the rear corner of
the house as shown on sketch enclosed therewith.
The Board directed the Clerk to follow the usual
procedure, putting the matter on the agenda for the
next meeting and meanwhile notifying neighboring
property owners of the request and allowing time
for the members of the Board to personally view
the site of the proposed fence.
- b. Division of 9th Election District
The Clerk read a letter from the County Board of Elec-
tions, dated December 15, 1958 advising that Election
District #9 had a registration of 955 as of October 29th,
1958 and was therefore subject to mandatory division.
Following some discussion, on motion by Councilman
Kane, seconded by Councilman Brush, it was unanimously
RESOLVED that the division of Election Dis-
trict #9, mandatory under Section 64 of the
Election Law, be referred to a committee
composed of the Chairmen of the Town of Ma-
maroneck Republican and Democratic Com-
mittees, Nils Hanson and Edward P. Meehan,
and the Chairman of Elections for the Town of
Mamaroneck, Charles Gronberg, for study
and report,
c. Order Prohibiting Parking on Boston Post Road at
Alden Road
The Clerk presented a communication from the State
Traffic Commission, dated December 16th, 1958, pro-
hibiting parking on the north side of Route US (Boston
Post Road) in the vicinity of its intersection with Alden
Road and enclosing a copy of such order for the Town
records, which the Board ordered received and filed.
d. Notice of Hearing on Orienta Bus Lines, Inc.
The Clerk presented a communication from the Public
Service Commission giving notice of a hearing to be held
on the Orienta Bus Lines, Inc. , which matter was re-

e. Association of Towns Annual Meeting
The Clerk presented a communication from the Associa-
tion of Towns of the State of New York announcing the an-
nual meeting of the Association to be held at the Hotel Com-
modore, New York City, on February 9th, 10th, and 11th,
1959 and requesting designation of the voting delegate and
alternate.

Whereupon, on motion by Councilman Brush, seconded
by Councilman Santoro, it was unanimously
RESOLVED that all Town Officials, officers,
and employees are hereby authorized to at-
tend the Annual Meeting of the Associationof
Towns of the State of New York, to be held
at the Hotel Commodore, New York City, on
February 9th, 10th, and 11th, 1959;
FURTHER RESOLVED that Town Attorney
Delius be designated delegate of the Town of
Mamaroneck for the purpose of voting and
Councilman Peter F. Kane, Jr. be desig-
nated alternate;
FURTHER RESOLVED that the Comptroller
be and he hereby is authorized to audittheir
claims for expenses, said expenses to be
paid out of the item in the budget for travel-
ing expenses.
f. Approval of Petition of The Yonkers Railroad Company
The Clerk presented a notice from the Public Service
Commission granting approval of the petition of The
Yonkers Railroad Company for authority to substitute
buses for cars on tracks and to operate on routes supple-
mental thereto and deviating therefrom„ which the Board
ordered received and placed on file.
COMMUNICATIONS (Not on Agenda)
1) Memorandum from Town Engineer
The Clerk read the following memorandum addressed to
the Town Board by the Town Engineer under date of Janu-
ary 6th, 1959, which was ordered received and filed.
"Tannous Property
Inspection of the property of Richard Tannous,
#1036 Old White Plains Road, shows that the
property in the rear has been filled in so that
the existing cement block wall is now only four
feet above grade to comply with the Town
Ordinance."

2) Communication from Jerome N. Wanshel
The Clerk presented a letter addressed to the attention of
the Supervisor and Members of the Town Board by Jerome
N. Wanshel as attorney for Herbert L. Werner under date of
January 2nd, 1959 referring to the report submitted by
the Town Attorney under date of November 18th, 1958
in connection with the request for the installation of
curbs on Fenimore Road previously presented by Mr.
Wanshel on behalf of his client.
Following some discussion during which Mr. Wan-
shel, who was present, addressed the Board in connec-
tion with this matter, it was referred to Councilman
Santoro, the Town Engineer, and the Superintendent of
Highways for further investigation and report.

Councilman Santoro --
1) Installation of Light at Intersection of Parking Ramp
and Myrtle Boulevard
In connection with the request of the Board of Police
Commissioners for the installation of a street light at
the intersection of the parking ramp and Myrtle Boule-
vard, Councilman Santoro reported that a light of the
type requested (aluminum pole with mercury vapor
street light fixture) could be obtained from surplus
stock at Whiffen Electric Company of White Plains for
the sum of $495. 00. This price, he advised, would ef-
fect a saving for the Town of several hundred dollars
- and he therefore recommended the purchase and in-
stallation of such pole and light fixture.
Whereupon, on his motion, seconded by Councilman
Kane, it was unanimously
RESOLVED that this Board hereby authorizes
the purchase and installation of one aluminum
pole with mercury vapor light fixture to be
located at the intersection of the parking ramp
and Myrtle Boulevard; said pole and light fix-
ture to be purchased from and installed by
Whiffen Electric Company of White Plains for
a total price not to exceed the sum of $495. 00.
REPORT OF THE TOWN ATTORNEY
1) Zoning Violation, Block 504 - Parcels 580 and 471
In connection with a complaint of a Zoning violation on
the property known as Block 504 - Parcels 580 and 471 on
the Tax Assessment Map of the Town of Mamaroneck, the
Town Attorney reported that the attorney for the owner of
the property, Sidney J. Doherty, had advised that action
had been started to eliminate the violation and he there-
fore suggested that this matter be carried over to the next
meeting of the Board.
2) Town of Mamaroneck vs. D. J. Cioffoletti, Jr.
The Town Attorney reported that the attorney for the
defendant had moved for dismissal on affidavit and ad-
vised that in his opinion, the Town should oppose this mo-
tion on the argument that the house had been converted in-
to a two-family residence.
3) Certiorari Proceedings on Block 509 - Parcel 26
The Town Attorney, advising that the certiorari action
on the property known as Block 509 - Parcel 26 on the Tax
Assessment Map of the Town of Mamaroneck had been re-
ferred to a referee for a hearing, stated that he felt the
Town should obtain an independent appraisal of this prop-
erty and requested authorization to engage the services of
a real estate appraiser at a fee not to exceed the sum of
"$250. 00.

Whereupon, on motion by Councilman Santoro, sec-
onded by Councilman Kane, it was unanimously
RESOLVED that this Board hereby authorizes
the Town Attorney to engage the services of
a real estate appraiser to make an appraisal
of the property known as Block 509, Parcel
26 on the Tax Assessment Map of the Town of
Mamaroneck at a fee not to exceed the sum
of $250. 00,
4) Requests for Traffic Signs
In connection with several requests for traffic signs
received from the Board of Police Commissioners, the
Attorney recommended that this matter be put over to
the next meeting in view of the fact that an additional re-
quest had come in late today,
5) Sign Violation, Embassy Cleaners
The Attorney reported that Embassy Cleaners had
been notified of a sign violation on December 3rd, 1958
and that he was advised that steps were being taken to
correct this violation.
ADJOURNMENT
There being no other business to come before the meeting, it
was declared adjourned at 8.55 p. m. ,, to reconvene on Jan-
uary 21st, 1959.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.
a. Communications
In Commissioner Waterman°s absence, Commissioner
Brush stated that there were no communications to be
presented at this meeting.
b. Reports
In the absence of Commissioner Waterman, Commissioner
Brush presented the Fire Inspectorts reports on the schools in

the unincorporated area of the Town, which the Board
ordered received and placed on file.
At this time, the Building Inspector reported that
all schools had been notified formally of any violations
and that each was very cooperative and presently en-
gaged in correcting existing violations.
Councilman Kane requested that a close check be
kept on the completion of the correction of violations
with a progress report submitted to the Board at the
next meeting, and that if such violations were not cor-
rected within the alloted time, legal action be initiated
to close any school still in violation.
c. Claims
In Commissioner Waterman°s absence, Commis-
sioner Brush presented the following Fire Department
claims, which had been audited by the Comptroller and
approved by the Fire Chief, and upon his motion which
was seconded by Commissioner Kane, it was unanimously
RESOLVED that the following claims be and
they hereby are approved and the Supervisor
and Comptroller be and they hereby are au-
thorized to pay the same out of the budget
